A Quantcrit Analysis Of Context, Discipline, Special Education, And Disproportionality, Rebecca A. Cruz, Saili S. Kulkarni, Allison R. Firestone Jan 2021

A Quantcrit Analysis Of Context, Discipline, Special Education, And Disproportionality, Rebecca A. Cruz, Saili S. Kulkarni, Allison R. Firestone

Faculty Research, Scholarly, and Creative Activity

Using a dis/ability critical race theory (DisCrit) and critical quantitative (QuantCrit) lens, we examine disproportionate application of exclusionary discipline on multiply marginalized youth, foregrounding systemic injustice and institutionalized racism. In doing so, we examined temporal-, student-, and school-level factors that may result in exclusion and othering (i.e., placing into special education and punishing with out-of-school suspensions) within one school district. We frame this study in DisCrit and QuantCrit frameworks to connect data-based decision making to sociocultural understandings of the ways in which schools use both special education and discipline to simultaneously provide and limit opportunities for different student groups. Results …

Model-Based Clustering, Classification, And Discriminant Analysis Using The Generalized Hyperbolic Distribution: Mixghd R Package, Cristina Tortora, Ryan P. Browne, Aisha Elsherbiny, Brian C. Franczak, Paul D. Mcnicholas

Faculty Research, Scholarly, and Creative Activity

The MixGHD package for R performs model-based clustering, classification, and discriminant analysis using the generalized hyperbolic distribution (GHD). This approach is suitable for data that can be considered a realization of a (multivariate) continuous random variable. The GHD has the advantage of being flexible due to skewness, concentration, and index parameters; as such, clustering methods that use this distribution are capable of estimating clusters characterized by different shapes. The package provides five different models all based on the GHD, an efficient routine for discriminant analysis, and a function to measure cluster agreement. This paper is split into three parts: the …

The Need For A Strong And Stable Federal Public Health Agency Independent From Politicians, Jacqueline Salwa, Christopher Robertson Jan 2021

The Need For A Strong And Stable Federal Public Health Agency Independent From Politicians, Jacqueline Salwa, Christopher Robertson

Faculty Scholarship

The COVID-19 pandemic has revealed the precariousness of federal public health institutions in the United States, and how disastrously things can go when those institutions are undermined by political forces. Such institutions can be disbanded, underfunded, populated with incompetent political hacks, manipulated, or sidelined. As a field, public health in particular needs some political space, given that it requires deep scientific expertise and needs to communicate to the public clearly, reliably, and with authority to engender trust. Key public health agencies, such as the Centers for Disease Control and Prevention (CDC) in particular, should be buttressed against future political encroachment, …

Deficit Frame Dangers, Jonathan Feingold Jan 2021

Deficit Frame Dangers, Jonathan Feingold

Faculty Scholarship

Civil rights advocates have long viewed litigation as an essential, if insufficient, catalyst of social change. In part, it is. But in critical respects that remain underexplored in legal scholarship, civil rights litigation can hinder short- and long-term projects of racial justice.

Specifically, certain civil rights doctrines reward plaintiffs for emphasizing community deficits—or what I term a “deficit frame.” Legal doctrine, in other words, invites legal narratives that track, activate, and reinforce pernicious racial stereotypes. This dynamic, even in the context of well-intended litigation, risks entrenching conditions that drive racial inequality—including the conditions that litigation is often intended to address. …

The Covid-19 Pandemic And The Technology Trust Gap, Johanna Gunawan, David Choffnes, Woodrow Hartzog, Christo Wilson Jan 2021

The Covid-19 Pandemic And The Technology Trust Gap, Johanna Gunawan, David Choffnes, Woodrow Hartzog, Christo Wilson

Faculty Scholarship

Industry and government tried to use information technologies to respond to the COVID-19 pandemic, but using the internet as a tool for disease surveillance, public health messaging, and testing logistics turned out to be a disappointment. Why weren’t these efforts more effective? This Essay argues that industry and government efforts to leverage technology were doomed to fail because tech platforms have failed over the past few decades to make their tools trustworthy, and lawmakers have done little to hold these companies accountable. People cannot trust the interfaces they interact with, the devices they use, and the systems that power tech …

Beginning in August 2016, a series of class action lawsuits were filed on behalf of participants and beneficiaries of 403(b) employee retirement plans sponsored by major American colleges and universities. These plans are regulated by the 1974 Employee Retirement Income Security Act (“ERISA”), which sets minimum standards to protect the participants and beneficiaries of voluntarily established retirement and health plans. The allegations in the several lawsuits have centered primarily around breaches of fiduciary duties by those charged with administering the plan.

These cases are all class action lawsuits brought on behalf of the participants and beneficiaries of the plans in …

Scientists are increasingly concerned with making their work easy to verify and build upon. Associated practices include sharing data, materials, and analytic scripts, and preregistering protocols. This has been referred to as a “credibility revolution”. The credibility of empirical legal research has been questioned in the past due to its distinctive peer review system and because the legal background of its researchers means that many often are not trained in study design or statistics. Still, there has been no systematic study of transparency and credibilityrelated characteristics of published empirical legal research. To fill this gap and provide an estimate of …

Helping The Have-Nots: Examining The Relationship Between Rehabilitation Adherence And Self-Efficacy Beliefs In Acl Reconstructed Naia And Ncaa Dii And Diii Female Athletes, Myles Tutin Englis

Theses and Dissertations--Kinesiology and Health Promotion

Anterior cruciate ligament injuries are among the most common and traumatic sport-related injuries, and often negatively impact one’s quality of life during and post-rehabilitation. For many NCAA Division I and professional female athletes, rehabilitation is streamlined with a multidisciplinary team, including sport psychology. For others (e.g., NAIA, NCAA Division II, III athletes) this may not always be the case, as many of these athletic programs may not have the resources to meet the various needs of injured and rehabilitating female student-athletes. In these instances, rehabilitation motivation, adherence, and success may be more dependent on the athletes’ individual resources and personalities, …

Is What Works Working? Thinking Evaluatively About The What Works Clearinghouse, Andrew A. Nelson Jan 2021

Is What Works Working? Thinking Evaluatively About The What Works Clearinghouse, Andrew A. Nelson

Theses and Dissertations--Education Sciences

Since the mid-twentieth century, the U.S. Department of Education has drafted and enacted policies to bridge the research-practice gap—that is, the gap between “what works” according to educational research and what is actually practiced by teachers and their administrators (e.g., Dirkx, 2006; Joyce & Cartwright, 2019; Tseng, 2012). One of the latest manifestations of this “what works” political legacy is the What Works Clearinghouse (WWC), which took shape as part of the Institute of Education Sciences (IES) in 2002. The WWC’s mission is to be a “central and trusted source of scientific evidence for what works in education” (WWC, 2020d, …
