Providing Hope After Trauma: Educating In A Juvenile Residential Center, Joanna C. Weaver, Cynthia D. Bertelsen, Mallie Grim, Adrienne Sarbaugh, Timothy Murnen, Meggan Hartzog

School of Teaching and Learning Faculty Publications

The field of integrated language arts is an ideal forum for sharing stories, discussing perspectives, expressing emotions in a healthy way, and challenging the systems that govern and shape our lives. Accomplishing this goal in a traditional classroom can sometimes be difficult, but for a moment, consider the physical space of a classroom within a juvenile residential center (JRC). This space brings many obstacles that traditional classrooms, teachers, and students do not have to address. To thrive, students need to be in a safe environment of trust. Trust is both critical and challenging to build in a space with so …

Defining Forced Labor: The Legal Battle To Protect Detained Immigrants From Private Exploitation, Samantha Sherman Sep 2021

Defining Forced Labor: The Legal Battle To Protect Detained Immigrants From Private Exploitation, Samantha Sherman

University of Chicago Law Review

Privately run immigration detention facilities allegedly profit from a nation-wide system of forced labor. People detained in these for-profit facilities allege that they are compelled to work—often without pay—under threats of solitary confinement, deprivation of basic necessities, and other serious harms. Advocates have challenged these human rights abuses through a series of class action lawsuits under the Trafficking Victims Protection Act (TVPA). The TVPA’s forced labor provision, codified at 18 U.S.C. § 1589, prohibits the use of “labor or services” obtained by force or coercion. If successful, these lawsuits would not only help vindicate the rights of the hundreds of …

There are faculty and staff members, some who were working at Cardozo at the time, and some who were employed elsewhere. These contributions have been very lightly edited for length and clarity and broken up to provide …

Death Penalty Keynote: Why Mitigation Matters, Now And For The Future, Stetler, Russell Sep 2021

Death Penalty Keynote: Why Mitigation Matters, Now And For The Future, Stetler, Russell

Santa Clara Law Review

This Article examines the current state of the death penalty in California and nationally through the lens of mitigation—the empathy-evoking evidence that has been a constitutional requirement to ensure individualized sentencing in the era of the modern American death penalty. It situates the discussion in the context of the extraordinary events of 2020: the Covid-19 pandemic, the heightened awareness of racial inequities reflected in the Black Lives Matter movement, and the federal execution spree in the final six months of the Trump administration. The Article began as the keynote address at California’s annual Capital Case Defense Seminar on February 13, …

Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield Sep 2021

Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield

Connecticut Law Review

This Essay presents the concept of “existential crime.” It argues that our notion of crime has conflated acts that challenge the racial premise on which a state is founded with acts that breach what Karim Murji (2009) calls “norms of propriety.”1 It argues that the conflation of these different types of social acts into our conceptualization of crime is a problem because this unnecessary and deliberate synthesis (1) privileges Western liberal philosophies that presume justice for everyone is achievable in states that were originally built on criteria for racial inclusion/exclusion, e.g., racial domination of one group over others; and (2) …

Variations In Victim Presence In Restorative Youth Conferencing Programs: The Use Of Surrogate Victims Increases Reparation Completion, Anne Hobbs, Ana Cienfuegos-Silvera, Lindsey E. Wylie Sep 2021

Variations In Victim Presence In Restorative Youth Conferencing Programs: The Use Of Surrogate Victims Increases Reparation Completion, Anne Hobbs, Ana Cienfuegos-Silvera, Lindsey E. Wylie

Criminology and Criminal Justice Faculty Publications

Victim-offender conferencing programs have expanded the type of victims involved in restorative rituals. However, little research has examined how variations in victim presence might impact these interventions. The aim of this study was to examine whether conferences involving actual victims resulted in higher reparation completion and how surrogate characteristics might impact reparation outcomes. Using regression modeling, we estimated how the variables of interest predicted reparation completion. Conferences with surrogates had a higher probability of completion than those with actual victims. Using surrogates may be a promising strategy to expand restorative justice practices when actual victim participation is not possible.

