Lech's Mess With The Tenth Circuit: Why Governmental Entities Are Not Exempt From Paying Just Compensation When They Destroy Property Pursuant To Their Police Powers, Emilio R. Longoria

On June 29, 2020, the Supreme Court denied certiorari in Lech v. Jackson, a Tenth Circuit inverse condemnation case, which held that governmental entities are categorically exempt from paying just compensation when they destroy private property pursuant to their police powers. This denial of certiorari cements a highly controversial circuit court holding into our takings jurisprudence the effects of which will be serious and far reaching. This article dissects the Tenth Circuit's opinion in Lech and explains how and why this holding should be revisited. Background: CT pan-scans have become increasingly commonplace as part of the initial diagnostic work-up for patients sustaining traumatic injuries. They have proven effective in improving diagnostic accuracy in those with high energy mechanisms of injury. However, the utility of pan-scans in the geriatric population sustaining low energy traumatic injuries remains unproven. There is no study that assesses the usefulness of CT pan-scans in patients who sustain injuries related to osteoporosis, also known as fragility fractures.

Achilles tendon ruptures are one of the most common tendon injuries. Numerous surgical procedures have been developed to repair these injuries, but there is no consensus as to which technique is superior. This combined cadaveric and finite element model study was performed to compare directly initial biomechanical integrity between two operative techniques and use these resulting data to validate a finite element model.

แก๊สธรรมชาติอัดเป็นพลังงานทดแทนที่ได้รับความนิยมในระบบขนส่งสาธารณะ เนื่องจากซีเอ็นจีเป็นพลังงานสะอาด ค่าออกเทนสูงและราคาถูก เมื่อเปรียบเทียบกับเชื้อเพลิงชนิดอื่นและสามารถใช้งานในรูปแบบของระบบเชื้อเพลิงสองชนิด (dual-fuel) ในงานวิจัยนี้ได้ทำการศึกษาตัวแปรที่มีผลต่อการเสื่อมสภาพของน้ำมันหล่อลื่นมาตราฐานกึ่งสังเคราะห์สำหรับเครื่องยนต์แกโซลีน-ซีเอ็นจี โดยทำการเก็บตัวอย่างน้ำมันหล่อลื่นตามระยะทางที่กำหนดและทำการวิเคราะห์อิงตามมาตราฐาน ASTM จากการวิเคราะห์ความหนืดซึ่งเป็นสมบัติสำคัญของน้ำมันหล่อลื่นที่อุณหภูมิ 40 °C และ 100 °C พบว่าที่อุณหภูมิ 100 °C ความร้อนส่งผลให้เกิดการสลายพันธะภายในโมเลกุลทำให้ฟิล์มน้ำมันมีลักษณะบางลงและเป็นตัวเร่งต่อการเกิดปฏิกิริยาออกซิเดชัน โดยผลิตภัณฑ์ของปฏิกิริยาออกซิเดชันสามารถวิเคราะห์ด้วยเทคนิคฟูเรียร์ทรานส์ฟอร์มอินฟราเรดสเปกโทสโกปี (FT-IR) แสดงถึงการเปลี่ยนแปลงสมบัติทางเคมีของน้ำมันหล่อลื่นเนื่องจากหมู่ฟังก์ชันคาร์บอนิล (C=O) มีความเข้มข้นจากผลิตภัณฑ์ของออกซิเดชัน และมีผลทำให้ปริมาณกรดและค่าความหนืดเพิ่มขึ้น ส่งผลทำให้ชิ้นส่วนภายในเครื่องยนต์ถูกกัดกร่อน จากการวิเคราะห์ปริมาณเบสในน้ำมันหล่อลื่นที่บ่งชี้ถึงประสิทธิภาพของสารทำความสะอาด พบว่าที่ระยะทางมากกว่า 15000 กิโลเมตร ความเข้มข้นของสารเติมแต่งอัลคาไลน์จะลดลงครึ่งหนึ่งจากปริมาณเริ่มต้น แสดงให้เห็นถึงการเสื่อมสภาพของสารเติมแต่งจากความเข้มข้นของสิ่งสกปรกที่เกิดขึ้น เช่น ฝุ่น น้ำ โลหะและเขม่า

