A Method Of Measuring The Value Of Minor League Sports To A Community: An Illustration Of The Application Of Economic Impact Ananlyses, Dennis H. Tootelian, Audrey G. Mikhailitchenko

Global Sport Business Journal

The American public, as well as those in other countries, has long been fascinated with athletes, sports teams, and sports events. As a result, one of the dilemmas confronting city managers in their efforts to serve their residents is whether to seek to add or retain a professional sports team to their city’s leisure/entertainment mix. In addition to assessing resident interest in spectator sports as a leisure-time activity, one of the more critical questions they must address in their decision-making processes is: How much economic value is there in having a professional sports team in the city? Economic value is …

Evaluating The Moral Framing Of Disaffiliation: Sociological And Pastoral Perspectives On The Rise Of The “Nones”, Brett C. Hoover Jan 2021

Evaluating The Moral Framing Of Disaffiliation: Sociological And Pastoral Perspectives On The Rise Of The “Nones”, Brett C. Hoover

Theological Studies Faculty Works

The wave of religious disaffiliation that began in the 1990s in the United States has gone from a concern of pastoral leaders to perhaps the concern of pastoral leaders. This article examines a moral framing of religious disaffiliation—where disaffiliation is seen as a symptom of larger moral struggles in society. After a review of contemporary sociological research on the phenomenon of disaffiliation, its roots and causes, the article explores the thinking of the influential Catholic bishop and media entrepreneur Robert Barron as an example of the moral framing of religious disaffiliation. Barron operates as a “moral entrepreneur” in today’s media-rich …

Arbitration In The Age Of Covid: Examining Arbitration's Move Online, Amy J. Schmitz Jan 2021

Arbitration In The Age Of Covid: Examining Arbitration's Move Online, Amy J. Schmitz

Faculty Publications

Arbitration has been moving online over time with the growth of the Internet and Online Dispute Resolution ("ODR"), which includes use of technology to assist online negotiation, mediation, arbitration, and variations thereof Online Arbitration ("OArb ") is nonetheless a unique subset of ODR because it usually culminates in a final and binding award by a neutral third party that is enforceable under the Federal Arbitration Act ("FAA"). Indeed, I have written about OArb on prior occasions, due to its unique status under the FAA and other arbitration laws. However, OArb was relatively limited until the COVID-19 pandemic sparked the acceleration …

The Role Of Visa Status And Acculturation In The Health Of Us Immigrants, Serra Sevde Hatipoglu Jan 2021

The Role Of Visa Status And Acculturation In The Health Of Us Immigrants, Serra Sevde Hatipoglu

All ETDs from UAB

Using data from the 2003 New Immigrant Survey, I examined the association between visa status and acculturation with physical, mental, and self-rated health among immigrants residing in the United States. The primary predictor variable in the study is immigrant visa status. The outcome variables of interest include physical health as any morbidity (chronic diseases), mental health as depressed (as defined by the DSM-IV) and self-rated health (poor self-rated health). Using logistic regressions, I found those with unfavorable visa statuses have worse mental, physical, self-rated health compared to the favorable visa holders. I used inverse odds ratio weighted (IORW) mediation method …

Introduction: Situating, Researching, And Writing Comparative Legal History, John G. H. Hudson, William Eves

Other Publications

This volume is a selection of essays taken from the excellent range of papers presented at the British Legal History Conference hosted by the Institute for Legal and Constitutional Research at the University of St Andrews, 10–13 July 2019. The theme of the conference gives this book its title: ‘comparative legal history’. The topic came easily to the organisers because of their association with the St Andrews-based European Research Council Advanced grant project ‘Civil law, common law, customary law: consonance, divergence and transformation in Western Europe from the late eleventh to the thirteenth centuries’. But the chosen topic was also …

International Legal Argumentation: Practice In Need Of A Theory, Ian Johnstone, Steven R. Ratner Jan 2021

International Legal Argumentation: Practice In Need Of A Theory, Ian Johnstone, Steven R. Ratner

Other Publications

In a decentralized global system that lacks the formal trappings of domestic governance systems, most disputes between and among states and non-state actors never reach either a domestic or an international courtroom for authoritative resolution. This state of affairs continues, even with the creation of new international tribunals in recent decades. Despite, indeed because of, the relative scarcity of judicial settlement of disputes, international legal argumentation remains pervasive, but notably in a range of nonjudicial settings. States, corporations, nongovernmental organizations (NGOs), and even guerrilla groups make claims in international legal terms in political bodies like the United Nations’ organs or …

