The Anchor: 2021
The Anchor began in 1887 and was first issued weekly in 1914. Covering national and campus news alike, Hope College’s student-run newspaper has grown over the years to encompass over two-dozen editors, reporters, and staff. For much of The Anchor's history, the latest issue was distributed across campus each Wednesday throughout the academic school year (with few exceptions). In recent years The Anchor moved to monthly print issues and a more frequently updated website. The Anchor is now published in print twice per academic semester. Occasionally, the volume and/or issue numbering is irregular.

The plain-error stand-ard does not apply in this case, and this Court should affirm the judgment below if it determines either that Rehaif er-ror is structural or that the Government cannot carry its burden to show that the error was harmless.
Indian Media Narratives In Gang Rape, Astha Bhandari
Indian Media Narratives In Gang Rape, Astha Bhandari
Sociology & Criminal Justice Theses & Dissertations
Violence against women is a worldwide phenomenon, and while brutal crimes shock us, it is nothing exceptional. This social construction of violence against women is displayed through the media's language. The language then portrays structures of power dynamics, fueling patriarchal discourse, where masculinity becomes the king, and femininity denigrated, birthing a rape culture. This study explores the impact of media reporting of gang rape cases of women in India and investigates the media reporting of nine different gang rape cases, post 2012 Delhi gangrape.
The research looks to identify the media semantics used in portraying the victims in the print …
Courageous Endurance: The Lived Experiences Of Trans Folx And The Criminal Legal System, April Carrillo
Courageous Endurance: The Lived Experiences Of Trans Folx And The Criminal Legal System, April Carrillo
Sociology & Criminal Justice Theses & Dissertations
The field of criminology and criminal justice have widely ignored the experience of being a trans person and interacting with the criminal legal system, despite the reality that trans folx experience discrimination and harm at the hands of criminal legal practitioners. This dissertation explores these experiences, as well as how trans folx navigate a myriad of other issues to include their identity and institutional discrimination. Trans folx are not guaranteed many protections or rights in the United States which leaves them at an especially vulnerable position when entering the criminal legal system. Essentially, trans folx are forced to navigate a …
Wrath And Relationships: Homicide Weapon Choice And Victim Offender Relationships, Joseph Gonnella
Wrath And Relationships: Homicide Weapon Choice And Victim Offender Relationships, Joseph Gonnella
Sociology & Criminal Justice Theses & Dissertations
The purpose of this study is to examine the influence that victim-offender relationships and the event circumstances have on homicide weapon choice. From Cornish and Clarke’s Rational Choice theoretical perspective, offenders go through decision- making processes to determine which weapon will be the most effective to meet their goal, based on the circumstances of the event. This study examined the use of three weapon types: firearms, knife/ blunt objects, and personal weapons, amongst victim-offender relationships such as acquaintance, intimate, non-intimate family/friend, and strangers along with circumstances such as homicides committed as the result of a felony, and homicides committed as …