การวิจัยครั้งนี้เป็นการวิจัยเชิงพรรณนาโดยใช้วิธีวิจัยแบบเดลฟายเพื่อศึกษาตัวชี้วัดผลลัพธ์ความปลอดภัยของผู้ป่วยและพยาบาลวิชาชีพ แผนกอุบัติเหตุและฉุกเฉิน โรงพยาบาลตติยภูมิ ผู้ให้ข้อมูลเป็นผู้เชี่ยวชาญด้านระบบการรักษาพยาบาลฉุกเฉิน การดูแลผู้ป่วยแผนกอุบัติเหตุและฉุกเฉิน โรงพยาบาลตติยภูมิ จำนวน 20 คน คัดเลือกแบบเจาะจงและแบบวิธีบอกต่อ เครื่องมือที่ใช้ในการวิจัย คือ แบบสัมภาษณ์และแบบสอบถาม ซึ่งผ่านการตรวจสอบความตรงโดยผู้เชี่ยวชาญ วิเคราะห์ข้อมูลเชิงคุณภาพโดยใช้การวิเคราะห์เนื้อหา และใช้สถิติบรรยาย ได้แก่ มัธยฐานและพิสัยระหว่าง ควอไทล์ ผลการวิจัยพบว่า ตัวชี้วัดผลลัพธ์ความปลอดภัยของผู้ป่วย แผนกอุบัติเหตุและฉุกเฉิน โรงพยาบาลตติยภูมิ ประกอบด้วย 7 ด้าน ได้แก่ 1) ความปลอดภัยจากการได้รับการดูแลในภาวะฉุกเฉิน 2) ความปลอดภัยจากการได้รับการดูแลส่งต่อภายนอกโรงพยาบาล 3) ความปลอดภัยจากการได้รับการดูแลส่งต่อภายในโรงพยาบาลและการดูแลรักษาต่อเนื่อง 4) ความปลอดภัยด้านการสื่อสารและสัมพันธภาพกับทีมสุขภาพ 5) ความปลอดภัยด้านการติดเชื้อ 6) ความปลอดภัยด้านสิ่งแวดล้อม 7) ความปลอดภัยด้านการได้รับยาและเลือด โดยมีตัวชี้วัดทั้งหมด 59 ตัวชี้วัด มีค่ามัธยฐานอยู่ในช่วง 3.75 – 4.75 และค่าพิสัยระหว่างควอไทล์อยู่ในช่วง .25 – 2.02 ส่วนตัวชี้วัดผลลัพธ์ความปลอดภัยของพยาบาลวิชาชีพ แผนกอุบัติเหตุและฉุกเฉิน โรงพยาบาลตติยภูมิ ประกอบด้วย 5 ด้าน ได้แก่ 1) ความปลอดภัยด้านสิ่งแวดล้อมในการปฏิบัติงานและการป้องกันความรุนแรง 2) ความปลอดภัยจากการได้รับการดูแลป้องกันการติดเชื้อ 3) ความปลอดภัยจากการได้รับการดูแลในระบบส่งต่อและกฎหมาย 4) ความปลอดภัยจากการได้รับการดูแลด้านสภาพจิตใจ 5) ความปลอดภัยด้านข้อมูลสารสนเทศ รวม 62 ตัวชี้วัด มีค่ามัธยฐานอยู่ในช่วง 4.12 – 4.75 และค่าพิสัยระหว่างควอไทล์อยู่ในช่วง .25 – 1.16 ผลการวิจัยครั้งนี้สามารถใช้กำหนดเป็นแนวทางการประเมินผลลัพธ์เพื่อปรับปรุงกระบวนการดูแลผู้ป่วยให้มีความเหมาะสมและมีประสิทธิภาพ และเป็นแนวทางในการพัฒนาให้เกิดพฤติกรรมความปลอดภัยในการทำงานของพยาบาลวิชาชีพ แผนกอุบัติเหตุและฉุกเฉิน ในโรงพยาบาลระดับตติยภูมิ

