When Miami, Florida, was incorporated in 1896, most white residents mirrored the prevailing attitude toward blacks. Negroes, they assumed, were inferior people who represented a potential threat to the white community. This attitude resulted in the consignment of blacks to cramped quarters with inadequate municipal services, creation of a dual system of justice, and semi-official tolerance of white terrorism. The symbol and guardian of this order was the police.

This presentation provides an overview of Supreme Court caselaw regarding qualified immunity and government officials’ right to interlocutory appeal from denials of qualified immunity, and provides a brief discussion of ways trial lawyers can overcome interlocutory appeals to provide their injured plaintiffs with an opportunity to be heard and vindicated at trial by a jury.

“Open courts” are a bedrock principal of our judicial system, and court secrecy, including concealment of pretrial proceedings, poses a serious threat to public safety. Overbroad protective orders have concealed facts uncovered during litigation regarding some of the most important public harms, keeping them secret when the public needs protection. Protective orders routinely include provisions that allow parties to designate discovery material as “confidential” without further judicial review. These orders are often abused and result in unnecessary costs to litigants, the courts, and the public’s confidence in the court system. This is always a mistake because it harms the discovery …

Implicit bias is something that everyone has but many cannot identify within themselves. Judge Draper draws on caselaw, research, and anecdotes from her own career to demonstrate the ways that implicit bias can impede equitable and just court experiences for all. She argues for the importance of more diverse juries, implicit bias instruction early in the proceedings, and the use of Batson as remedies to counteract bias.

This presentation sheds light on a part of officer involved shootings not always discussed at a legal symposium: the potential bias that emerges at a crime scene during an investigation. The speaker explores the evidentiary challenges associated with an officer involved shooting, and describes the reconstruction project that he led as a consultant during the investigation and trial of off-duty police officer Amber Guyger, who was convicted of the murder of Botham Jean.

Eyewitness identification often plays a crucial role in the criminal justice system. It can be used to make an arrest, both exonerate and convict suspects, fuel police interrogation, and influence a plea bargaining decision. In the meantime, eyewitness misidentification has contributed to approximately 69% of the wrongful convictions, making it the leading factor in wrongful convictions nationwide. Hence, the central question that will be explored in this thesis is: Why eyewitness testimony is so powerful despite it is prone to error? Sustaining Boys' Motivation Over The Transition To Middle School: Can Interpersonal Resources Protect Boys From Engagement Declines Across Sixth Grade?, Brandy Anne Brennan

Recent research has highlighted the challenges boys face in school. Boys are overrepresented on indicators of negative academic outcomes, such as detention, suspension, and dropout, as well as underperformance on state and national tests. Moreover, these effects may be long lasting: Compared to females, male students are less likely to graduate high school, enroll in college, and complete a college degree, and they may be particularly vulnerable in middle school. As students enter middle school, their motivation and engagement normatively decline, and these losses may be especially problematic for boys. Nevertheless, research documents the importance of close relationships with parents, …

At the time of Miami’s incorporation in 1896, the fortunes of black Americans had declined to their lowest level since the Civil War. The heady illusions and notable accomplishments of the freedmen during Reconstruction had succumbed to the harsh realities of economic dependency and the restoration of white Democratic rule in the South. Increasingly, blacks found themselves scapegoats for political and economic tensions and targets of virulent new doctrines of racial inferiority, resulting in widespread disfranchisement, segregation (Jim Crow) legislation, and increasing white intimidation and violence in Florida and elsewhere in the South. Private prisons, like hotels, are most profitable when they are at maximum occupancy and their guests stay for longer periods of time. Because the business-model for private prisons is predicated on incarceration rates dictated by public policy, one would presume that private prison corporations expend great resources to advocating for stricter criminal laws and sentencing. This note explores the role of political lobbying and campaign contributions of private prison corporations to see if a correlative relationship exists between their advocacy and stricter crime laws. Non-Consensual Condom Removal In Canadian Law Before And After R. V. Hutchinson, Lise Gotell, Isabel Grant
Dalhousie Law Journal
This paper examines the phenomenon of non-consensual condom removal (NCCR) and its relationship to sexual assault in Canada. Using empirical studies and the insights of feminist theory, we explore the nature of the harms caused by NCCR and contend that this pervasive practice constitutes sexual assault. We then critique the decision of R v Hutchinson, which held that condom sabotage does not negate subjective consent, ignoring the dignitary harms of NCCR. While lower court decisions before Hutchinson recognized that consent to sex with a condom does not include consent to sex without, courts after Hutchinson have struggled to distinguish the …

