Covid-19 And Comparative Corporate Governance, Martin Gelter, Julia M. Puaschunder Jan 2021

Covid-19 And Comparative Corporate Governance, Martin Gelter, Julia M. Puaschunder

Faculty Scholarship

With the pandemic caused by the novel coronavirus SARS-CoV-2 raging around the world, many countries’ economies are at a crucial juncture. The COVID-19 external shock to the economy has the potential to affect corporate governance profoundly. This Article explores its possible impact on comparative corporate governance. For an economy to operate successfully, a society must first find a politically sustainable social equilibrium. In many countries, historical crises—such as the Great Depression and World War II—have resulted in a reconfiguration of corporate governance institutions that set the course for generations. While it is not yet clear whether COVID-19 will have a …

The Racial Architecture Of Criminal Justice, I. Bennett Capers Jan 2021

The Racial Architecture Of Criminal Justice, I. Bennett Capers

Faculty Scholarship

One of the pleasures of contributing to symposia—especially symposia where each contribution is brief—is the ability to engage in new explorations, test new ideas, and offer new provocations. I do that now in this essay about race, architecture, and criminal justice. I begin by discussing how race is imbricated in the architecture of courthouses, the quintessential place of supposed justice. I then take race and architecture a step further. If we think of architecture expansively—Lawrence Lessig’s definition of architecture as “the physical world as we find it” comes to mind—then it becomes clear that race is also imbricated in the …

The International Governance Of Refugee Work: Reflections On The Jordan Compact, Jennifer Gordon Jan 2021

The International Governance Of Refugee Work: Reflections On The Jordan Compact, Jennifer Gordon

Faculty Scholarship

For the past seventy years, separate international regimes have governed the economic lives of refugees and labor migrants. The United Nations High Commissioner for Refugees (UNHCR) oversees all aspects of refugee resettlement, including livelihoods, while the International Labor Organization (ILO) is charged with addressing the labor rights of migrants. This division has become increasingly problematic as international actors have sought to move refugees into employment arenas from which they have been largely excluded since the end of WWII. This article uses a case study of the 2016 EU-Jordan Compact to illustrate the risks inherent in positioning refugees as workers in …

Mala Prohibita And Proportionality, Youngjae Lee Jan 2021

Mala Prohibita And Proportionality, Youngjae Lee

Faculty Scholarship

What is the proportionate punishment for conduct that is neither harmful nor wrongful? A likely response to that is that one ought not to be punished at all for such conduct. It is, however, common for the state to punish harmless conduct the wrongfulness of which is not always apparent. Take, for example, the requirement that those who give investment advice for compensation do so only after registering as an investment advisor. Advising a person on how to invest his or her funds and accepting a fee for the advice without registering with the government does not seem harmful or …

Menstrual Dignity And The Bar Exam, Marcy L. Karin, Margaret E. Johnson, Elizabeth B. Cooper Jan 2021

Menstrual Dignity And The Bar Exam, Marcy L. Karin, Margaret E. Johnson, Elizabeth B. Cooper

Faculty Scholarship

This Article examines the issue of menstruation and the administration of the bar exam. Although such problems are not new, over the summer and fall of 2020, test takers and commentators took to social media to critique state board of law examiners’ (“BOLE”) policies regarding menstruation. These problems persist. Menstruators worry that if they unexpectedly bleed during the exam, they may not have access to appropriately sized and constructed menstrual products or may be prohibited from accessing the bathroom. Personal products that are permitted often must be carried in a clear, plastic bag. Some express privacy concerns that the see-through …

Would Reasonable People Endorse A ‘Content-Neutral’ Law Of Contract?, Aditi Bagchi Jan 2021

Would Reasonable People Endorse A ‘Content-Neutral’ Law Of Contract?, Aditi Bagchi

Faculty Scholarship

This essay raises two challenges to Peter Benson’s compelling new account of contract law. First, I argue that Benson’s use of the concept of reasonableness goes beyond the Rawlsian account to require that we impute to others a capacity to transcend their contingent circumstances in the context of contractual choice. In fact, our choices in contract are driven by external contingencies and it is only reasonable to take those constrains on other people’s choices into account. Second, I contest Benson’s related claim that contract law should be, and largely is, content-neutral. I argue to the contrary that the justice of …

Metaphors Of International Law, Harlan G. Cohen Jan 2021

Metaphors Of International Law, Harlan G. Cohen

Faculty Scholarship

This chapter explores international law in search of its hidden and not-so-hidden metaphors. In so doing, it discovers a world inhabited by states, where rules are mined or picked when ripe, where trade keeps boats forever afloat on rising tides. But is also unveils a world in which voices are silenced, inequality is ignored, and hands are washed of responsibility.

International law is built on metaphors. Metaphors provide a language to describe and convey the law’s operation, help international lawyers identify legal subjects and categorize situations in doctrinal categories, and provide normative justifications for the law. Exploring their operation at …

“You Pulled The Chair From Right Under Me!”: How A Black Young Man Disappears From A High School Reading Class, Loukia K. Sarroub

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Relational identities in the classroom shape teachers and their students as well as the researchers who study them for the long term. Researchers whose fieldwork is located at “home” simultaneously embody with research participants the past, present, and future interactions on a shared continuum of experience. The collaborative enterprise of fieldwork is relived, retold, remade, and it is always present.

In this chapter, the shared, embodied experience that infused the ethnographic space in situ transformed one’s understanding of young people, their teacher, and the researcher. The study was focused on better understanding students’ experiences with literacy in high school. Within …

Hand Hygiene For Health Promotion, Phyllis Knight-Brown Jan 2021

Hand Hygiene For Health Promotion, Phyllis Knight-Brown

Doctor of Nursing Practice Projects

For many years public health organizations, such as The World Health Organization (WHO) and The Centers for Disease Control and Prevention (CDC), have stressed the need for proper hand hygiene. Proper hand hygiene requires a prescribed process to rid the hands of potentially infecting organisms by using soap and water (handwashing) or hand sanitizer (sanitizing). These processes need to be performed at critical times to promote infection prevention. Many studies have shown that hand hygiene is a learned behavior that becomes habitual over time, and behavior change mechanisms in addition to education are needed to affect a long-term change in …

Computer Science Faculty Publications

This paper presents EDSC, a novel smart contract platform design based on the event-driven execution model as opposed to the traditionally employed transaction-driven execution model. We reason that such a design is a better fit for many emerging smart contract applications and is better positioned to address the scalability and performance challenges plaguing the smart contract ecosystem. We propose EDSC’s design under the Ethereum framework, and the design can be easily adapted for other existing smart contract platforms. We have conducted implementation using Ethereum client and experiments where performance modeling results show on average 2.2 to 4.6 times reduced total …

Digging The Issues And Concerns In Subject Access Towards Discoverability Of Information And Resources, David A. Cabonero, Judy Ann P. Jandoc, Jeazel T. Cabalo, Wina B. Dominguez

Library Philosophy and Practice (e-journal)

There is an information explosion in this computer age due to the rapid developments of information and communications technology. As a result, research and studies are quickly published because of faster printing and open access publishing. With these, access to information and resources is somewhat compromised. Without access, these collections are meaningless to educators, researchers, scholars, and other information users. Thus, this study prompted to determine the: 1) level of familiarity in the fundamental principles of subject cataloging; 2) level of usage familiarity of: a) grammar and code of relationships, b) types of subject headings and subdivisions, and c) authority …