งานวิจัยมีวัตถุประสงค์เพื่อศึกษาปัจจัยที่ส่งผลต่อพฤติกรรมการซื้อสินค้าอุปโภคบริโภคออนไลน์ของผู้บริโภคในเขตกรุงเทพและปริมณฑล และศึกษาลักษณะพฤติกรรมการซื้อสินค้าอุปโภคบริโภคผ่านช่องทางออนไลน์ กลุ่มตัวอย่างเป็นผู้บริโภคในเขตกรุงเทพและปริมณฑลที่เคยซื้อสินค้าอุปโภคบริโภคผ่านช่องทางออนไลน์จำนวน 400 คน สถิติที่ใช้ในการวิเคราะห์ข้อมูล ได้แก่ ความถี่ ร้อยละ และสถิติที่ใช้ในการทดสอบสมมติฐานคือ การวิเคราะห์สมการถดถอยพหุคูณ (Multiple Regression Analysis) ผลการศึกษาพบว่าช่องทางการซื้อสินค้าอุปโภคบริโภคออนไลน์ที่นิยม คือ Shopee และ Lazada ความถี่ในการสั่งซื้อส่วนใหญ่ซื้อเดือนละ 1 ครั้ง มีค่าใช้จ่ายเฉลี่ยในการสั่งซื้อครั้งละ 501-1,000 บาท สินค้าที่นิยมซื้อผ่านช่องทางออนไลน์ คือ ของใช้ส่วนตัว เช่น สบู่ ยาสระผม และ ของใช้ในบ้าน เช่น น้ำยาทำความสะอาด กระดาษชำระ สาเหตุที่เลือกซื้อสินค้าอุปโภคบริโภคผ่านช่องทางออนไลน์ คือ ความสะดวกสบาย ราคา และโปรโมชั่นสินค้า นิยมชำระเงินผ่านบัตรเครดิต/บัตรเดบิต และชอบนโยบายการจัดส่งสินค้าแบบฟรีค่าจัดส่ง ไม่มียอดการสั่งซื้อขั้นต่ำ (ราคาสินค้ารวมค่าจัดส่ง) และยังคงจะซื้อสินค้ายี่ห้อเดิม แต่จะซื้อจากช่องทางออนไลน์อื่นที่มีราคาสินค้าและค่าจัดส่งที่ถูกกว่า ผลการทดสอบสมมติฐานพบว่า ปัจจัยที่ส่งผลต่อพฤติกรรมการซื้อสินค้าอุปโภคบริโภคออนไลน์ของผู้บริโภคในเขตกรุงเทพและปริมณฑลอย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05 มีจำนวน 5 ปัจจัย ดังนี้ ปัจจัยด้านกายภาพและการนำเสนอ (Physical Evidence/Environment and Presentation) ปัจจัยการส่งเสริมการตลาด (Promotion) ปัจจัยด้านการขนส่ง (Transportation) ปัจจัยด้านบุคคล (People) และปัจจัยผลิตภัณฑ์ (Product)

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อวิเคราะห์ปัจจัยที่มีความสัมพันธ์ต่อความเชื่อมั่นของพนักงานบริษัทการบินไทย จำกัด มหาชน เมื่อเข้าสู่กระบวนการปรับโครงสร้างใหม่และเพื่อเป็นแนวทางการปรับปรุงและส่งเสริมความเชื่อมั่นของพนักงานต่อองค์กรของบริษัท การบินไทย จำกัด มหาชน เพื่อนำผลได้มามาใช้เป็นแนวทางในการเสริมสร้างความเชื่อของพนักงานต่อบริษัท และเพื่อเป็นข้อมูลในการพัฒนาด้านทรัพยากรบุคคลต่อไป กลุ่มตัวอย่างในการศึกษาคือพนักงานบริษัท การบินไทย จำกัด มหาชน รวมทั้งสิ้นจำนวน 400 คน การวิจัยครั้งนี้ใช้ระเบียบวิธีวิจัยแบบปริมาณ เครื่องมือที่ใช้ในการเก็บข้อมูล การวิจัย เชิงปริมาณใช้แบบสอบถาม สถิติที่ใช้ในการ วิเคราะห์ข้อมูล ได้แก่ ความถี่ ร้อยละ ค่าเฉลี่ย ส่วนเบ่ียงเบนมาตรฐาน Independent Samples t-test, One-Way ANOVA และค่าสัมประสิทธิ์สหสัมพันธ์แบบเพียร์สัน จากการวิจัยพบว่า 1) ปัจจัยด้านความผูกพัน มีความสัมพันธ์กับความเชื่อมั่นของพนักงาน โดยพนักงานปรารถนาที่จะเห็นบริษัทเปลี่ยนแปลงไปทางที่ดีขึ้นมากที่สุด 2) ปัจจัยด้านภาพลักษณ์มีความสัมพันธ์กับความเชื่อมั่นของพนักงานในระดับมาก โดยพนักงานเห็นว่าเป็นองค์กรที่ได้รับรางวัลและการรับรองตามมาตรฐานการบินมากมาย 3) ปัจจัยด้านการปรับโครงสร้างองค์กรมีความสัมพันธ์กับความเชื่อมั่นของพนักงานในระดับมาก โดยพนักงานเห็นด้วยกับการปรับโครงสร้างองค์กรใหม่ในครั้งนี้ 4) ผลการวิเคราะห์ปัจจัยที่มีความสัมพันธ์กับความเชื่อมั่นของพนักงาน บริษัท การบินไทย จำกัด พบว่า ปัจจัยด้านภาวะผู้นำ ด้านความผูกพัน ด้านภาพลักษณ์ และด้านการปรับโครงสร้าง มีความสัมพันธ์ความเชื่อมั่นของพนักงาน บริษัทการบินไทย จำกัด มหาชน เมื่อเข้าสู่กระบวนการปรับโครงสร้างใหม่อย่างมีนัยยะสำคัญที่ระดับ 0.01 5) แนวทางในการแก้ไขการส่งเสริมความเชื่อมั่นของพนักงานควรมีให้เพิ่มมากขึ้นกว่าเดิม จัดกิจกรรมเสริมสร้างการรับรู้ต่าง ๆ ร่วมกันมากขึ้น โดยเป็นไปอย่างโปร่งใสและตรวจสอบได้

