Qualified Immunity: How Mississippi’S District Courts Have Shown Why The Doctrine Should Be Done Away With, Hannah E. Sawyer
Qualified Immunity: How Mississippi’S District Courts Have Shown Why The Doctrine Should Be Done Away With, Hannah E. Sawyer
Honors Theses
Qualified immunity is a legal doctrine created by the Supreme Court that has allowed police officers to violate people’s rights without fear of consequences. This doctrine protects all but the completely incompetent or those who violate people’s rights knowingly. The original intent of the Supreme Court was to prevent overdeterrence of police officers because of insubstantial lawsuits from being brought against them. This has backfired and now it seems that officers are under deterred because they are often simply placed on administrative leave with little to no consequences. The United States has seen numerous protests in just the last year …

Oneness In Christ: A Qualitative Study Of Women’S Initial Experiences Leading In Public Worship At Broadway Church Of Christ, Shannon Clarkson Rains, Jennifer M. Dabbs, Kaley D. Ihfe
Discernment: Theology and the Practice of Ministry
Few Church of Christ women have had experience with taking an active leadership role in a worship service since these congregations have traditionally believed women leading worship is unscriptural. Recently more Churches of Christ have begun to change their understanding of scripture in ways that are more inclusive of women. In March 2019, after a six-month church wide bible study at the historic Broadway Church of Christ in Lubbock, TX, women took on public roles in a worship service in what was for most of them the first time to serve in front of a congregation.
To document their experiences, …

Does The Decriminalization And The Legalization Of Recreational And Medical Marijuana Affect Crime Rates? A Panel Data Analysis Of The New England States, Patrick Donovan
Honors Projects in Economics
Marijuana laws and their impact is always a topic of controversy. The major marijuana laws are the legalization of recreational marijuana, the legalization of medical marijuana, and the decriminalization of marijuana. This paper looked at specifically their impacts on three types of crime rates: non-marijuana drug sale crime rates, non-marijuana drug possession crime rates, and non-drug crimes. This study used panel data for the six New England state from 2000-2019 and ran panel data regressions to determine the change of each type of crime rate from before to after each policy implemented. A total of nine regressions pairing each policy …

The Process And Application Of Examining Trace Evidence And Testifying In A Court Of Law, Jillian Fry
The Process And Application Of Examining Trace Evidence And Testifying In A Court Of Law, Jillian Fry
Honors Projects
This paper follows the process of analyzing trace evidence taken from the scene of a crime, writing the report to take to the court for trial, and the process of testifying in a court of law. This was done through an internship at Bowling Green State University where a mock case was created and presented to the author. The author worked the case and then testified to the results in a moot court setting. The author then wrote about their experience during the analysis, the preparation for the trial, and the aftermath of the trial.

Children Are Human, Kim Pearson
Children Are Human, Kim Pearson
Texas A&M Law Review
There are great benefits to be had should the United States, one of the global leaders in economic strength and political power, ratify the United Nations Convention on the Rights of the Child (“CRC”). The mystery of the United States’s ultimate reluctance to ratify the CRC, despite the nation’s central role in the drafting process, has been interrogated for years. Scholars and policy- makers have developed compelling narratives regarding obstacles to the United States’s ratification and implementation of the CRC. However well- reasoned the arguments for ratification are, there has been little progress in persuading the United States to ratify …
Exploring The Relationships Between Community Experiences And Well-Being Among Youth Experiencing Homelessness, Katricia Stewart
Exploring The Relationships Between Community Experiences And Well-Being Among Youth Experiencing Homelessness, Katricia Stewart
Dissertations and Theses
The current dissertation presents two published empirical studies and one new study informed by the findings and recommendations of the first two. The first study investigated how intrapersonal factors (self-esteem, psychological distress, and optimism) and social-contextual factors (social support, sense of community, and empowerment) relate to the psychological well-being of 100 youth experiencing homelessness. The results indicated that all six variables were significantly related to well-being, but the intrapersonal factors had a stronger association with psychological well-being than the social-contextual factors. The second manuscript is a qualitative study investigating what community means to youth experiencing homelessness, what communities they are …

