Nevada Supreme Court Summaries
District courts must apply the catalyst theory to determine whether a party prevails in litigation related to public records. A district court abuses its discretion when it fails to consider all five factors under Las Vegas Metropolitan Police Department v. Center for Investigative Reporting, Inc., 136 Nev. 122, 460 P.3d 952 (2020) (“CIR” factors). Courts must make proper findings for each of the five factors and balance the factors to determine whether a party prevailed.

BACKGROUND: Achondroplasia is the most common genetic skeletal disorder causing disproportionate short stature/dwarfism. Common additional features include spinal stenosis, midface retrusion, macrocephaly and a generalized spondylometaphyseal dysplasia which manifest as spinal cord compression, sleep disordered breathing, delayed motor skill acquisition and genu varus with musculoskeletal pain. To better understand the interactions and health outcomes of these potential complications, we embarked on a multi-center, natural history study entitled CLARITY (achondroplasia natural history study). One of the CLARITY objectives was to develop growth curves (length/height, weight, head circumference, weight-for-height) and corresponding reference tables of mean and standard deviations at 1 month increments …

Sentiment Analysis is a process of extracting information from a large amount of data and classifying them into different classes called sentiments. Python is a simple yet powerful, high-level, interpreted, and dynamic programming language, which is well known for its functionality of processing natural language data by using NLTK (Natural Language Toolkit). NLTK is a library of python, which provides a base for building programs and classification of data. NLTK also provides a graphical demonstration for representing various results or trends and it also provides sample data to train and test various classifiers respectively. Sentiment classification aims to automatically predict …
Introduction: Racism Without Racists, Robert A. Schapiro
Introduction: Racism Without Racists, Robert A. Schapiro
San Diego Law Review
This Symposium on Systemic Racism offers a timely review and analysis of an urgent and persistent problem plaguing the United States. Many of the narratives we offer about the history and trajectory of law and society emphasize progress with respect to racism and the struggle for equality. We note the milestones of racial progress: the Thirteenth Amendment’s abolition of slavery in 1865; the 1868 adoption of the Fourteenth Amendment with its command of “equal protection”; the Supreme Court’s 1954 decision in Brown v. Board of Education declaring state-sponsored racial segregation unconstitutional; the enactment of the Civil Rights Act of 1964, …

Systemic Racism: Patterns Of Black Disadvantage And White Advantage Linked To Slavery, Roy L. Brooks
San Diego Law Review
In this Article, I engage systemic racism in two ways. First, I discuss some of its current manifestations, Part II. In particular, I will offer powerful examples of systemic racism, Section A, and explain the link between slavery and extant systemic racism, Section B. Next, I analyze the forces in this country that sustain systemic racism well into the post-civil rights period, Part III. I will spend a fair amount of time examining socio-psychological paradigms and institutional practices or policies that perpetuate or contribute to manifestations of systemic racism. The former consists of various forms of racial bias, Section A, …

This Is The House That Law Built: A Systems Story Of Racism, Palma Joy Strand
San Diego Law Review
In this essay, I explore the system-ness of racism. A systems understanding of racism enables us to more fully comprehend the magnitude and depth of racism, its reach and rootedness. This systems understanding provides the foundation for some initial and overarching observations about law and systemic racism.
Think Nationally, Act Locally: Cities And The Struggle For Social Justice, Harold Mcdougall
Think Nationally, Act Locally: Cities And The Struggle For Social Justice, Harold Mcdougall
San Diego Law Review
Liberals and progressives typically look to the national government to make policy aimed at achieving social justice. Historically, that is not without reason. As Professor Kathleen Morris of Golden Gate University School of Law put it in a recent email exchange, "social elites reached for the federal level in large part because the states and localities proved themselves to be genuinely terrifying to marginalized folks between 1860 and 1980.”
Few things remain constant in the struggle for social justice, however. The liberal and progressive national focus backfired as conservative and right-wing forces built power in state legislatures, enabling them to …
The Death Row Phenomenon: A Prohibition Against Torture, Cruel, Inhuman And Degrading Treatment Or Punishment, Nkem Adeleye
The Death Row Phenomenon: A Prohibition Against Torture, Cruel, Inhuman And Degrading Treatment Or Punishment, Nkem Adeleye
San Diego Law Review
Several debates on the legitimacy, constitutionality, and acceptability of the death penalty have arisen throughout the years. The death row phenomenon refers to the psychological effects on prisoners of being on death row for a prolonged period while awaiting an imminent execution under harsh conditions of confinement. Having been declared a violation of a customary norm of international law by several international tribunals and national courts, this Article explores the possibility of the death row phenomenon, as a legal concept, becoming widely accepted and ultimately preventing the execution of another category of offenders. The existence of a lack of judicial …

