Infected Judgment: Problematic Rush To Conventional Wisdom And Insurance Coverage Denial In A Pandemic, Erik S. Knutsen, Jeffrey W. Stempel
Infected Judgment: Problematic Rush To Conventional Wisdom And Insurance Coverage Denial In A Pandemic, Erik S. Knutsen, Jeffrey W. Stempel
Scholarly Works
The COVID-19 pandemic created not only a public health crisis but also an insurance coverage imbroglio, prompting near-immediate business interruption claims by policyholders impacted by government restrictions ordered in response to the pandemic. Insurers and their representatives "presponded" to the looming coverage claims by quickly moving to denigrate arguments for coverage, engaging in a pre-emptive strike that has largely worked to date, inducing too many courts to rush to judgment by declaring-as a matter of law-that policy terms such as "direct physical loss or damage" do not even arguably encompass the business shutdowns resulting from COVID-19. Our closer examination of …

Being In Centro: The Anthropology Of Schelling's Human Freedom, Michael Vater
Being In Centro: The Anthropology Of Schelling's Human Freedom, Michael Vater
Philosophy Faculty Research and Publications
Schelling presents the 1809 freedom essay as the idealistic flowering of a vision of system he always held. He is not disingenuous but somewhat perplexing in claiming that the system always was complete in nuce, even though not expounded completely. Tilliette captured the ambiguity nicely in designating Schelling’s oeuvre «une philosophie en devenir». This mid-career essay must be read backwards to the earliest essays republished with it—especially to their views of willing, freedom, and moral responsibility—and simultaneously forward to the late philosophy’s analysis of God’s freedom as freedom from being, even necessary being. I locate Freedom’s …
Does Nonattachment Predict Levels Of Experimentally Induced Social Stress And Cognitive Features Of Social Anxiety Disorder? Possible Implications For Future Treatment, Anna Gernand
All-Inclusive List of Electronic Theses and Dissertations
Social anxiety disorder (SAD) is characterized by a fear of negative evaluation that often results in behaviors such as avoidance intended to mitigate the risk of making a negative impression on others or making their social anxiety known (American Psychiatric Association, 2013). Engaging in self-focused attention is a covert manner in which individuals with SAD can protectively monitor their speech, behavior, and physical symptoms of anxiety (e.g., blushing) in an effort to compensate for their perceived susceptibility to negative evaluation (Clark & Wells, 1995). Self-focused attention in social anxiety has been widely studied and found to elevate rather than alleviate …
Evaluation Of Substance Abuse Measures In Identifying Drug Seeking Behavior, Dylan M. Songer
Evaluation Of Substance Abuse Measures In Identifying Drug Seeking Behavior, Dylan M. Songer
All-Inclusive List of Electronic Theses and Dissertations
The opioid crisis consuming the U.S. has resulted in approximately 115 daily deaths that may be partially due to prescribing practices of opioid-based medications. Screeners used to assess for opioid abuse are often dichotomous, face-valid, and allow individuals to easily hide their substance abuse. The current study examined if brief screeners can be used to detect opioid abuse that is intentionally hidden, and proposed that modifying dichotomous response sets to Likert-scales will increase variability in responses, resulting in better detection of hidden substance abuse. It was hypothesized that individuals instructed to malinger will have lower scores on the original and …
Examining Predictors Of Teachers Executive Functioning Knowledge, Intervention Self-Efficacy, And Belief In Neuromyths, Abbie Jones
All-Inclusive List of Electronic Theses and Dissertations
Executive functions (EF) are a set of developmentally progressing, conscious, and goal-directed behaviors that allow people to behave in controlled, logical, and socially desirable ways. Dysfunctions in the cognitive systems ruling EF are associated with diagnosable disorders including attention-deficit hyperactivity disorder (ADHD), autism spectrum disorder (ASD), and many mood and personality disorders. Throughout the lifespan, and especially early in development, EF responds well to evidence-based intervention with measurable and significant improvements in numerous academic and life outcomes. Schools are a logical setting where evidence-based EF intervention can be implemented for every child to improve the lifelong outcomes associated with well-developed …