Examining Bystander Blame In Rape And Sexual Assault, Katherine E. Purdom
Honors Theses
The present study investigated the effect of various factors on blame distribution in sexual violence cases. Participants (N = 378) were randomly assigned to either a rape (N = 187) or sexual assault (N = 190) condition and directed to read a scenario that varied only by the terminology indicated by the condition. Participants were provided two pre-filled slots labeled as the perpetrator and victim. Additionally, they were given two blank “free-response” options in which participants could assign blame and indicate a responsible party if they found it necessary. Data was gathered from the male (N = 163) and female …

When Children’S Rights Are At Stake, Shall Court Remain Silent? Analysis On The Implementation Of Passivity Of Judge Principle In Child Marriage Dispensation In Indonesia, Laras Susanti Ms
Indonesia Law Review
This article explores the existence of asas hakim pasif (passivity of judge principle) in cases involving children in civil cases in Indonesia. As one of the basic principles in civil procedure, judges must be bound by the scope of the case and evidence brought by parties. The principle is not absolute, however, showing that under the Law on Judicial Power; judges are obliged to uphold justice by exploring law and social values more than often. A study case in marriage dispensation shows that judges are facing pluralism orders. Therefore, judges’ value and understanding of children’s rights is a determinant factor. …

Can Emerging Adults' Dating Psychological Aggression Be Explained By Family-Of-Origin Psychological Aggression, Emotion Dysregulation, And Drinking?, Deepali M. Dhruve
Theses and Dissertations
Intimate partner violence (IPV) impacts the lives of millions of individuals. Previous studies frequently cite family-of-origin aggression as a risk factor for later experiences with IPV. The current study sought to identify factors that explain and moderate risk for dating psychological aggression (DPA) in college adults, and gender differences in those associations. Participants (464 women, 142 men) aged 18 to 37 years, who were in a current romantic relationship lasting at least 3 months, completed measures of past psychological aggression in the family-of-origin (PAF), current emotion dysregulation, and DPA perpetrated in current intimate relationships. Emotion dysregulation mediated the relationship between …

Child Welfare Service Worker's Perspective Of The Juvenile Justice System, Valorie Antone, Kathryn Whitehead, Alexander Comeau, Zoe Donvan
Thinking Matters Symposium
Prior literature indicates youth who have had adverse childhood events or are diagnosed with a mental illness are more likely to become involved in the juvenile justice system (Chappard & Maggard, 2020). While research has been performed to involve juvenile justice workers and juveniles that have been involved in the system, there has been little involvement by the child welfare workers who have followed the trajectory of the youth from the beginning of involvement. This study investigates the perceptions of child welfare workers regarding youth involvement in the criminal justice system, addressing a current gap in the literature. In terms …

A Participatory Action Research Study Of Police Interviewing Following Crisis Intervention Team Training, Maria Felix-Ortiz, Catherine Steele, Marisa Deguzman, Georgen Guerrero, Melissa Graham
Verbum Incarnatum: An Academic Journal of Social Justice
Estimates vary, but a third to one half of individuals shot and killed by police have a mental illness or disability, and many who are taken into custody languish in county jails where no treatment for their illness is available. The Crisis Intervention Team (CIT) model is an increasingly important adjunct to U.S. police training because it de-escalates tense situations, diverts people with mental illness away from jail and into treatment, and can reduce the risk of civilian deaths during a police encounter. As such, it is a strategy for reducing the social injustice of incarceration or deaths of people …