Eradicating Race-Based Health Disparities By Effectuating The Fair Housing Act's De-Segregation Intent, Parisa Ijadi-Maghsoodi
San Diego Law Review
This Article illustrates how Congress did not adopt this anti-segregation legislation in a vacuum. Rather, as the Supreme Court recently acknowledged, the FHA was a response to racial segregation. Congress enacted the legislation days after Dr. Martin Luther King Jr.’s assassination and on the heels of the Kerner Commission’s report, which identified segregation as the cause of unprecedented nationwide civil unrest.
Part II of this Article demonstrates how housing is a major determinant of health, identifies the extent to which our nation is segregated, and illustrates how segregation exacerbates health inequities among racial and ethnic lines. Part III presents the …
Race-Based Discrimination In The Totality Of The Circumstances: Why America's Highest Court Should Permit Section 2 Voting Rights Act Challenges To State Felon Disenfranchisement Laws, Ellen Atkinson
San Diego Law Review
Betty McKay served twenty-seven years in prison. During her past three years on parole, she became a motivational speaker, justice advocate, and organizer. Similarly, John Windham served thirty years in prison. Since his release from prison to parole in 2018, he became a motivational speaker and consultant, and works with nonprofits providing reentry services to others formerly incarcerated. But that is not all Ms. McKay and Mr. Windham have in common: Neither has ever been able to vote. They are among the 50,000 parolees in the State of California that, despite having served their prison sentences, have been barred from …
Amici Curiae Observations On Sexual- And Gender-Based Crimes, Particularly Sexual Slavery, And On Cumulative Convictions Pursuant To Rule 103 Of The Rules Of Procedure And Evidence, Jocelyn Getgen Kestenbaum
Amici Curiae Observations On Sexual- And Gender-Based Crimes, Particularly Sexual Slavery, And On Cumulative Convictions Pursuant To Rule 103 Of The Rules Of Procedure And Evidence, Jocelyn Getgen Kestenbaum
Amicus Briefs
Sexual slavery is not a “form” of enslavement; rather, all acts of a sexual nature, including control over sexuality, sexual integrity and sexual and reproductive autonomy, constitute indicia of the exercise of powers of ownership of enslavement in all its forms. Consequently, enslavement as a crime against humanity is not “in the abstract entirely encompassed within sexual slavery.” To avoid entering cumulative convictions for separately enumerated crimes that do not each have a distinct element from the other, and to avoid a continuation of a discriminatory application of the law, amici suggest that, in the interests of justice, the …

In this article, we describe the case of “Keri,” a fifth-grade teacher who had completed an Elementary Mathematics Specialist (EMS) certification program. Drawn from a larger study investigating the knowledge, beliefs, and practices of EMSs, Keri's case was unique in that she was teaching mathematics to four classes in a departmentalized structure, where students were placed into different classes according to perceived mathematics ability. Observations from the larger study revealed that Keri's instructional practices did not align with her reported beliefs and knowledge. To explore this deviation, we conducted a case study where we observed Keri's instruction across multiple classes …

See You In The Funny Pages: Forms And Aesthetics Of Newspaper Comic Strips In Bill Watterson's Calvin And Hobbes, Jack Mallard
See You In The Funny Pages: Forms And Aesthetics Of Newspaper Comic Strips In Bill Watterson's Calvin And Hobbes, Jack Mallard
LSU Doctoral Dissertations
This project looks at how Bill Watterson’s aesthetics and his employment of the comics apparatus, as well as his advocacy for learning the history of the formal development (and decline) of the newspaper comic strip, influence Calvin and Hobbes’ approach to art, family, education, and other cultural topics. By adapting Thierry Groensteen’s theory of spatio-topia, a term describing comics’ ability to provoke meaning from how graphic, verbal, and structural elements inhabit space and relate to one another within space, I demonstrate how Bill Watterson’s quality as a comics artist comes as much from his ability to activate spatio-topic potentials …