The Impact Of Covid-19 On Immigration Detention, Fatma Marouf
Faculty Scholarship
COVID-19 has spread quickly through immigration detention facilities in the United States. As of December 2, 2020, there have been over 7,500 confirmed COVID-19 cases among detained noncitizens. This Article examines why COVID-19 spread rapidly in immigration detention facilities, how it has transformed detention and deportation proceedings, and what can be done to improve the situation for detained noncitizens. Part I identifies key factors that contributed to the rapid spread of COVID-19 in immigration detention. While these factors are not an exhaustive list, they highlight important weaknesses in the immigration detention system. Part II then examines how the pandemic changed …
Patterned Adolescent Socially Deviant Behavior, Raymond B. Smith
Patterned Adolescent Socially Deviant Behavior, Raymond B. Smith
Theses and Dissertations
Research suggests that most adolescent youth AY (AY) will engage in socially deviant behavior (SDB) beginning from ages 10-14, peak in rate of participation at 16-17, and begin to desist thereafter (ages 17 and older). AY participation in SDB varies by frequency and severity, ranging from minor acts such as smoking cigarettes to behaviors that threaten the safety of self and others. Most AY do not participate in SDB to harm, however, but instead are attempting to express autonomous function from parental and adult oversight. During adolescence, youth become aware of their physical transformation to adulthood and growing sense of …
Why So Long? Examining The Nexus Between Case Complexity And Delay In Florida’S Death Penalty System, Corey Daniel Burton
Why So Long? Examining The Nexus Between Case Complexity And Delay In Florida’S Death Penalty System, Corey Daniel Burton
Theses and Dissertations
Over the last few decades, there has been greater recognition that increased time on death row is a significant problem in the United States that is getting worse. Beginning with the U.S. Supreme Court’s denial of certiorari in Lackey v. Texas (514 U.S. 1045, 1995), numerous defendants have attempted to assert Eighth Amendment claims of cruel and unusual punishment on the grounds that the length of their death row confinement combined with their subsequent execution is unconstitutional. Although such claims have been unsuccessful in the U.S. Supreme Court, other federal courts have examined the issue. In 2014, the Central District …
Anxiety In Preschool-Aged Children With Autism: Rates, Symptoms, And Predictors, Neilson Chan
Anxiety In Preschool-Aged Children With Autism: Rates, Symptoms, And Predictors, Neilson Chan
Loma Linda University Electronic Theses, Dissertations & Projects
Epidemiological studies indicate that children with Autism Spectrum Disorder (ASD) are at high risk for developing co-occurring anxiety symptoms and diagnosable anxiety disorders, with prevalence rates ranging from 40% to 78%. Further, studies have suggested that children with ASD experience more clinically significant symptoms of anxiety compared to children without ASD as early as toddlerhood. However, few studies have examined the comorbidity of anxiety and ASD in early childhood. In the current study, we included a sample of young children (ages 3 to 5) with ASD (n = 77) and an age-matched typically developing comparison group (n = 55) to …
Alternative Education And Accountability: An Exploration, Kate Storks
Alternative Education And Accountability: An Exploration, Kate Storks
School of Education and Leadership Student Capstone Projects
As schools grapple with the effects of federal accountability under Every Student Succeeds Act, alternative schools are often over-identified as poorly performing. This research brings together current understandings of alternative accountability in the United States to identify which indicators are effective in evaluating school quality in alternative schools. Alternative schools are defined as schools that serve students, aged 16-24 and deemed at-risk and who have not had success in traditional public schools. This research concluded that the typical accountability frameworks that have been set for traditional K-12 schools are inappropriate for alternative campuses whose students are generally behind grade level …
How To Be An Antiracist Educator, Veronica Myers
How To Be An Antiracist Educator, Veronica Myers
School of Education and Leadership Student Capstone Projects
Every educator should be antiracist. Racism, both overt and inadvertent, in the classroom leads to students entering the school to prison pipeline, the widening of the opportunity gap, and lack of support for English language learners. This capstone project works to answer the research question: How can educators be antiracist and incorporate antiracist practices into teaching elementary students? Antiracist strategies in the classroom include developing strong and positive relationships with all students, using culturally relevant pedagogy in the classroom, and providing ESL students with language support. This project also provides educators with the opportunity to engage in a series of …
Addressing And Supporting Student Behaviors Related To Trauma Through Social-Emotional Learning, Mindfulness, And Restorative Discipline, Alison Sasada
School of Education and Leadership Student Capstone Projects
Research has shown that Adverse Childhood Experiences can have devastating and lifelong effects on children including changes in brain structure and function as well as problems with behavioral and emotional regulation. With the support of caring adults and appropriate services however, children who suffer trauma can recover and go on to lead happy and successful lives as adults. Educators and school personnel play an important role in this. Trauma-informed practices such as social-emotional learning, mindfulness, and restorative discipline are crucial in working to mitigate the long-term effects of trauma and supporting students who have faced adversity. The research conducted throughout …

The Prison Litigation Reform Act And The Physical Injury Requirement In The Context Of Transgender Inmates, Hunter Kravitz
Cardozo International & Comparative Law Review
The note examines the impact of the Prison Litigation Reform Act (PLRA) on transgender inmates, focusing on its physical injury requirement, which disproportionately bars access to justice for those with mental or emotional injuries. It highlights the ethical and constitutional concerns arising from the PLRA's application, particularly its unequal treatment of transgender inmates, and advocates for reforms to ensure equitable access to justice.
Prostitutes And Policing - Analysis Of Tactics Used To Reduce The Demand For Sex, Morgan Helfman
Prostitutes And Policing - Analysis Of Tactics Used To Reduce The Demand For Sex, Morgan Helfman
Cardozo International & Comparative Law Review
The note critically examines the tactics used to reduce demand for commercial sex, focusing on the Nordic Model and its implementation in the U.S. It argues that while these tactics aim to deter buyers through shaming and criminalization, they raise ethical, legal, and practical concerns, particularly regarding police misconduct and the impact on marginalized communities. The analysis advocates for a shift toward education and rehabilitation over punitive measures to address the root causes of prostitution.
On Command, Diane Marie Amann
On Command, Diane Marie Amann
Scholarly Works
By reference to the Lieber Code and other sources, this essay emphasizes the history of responsibility underlying the doctrine of command responsibility, and further criticizes developments that seem to have intermingled that doctrine with what are called “modes of liability. The essay urges that consideration of commander responsibility stand apart from other such “modes,” and cautions against a jurisprudence that raises the risk that, before fora like the International Criminal Court, no one can be held to account. It appears in a symposium issue exploring a 2020 Cambridge University Press book by Darryl Robinson, Justice in Extreme Cases: Criminal Law …

