The Escalation Of Gender-Based Violence During Lockdown As A Practical Theological Concern In The South African Context, Me Baloyi
Journal of International Women's Studies
The year 2020 will be remembered as the year in which the coronavirus managed to disturb almost the entire planet from many of its activities. During the lockdown, which saw more than 195 countries in the world trying to combat the virus, gender-based violence in South Africa rose at an alarming rate. The skyrocketing statistics reported to police during this period raises a lot of concern as to why, instead of lockdown uniting families and marriages, reports of violence are on the rise. Aside from other factors that the research will unveil, theologically the church is not innocent of its …

The American College of Surgeons Committee on Trauma requires that trauma centers demonstrate adequate financial support for an injury prevention program as part of the verification process. With the ongoing challenges that arise with important social determinants of health, trauma centers have the important task of navigating a patient through the complex process of obtaining services and tools for success. This summary from the American Association for the Surgery of Trauma Prevention Committee focuses on a model that has been present for several years, but has not been brought to full awareness in the trauma world. It highlights the importance …

Criminal Protection Of The Image Of Person In Human Rights: A Study In The French, Bahraini, And Libyan Legislations, Dr. Mashallah Othman Muhammad
UAEU Law Journal
Individual or personal freedom is a basic and important requirement of the human being in various peoples and throughout the ages. The person has taken a long march of struggle and struggle to defend and protect it, and this has been demonstrated in the affirmation of personal freedom and the rights associated with it in various legislations around the world.
At the forefront of those rights is the human right to prohibit the image and not to take it, publish it or use it without its consent.
The risks to this right have increased with the scientific and technological progress …
Knowledge From Below, Meghan Surges
Knowledge From Below, Meghan Surges
Masters Theses
This thesis elucidates artistic research on the programmed world and its brutal machines. It describes a practice that hones a deviant worldview while confronting ubiquity. Applying web scraping as an investigative tool and a filmmaking methodology, I work with archives of traffic images. The pictures, portraying the smart city through its scattered, self-surveilling eyes, offer a cinematic mirror of reality. I select, annotate, and edit sequences to expose agents of administrative violence. Rejecting a vision of progress that rests on exploitation, I aim to destabilize readings of surveillance and policing as beacons of safety. My work proposes models for seeing …
Beyond “Children Are Different”: The Revolution In Juvenile Intake And Sentencing, Josh Gupta-Kagan
Beyond “Children Are Different”: The Revolution In Juvenile Intake And Sentencing, Josh Gupta-Kagan
Washington Law Review
For more than 120 years, juvenile justice law has not substantively defined the core questions in most delinquency cases—when should the state prosecute children rather than divert them from the court system (the intake decision), and what should the state do with children once they are convicted (the sentencing decision)? Instead, the law has granted certain legal actors wide discretion over these decisions, namely prosecutors at intake and judges at sentencing. This Article identifies and analyzes an essential reform trend changing that reality: legislation, enacted in at least eight states in the 2010s, to limit when children can be prosecuted …

Higher Ground: Rev. Dr. William Barber Ii And The Political Content Of Prophetic Form, Braxton D. Shelley
Higher Ground: Rev. Dr. William Barber Ii And The Political Content Of Prophetic Form, Braxton D. Shelley
Yale Journal of Music & Religion
This essay argues that Rev. Dr. William J. Barber’s message on “Higher Ground,” a speech delivered at a massive 2014 protest rally, reveals his intentional problematization of distinctions between the sacred and the secular. As Barber’s articulation of what Ashon Crawley calls “Blackpentecostal breath” spill over the boundaries posited by conventional categories—they are too ecstatic to be ordinary speeches, and too political to be traditional sermons—these plural expressions identify themselves as sounds that come from another world. If both content and form are understood as thought, it becomes apparent that these prophetic utterances critique the oppression wrought by contemporary social …
Legal Liability For Corporations Doing Business In The West Bank: An Analysis Of Corporate Liability And A Shareholder Proposal Solution For Mitigating Risky Business Activity, Mila Kelly
William & Mary Business Law Review
For over half a century, Israeli Settlements in the occupied West Bank have expanded significantly in both land and economic activity. While this expansion has not been without criticism from the international community over fear of humanitarian law violations, global businesses have not shied away from the profitability of this region. This engagement in corporate activity within any disputed territory comes with its fair share of business risk, including legal liability for complicity in purported human rights violations.
This Note will examine the hypothetical liability for corporations doing business in the West Bank and explain how international law and the …
Understanding The Bounds Of Legitimacy: Weber’S Facets Of Legitimacy And The Police Empowerment Hypothesis, Kyle Mclean, Justin Nix
Understanding The Bounds Of Legitimacy: Weber’S Facets Of Legitimacy And The Police Empowerment Hypothesis, Kyle Mclean, Justin Nix
Criminology and Criminal Justice Faculty Publications
Despite considerable evidence that police legitimacy results in beneficial outcomes like compliance, cooperation, and empowerment, scholars have yet to agree on how to define and operationalize legitimacy. Drawing on Max Weber’s facets of legitimacy, we developed and tested a measure of “traditional authority,” reflecting the possibility that some people legitimate the police more so based on tradition than normative concerns regarding fairness. Confirmatory factor analysis of survey data from a national sample of 701 US adults revealed that our traditional authority items loaded separately from items commonly used to capture feelings of trust, obligation to obey, and moral alignment. Furthermore, …