Explaining Deep Learning Models For Tabular Data Using Layer-Wise Relevance Propagation, Ihsan Ullah, Andre Rios, Vaibhov Gala, Susan Mckeever
Articles
Trust and credibility in machine learning models are bolstered by the ability of a model to explain its decisions. While explainability of deep learning models is a well-known challenge, a further challenge is clarity of the explanation itself for relevant stakeholders of the model. Layer-wise Relevance Propagation (LRP), an established explainability technique developed for deep models in computer vision, provides intuitive human-readable heat maps of input images. We present the novel application of LRP with tabular datasets containing mixed data (categorical and numerical) using a deep neural network (1D-CNN), for Credit Card Fraud detection and Telecom Customer Churn prediction use …

The Effect Of Foreign Direct Investment On Colombia’S Economic Growth And The Role Of Human Capital: Does Foreign Direct Investment Foster Growth?, Jean K. Plantin
Master's Theses
Abstract: Since the pioneering work of John H. Dunning on the role of foreign direct investment (FDI) in the economic growth of the United Kingdom, many experts have debated the growth effect of FDI in an economy. This study investigated the impact of FDI on Colombia’s economic growth from 1990 to 2019. Moreover, it explored whether the Colombian economy has benefited from positive spillover from FDIs. Additionally, the paper examined how the stock level of human capital conditioned the effect of FDI on GDP per capita growth. To this end, the analysis separated tertiary enrollments from the human capital …

This paper presents the results of a search for generic short-duration gravitational-wave transients in data from the third observing run of Advanced LIGO and Advanced Virgo. Transients with durations of milliseconds to a few seconds in the 24–4096 Hz frequency band are targeted by the search, with no assumptions made regarding the incoming signal direction, polarization, or morphology. Gravitational waves from compact binary coalescences that have been identified by other targeted analyses are detected, but no statistically significant evidence for other gravitational wave bursts is found. Sensitivities to a variety of signals are presented. These include updated upper limits on …

Levels Of Angiotensin-Converting Enzyme And Apolipoproteins Are Associated With Alzheimer’S Disease And Cardiovascular Diseases, Chun Xu, Debra Garcia, Yongke Lu, Kaysie Ozuna, Donald A. Adjeroh, Kesheng Wang
Health & Biomedical Sciences Faculty Publications
Angiotensin-converting enzyme-1 (ACE1) and apolipoproteins (APOs) may play important roles in the development of Alzheimer’s disease (AD) and cardiovascular diseases (CVDs). This study aimed to examine the associations of AD, CVD, and endocrine-metabolic diseases (EMDs) with the levels of ACE1 and 9 APO proteins (ApoAI, ApoAII, ApoAIV, ApoB, ApoCI, ApoCIII, ApoD, ApoE, and ApoH). Non-Hispanic white individuals including 109 patients with AD, 356 mild cognitive impairment (MCI), 373 CVD, 198 EMD and controls were selected from the Alzheimer’s Disease Neuroimaging Initiative (ADNI) dataset. Multivariable general linear model (GLM) was used to examine the associations. ApoE ε4 allele was associated with …

Teleasinae are commonly collected scelionids that are the only known egg parasitoids of carabid beetles and therefore play a crucial role in shaping carabid populations in natural and agricultural ecosystems. We review the available host information of Teleasinae, report a new host record, and revise Gryonoides Dodd, 1920, a morphologically distinct teleasine genus. We review the generic concept of Gryonoides and provide diagnoses and descriptions of thirteen Gryonoides species and two varieties: G. glabriceps Dodd, 1920, G. pulchellus Dodd, 1920 (= G. doddi Ogloblin, 1967, syn. nov. and G. pulchricornis Ogloblin, 1967, syn. nov.), G. brasiliensis Masner & Mikó, sp. …

Department of Paediatrics and Child Health
Background: Wilson's disease (WD) is a rare inherited disorder that leads to copper accumulation in the liver, brain, and other organs. WD is prevalent worldwide, with an occurrence of 1 per 30,000 live births. Currently, there is no gold standard diagnostic test for WD. The objective of this systematic review is to determine the diagnostic accuracy for WD of three biochemical tests, namely hepatic copper, 24-hour urinary copper, and ceruloplasmin using the Leipzig criteria.
Methods: Adhering to PRISMA guidelines, databases including PubMed/MEDLINE, CINAHL Plus, Web of Science, and Cochrane were searched. Studies that comprised of confirmed or suspected WD along …
