Transparency's Ai Problem, Hannah Bloch-Wehba Jun 2021

Transparency's Ai Problem, Hannah Bloch-Wehba

Faculty Scholarship

A consensus seems to be emerging that algorithmic governance is too opaque and ought to be made more accountable and transparent. But algorithmic governance underscores the limited capacity of transparency law—the Freedom of Information Act and its state equivalents—to promote accountability. Drawing on the critical literature on “open government,” this Essay shows that algorithmic governance reflects and amplifies systemic weaknesses in the transparency regime, including privatization, secrecy, private sector cooptation, and reactive disclosure. These deficiencies highlight the urgent need to reorient transparency and accountability law toward meaningful public engagement in ongoing oversight. This shift requires rethinking FOIA’s core commitment to …

Use Of The Prescription Drug Monitoring Program For Substance Abuse Monitoring And Pain Management, Crystal P. Beddard

Electronic Theses and Dissertations

Abstract

The United States is in an opioid epidemic. The comitant use of opiates and benzodiazepines can ultimately result in death. This project consisted of a quality improvement approach addressing the continued need to educate prescribers on coprescribing benzodiazepines and opioids to the adult population. A qualitative and quantitative descriptive analysis was utilized for data collection. The results will assist in determining if accessing the Prescription Drug Monitoring Program (PDMP) and utilizing evidence-based guidelines before prescribing treatment compared to the nonutilization of the PDMP and evidence-based guidelines aid in the reduction of mortality and overdose rates within a three-month period. …

Diskarte Lang: Dealing With Operational Challenges In A Philippine City Jail, Hannah Glimpse Nario-Lopez May 2021

Diskarte Lang: Dealing With Operational Challenges In A Philippine City Jail, Hannah Glimpse Nario-Lopez

Social Transformations Journal of the Global South

The subhuman conditions in Philippine jails and prisons is a pressing concern because of its ill effects in delivery of rehabilitative justice. While many elements are at play, coming from all institutions involved in the justice process, there is a notion that looking into the administrative side of prisons and the role of jail officers oversimplifies the problem and overemphasizes the clout of prison regimes. This study would like to forward an alternative view. Although officers bear authority through their badges, their command over the facility is confronted, challenged, and negotiated by detainees amidst structural deficiencies. Using qualitative methodology and …

The Medical Treatment Of Obesity: On The Page & In The Office, Shayla J. Staley May 2021

The Medical Treatment Of Obesity: On The Page & In The Office, Shayla J. Staley

LSU New Orleans Theses and Dissertations

This paper sought out the causes of weight discrimination in healthcare. Through content analysis of medical journals, the study illuminated several causes. These causes were used to create a concept matrix surrounding the medicalization of fatness that illustrated how these concepts are defined relationally, as well as how they combine to form the medical conception of the “obesity epidemic”. The concept matrix carries an indirect influence upon weight stigma that can lead to weight discrimination when fat folks seek out healthcare.

The Federalist Society And Constitutional Interpretation: Who Gets To Say What The Constitution Says, Deborah L. Toscano May 2021

The Federalist Society And Constitutional Interpretation: Who Gets To Say What The Constitution Says, Deborah L. Toscano

LSU New Orleans Theses and Dissertations

The Federalist Society was organized in 1982 by conservative law students to counteract what they perceived to be a liberal bias in law schools, the courts, and government administration. Forty years later there is an acknowledgement of a rightward turn in the Supreme Court which scholars have attributed in part to the efforts of the Federalist Society. However, there is still little understanding of just how that change came about. This dissertation takes a step toward understanding that question. Viewing the Federalist Society as the center of a network of lawyers, think tanks, and legal institutions, I examine the influence …

Developing A Theater Skills-Based Workshop To Facilitate Exploration Of Self-Identity For Young People, Natasha N. Goss

Critical and Creative Thinking Capstones Collection

This synthesis will explore the premise of a working outreach platform comprised of experiential methodology, and practical tools and strategies to serve the intended audience. The paper presents an in-depth example of a workshop curriculum created for middle-school aged youth, (12-14 years old), who may struggle with self-esteem, understanding their self-worth, and making responsible decisions. The work explores two intersecting ideas that 1) poor self-concepts and misperceived thinking can lead youth to behave negatively and make detrimental decisions, and 2) theater involvement can produce a theater-based skillset capable of combating those poor self-concepts and misperceived thoughts and changing the trajectory …

Equal Injustice For All: High Quality Self-Representation Does Not Ensure A Matter Is “Fairly Heard”, Jona Goldschmidt May 2021

Equal Injustice For All: High Quality Self-Representation Does Not Ensure A Matter Is “Fairly Heard”, Jona Goldschmidt

Seattle University Law Review Online

Self-represented litigants (SRLs) are generally less successful in court than parties with legal representation. Some access-to-justice programs view self-representation as a skill that can be taught and will lead to more success in case outcomes, but Jona Goldschmidt pushes back against this assumption. Goldschmidt argues that even high functioning, educated, and computer savvy SRLs are at a disadvantage in the courtroom when courts strictly enforce rules and do not offer reasonable accommodations.

In this Article, Goldschmidt evaluates three cases that illustrate expert SRLs’ challenges in the courtroom, and he argues that ridged rule enforcement and failure to accommodate lead to …

Guilt By Obesity: A Closer Look At Obesity Stigmas, Loriana Goulding May 2021

Guilt By Obesity: A Closer Look At Obesity Stigmas, Loriana Goulding

Intuition: The BYU Undergraduate Journal of Psychology

Obesity stigmas have led to an increased interest in the body-positivity movement in recent years. However, despite the decreasing discrimination and shaming of the obese, many people still consciously and unconsciously adhere to obesity stigmas and myths. These false beliefs are harmful not only to obese individuals but also to society, given that over 1/3 of the U.S. adult population is now obese (Centers for Disease Control and Prevention, 2017). These stigmas can be especially harmful to obese individuals who are victims of wrongdoings and to obese individuals who are accused of a wrongdoing (Yamawaki, Riley, Rasmussen, & Cook, 2018). …