On “Ur-Contempt” And The Maintenance Of Racial Injustice: A Response To Monahan's “Racism And ‘Self-Love’: The Case Of White Nationalism”, Grant J. Silva
Philosophy Faculty Research and Publications
This article offers a response to Michael J. Monahan’s engagement with and criticism of Grant Silva’s article “Racism as Self-Love.” So as to demonstrate how Monahan’s idea of “ur-contempt” fits alongside the author’s project and supplements his attempt to challenge the variety of forms of moral obfuscation employed by white nationalists and other racists today, this response begins with an overview of the central critique of moral responsibility for racism that Silva’s work offers. At stake is the attempt, by unabashed white supremacist and others, to bank on historical acts of racial oppression and reap the benefits of elevated social …

Business Faculty Publications and Presentations
COVID-19 has had a substantial impact on transit workers’ lives, especially among public-facing vehicle operators. The current project examined relationships between workers’ knowledge and perceptions of their employer’s COVID-19 safety responses, job attitudes, and health. We surveyed transit workers (N = 174) between July and August 2020 and followed up 3 months later. Fifty-seven workers responded to the follow-up survey. Surveys addressed workers’ knowledge and perceptions of their employer implementing Centers for Disease Control and Prevention (CDC)-recommended COVID-19 safety responses, COVID-19 risk perceptions, job attitudes, and health factors. Employees reported knowledge of their employer implementing ~8 of 12 CDC-recommended responses. …

Blacks In Oregon, Darrell Millner
Blacks In Oregon, Darrell Millner
Black Studies Faculty Publications and Presentations
Periodically, newspaper or magazine articles appear proclaiming amazement at how white the population of Oregon and the City of Portland is compared to other parts of the country. It is not possible to argue with the figures—in 2017, there were an estimated 91,000 Blacks in Oregon, about 2 percent of the population—but it is a profound mistake to think that these stories and statistics tell the story of the state's racial past. In fact, issues of race and the status and circumstances of Black life in Oregon are central to understanding the history of the state, and perhaps its future …

Journal of Dental Sciences
Abstract Background/ purpose Older patients inevitably have a higher need for implant treatment, it is unknown how mental changes or psychological aspects affect the outcome of implant treatment. This study evaluated the success rate of implants and the influence of personality traits in the older people. The goal was to provide evidence for predictable implant treatment while taking into account the unique psychological changes of elders. Materials and methods Participants were patients who were able to independently visit our hospital between March 2004 and May 2021. Inclusion criteria were patients aged 65 years or older at the time of implant …

Big Data: Potential As An Ocular Epidemiology And Public Health Tool, Michael Moore
Doctoral
Refractive error is a significant cause of vision impairment both through the limited access to correction in some areas and the associated ocular diseases for which refractive errors are risk factors. Having timely, regular access to population level estimates of refractive error and vision impairment is necessary to adequately plan public health resources and resource appropriate interventions. A lack of access to current and regularly updated refractive error and vision impairment prevalence data has been identified as a significant limitation in predicting future population trends with many countries lacking any prevalence data or available data being outdated. This project addresses …

Above And Beyond: Ethics And Responsibility In Civil Engineering, Shannon Chance, Rob Lawlor, Inês Direito Direito, John Mitchell
Articles
This exploratory study investigates how nine London-based civil engineers have enacted ‘global responsibility’ and how their efforts involve ethics and professionalism. The study assesses moral philosophies related to ethics, as well as professional engineering bodies’ visions, accreditation standards, and requirements for continuing professional development. Regarding ethics, the study questions where the line falls between what an engineer ‘must do’ and what ‘would be good to do’. Although the term ethics did not spring to mind when participants were asked about making decisions related to global responsibility, participants’ concern for protecting the environment and making life better for people did, nonetheless, …

