Pension Fiduciaries And Climate Change: A Canadian Perspective, Maziar Peihani Jan 2021

Pension Fiduciaries And Climate Change: A Canadian Perspective, Maziar Peihani

All Faculty Publications

Climate change has emerged as a major issue of financial risk for Canadian pension funds when determining where to place investments. The author argues that while such pension funds recognize climate change as an issue that holds the potential for significant financial risk, the funds’ current approach to climate-related risks faces critical limitations. The author identifies the current practices of the five largest pension funds in Canada when faced with climate-related financial risks, then discusses the key shortcomings in current practices among the pension funds in three main areas.
First, the author examines organizational governance, which seeks to understand investment …

Online Or In-Person? Examining College Decisions To Reopen During The Covid-19 Pandemic In Fall 2020, Jacob Felson, Amy Adamczyk Jan 2021

Online Or In-Person? Examining College Decisions To Reopen During The Covid-19 Pandemic In Fall 2020, Jacob Felson, Amy Adamczyk

Publications and Research

When coronavirus disease 2019 (COVID-19) became a major impediment to face-to-face college instruction in spring 2020, most teaching went online. Over the summer, colleges had to make difficult decisions about whether to return to in-person instruction. Although opening campuses could pose a major health risk, keeping instruction online could dissuade students from enrolling. Taking an ecological approach, the authors use mixed modeling techniques and data from 87 percent of two- and four-year public and four-year private U.S. colleges to assess the factors that shaped decisions about fall 2020 instructional modality. Most notably, the authors find that reopening decisions about whether …

Improving The Credibility Of Empirical Legal Research: Practical Suggestions For Researchers, Journals, And Law Schools, Jason Chin, Alexander Dehaven, Tobias Heycke, Alexander Holcombe, David Mellor, Justin Pickett, Crystal Steltenpohl, Simine Vazire, Kathryn Zeiler Jan 2021

Improving The Credibility Of Empirical Legal Research: Practical Suggestions For Researchers, Journals, And Law Schools, Jason Chin, Alexander Dehaven, Tobias Heycke, Alexander Holcombe, David Mellor, Justin Pickett, Crystal Steltenpohl, Simine Vazire, Kathryn Zeiler

Faculty Scholarship

Fields closely related to empirical legal research are enhancing their methods to improve the credibility of their findings. This includes making data, analysis code, and other materials openly available, and preregistering studies. Empirical legal research appears to be lagging behind other fields. This may be due, in part, to a lack of meta-research and guidance on empirical legal studies. The authors seek to fill that gap by evaluating some indicators of credibility in empirical legal research, including a review of guidelines at legal journals. They then provide both general recommendations for researchers, and more specific recommendations aimed at three commonly …

Can Sandel Dethrone Meritocracy? Comment On M. Sandel's The Tyranny Of Merit, Robert L. Tsai Jan 2021

Can Sandel Dethrone Meritocracy? Comment On M. Sandel's The Tyranny Of Merit, Robert L. Tsai

Faculty Scholarship

This is an invited review essay of Michael Sandel, The Tyranny of Merit: What's Become of the Common Good? (FSG 2020), for the inaugural issue of The American Journal of Law and Inequality (R. Kennedy, M. Minow, C. Sunstein, eds.). Sandel makes three principal arguments: (1) meritocracy is deeply flawed because it worsens inequality and fills meritocracy's winners with hubris and losers with shame; (2) universities should introduce a lottery into the admissions process; and (3) this reform, coupled with increased emphasis on the dignity of labor, will repair the politics of resentment that now roil our country.

Selling Out: An Instrumentalist Theory Of Legal Ethics, Keith N. Hylton Jan 2021

Selling Out: An Instrumentalist Theory Of Legal Ethics, Keith N. Hylton

Faculty Scholarship

Legal ethics has received attention mostly from scholars who view it as a field for the application of moral philosophy. However, economic analysis is also useful in the study of legal ethics, because it can illuminate the incentives that generate ethical dilemmas and controversies. This is especially true in the subfield this paper devotes its attention to, lawyer conflict of interest rules. The problem I focus on is the incentive of the lawyer to "sell out" his client-for example, by providing confidential information to a potential adversary or by providing legal misinformation to the client in order to aid the …

