Disabilities On Death Row: The Ada, Ableism, And Alternatives To The Eighth Amendment, Christopher Hill J.D., Ll.M

Lincoln Memorial University Law Review Archive

In one of the most recent death penalty cases, the Supreme Court of the United States held that the Eighth Amendment to the Constitution’s prohibition against cruel and unusual punishment does not guarantee a painless death and that the execution was constitutional if there was not “superadded” pain, despite the inmate’s disability causing extreme pain when he was required to lie down on a gurney. While the Court used an Eight Amendment analysis to determine whether additional pain triggers further protection for a death row inmate, it may be time to view some cruel and unusual punishment claims under a disability …

Machine Learning In Complex Scientific Domains: Hospitalization Records, Drug Interactions, Predictive Modeling And Fairness For Class Imbalanced Data, Arghya Datta

McKelvey School of Engineering Graduate Student Theses & Dissertations

Machine learning has demonstrated potential in analyzing large, complex datasets and has become ubiquitous across many fields of scientific research. As machine learning is actively deployed in many complex and critical domains, it is essential for machine learning to engage with domain expertise to aid in knowledge discovery as well as address challenges in predictive modeling in complex domains. Domain expertise represents an essential and elaborate collection of knowledge that is often under-utilized when applying machine learning in complex domains. In this dissertation, I have addressed existing challenges regarding knowledge discovery in complex domains via engagement with domain expertise, particularly …

Patterns And Trends Among Intimate Partner Homicide Cases: An Analysis By Victim’S Sex And Race/Ethnicity, Shih-Ying Cheng Aug 2021

Patterns And Trends Among Intimate Partner Homicide Cases: An Analysis By Victim’S Sex And Race/Ethnicity, Shih-Ying Cheng

Arts & Sciences Graduate Student Theses and Dissertations

Data suggest sex and race/ethnicity disparities in intimate partner homicide (IPH) and different trends in the IPH rates over time by sex and racial/ethnic groups. It is, however, less clear how to explain the disparities using the existing literature. This dissertation investigates the patterns and trends among IPH cases with a focus on differences within and between victims’ sex and race/ethnicity subgroups using the National Violent Death Reporting System, Restricted Access Database (NVDRS-RAD). Data were linked to Census and policy data using the geographic indicator in the NVDRS-RAD. Latent class analysis (LCA) and mixed-effects modeling were performed to identify patterns …

Racial Profiling: Understanding The Practice Of Stop-And-Frisk In New York City, Lisa Ly

Spectra Undergraduate Research Journal

Racial profiling has become a prominent issue in modern policing today. Instead of being based on individual suspicion, racial profiling embodies a belief that people of color are continuously singled out by the police for scrutiny and harassment. Policies and procedures make the Black community vulnerable to police discrimination and racial profiling. Floyd et al. v. City of New York et al. (2013) declared that the New York Police Department’s (NYPD) practice of stop-and-frisk was racially profiling Black civilians. This study sought (1) to determine if the NYPD post-Floyd is still engaging in racial profiling towards Black civilians; and (2) …

Machine Learning As A Tool For Wildlife Management And Research: The Case Of Wild Pig-Related Content On Twitter, Lauren M. Jaebker, Hailey E. Mclean, Stephanie A. Shwiff, Keith M. Carlisle, Tara L. Teel, Alan D. Bright, Aaron M. Anderson

Human–Wildlife Interactions

Wild pigs (Sus scrofa) are a non-native, invasive species that cause considerable damage and transmit a variety of diseases to livestock, people, and wildlife. We explored Twitter, the most popular social media micro-blogging platform, to demonstrate how social media data can be leveraged to investigate social identity and sentiment toward wild pigs. In doing so, we employed a sophisticated machine learning approach to investigate: (1) the overall sentiment associated with the dataset, (2) online identities via user profile descriptions, and (3) the extent to which sentiment varied by online identity. Results indicated that the largest groups of online …

Can The Requirements Of Shariah Law Regarding Criminal Punishments Be Interpreted In A Way That Is Compatible With The Iccpr And Cat?, Alfitri Alfitri

Indonesian Journal of International Law

Criminal law deals with the protection of public interests and values deemed to be crucial for a particular society. In Islam, these values are ascribed to the divine commands. Thus, there will be calls from some Muslims for the implementation of Islamic criminal law by the state for they believe that this is required by Islam. Can therefore the death penalty or corporal punishments required by the Shariah law be imposed by a state while they are in conflict with the state’s obligation to comply with international human rights instruments? This paper will analyze this uneasy situation faced by some …

