The Fantasy Of The Unchaste Mentality, Tara N. Summerville, Kevin Bennardo Jan 2021

The Fantasy Of The Unchaste Mentality, Tara N. Summerville, Kevin Bennardo

For the past forty years, North Carolina’s rape-shield legislation has served as a laboratory of experimentation. Like the rape-shield legislation of every state, it generally prevents the admission of complaining witnesses’ past sexual history in sexual assault prosecutions. However, North Carolina’s rape-shield rule contains a unique exception not found elsewhere in the country. The exception, which we label the “fantasy exception,” permits the admission of a complaining witness’s past sexual behavior when it is offered as the basis of expert psychological or psychiatric opinion that the complainant fantasized or invented the charged assault.

This Article is the first to rigorously …

Children Librarians’ Knowledge And Attitude Towards Children With Neuro-Developmental Disorders: Implications For Inclusive Library Services, Charity N. Onyishi Jan 2021

Children Librarians’ Knowledge And Attitude Towards Children With Neuro-Developmental Disorders: Implications For Inclusive Library Services, Charity N. Onyishi

Library Philosophy and Practice (e-journal)

Neuro-developmental disorders (NDDs) are becoming increasingly prevalent among the children population and are the underserved groups in the schools and other learning institutions like a library. The high prevalence of children living with NDDs also highlights the need for the inclusion of children victims in all learning opportunities and supporting them to attain their maximum possible potentials. As the children are increasingly being included in library services, there is a need to know how knowledgeable the children librarians are about NDDs and their attitude towards children with NDDs and their inclusion in library services. Using a qualitative approach, this study …

Exploiting Virtual Realities For Library Serial Services To Nigeria Disabled Patrons, Adebowale Jeremy Adetayo, Augustine I. Enamudu, Folashade Munirat Lawal

Library Philosophy and Practice (e-journal)

Disabled patrons have faced unparalleled marginalization in Nigerian libraries due to facilities designed for ordinary users, which the disabled find challenging to navigate. As a result, access to serial services supplied by these institutions is constrained. The challenge of libraries is apparent, as seen by the decline of disabled patronage. In the face of this difficulty, they must act quickly to guarantee that their primary goal of fulfilling the information requirements of all classes of people is met. Librarians must re-strategize their serial services utilizing virtual realities in order to remain relevant. The article delves into the practical application of …

Biblical Concepts In Action: A Case For Discipleship In The Worship Ministry, Wendall D. Reed Jan 2021

Biblical Concepts In Action: A Case For Discipleship In The Worship Ministry, Wendall D. Reed

Doctoral Dissertations and Projects

The purpose of this qualitative historical study is to examine the discipleship of the worship ministry in the local church according to biblical principles of discipleship. Despite the biblical examples of discipleship benefits, worship ministry personnel are often not included in discipleship efforts from church leadership. The leadership and the congregation alike may assume their spiritual maturity. The preaching ministry and the worship ministry are the most public act of worship viewable by congregants. Some worship ministry volunteers and staff may feel they are expected to have already been discipled and may be reluctant to pursue discipleship engagement. This study …

Predictors Of The Treatment Retention And Quality Of Recovery From Opioid Use Disorder Using Buprenorphine In Medication-Assisted Treatment: A Pilot Study Of The Effects Of Hope, Grit, And Readiness To Change, John S. Pulliam

Doctoral Dissertations and Projects

Opioid misuse remains at epidemic proportions in the United States and other countries. Buprenorphine has been found effective in treating opioid use disorder (OUD). Understanding the roles of personal characteristics and readiness to change in addiction treatment retention and quality of recovery could be beneficial in office-based medication-assisted treatment for OUD. Researchers have explored OUD treatment methods and outcomes and have examined various predictive factors in treatment results, including demographic, socioeconomic, and psychological variables. However, few characteristics have been found to be consistent indicators of treatment retention and recovery quality. The constructs of hope agency, hope pathways, grit, and readiness …

Unveiling The Usage Of Technology In Higher Education Institutions (Heis) In Pakistan: A Study Employing Multi-Group Analysis (Mga), Muhammad Asif Munir Mr., Ghulam Shabir Dr.