Self-Exciting Point Process For Modelling Terror Attack Data, Siyi Wang Jan 2021

Self-Exciting Point Process For Modelling Terror Attack Data, Siyi Wang

Theses and Dissertations (Comprehensive)

Terrorism becomes more rampant in recent years because of separatism and extreme nationalism, which brings a serious threat to the national security of many countries in the world. The analysis of spatial and temporal patterns of terror data is significant in containing terrorism. This thesis focuses on building and applying a temporal point process called self-exciting point process to fit the terror data from 1970 to 2018 of 10 countries. The data come from the Global Terrorism database. Further, an application in predicting the number of terror events based on the self-exciting model is another main innovative idea, in which …

Exploring The Relationship Between Dog Ownership, Physical Activity, And Mental Health, Stephanie Ho, Jennifer Robertson-Wilson, Mark Eys

Theses and Dissertations (Comprehensive)

The physical and mental health benefits of regular physical activity have been well-documented (e.g., Reiner et al., 2013; White et al., 2017). Additionally, owning a dog is associated with positive health outcomes as owners are encouraged to walk. Dogs are also a source of comfort during stressful times for those in their presence (e.g., Brown & Rhodes, 2006; Westgarth et al., 2017). The aim of this study was to examine the relationship between dog ownership, physical activity, and mental health among the university student population. Over 500 university students completed questionnaires assessing their demographic information, mental health, dog ownership status, …

Park Agency Social Media Communication During The Covid-19 Crisis, Raluca Oprean

Theses and Dissertations (Comprehensive)

The COVID-19 pandemic has affected all industries and organizations, including park agencies. There is a lack of research on how park agencies utilize Twitter during times of crisis, specifically during the COVID-19 pandemic. How park agencies communicate with the public and how they use their social media has not been extensively studied. In addition, the coronavirus pandemic is a novel management issue for these agencies, and there has been no empirical analysis in the ways in which information is being communicated to the public or how that information is being perceived.

This study aims to better understand park agency response …

Three Essays On Addressing Risks Under The Servicizing Business Model, Tina Arabian Jan 2021

Three Essays On Addressing Risks Under The Servicizing Business Model, Tina Arabian

Theses and Dissertations (Comprehensive)

In view of the recent trend to prioritize access to a product over ownership, manufacturers may consider switching from selling their product to servicizing. The benefits of the servicizing business model, under which a firm sells the use or functionality of a product rather than the product itself, extend beyond providing firms with new economic opportunities. It is also recognized as a sustainable business model because it encourages firms and customers to be more conscious of product design and consumption patterns, respectively. Although this business model offers opportunities to the environment and the economy, it entails the risks of product …

What Is Canada Doing? An Analysis Of Canadian University Sexual Violence Policies, Konnor Legault Jan 2021

What Is Canada Doing? An Analysis Of Canadian University Sexual Violence Policies, Konnor Legault

Theses and Dissertations (Comprehensive)

As social awareness of the prevalence of sexual violence on university campuses has increased, it is important to understand the role of university policies in providing protection and support for the campus community and people affected by sexual violence. The purpose of this research is to analyze and compare Sexual Violence Policies (SVP) from four Canadian universities. The analysis evaluates the comprehensiveness of the policies and considers how power, and ideas of power are embedded within SVPs. Findings suggest that policies are at times comprehensive, but may be missing important information, such as including an Objectives section in the policies. …

Let The Punishment Fit The Crime: How Retributive Fairness Perceptions Influence Observers’ Tax Compliance Intentions, Tisha King Jan 2021

Let The Punishment Fit The Crime: How Retributive Fairness Perceptions Influence Observers’ Tax Compliance Intentions, Tisha King

Theses and Dissertations (Comprehensive)

The purpose of my research is to investigate how perceptions of retributive justice influence tax compliance. I address this objective by proposing two research questions: (1) How do taxpayers perceive the propriety of punishment for tax evasion? (2) How and when are observers’ compliance intentions influenced by perceptions of fairness disclosures about a specific retributive outcome, and the presence of a fairness-relevant disclosure?