Kejahatan Korporasi Suatu Fenomena Lama Dalam Bentuk Baru, Mardjono Mardjono Reksodiputro Reksodiputro

Indonesian Journal of International Law

The economic crisis in 1997 has confirmed the Indonesian society that white collar criminality also exist in their country. The failure to bring the corporate criminals to court was caused by the difficult of the Indonesian justice system to accept that corporations can also be held accountable under the Indonesian criminal law. On the other hand, legislature has accepted that corporations (as juristic persons) can be held liable, beside the managers (as natural persons). Since 1995, law no. 7 on economic crimes also include juristic persons as subjects of the law. This has been followed by the legislature in 1963 …

International Criminal Court (Icc) In Comparison With The Indonesian Human Rigths Court, Muladi Muladi

Indonesian Journal of International Law

Konvensi Roma menyatakan "No reservations may be made to this Statute". Namun dalam UU No. 26/2000 penyelarasan yang dilakukan secara parsial telah menimbulkan suatu permasalahan dalam praktiknya. Komunitas Hukum di Indonesia …

Employment Assistance And Offender Desistance: An Evaluation Of Recidivism In A Faith-Based Re-Entry Program, Caitlin J. Steckley, Emily Friedman, Rachel Simmons

PANDION: The Osprey Journal of Research and Ideas

Recently released criminal offenders are generally subjected to heavy stigma as they reenter society which is compounded by the general isolation that many feel upon release. Because of these difficulties, re-entry programs can be an effective and prosocial way for ex-offenders to reintegrate back into the community and workforce. This project was designed to evaluate the effectiveness of a local faith-based, non-profit re-entry program in Duval County between the years 2015 and 2019. Prisoners of Christ (POC) services both low and high-risk offenders through their employment assistance and residential housing programs. We conducted quantitative research on POC participants utilizing rearrest …

Exploring The Impact Of Interpersonal Trust On Health Outcomes In Rapidly Gentrifying Neighborhoods In Portland, Oregon, Julie Ha, Yves Labissiere

McNair Symposium

Social determinants have been recognized to be significant factors contributing to the overall health outcomes of individuals. However, there is limited research on how these factors have directly impacted the mental and physical wellness of people in neighborhoods who are experiencing rapid gentrification. The objective of this study is to determine whether the level of interpersonal trust present between individuals in neighborhoods is associated with the mental and physical health outcomes among its residents. This quantitative study uses the Albina-Rockwood Neighborhood Promise Survey, which uses data from a random sample of families living in two rapidly gentrified neighborhoods in Portland, …

Changes In Jail Admissions Before And After Traumatic Brain Injury, Joseph A. Schwartz, Emily M. Wright, Ryan E. Spohn, Michael Campagna, Benjamin Steiner, Ebonie Epinger

Criminology and Criminal Justice Faculty Publications

Objectives

Traumatic brain injury (TBI) is differentially concentrated within incarcerated populations. Despite the consistency of this observation, the timing of within-individual changes in criminal justice contact in relation to TBI remains under-investigated. For example, previous studies have primarily considered TBI as a causal influence of later criminal justice contact. However, TBI may also serve as a consequence of criminal justice contact or a criminogenic lifestyle. The current study simultaneously observes both possibilities by examining criminal justice contact before, around the time of, and after the first reported TBI.

Methods

Drawing from a combination of self-report and lifetime official record data …

Analysis Of The Effects Of Spatiotemporal Demand Data Aggregation Methods On Distance And Volume Errors, Zachary Hornberger, Bruce A. Cox, Raymond R. Hill

Faculty Publications

Purpose — Large/stochastic spatiotemporal demand data sets can prove intractable for location optimization problems, motivating the need for aggregation. However, demand aggregation induces errors. Significant theoretical research has been performed related to the modifiable areal unit problem and the zone definition problem. Minimal research has been accomplished related to the specific issues inherent to spatiotemporal demand data, such as search and rescue (SAR) data. This study provides a quantitative comparison of various aggregation methodologies and their relation to distance and volume based aggregation errors. Design/methodology/approach — This paper introduces and applies a framework for comparing both deterministic and stochastic aggregation …