In fall 2020, as the nation elected Joe Biden to be our Forty-Sixth President, Oregon voters also passed a noteworthy new drug law reform. Known as Measure 109, Oregon’s path-breaking law legalizes the use of psilocybin, a hallucinogenic substance found in magic mushrooms. Measure 109 is designed to unlock the therapeutic potential of psilocybin, which advocates tout as an effective and safe treatment for depression and other psychological conditions.
Given the burgeoning interest in psychedelics, many people are excited to see how Oregon’s psilocybin experiment pans out. But at this point, it remains unclear whether the experiment will even get …
Preventive Justice: How Algorithms Parole Boards, And Limiting Retributivism Could End Mass Incarceration, Christopher Slobogin
Preventive Justice: How Algorithms Parole Boards, And Limiting Retributivism Could End Mass Incarceration, Christopher Slobogin
Vanderbilt Law School Faculty Publications
A number of states use statistically derived algorithms to provide estimates of the risk of reoffending. In theory, these risk assessment instruments could bring significant benefits. Fewer people of all ethnicities would be put in jail prior to trial and in prison after conviction, the duration of sentences would be reduced for low-risk offenders, and treatment resources would be more efficiently allocated. As a result, the capital outlays for prisons and jails would be substantially reduced. The public would continue to be protected from the most dangerous individuals, while lower-risk individuals would be less subject to the criminogenic effects of …

Changing The Way We See Modern Policing: Abolition Or Reform, Kathryn Miller, Marbré Stahly-Butts, Mecole Jordan-Mcbride, Kate Levine, Benjamin Tucker, Kumar Rao
Cardozo Journal of Equal Rights & Social Justice
The symposium examines the historical and systemic roots of mass incarceration in the United States, tracing its origins to the 13th Amendment, Black Codes, convict leasing, and the war on drugs. It critiques the prison industrial complex as a system of oppression rooted in racism, capitalism, and heteropatriarchy, and advocates for transformative reforms to dismantle policing and incarceration. The analysis emphasizes the need to move beyond superficial reforms and instead adopt abolitionist approaches that address the root causes of systemic violence and inequality.
Leadership In Disciplinary Alternative Education Programs And The School To Prison Pipeline, April Michele Smith
Leadership In Disciplinary Alternative Education Programs And The School To Prison Pipeline, April Michele Smith
Electronic Theses and Dissertations
Current research about the school to prison pipeline has focused on the impact of zero-tolerance policies in public education on historically marginalized student populations, especially school exclusionary practices of minority and learning-disabled students. This transcendental phenomenological study extended the understanding of disciplinary alternative education programs’ place in the school to prison pipeline trajectory. According to critical race and social justice leadership theories, the investigation and exposure of the public education components leading students into the school to prison pipeline are violations of student civil rights that require scrutiny and actionable public education reform focused on equity and inclusion. The purpose of …

The Dark Triad: Pathological Personality Traits, Brett S. Burton
The Dark Triad: Pathological Personality Traits, Brett S. Burton
Student Publications
People tend to view personality as a light-hearted, positive facet of psychology. However, the fact is that there are many unpleasant and dark aspects to personality. Psychologists have identified a grouping of three dark personality traits in subclinical individuals, which is termed the “Dark Triad”. The Dark Triad includes narcissism, psychopathy, and machiavellianism, which have their own unique twists but all have the basis of callous behavior and manipulation of others. This term was coined by researchers Paulhus and Williams (2002) when they measured these constructs and concluded that they were overlapping, but distinct concepts. The origin of these traits …

Public Safety Agencies And Uav Technology: A Review Of Uses, Lacey L. Weynand
Student Publications
This study utilizes a systematic review of some of the scholarly literature available on drone usage within Southern California, specifically in Los Angeles and Chula Vista. I ask: how do public safety agencies use drone technology? The review will cover cases from existing scholarly literature, as well as policy reports and books from the Google Scholar database. A systematic review was the best methodology to begin fully investigating my research question, since the scope could have been so large that individual data points would have been difficult to find and instead requires a macro-level review. This data will provide a …

Prosecuting Executive Branch Wrongdoing, Julian A. Cook
Scholarly Works
Attorney General William Barr's handling of Robert Mueller's Report on the Investigation into Russian Interference in the 2016 Presidential Election was undeniably controversial and raised meaningful questions regarding the impartiality of the Department of Justice. Yet, Barr's conduct, which occurred at the conclusion of the Mueller investigation, was merely the caboose at the end of a series of controversies that were coupled together from the outset of the investigation. Ensnarled in dissonance from its inception, the Mueller investigation was dogged by controversies that ultimately compromised its legitimacy.
Public trust of criminal investigations of executive branch wrongdoing requires prosecutorial independence. To …

Considering The Therapeutic Consequences Of Recent Reforms To Civil Statutes Of Limitations For Child Sexual Abuse Claims, Emma Hetherington
Scholarly Works
In recent years, child sexual abuse has emerged as a major topic of news, documentaries, and Hollywood films. Public attention on child sexual abuse, including the Boston Globe's reporting on the sexual abuse of children by priests in the Catholic Church, sexual abuse of elite gymnasts, and the #MeToo movement, have brought increased attention to the issue, sparking calls for reform and access to justice. State legislatures across the country have answered these calls for reform by seeking to improve civil statutes of limitation in order to increase survivor access to justice. Between 2002 and 2020, forty-eight states and the …
