2021-January-22-Public Safety Earns Tennessee Law Enforcement Accreditation, University Marketing And Communication, East Tennessee State University
ETSU News
JOHNSON CITY (Jan. 22, 2021) – The Tennessee Law Enforcement Accreditation (TLEA) Program has granted a third accreditation status to the Department of Public Safety at East Tennessee State University.
To achieve accreditation with TLEA, an agency voluntarily submits to a three-year process of enhancing its professionalism and effectiveness utilizing 160 law enforcement standards and participating in a thorough on-site assessment. The standards evaluate the agency’s policies, which address a variety of areas including organizational, operational and budget management practices. The program is intended to encourage cooperation, recognize professional standing, develop professional services and ensure public safety throughout the State …

Defensive Publications Series
Services that track wildfire spread and trajectory can provide such information and issue related alerts. The information obtained from current services is often stale and ineffective in helping people determine whether they are likely to be harmed by the fire. Moreover, such information is not in a form that lay persons can easily grasp, thus making it difficult for them to derive actionable insight from the received information. This disclosure describes techniques to leverage satellite imagery to automatically detect and outline the boundaries of large fires. The outlined boundaries are updated regularly and surfaced as appropriate within various pertinent applications …

The Right To Seek Asylum In Canada (During A Global Pandemic), Elise Mercier, Sean Rehaag
The Right To Seek Asylum In Canada (During A Global Pandemic), Elise Mercier, Sean Rehaag
Osgoode Hall Law Journal
This article analyzes the effect that the Canadian Government’s use of emergency powers during the COVID-19 global pandemic has had on the right to seek asylum in Canada. The article suggests that that the federal government has taken advantage of a public health crisis to make a contentious political problem—the entry of asylum seekers between land ports of entry (such as at Roxham Road)—go away. It details how the Quarantine Act and various Orders in Council have been used to temporarily extend the Safe Third Country Agreement between Canada and the United States (STCA) across the entire length of the …

Covid-19, The Shadow Pandemic, And Access To Justice For Survivors Of Domestic Violence, Jennifer Koshan, Janet Mosher, Wanda Wiegers
Osgoode Hall Law Journal
The COVID-19 pandemic has co-existed alongside a far less visible “shadow pandemic” of violence against women, with COVID-19 impacting the number and complexity of domestic violence cases and enabling new tactics for coercive control. This article provides a preliminary assessment of the extent to which Canada’s responses to the COVID-19 pandemic have prioritized the safety of women and children, with a focus on the courts and women’s access to justice. We examine court directives and judicial decisions triaging which cases would be heard as “urgent,” as well as courts’ decisions on the merits in cases involving domestic violence and COVID-19, …
Trial Delay Caused By Discrete Systemwide Events: The Post-Jordan Era Meets The Age Of Covid-19, Palma Paciocco
Trial Delay Caused By Discrete Systemwide Events: The Post-Jordan Era Meets The Age Of Covid-19, Palma Paciocco
Osgoode Hall Law Journal
Court closures necessitated by COVID-19 have resulted in extensive trial delay, with implications for the section 11(b) Charter right to be tried within a reasonable time. Although COVID-19 appears to be a straightforward example of an “exceptional circumstance” under the Jordan framework that governs section 11(b), careful analysis reveals that it falls within a category not contemplated by that framework—what this article calls “discrete systemwide events.” Because COVID delay impacts cases across the system, the reasonable steps that can be taken to reduce it are themselves largely systemic in nature. Crucially, the exceptional circumstances analysis stipulated by Jordan focuses exclusively …

The Court System In A Time Of Crisis: Covid-19 And Issues In Court Administration, Richard Haigh, Bruce Preston
Osgoode Hall Law Journal
Canadian courts, in many ways, are neither efficient nor effective. This has been clear for many years. This article looks broadly at how little attention has been paid to court administration in the past, especially during times of crisis, and examines the impact the current pandemic may have on the future of Canadian court administration. In this vein, we examine emergency plans in general before turning to pandemic-specific plans and how, especially in Canada, these have been found wanting during this current crisis. Like most organizations, courts have developed plans – business contingency (BCPs) in Canada and continuity of operation …

What Does The Public Want Police To Do During Pandemics? A National Experiment, Justin Nix, Stefan Ivanov, Justin T. Pickett
What Does The Public Want Police To Do During Pandemics? A National Experiment, Justin Nix, Stefan Ivanov, Justin T. Pickett
Criminology and Criminal Justice Faculty Publications
We administered a survey experiment to a national sample of 1,068 US adults in April 2020 to determine the factors that shape support for various policing tactics in the midst of the COVID-19 pandemic. Respondents were sharply divided in their views about pandemic policing tactics, and were least supportive of policies that might limit public access to officers or reduce crime deterrence. Information about the health risks to officers, but not to inmates, significantly increased support for “precautionary” policing, but not for “social distance” policing. The information effect was modest, but may be larger if the information came from official …