The Unintentional Cost Of A Free Public Sex Offender Registry, Rebekah E. Leavitt
The Unintentional Cost Of A Free Public Sex Offender Registry, Rebekah E. Leavitt
Intuition: The BYU Undergraduate Journal of Psychology
This literature review analyzes the efficacy of modern legislation guiding public access to sex offender registries and draws on research utilizing surveys, interviews, and statistical observations of convicted sex offenders to determine sources of ineffective practices at the legislative level. By utilizing Braithwaite’s reintegrative shaming theory (1989), in which stigmatizing shame is significantly less efficient in criminal contexts, current legislation and its impact on common issues experienced by sex offenders (including sexually addictive behaviors and childhood sexual abuse) are examined. The discerned prevalence of stigmatizing shame in modern legislation, which focuses on the individual rather than the undesirable behavior, indicates …
Failure To Report: The Detrimental Effects Following Sexual Assault, Lindsey R. Osborne
Failure To Report: The Detrimental Effects Following Sexual Assault, Lindsey R. Osborne
Intuition: The BYU Undergraduate Journal of Psychology
Sexual assault is a prominent issue in society, yet many people remain unaware of the serious effects following sexual assault. Victims who report to legal authorities tend to experience disbelief and blame because of the prevalence of rape myths. Due to the severity of the trauma, hormones released by the brain hinder proper brain functioning and can cause a little-known evolutionary response termed tonic immobility (TI). The psychological outcome of sexual assault commonly results in or worsens several psychological conditions, including depression, anxiety, PTSD, and drug and alcohol abuse. Guilt, self-blame, and adverse emotions are accelerated with negative interactions while …

Analysis Of Administrative Agency Adjudicatory Hearing Use Of Remote Appearances And Virtual Hearings, Fredric I. Lederer, Center For Legal & Court Technology
Faculty Publications
With the advent of the COVID-19 pandemic, federal and state courts and federal adjudicatory agencies suspended most trials and hearings. Faced with the requirement to fulfill their basic mission, many resumed partial operations using computer-based video conferencing, especially for preliminary legal and procedural matters. As time passed, the use of that videoconferencing extended to bench trials in courts and to adjudicatory hearings and proceedings such as settlement meetings, mediations, arbitrations, and status conferences in federal agencies. As of this writing, there have also been a small number of remote or virtual jury trials in state and federal courts.
The Administrative Conference …

Transfer Of Child Offenders To Adult Criminal Courts In The Usa: An Unnecessary Exercise, Unconstitutional Practice, International Law Violation, Or All Of The Above?, Roger-Claude Liwanga, Patrick Ibe
Georgia Journal of International & Comparative Law
There is an ongoing debate over the legality and effectiveness of the use of judicial waiver as a tool to fight violent crimes, including those committed by children in the United States. Judicial waiver or transfer of juveniles is a process by which child offenders are transferred from the juvenile court to adult criminal courts to be tried and sentenced as adult offenders. Despite the implicit recognition of the constitutionality of this practice by the United States Supreme Court, this paper contends that the transfer of child offenders to adult criminal courts violates key provisions of the Convention on the …

The Perception Of Actors Toward Collaboration In Public Services: Evidence From Civil Registration Services Innovation In The Pangkajene And Island Regency, Krisna Puji Rahmayanti
BISNIS & BIROKRASI: Jurnal Ilmu Administrasi dan Organisasi
This paper aims to analyze the perception of involved actors toward collaboration and investigate conditions that motivate actors to collaborate in delivering public services. This study uses pragmatic philosophy that utilizes qualitative data collection. Despite the government as the leading service provider, non-state actors' involved in planning, organizing, and evaluating service delivery. By conducting a focus group discussion, providing an open question survey, and analyzing relevant news, this research emphasizes that public service providers and communities involved in public service delivery perceived collaboration as working with others or cooperating and achieving common goals. The actors’ belief that achieving common goals …

Drug use among refugee populations is a concerning trend in many urban American cities. For instance, Omaha, Nebraska is home to an estimated 7,000 refugees from Myanmar, with at least 75% of those being Karen refugees. The purpose of this paper is to explore methamphetamine use among Karen adolescents in Omaha and to examine whether Karen youth bring their drug use habits with them from refugee camps or if they learn about drugs from their American peers. Two focus groups of Karen youth and two focus groups of Karen parents were conducted to examine methamphetamine use among this population. Findings …

Online Sexual Harassment Amongst Women Students At Santa Clara University, Anjali Rangaswami, Elvena Gevargiz
Online Sexual Harassment Amongst Women Students At Santa Clara University, Anjali Rangaswami, Elvena Gevargiz
Silicon Valley Sociological Review
Online sexual harassment has continued to be a pervasive force in universities. Scholarship suggests that female-identifying students experience particularly high rates of sexual harassment, but little research explores how it manifests in online spaces. Thus, we investigate whether women students at Santa Clara University (SCU) experience online sexual harassment, and what forms of harassment they experience. First, a survey of 50 women undergraduate students was conducted to assess whether respondents had experienced online sexual harassment, and if so, on which platforms. Selecting from survey respondents who opted-in for further research, we conducted semi-structured ethnographic interviews with four students about their …

Calls For Accountability: Redefining The Culture Of Policing In Las Vegas, Olivia K. Cheche
Governance: The Political Science Journal at UNLV
In summer 2020, national attention on racial injustice brought into focus the culture of policing as a critical area of policy exploration for the United States. The purpose of this policy report is to examine the culture of policing in the Las Vegas metropolitan area, and specifically within Las Vegas's largest police force, the Las Vegas Metro Police Department (LVMPD). Through this case study analysis, the racial, social and fiscal aspects of the culture of policing are investigated between the years 2016 & 2020. The research here presents data on disparities within policing found at the national and local levels. …