การพัฒนาสมรรถนะการทำงาน เป็นการเพิ่มประสิทธิภาพและประสิทธิผลในการปฏิบัติงาน ให้บุคคลากรพร้อมต่อการเข้าสู่ตำแหน่งในอนาคต และปฏิบัติงานได้บรรลุผลตามเป้าประสงค์ขององค์การ การศึกษาวิจัยครั้งนี้มีวัตถุประสงค์ (1) เพื่อศึกษาแนวทางในการพัฒนากรอบสมรรถนะพยาบาลหัวหน้าหอผู้ป่วย โรงพยาบาลจุฬาภรณ์ ราชวิทยาลัยจุฬาภรณ์ (2) เพื่อศึกษาการพัฒนาบุคลากรเข้าสู่ตำแหน่ง และช่องว่างขีดความสามารถ (Competency gap) ที่พยาบาลหัวหน้าเวร และพยาบาลวิชาชีพควรพัฒนาเพื่อขึ้นสู่ตำแหน่งพยาบาลหัวหน้าหอผู้ป่วยวิกฤต ในบริบทของงานวิจัยนี้ ผู้ให้ข้อมูลคือพยายาบาลหอผู้ป่วยวิกฤต โรงพยาบาลจุฬาภรณ์ ราชวิทยาลัยจุฬาภรณ์ จำนวน 9 คน ได้แก่ หัวหน้าหอผู้ป่วยวิกฤต จำนวน 1 ราย หัวหน้าเวร จำนวน 6 ราย และพยาบาลวิชาชีพ จำนวน 2 ราย โดยเป็นการวิจัยเชิงคุณภาพ เก็บข้อมูลจากการค้นคว้าเอกสาร และการสัมภาษณ์เชิงลึกโดยการเลือกกลุ่มผู้ให้ข้อมูลแบบเจาะจง ผลการศึกษาพบว่า โดยภาพรวมแล้วพยาบาลหัวหน้าเวรและพยาบาลวิชาชีพทั้ง 9 คน มีความพร้อมที่จะขึ้นสู่ตำแหน่งหัวหน้าหอผู้ป่วยวิกฤต โดยได้รับสมรรถนะทั้ง 5 หมวด อยู่ในระดับผู้เชี่ยวชาญ (Expert) แต่ยังมีรายละเอียดบางประการที่ต้องมีการพัฒนาเพิ่มเติม ได้แก่ สมรรถนะด้านการวิจัยและการสื่อสารกับผู้ร่วมงานและสหวิชาชีพในการปฏิบัติงานร่วมกันให้เป็นไปตามหลักการเพื่อการให้บริการทางการพยาบาลเป็นไปตามหลักวิธีที่ถูกต้อง นอกจากนี้ยังพบข้อเสนอแนะ การพัฒนาระดับบุคลากรควรมีการพัฒนาเกณฑ์ด้านสมรรถนะในการเข้าสู่ตำแหน่งเพิ่มขึ้น อาทิ ด้านการบริหารจัดการ และการพัฒนาระดับโรงพยาบาลให้มีความสามารถของหอผู้ป่วยวิกฤตที่สอดคล้องต่อบริบทความต้องการของพื้นที่ เป็นต้น