A 2018 U.S. Department of Justice report assessing data from thirty states found that eighty-three percent of those individuals released from state prisons in 2005 were rearrested within nine years.** When a revolving door ushers five of six individuals back into custody and decimates communities, more effective approaches to criminal justice demand attention. In countries around the world, restorative justice has been emerging as a promising candidate. It generally involves an interactive process in which stakeholders identify and grapple with harms caused by the crime. But many environments lack the resources to invoke its benefits. While restorative justice takes various …

In this Article I rely on the public policy concept of "policy transfer" to examine the impact of U.S. legislation, litigation, and politics on the Israeli criminal justice landscape. The Article identifies four eras: 1. The Great Light from the West - the ascent of U.S. criminal justice as British influence fades; 2. The Decade of Rights - a misperception of America as a paragon of criminal justice rights and protections that results in influences on Israeli jurisprudence; 3. The Law-and-Order Enchantment Period - a time at which Israeli scholars and policymakers import punitive trends from the U.S., particularly in …

Covid-19 Vaccine Uptake Through The Lived Experiences Of Health Care Personnel: Policy And Legal Considerations, Rachel Gur-Arie, Zackary Berger, Dorit Rubinstein Reiss
Faculty Scholarship
Purpose: To investigate whether coronavirus disease 2019 (COVID-19) vaccination campaigns targeted at health care personnel (HCP) in the United States have addressed the lived experiences of HCP on the frontlines of the COVID-19 pandemic and to analyze policy and legal considerations for improving COVID-19 vaccine uptake among HCP. Methods: We conducted a literature and policy review to explore the lived experiences of different occupational groups of HCP on the frontlines of the COVID-19 pandemic—physicians, nurses, trainees, and nonclinical essential workers—in relation to ongoing COVID-19 vaccination campaigns. Finally, we discuss policy and legal considerations to improve the state of HCP COVID-19 …

Restorative Justice, School Reopenings And Educational Equity: A Contemporary Mapping And Analysis Of State Law, Thalia Gonzalez, Rebecca Epstein, Claire Krelitz, Rhea Shinde

The opportunity to use restorative justice practices to address structural inequalities and reimagine school structures has become increasingly important in the wake of twin social and public health pandemics. As research-based restorative practices continue to grow across the country with the aim of fostering supportive, safe, and anti-racist learning environments, calls to codify school-based restorative justice are spreading. Despite the prevalence of on-the-ground practices since the 1990s and a growing evidence base for school-based restorative practices, there is little understanding of the effect of the legalization of restorative justice on individual- or school-level outcomes. This study is the first analysis …

Race, School Policing, And Public Health, Thalia Gonzalez

The ever-growing list of names of Black victims who have died at the hands ofpolice has emboldened a new public narrative that frames police violence—and other more commonplace, though less lethal, disparate policing practices—as a public health crisis rooted in this country’s history of racism and anti-Blackness. This public narrative in turn has spawned a diverse set of responsive actions in both the public and private sectors directed at addressing the effects of individual and structural racism on health. Yet missing from this linkage between police violence and racialized health disparities is any focus on the educational system, despite the …

Prescription-Drug Policing: The Right To Health Information Privacy Pre-And Post-Carpenter, Jennifer D. Oliva
Faculty Scholarship
This Article operates at the intersection of privacy law, Fourth Amendment doctrine, and prescription-drug surveillance instigated by the U.S. drug-overdose crisis. Reputable reporting sources frequently frame that ongoing crisis as a prescription-drug-overdose “epidemic.” Current epidemiological data, however, indicate that the majority of American overdose deaths are now a result of illicit and polysubstance drug use and not prescription-opioid misuse. The prescription-opioid- centric frame has nonetheless sparked the rapid rise of surveillance of prescribers and patients in the form of state prescription-drug monitoring program (“PDMP”) databases. State PDMPs, which maintain and analyze significant data concerning every dispensed controlled substance, surreptitiously collect …