Library Philosophy and Practice (e-journal)

Technology has brought changes in the behavioral intentions of students in higher education institutions (HEIs). It also helps them to be creative and innovative during their studies at universities. Literature review reveals that technology acceptance model (TAM) has been widely studied but unfortunately the usage of technology at academia has never been comparatively measured between private and public higher education institutions. This study measures effects of TAM-core variables on academic performance of graduate students of public and private HEIs, additionally, the moderating role of academic self-efficacy between actual usage of social media and academic performance was tested. By using a …

Taxing Nudges, Kathleen Delaney Thomas Jan 2021

Taxing Nudges, Kathleen Delaney Thomas

Faculty Publications

Governments are increasingly turning to behavioral economics to inform policy design in areas like health care, the environment, and financial decision-making. Research shows that small behavioral interventions, referred to as “nudges,” often produce significant responses at a low cost. The theory behind nudges is that, rather than mandating certain behaviors or providing costly economic subsidies, modest initiatives may “nudge” individuals to choose desirable outcomes by appealing to their behavioral preferences. For example, automatically enrolling workers into savings plans as a default, rather than requiring them to actively sign up, has dramatically increased enrollment in such plans. Similarly, allowing individuals to …

Barring Married Same-Sex Couples From Joint Adoption: Comparative Perspectives And The Case Of Taiwan, Holning S. Lau Jan 2021

Barring Married Same-Sex Couples From Joint Adoption: Comparative Perspectives And The Case Of Taiwan, Holning S. Lau

Faculty Publications

Taiwan is the first country in Asia to legalize same-sex marriage, but it forbids married same-sex couples from jointly adopting children. This article examines this restriction through the lens of comparative law, which brings into focus two main insights. First, we see that, out of all countries that have legalized same-sex marriage, Taiwan is one of only two that bar married same-sex couples from joint adoption. As this article will explain, the fact that Taiwan’s policy is so anomalous should spur skepticism of the policy’s appropriateness. Second, judicial opinions from around the world contain persuasive reasoning that further calls into …

The Final Act -- Deportation By Ice Air, Deborah M. Weissman, Angelina Godoy, Havan Clark Jan 2021

The Final Act -- Deportation By Ice Air, Deborah M. Weissman, Angelina Godoy, Havan Clark

Faculty Publications

Deportation is a legal concept about which much has been written. But it is more complicated. For noncitizens, forced expulsion is a lived experience occurring in time and space — an act against the body, mostly black and brown bodies. In this Article, we part ways with the well-established narratives of deportation and the punishment/non-punishment paradigm to conceive of deportation not only as a legal concept, but as a physical act — the final act — that is, the culmination of the immigration enforcement dragnet. The physical removal of persons from the United States requires a complex system comprised of …

Law In The Shadows Of Confederate Monuments, Deborah R. Gerhardt Jan 2021

Law In The Shadows Of Confederate Monuments, Deborah R. Gerhardt

Faculty Publications

Hundreds of Confederate monuments stand across the United States. In recent years, leading historians have come forward to clarify that these statues were erected not just as memorials but to express white supremacist intimidation in times of racially oppressive conduct. As public support for antiracist action grows, many communities are inclined to remove public symbols that cause emotional harm, create constant security risks and dishonor the values of equality and unity. Finding a lawful path to removal is not always clear and easy. The political power brokers who choose whether monuments will stay or go often do not walk daily …

Rabbi Lamm, The Fifth Amendment, And Comparative Jewish Law, Samuel J. Levine Jan 2021

Rabbi Lamm, The Fifth Amendment, And Comparative Jewish Law, Samuel J. Levine

Scholarly Works

Rabbi Norman Lamm’s 1956 article, “The Fifth Amendment and Its Equivalent in the Halakha,” provides important lessons for scholarship in both Jewish and American law. Sixty-five years after it was published, the article remains, in many ways, a model for interdisciplinary and comparative study of Jewish law, drawing upon sources in the Jewish legal tradition, American legal history, and modern psychology. In so doing, the article proves faithful to each discipline on its own terms, producing insights that illuminate all three disciplines while respecting the internal logic within each one. In addition to many other distinctions, since its initial publication, …

Replanting A Wild Seed: Black Women School Leaders Subverting Ideological Lynching, Whitneé Louise Garrett-Walker Jan 2021

Replanting A Wild Seed: Black Women School Leaders Subverting Ideological Lynching, Whitneé Louise Garrett-Walker

Doctoral Dissertations

Much race-based educational research is focused on teachers interrupting systems ofoppression in their classrooms, through methods such as curriculum and instruction, and preparing students to engage in the world (Alston, 2012; Bertrand & Rodela, 2017; Carpenter & Diem, 2013; Gooden & Dantley, 2012; Furman, 2012). I intentionally focus my attention on school leadership because while all stakeholders are responsible for maintaining school culture, as school leaders it is our responsibility to create conditions where the work of enacting social justice is expected in our schools. There continues to be a gap in educational research that deeply examines this level of …

Teaching Critical Thinking Skills In A Chinese Immersion School, Pui Hung Helen Wong