Canada’S Right-Wing Extremists: Mapping Their Ties, Location, And Ideas, Bessma Momani, Ryan Deschamps

Canada has often been seen as a progressive country that is welcoming to immigrants, promotes multiculturalism, and generally as a kind and tolerant society. This study used a two-month close examination of Canada’s RWE online presence surrounding the 2019 federal election. Using social network analysis, this study fills a needed empirical gap in current understanding of this network that are known to produce and sustain domestic terrorism and extremist hate crimes in Canada. Then using both discourse and correspondence analysis, we find that Canada’s Right-Wing Extremists (RWEs) galvanize around the following key ideas: leftist-propensities towards violence, projecting especially views against …

Human trafficking (HT) is a federal and international crime and is regarded as one of the most pressing human rights issues. Adult and minor victims are trafficked by force (rape, beatings, confinement), fraud, and coercion resulting in profound physical and psychological injuries (Chisolm-Straker et al., 2019, p. 72; Department of Homeland Security, 2020; Vera Institute of Justice, 2014, p. 6). The American Association for State Colleges and University’s (AASCU’s) American Democracy Project (ADP) and the Institute for Democracy and Higher Education (IDHE), located at Tufts University’s Jonathan M. Tisch College of Civic Life, formed a three-year partnership to pilot a process for fostering institutional change to advance political learning and engagement on college campuses. The multidimensional approach to collecting information, deploying dialogues, and crafting interventions provided insight into the necessity of generating institutional support for civic engagement initiatives.
This article reviews the goals, plan, and process of this three-year, multi-phased initiative. We weave throughout the results of multi-stage evaluations of …

This workshop will explore how the so-called Alt-Right and White Nationalist movement used conspiracy theories around the origin and challenge of the COVID-19 Pandemic to recruit members, advance their causes, and create social and cultural discord in an effort to create legitimacy for their racist and white supremacist attacks on community. After a discussion of the current state of the Alt-Right and White Nationalist movement, the workshop will interrogate the various online tools used by these groups to attack and dismantle community and human rights initiatives. Although the notion of sustainable peace requires acknowledging the role played by all actors, transitional processes around the world have inadequately addressed or completely ignored the direct and indirect participation of economic actors. In particular, Colombia's transitional justice regime left out corporations entirely. A skillshare between Colombian lawyers and US-based human rights attorneys showed some of the gaps that let corporations continue in impunity for profiting, benefiting from, or directly financing the conflict. Other than harming and deeply fracturing communities, the shortcomings of corporate accountability in post-conflict Colombia also leave land, rivers, and animals without redress. Abolition Constitutionalism And Non-Reformist Reform: The Case For Ending Pretrial Detention, René Reyes

The prison abolition movement encompasses a range of objectives and perspectives. While dismantling the carceral system may be the ultimate goal, incremental steps can be an important component of this long-term project. This Essay makes a case for the constitutional elimination of pretrial detention as one part of an incremental abolitionist agenda. The analysis pays particular attention to the Massachusetts Supreme Judicial Court’s recent decision in Commonwealth v. Lougee, which illustrates some of the ways in which the COVID-19 crisis has exacerbated preexisting injustices and inequities in the pretrial detention system.