The Effect Of Quality Of Life On Cardiometabolic Risk Factors In Postmenopausal Women, Chavela Lynn Riotutar
Cal Poly Humboldt theses and projects
Background: The emergence of cardiometabolic (CMD) indicators for Metabolic Syndrome (MetS) coincides with the decline in estrogen production during menopause and substantially increases development of cardiovascular disease (CVD) in women. Quality of life (QOL) encompasses physical, material, and social well-being. Research reveals a correlation between low QOL scores and CMD disease. Menopause significantly increases CMD risk, and may also lower QOL scores. Objective: To investigate the relationship between QOL and CMD risk in postmenopausal women. Method: Cisgender, postmenopausal women (age > 45 years) were recruited through emails to complete the online survey. Data collection included demographics, physical characteristics and activity level, …

Parents And Children’S Perceptions Of Their Gross Motor Abilities And Physical Activity Levels, Hailee D. Schmidt
Cal Poly Humboldt theses and projects
As children move through adolescence their level of physical activity declines. Researchers have demonstrated that physically inactive children perform worse in school and are more likely to be inactive in the future while also increasing their risk for future health problems as adults. The purpose of this study was to determine if parent perceptions of their child's gross motor skill abilities were similar to their child’s enjoyment of performing (GMS). The primary author hypothesized that parents' perceptions would impact their child’s enjoyment to perform GMS and that parents who believed their child demonstrated high levels of gross motor competence would …

Objective Research has shown grit and mindset can be improved, but no known research has investigated the effect of learning a new skill on grit and growth mindset. While grit and mindset seem to predict success in education and success, it is also not clear if initial grit or mindset have an effect on motor skill acquisition. The purposes of this research are to investigate if grit and growth mindset are predictors of learning a new skill and if learning a new skill leads to improvement in grit and growth mindset. Methods 14 students enrolled in a motor learning course …

Contemplative pedagogy involves teaching methods designed to cultivate deepened awareness, concentration, and insight. Contemplative practices work to undo the Cartesian mind–body dualism that says that mental phenomena are non-physical, or that the mind and body are distinct and separable. This project focuses on an understanding that our internal world includes communication with one’s self, acts of imagination and visualization, and recall and memory. These internal experiences foster many things, such as compassion and kindness, as well as resilience and sustainability through connection.

This paper seeks to address an absence of resources for teachers that highlight cross-curricular integration of physical education and core academics to benefit the learning, motivation, health, and academic outcomes of students. Curricular integration, or the highlighting of overlapping themes between subjects, has become a popular way to maximize educational time in schools. The benefits of curricular integration are well documented, however, less known are the benefits of curricular integration in the fields of physical education and special education. By analyzing existing literature, reviewing existing curricula and educational resources, and surveying educational professionals, a guide was created to support teachers …

Social Comparison Tendencies And The Reward Value Of Same-Sex Beauty Among Heterosexual Women, Melissa M. Martin Ms.
Cal Poly Humboldt theses and projects
Previous studies have suggested that heterosexual women, but not heterosexual men, find same sex beauty rewarding. This finding has been attributed to a “greater bisexual interest among heterosexual women”, but no other explanations have been offered or tested. The current study aimed to explore social comparison tendencies as a potential alternate explanation to this previously observed finding. Twenty-three heterosexual women completed a series of questionnaires designed to assess their social comparison tendencies (the social comparison orientation scale, the physical appearance comparison scale, and the intrasexual competition scale). They also completed a “pay-per-view” keypress task to measure the reward value of …

Environmental art projects use artistic interpretation to tell stories about the natural world, often with the hope that they will inspire awareness or behavioral change. In 2019, an art project to raise awareness about North American river otters (Lontra canadensis) was launched in Northern California, using over 100 river otter sculptures painted and decorated by local artists. Through a mixed-methods approach, I quantified the initial outcomes of the project, North Coast Otters, as well as the response to the project by the public on social media as a case study in environmental art and outreach.