To address the first research question, I conduct a survey of 331 adult Canadian taxpayers to ascertain the extent to which taxpayers perceive punishments for tax evasion as fair or unfair. I find that an appropriate punishment …

The Sower, The Story & Kingdom Space In The Gospel Of Mark, Susan Lankowski Jan 2021

The Sower, The Story & Kingdom Space In The Gospel Of Mark, Susan Lankowski

Theses and Dissertations (Comprehensive)

The kingdom of God is an ambiguous term that Jesus does not explicitly define. Traditional scholarship has explained the kingdom in terms of its social, cultural and time aspects. Recent scholarship is examining the spatiality of the kingdom of God to uncover its characteristics as a “space.” Spatiality seeks to understand how humans interact with space. Space captures the experience of human life and activity and stories, and storytelling reveal that experience. It is at the intersection of space and storytelling that this project examines the kingdom of God. The Gospel of Mark is a story that grew from an …

Three Essays On Financial Economics, Zhe Peng Jan 2021

Three Essays On Financial Economics, Zhe Peng

Theses and Dissertations (Comprehensive)

Essay 1 deals with a topic in market microstructure. It examines a type of trading mechanism called a speed bump. The speed bump was introduced to slow down incoming orders to reduce the informational advantage of certain high-speed traders who could exploit their information to take advantage of slower traders. In 2016, the Investors Exchange (IEX) became the first securities exchange in the US to introduce a speed bump. In our first essay, we use trading data from IEX to study this issue. IEX's speed bump includes two layers of delays: a fixed delay on displayed orders and a contingent …

The Lived Experiences Of Developmental Disability Caregivers And Service Providers In Ontario, Tetyana Ali

Theses and Dissertations (Comprehensive)

Providing care for children with developmental disabilities (CwDD) is complex and is a life-long journey. Caregivers (CGs) of CwDD experience higher levels of stress, declining mental and physical health, feelings of isolation, diminished financial outcomes, and an overall lower quality of life. Additionally, they often face marginalization and numerous barriers when trying to access funding and supports. This study explored the experiences of CGs of CwDD in the context of Ontario and included the perspectives of CGs and service providers (SPs) to investigate the role the government played in CGs ability to provide adequate care.

Twenty participants were recruited through …

Evaluating Employees’ Experiences In Implementing Covid-19 Safety Protocols In Ontario Parks, Jessica Kaatz Jan 2021

Evaluating Employees’ Experiences In Implementing Covid-19 Safety Protocols In Ontario Parks, Jessica Kaatz

Theses and Dissertations (Comprehensive)

The COVID-19 pandemic has created a wide range of public health challenges for park management and staff in Ontario. Green spaces have become a source of resilience during the spread of the virus, partly due to their proven positive impacts on social, mental and physical well-being. With the introduction of social distancing protocols, utilization of Personal Protective Equipment (PPE), and standardizing constant sanitation efforts, park employees are more responsible than ever for the daily implementation of rules governing park safety and security. At the same time, increased visitor numbers and continually changing government protocols that varied between regional jurisdictions have …

A Tale Of Two Tweets: What Factors Predict Forgiveness Of Past Transgressions On Social Media?, Andrew Dawson Jan 2021

A Tale Of Two Tweets: What Factors Predict Forgiveness Of Past Transgressions On Social Media?, Andrew Dawson

Theses and Dissertations (Comprehensive)

As more and more of our lives take place online, we are developing a very public and permanent record of our past views and actions. It is increasingly common for public figures to have their current image tarnished by their mistakes and transgressions in what is often the distant past. Although factors such as the passage of time and age of the actor are typically given consideration in moral judgement, they may be swept away by identity and politics when the transgressions are viewed along partisan lines. Three experiments (N = 2,018) found that judgements of a public figure …

Differential Patterns Of Microbiota Recovery In Symbiotic And Aposymbiotic Corals Following Antibiotic Disturbance, Shavonna M. Bent, Carolyn A. Miller, Koty H. Sharp, Colleen M. Hansel, Amy Apprill

Arts & Sciences Faculty Publications

Microbial relationships are critical to coral health, and changes in microbiomes are often exhibited following environmental disturbance. However, the dynamics of coral-microbial composition and external factors that govern coral microbiome assembly and response to disturbance remain largely uncharacterized. Here, we investigated how antibiotic-induced disturbance affects the coral mucus microbiota in the facultatively symbiotic temperate coral Astrangia poculata, which occurs naturally with high (symbiotic) or low (aposymbiotic) densities of the endosymbiotic dinoflagellate Breviolum psygmophilum. We also explored how differences in the mucus microbiome of natural and disturbed A. poculata colonies affected levels of extracellular superoxide, a reactive oxygen species thought to …