Doctoral Dissertations

As a frontline teacher and administrator, I received feedback consistently from parents and students asking for a fun and effective method of instruction for Chinese language development in the US. This study explored the micro-level of how teachers in Chinese immersion schools create an environment to support development of students’ critical thinking skills while learning Chinese. I applied a qualitative approach to the research and designed a case study focused on answering the following research questions: How do teachers help their students to develop critical thinking skills when teaching in a Chinese immersion program? What are the challenges teachers have …

Anthology Of An Empath, Meriel Melendrez Mees Jan 2021

Anthology Of An Empath, Meriel Melendrez Mees

Cal Poly Humboldt theses and projects

How can we live here together? How can we, human beings (especially those of us not considered as such, historically, presently, or in the future) and more-than-human beings live here together and care for each other? I set out to learn how a pair of permaculture farmers in Southern Humboldt lived and worked with these questions: I attempted a qualitative and quantitative analysis of twenty years of natural history journals that one of them recorded. I was particularly interested in the aesthetics of land tending, affective relationships with more-than-human beings, and disrupting settler colonialism through epistemic reparations to the Sinkyone …

The Influence Of Biological Sex, Athletic Identity And Pressure On Collegiate Athlete's Attitudes And Behaviors Toward Playing Through Pain And Injury, Margaret Anne Willis

Cal Poly Humboldt theses and projects

Injuries are to be expected when participating in all levels of collegiate sports (e.g., recreation, elite, club, intermural). It is common among collegiate athletes to continue practicing or competing despite being in pain/injured. This willingness to play hurt can cause negative consequences for athlete’s future health. The purpose of this study was to examine the influence of biological sex, athletic identity and pressure on collegiate athlete’s attitudes and behaviors toward playing through pain and injury. Student-athletes involved in NCAA (National Collegiate Athletic Association) Division II sports completed two questionnaires and one measurement scale: demographic questionnaire, Risk, Pain and Injury Questionnaire …

Why Do People Donate? Motivation Of Major Donors In Higher Education, Karin Hsuan Chao-Bushoven Jan 2021

Why Do People Donate? Motivation Of Major Donors In Higher Education, Karin Hsuan Chao-Bushoven

Cal Poly Humboldt theses and projects

Higher education has relied on private philanthropy since the establishment of the first universities in the U.S. This reliance has increased over the decades as a result of rising costs and decreased government investment. As such, it has become more critical to better understand what factors motivate philanthropists to increase their support of higher education; including direct support for teaching and research and increasing financial support for those students otherwise not able to pursue secondary education. However, much of the existing data focuses only on point-of-philanthropic-act, and neglects to examine motivational factors of long-term donors that have progressively increased their …

The Effect Of Partner Gender On Bisexual’S Percieved Lgbt+ Belonging, Danielle Siegel Jan 2021

The Effect Of Partner Gender On Bisexual’S Percieved Lgbt+ Belonging, Danielle Siegel

Cal Poly Humboldt theses and projects

Bisexual erasure is a phenomenon in which the existence of bisexuality is broadly omitted from history, media, and research. Bisexual erasure contributes to stereotypes that bisexuality is a strictly transitional identity, only used in the process of sexually-experimenting or coming out as gay. Although well-documented in qualitative research on bisexuality, the negative effects of bisexual erasure on bisexual women’s mental health and ability to access LGBT+ resources have not been shown in an experimental context. In a vignette study, participants (N= 276) were asked to review application materials for a potential recipient of an LGBT+ exclusive scholarship award. …

Beyond Care And Order In School Climate: A Qualitative Study Of Defender And Outsider Cognitions In Bullying Situations, William S. Richards Iv Jan 2021

Beyond Care And Order In School Climate: A Qualitative Study Of Defender And Outsider Cognitions In Bullying Situations, William S. Richards Iv

Cal Poly Humboldt theses and projects

This study examined the cognitions of students who intervene or do not intervene when they witness bullying incidents along with the ways that these cognitions may relate to these students’ perceptions of school climate at a small, rural high school in Northern California. Because increasing the frequency of bystander intervention has been found in prior studies to decrease bullying, this study illuminates the cognitive processes that support agency to intervene in bullying and distinguish them from cognitive processes that reduce agency to intervene. This study also identifies possible links between the ways students perceive school climate and their agency to …

The Role Of Hardiness And Autonomy Support On College Student Engagement, Kevin Douglas Cherry Jan 2021

The Role Of Hardiness And Autonomy Support On College Student Engagement, Kevin Douglas Cherry