The Perception Of Motherhood Through The Smiles And The Spit-Up, Sydney M. Forsythe
Honors College Theses
This research examines how motherhood is viewed by women, particularly mothers, in the southeast of the United States today. The treatment of women compared to men in women's studies has been a popular topic, but there is less research on mothers. This qualitative study is designed to hear personal stories from mothers and potential mothers, both employed and unemployed, describing how they feel mothers are perceived in the southeast of the United States. Facing the overwhelming literature that describes motherhood as associated with numerous negative impacts on women’s lives, this study explores the weight of joy or the paucity of …
Restoration Of A Nation, Deshauna Williams
Restoration Of A Nation, Deshauna Williams
Honors College Theses
Restorative justice is a growing school of penal thought which places emphasis on restoration and healing rather than punitive solutions. The purpose of this study is to assess whether prior experience with the criminal justice system, either as a victim, as an offender, or as an employee, affects perceptions of the foundations of restorative justice. These foundations include ideas such as punishment, retribution, and victim involvement. Additionally, this study examines how these perspectives influence the respondents’ perception of effectiveness or “justness” of the criminal justice system. Findings reveal that offenders have more negative views of punishment as a method of …

Innovative Virtual Role Play Simulations For Managing Substance Use Conversations: Pilot Study Results And Relevance During And After Covid-19, Glenn Albright, Nikita Khalid, Kristen Shockley, Kelsey Robinson, Kevin Hughes, Bethany Pace-Danley
Publications and Research
Background: Substance use places a substantial burden on our communities, both economically and socially. In light of COVID-19, it is predicted that as many as 75,000 more people will die from alcohol and other substance use and suicide as a result of isolation, new mental health concerns, and various other stressors related to the pandemic. Public awareness campaigns that aim to destigmatize substance use and help individuals have meaningful conversations with friends, coworkers, or family members to address substance use concerns are a timely and cost-effective means of augmenting existing behavioral health efforts related to substance use. These types of …

The Protection Of Free Choice And The Right To Passivity: Applying The Privilege Against Self-Incrimination To Physical Examinations And Documents' Submission, Rinat Kitai-Sangero
William & Mary Bill of Rights Journal
This Article addresses the question of whether the privilege against selfincrimination should cover physical examinations as well as the obligation to submit documents. This question requires a serious examination of the justifications underlying the privilege against self-incrimination and is of particular relevance in the current age of technological progress that expands the powers assigned to law enforcement agencies to access knowledge and thoughts stored in individuals’ minds. After addressing the comparative law regarding the applicability of the privilege against selfincrimination to physical examinations and to the obligation to submit documents and discussing key justifications for the privilege against self-incrimination, dividing …

Opioid Overdose Prevention And Naloxone Training Among College Students, Mackenzie Thode
DNP Projects
Background: Opioid abuse is a serious national crisis affecting both public health and economic welfare across the United States. In Tennessee, more than 1,800 overdose deaths were reported in 2018, with nearly 20% of those deaths occurring in Davidson County alone. The number of overdose deaths in Nashville has steadily risen amidst the COVID-19 pandemic by approximately 32% since 2019 to a total of 619 fatal overdoses in 2020, making it the city’s deadliest year on record. Review of evidence: Research shows that intranasal (IN) naloxone training is an effective approach to combating the opioid overdose crisis and can be …
Unexpected Inequality: Disparate-Impact From Artificial Intelligence In Healthcare Decisions, Sahar Takshi
Unexpected Inequality: Disparate-Impact From Artificial Intelligence In Healthcare Decisions, Sahar Takshi
Journal of Law and Health
Systemic discrimination in healthcare plagues marginalized groups. Physicians incorrectly view people of color as having high pain tolerance, leading to undertreatment. Women with disabilities are often undiagnosed because their symptoms are dismissed. Low-income patients have less access to appropriate treatment. These patterns, and others, reflect long-standing disparities that have become engrained in U.S. health systems.
As the healthcare industry adopts artificial intelligence and algorithminformed (AI) tools, it is vital that regulators address healthcare discrimination. AI tools are increasingly used to make both clinical and administrative decisions by hospitals, physicians, and insurers—yet there is no framework that specifically places nondiscrimination obligations …