An Assessment Of Undergraduate Students’ Research Literacy, Milushka M. Elbulok-Charcape Sep 2021

An Assessment Of Undergraduate Students’ Research Literacy, Milushka M. Elbulok-Charcape

Dissertations, Theses, and Capstone Projects

Research literacy refers to the knowledge and application of statistics and research methods knowledge. Research literacy is important because it enables individuals to become autonomous lifelong learners and informed research consumers. Compared to other types of literacies (e.g., informational, statistical, scientific, etc.), research literacy in the social sciences has received limited attention in psychological theory and research. As a result, assessments of research literacy have notable limitations. Some assessments place undue emphasis on content knowledge of statistics and research methods neglecting the application of knowledge, others present items in a de-contextualized manner, exploring conceptions or attitudes toward research itself rather …

From An Art To A Science: Features And Methodology In Computational Authorship Identification, Jonathan I. Manczur Sep 2021

From An Art To A Science: Features And Methodology In Computational Authorship Identification, Jonathan I. Manczur

Dissertations, Theses, and Capstone Projects

Nearly thirty years ago, the United States Supreme Court revaluated the criteria for accepting forensic science and expert testimony, challenging Forensic Linguistics to assert itself as a reputable science. Much work has been produced in the interim to that end, but much still needs to be accomplished to satisfy the judicial standards. Computational linguistics has the potential to provide that necessary analytical framework. This paper’s intent is two-fold. First, there are two competing theories on the proper features necessary to identify an unknown author. Four features were drawn from the syntactic computational linguistics tradition and four from computational stylometry to …

Ending Injustice: Solving The Initial Appearance Crisis, Pamela R. Metzger, Janet C. Hoeffel, Kristin Meeks, Sandra Sidi Sep 2021

Ending Injustice: Solving The Initial Appearance Crisis, Pamela R. Metzger, Janet C. Hoeffel, Kristin Meeks, Sandra Sidi

Deason Center Reports

Most Americans expect that if they are arrested, they will quickly appear before a judge, learn about the charges, and have an attorney assigned to defend them. The reality is vastly different. After arrest, a person can wait in jail for days, weeks, or even months before seeing a judge or meeting an attorney. This report chronicles the resulting initial appearance crisis and highlights its devastating consequences. More importantly, it provides policymakers and advocates with actionable recommendations.

How To Be A Better Plea Bargainer, Cynthia Alkon, Andrea Kupfer Schneider Sep 2021

How To Be A Better Plea Bargainer, Cynthia Alkon, Andrea Kupfer Schneider

Faculty Scholarship

Preparation matters in negotiation. While plea bargaining is a criminal lawyer’s primary activity, the value of this skill is discounted by law schools and training programs. A systemic model can be used to improve plea bargaining skills. This Article offers a prep sheet for both prosecutors and defense attorneys and explains how each element of the sheet specifically applies to the plea bargaining context. The prep sheet is designed as a learning tool so that the negotiator can learn from the sheet and then make their own. The sheet highlights important considerations such as understanding the interests and goals of …

R. C. Bissonnette And The (Un)Constitutionality Of Consecutive Periods Of Parole Ineligibility For A Life Sentence: Why The Qcca Got It Right And Why Section 745.51 Should Never Be Re-Written, Adelina Iftene Sep 2021

R. C. Bissonnette And The (Un)Constitutionality Of Consecutive Periods Of Parole Ineligibility For A Life Sentence: Why The Qcca Got It Right And Why Section 745.51 Should Never Be Re-Written, Adelina Iftene

Articles, Book Chapters, & Popular Press

This article reviews the constitutional arguments upheld by the QCCA in Bissonnette and weighs them against the challenges that trial judges have encountered in applying s. 745.51 since 2012. By drawing on a qualitative review of cases in which s. 745.51 has been applied, as well as Charter principles, sentencing case law, and international practices, this article posits that the QCCA was correct in its approach to s. 745.51, both in finding it unconstitutional and in finding that the provision should not be read down to render it constitutional. This article advances the central argument that, in the context of …

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett Sep 2021

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett

Cardozo Law Review

Prosecutorial discretion in immigration enforcement stands at a crossroads. It was the centerpiece of Obama’s immigration policy after efforts to pass comprehensive immigration reform failed. Under the Trump administration, it was declared all but dead, replaced by an ethos of maximum enforcement. Biden has promised a return to the status quo ante, but the record of using prosecutorial discretion to accomplish humanitarian goals in immigration enforcement under Obama was, at best, mixed. Moreover, it is unclear whether Biden can depend on the availability of programs such as Deferred Action for Childhood Arrivals (DACA), Obama’s signature prosecutorial discretion program. Although the …