การเพิ่มมูลค่าขยะเศษอาหารจากโรงแรม ห้างสรรพสินค้า และตลาดสด, ณัฐิวรรณ เดชกำแหง

งานวิจัยนี้ศึกษาอัตราการเกิดขยะมูลฝอยชุมชนของอาคารสถานประกอบการพาณิชย์ 3 ประเภท ได้แก่ โรงแรม อาคารศูนย์การค้าหรือห้างสรรพสินค้า ซุปเปอร์มาร์เก็ต และร้านสะดวกซื้อ และตลาดสด จากการศึกษาพบว่าตลาดสดมีอัตราการเกิดขยะมูลฝอยสูงที่สุดอยู่ในช่วง 149 – 3,724 กก./วัน ซึ่งมีองค์ประกอบหลักเป็นขยะเศษอาหาร ร้อยละ 81.31 ห้างสรรพสินค้า ซุปเปอร์มาร์เก็ต และร้านสะดวกซื้อมีอัตราการเกิดขยะมูลฝอยอยู่ในช่วง 17– 3,591 กก./วัน องค์ประกอบหลักเป็นขยะเศษอาหารร้อยละ 54.94 และโรงแรมมีอัตราการเกิดขยะมูลฝอยอยู่ในช่วง 12.7 – 319.5 กก./วัน องค์ประกอบหลักเป็นขยะรีไซเคิลได้ร้อยละ 42.77 รองลงมาเป็นขยะเศษอาหารร้อยละ 37.03 ในปัจจุบันขยะเศษอาหารทั้งหมดที่เกิดขึ้นภายในสถานประกอบการส่วนใหญ่ถูกทิ้งปะปนกับขยะมูลฝอย โดยไม่มีการคัดแยกที่ถูกต้องตั้งแต่ต้นทาง มีเพียงขยะที่สามารถรีไซเคิลได้เท่านั้นที่ถูกคัดแยกและจัดการได้อย่างเหมาะสม หากมีการคัดแยกขยะเศษอาหารที่แหล่งกำเนิดและมีการจัดการที่ดีแล้ว สามารถนำมาเพิ่มมูลค่าได้การทิ้งไปอย่างเสียเปล่าหรือต้องเสียค่าใช้จ่ายในการกำจัด โดยสถานประกอบการทั้ง 3 ประเภทนั้นต่างก็มีแนวทางการใช้ประโยชน์ที่ต่างกันไปตามบริบทของสถานประกอบการ ไม่ว่าจะเป็นการนำเศษอาหารที่เหลือจากการเตรียมมาประกอบอาหารเป็นเมนูใหม่ในไลน์บุฟเฟต์ของโรงแรม ห้างสรรพสินค้าซุปเปอร์มาร์เก็ต และร้านสะดวกซื้อสามารถนำเบเกอรี่ที่จะผลิตและจำหน่ายแบบวันต่อวันที่จำหน่ายไม่หมดส่งต่อให้กับมูลนิธิหรือหน่วยงานที่เกี่ยวข้องกับการกระจายอาหารไปสู่ผู้ที่ต้องการ ขณะที่ตลาดสดสามารถทำจุดรวบรวมขยะเศษอาหารจากแต่ละแผงค้าเพื่อจำหน่ายเป็นอาหารสัตว์หรือผลิตสารปรับปรุงดินได้

There are a few studies on menstrual hygiene of students, but none on menstrual hygiene of Buddhist nuns although there are 60,400 nuns, 0.1% of the total population, in need to practise menstrual hygiene. The study objective is to assess characteristics and factors associated with Buddhist nuns’ menstrual hygiene practices in North District, Yangon. This thesis is organized in two main parts. First, we study the Hyers-Ulam stability of impulsive integro-differential equations in Banach spaces. By using iterative methods, we establish sufficient conditions for existence of solutions and Hyers-Ulam stabilities. These conditions are based on the analysis of iterative methods. The second part deals with the control problems of impulsive integro-differential equations in Banach spaces. The iterative methods are used to investigate results and some examples are constructed to illustrate results. Moreover, we extend the scope of our study to the class of second order impulsive integro-differential equations in Banach spaces.

Alzheimer’s disease (AD) is a complex neurodegenerative disease that is characterized by the deposition of amyloid beta (Ab) peptides and, consecutively, by a loss of memory and cognitive functions. The amyloid cascade hypothesis suggests that Ab deposition is the main pathogenic of AD. There is evidence that both changes in production and clearance of Ab may be involved in AD pathology. Past studies have shown that exercise training leads to an upregulation in proteins directly involved with Ab clearance.