Awakening The American Jury: Did The Killing Of George Floyd Alter Juror Deliberations Forever?, Tamara F. Lawson Jan 2021

Awakening The American Jury: Did The Killing Of George Floyd Alter Juror Deliberations Forever?, Tamara F. Lawson

Articles

In the summer of 2020, the witnessing of George Floyd's death triggered an outpouring of public expression far beyond other cases in modern times. While the experience led some to advocate for reform and participate in antiracism rallies, marches, and campaigns, it also forced many others into internal reflection, awareness, and awakening to the knowledge of a lived experience with police different from their own. The gruesome realities of the video were irreconcilable with those prior beliefs and did not comport with any moral or legal standards of dignity. Prior to witnessing George Floyd's death on video at the hands …

Democratization As A Peacekeeping Strategy: A Comparative Analysis Of The United States And The European Union, Gabrielle Orphali

Honors Undergraduate Theses

The purpose of this study is to determine whether democratization should be utilized as a method of peacekeeping. This is determined by studying both the United States and the European Union's efforts to spread democracy globally. The historic framework is studied to understand the unique perspective each body has formed in defining democracy, and the method through which it should be spread. The definition of power, democracy, and the state are studied. The concepts are applied to the case studies of Iraq and Turkey in order to make a determination.

Analyzing The Use Of A Montessori-Based Activity & Its Effect On Engagement & Affect In Persons With Dementia: A Replication Study, Emilee J. Andersen

All Graduate Theses, Dissertations, and Other Capstone Projects

Activities are an essential element in institutionalized settings for persons with dementia. Challenges are faced, however, when developing and implementing stimulating and meaningful activities for this population. Over the past two decades, Montessori-based activities (MBAs) have been investigated as a means for meeting the needs of persons with dementia residing in long-term care facilities. MBAs were developed to enhance the quality of life for individuals experiencing dementia through maximization of engaging and meaningful activities. The purpose of the current study was to expand on the empirical literature related to the use of MBAs for persons with dementia by replication of …

Smart Ageing And Renewal Through Entrepreneurial Skills Training, Sarah Davis Jan 2021

Smart Ageing And Renewal Through Entrepreneurial Skills Training, Sarah Davis

Theses

Globally, while the population is ageing, only 3% of older (≥65 years) adults are engaged in entrepreneurship. The Healthy Ageing agenda is responding to the population trends by increasing its focus on elements of active or productive ageing (incorporating older working) with quality of life as a primary outcome. Alignment and exploitation of the synergies between healthy ageing and older entrepreneurial engagement are lacking. Entrepreneurship education is broadening its focus and targeting inclusivity, albeit with as yet little focus on the older population. Older entrepreneurship, while tentatively linked with increased quality of life, has yet to receive direct attention in …

The Effect Of Proximal Carceral Contact On Political Participation, Emily Loomis Jan 2021

The Effect Of Proximal Carceral Contact On Political Participation, Emily Loomis

Honors Program Theses

In light of the events of the summer of 2020 with the murder of George Floyd, Ahmaud Arbery, and Breanna Taylor, the United States has seen nationwide protests. The purpose of this research is to further examine the relationship between the criminal justice system and the individuals who come into indirect contact with it. The carceral state, or criminal justice system, has expanded rapidly in the last fifty years. An institution of its size and influence has far-reaching consequences, including on those who do not directly come into contact with it. This can affect how everyday citizens interact with the …

The Case For Decriminalisation Of Abortion, Jonathan Herring Jan 2021

The Case For Decriminalisation Of Abortion, Jonathan Herring

National Law School of India Review

This article makes the case for decriminalising abortion. It argues that abortion should be treated in the same way as other medical treatments, and only be a criminal offence if undertaken without the consent of the patient, or in a grossly inappropriate way. The article summarises the standard arguments made for decriminalising abortion: that the criminalisation restricts access to safe abortion and undermines women’s autonomy rights. The article also offers some further arguments in favour of decriminalisation from an ethic of care perspective. These are that abortion is a public good, in promoting caring relationships; that abortion protects rights of …