Cal Poly Humboldt theses and projects

The gap between college student enrollment and graduation rates remains a problem for college students and administrators. Literature on persistence in college suggests that factors such as hardiness and autonomy support may contribute to student perseverance through degree attainment. The current study focused on these constructs using a framework based on self-determination theory (SDT; Ryan & Deci, 1985). Factors related to student persistence, namely hardiness and autonomy support, were expected to positively predict college student engagement. Furthermore, hardiness was expected to moderate the relationship between autonomy support and college student engagement. College students from a university and a community college …

The Relationship Between Autoimmunity And Polyautoimmunity, David Schon Jan 2021

The Relationship Between Autoimmunity And Polyautoimmunity, David Schon

The Science Journal of the Lander College of Arts and Sciences

Autoimmune disease refers to a systemic immune response by the body against its own healthy tissue and cells. This results in various non-specific and systemic inflammatory processes that evolve into more than 100 individual diseases. Numerous biological similarities exist between the different pathophysiological pathways, including biochemical cascades and inflammasome mediators. This paper aims to investigate whether contracting one form of autoimmune disease can lead to the development of polyautoimmunity and multiple autoimmune syndrome. Scientists have identified chronic levels of high stress as a contributor to higher levels of C-reactive protein and several immune modulating interleukins, which can lead to both …

School “Safety” Measures Jump Constitutional Guardrails, Maryam Ahranjani Jan 2021

School “Safety” Measures Jump Constitutional Guardrails, Maryam Ahranjani

Scholarly Works

In the wake of George Floyd's murder and efforts to achieve racial justice through systemic reform, this Article argues that widespread "security" measures in public schools, including embedded law enforcement officers, jump constitutional guardrails. These measures must be rethought in light of their negative impact on all children and in favor of more effective-and constitutionally compliant-alternatives to promote school safety. The Black Lives Matter, #DefundthePolice, #abolishthepolice, and #DefundSchoolPolice movements shine a timely and bright spotlight on how the prisonization of public schools leads to the mistreatment of children, particularly children with disabilities, boys, Black and brown children, and low-income children. …

Resilience In Cancer Patients, Lori A. Gardner Jan 2021

Resilience In Cancer Patients, Lori A. Gardner

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

The phenomenon of resilience has long been identified as a key talking point within the realm of overall mental health, but the concept’s specific meaning, qualities, and sources remain somewhat elusive. For those with chronic health conditions, resilience is often identified as essential to coping effectively with significant disruptions to daily activities. The purpose of this study was to better understand the concept of resilience and to determine themes that underlie resilience, specifically within a cancer patient population. This goal was addressed by using a qualitative approach to elicit commonalities among the experiences of cancer patients representing varying types and …

Clinical Considerations For Treating Adult Survivors Of Child Sexual Abuse: A Proposal For Integrating Intersubjective Systems Theory And Feminist Perspectives, Kristen Schrijver Jan 2021

Clinical Considerations For Treating Adult Survivors Of Child Sexual Abuse: A Proposal For Integrating Intersubjective Systems Theory And Feminist Perspectives, Kristen Schrijver

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

The goal of this paper is to offer clinical considerations for clinicians working with adult survivors of extrafamilial child sexual abuse (CSA) by 1) defining the stages of sexual abuse grooming of the child and their entire family system, 2) defining and integrating intersubjective and feminist approaches to treatment, and 3) providing methods for depathologizing CSA survivors’ experience of shame. These three objectives aim to increase awareness and knowledge of sexual abuse grooming, as well as offer an integrative theoretical framework for individual therapy with adult survivors of CSA.

Tangibility As Technology, João Marinotti Jan 2021

Tangibility As Technology, João Marinotti

Articles by Maurer Faculty

Property law has traditionally relied on tangible boundaries to delineate legal thinghood and to inform the bounds of in rem rights and duties. Unfortunately, property doctrines have fossilized around tangibility, causing fragmentation in the legal treatment of digital assets. In the United States, for example, cryptocurrencies and non-fungible tokens (NFTs) may simultaneously be classified as commodities, securities, currencies, assets, or not property at all, depending on the jurisdiction, domain, or specific asset in question. This fragmented system of overlapping legal treatments increases the information cost of using digital assets, decreases efficiency, and ultimately hinders future innovation.

In this Article, I …

Communication Faculty Publications and Presentations

This Open Access book tracks the latest trends in the theory, research, and practice of entertainment-education, the field of communication that incorporates social change messaging into entertaining media. Sometimes called edutainment, social impact television, narrative persuasion, or cultural strategy, this approach to social and behavior change communication offers new opportunities including transmedia and digital formats. However, making media can be a chaotic process. The realities of working in the field and the rigid structures of scholarly evaluation often act as barriers to honest accounts of entertainment-education practice. In this collection of essays, experienced practitioners offer unique insight into how entertainment-education …