Phase Formation And Thermal Conductivity Of Zirconium Carbide, Yue Zhou Jan 2021

Phase Formation And Thermal Conductivity Of Zirconium Carbide, Yue Zhou

Doctoral Dissertations

“This research focused on the synthesis and phase formation of zirconium carbide with different carbon contents, and lattice thermal conductivity of zirconium carbide with different carbon vacancy, hafnium, and oxygen contents.

Nominally pure phase ZrCx was synthesized by solid-state reaction of zirconium hydride (ZrHs) and carbon black at a temperature as low as 1300°C. The powder synthesized at 1300C was carbon deficient ZrCx . Carbon stoichiometry of the as- synthesized powders increased as the synthesis temperature increased. As the synthesis temperature increase, the oxygen content of ZrCx decreased due to the increasing C site occupancy. Low stoichiometry …

Critical Behavior In Evolutionary And Population Dynamics, Stephen Walter Ordway Jan 2021

Critical Behavior In Evolutionary And Population Dynamics, Stephen Walter Ordway

Doctoral Dissertations

“This study is an exploration of phase transition behavior in evolutionary and population dynamics, and techniques for predicting population changes, across the disciplines of physics, biology, and computer science. Under the looming threat of climate change, it is imperative to understand the dynamics of populations under environmental stress and to identify early warning signals of population decline. These issues are explored here in (1) a computational model of evolutionary dynamics, (2) an experimental system of decaying populations under environmental stress, and (3) a machine learning approach to predict population changes based on environmental factors. Through the lens of critical phase …

Incoherent Radar Imaging For Breast Cancer Detection And Experimental Validation Against 3d Multimodal Breast Phantoms, Antonio Cuccaro, Angela Dell'aversano, Giuseppe Ruvio, Jacinta Browne, Raffaele Solimene Jan 2021

Incoherent Radar Imaging For Breast Cancer Detection And Experimental Validation Against 3d Multimodal Breast Phantoms, Antonio Cuccaro, Angela Dell'aversano, Giuseppe Ruvio, Jacinta Browne, Raffaele Solimene

Articles

: In this paper we consider radar approaches for breast cancer detection. The aim is to give a brief review of the main features of incoherent methods, based on beam-forming and Multiple SIgnal Classification (MUSIC) algorithms, that we have recently developed, and to compare them with classical coherent beam-forming. Those methods have the remarkable advantage of not requiring antenna characterization/compensation, which can be problematic in view of the close (to the breast) proximity set-up usually employed in breast imaging. Moreover, we proceed to an experimental validation of one of the incoherent methods, i.e., the I-MUSIC, using the multimodal breast phantom …

Raman spectroscopy can provide a rapid, label-free, nondestructive measurement of the chemical fingerprint of a sample and has shown potential for cancer screening and diagnosis. Here we report a protocol for Raman microspectroscopic analysis of different exfoliative cytology samples (cervical, oral and lung), covering sample preparation, spectral acquisition, preprocessing and data analysis. The protocol takes 2 h 20 min for sample preparation, measurement and data preprocessing and up to 8 h for a complete analysis. A key feature of the protocol is that it uses the same sample preparation procedure as commonly used in diagnostic cytology laboratories (i.e., liquid-based cytology …

Health Information Beyond Pandemic Emergencies: Privacy For Social Justice, Leslie Francis Jan 2021

Health Information Beyond Pandemic Emergencies: Privacy For Social Justice, Leslie Francis

American University Law Review

The COVID-19 pandemic has forcefully revealed the critical importance of timely information to identify emerging infections, discern patterns of disease, and stop disease spread. Information about individuals both as patients, and as ordinary people in the world is necessary for each of these tasks. Yet the implications for information use and efforts to achieve social justice are significant.

This Article first surveys information needs as revealed by the pandemic. It then articulates different normative approaches to privacy and confidentiality to develop two implications for privacy and justice: that information gleaned in clinical care and information possessed by public health should …

Congressional Surveillance, Aaron R. Copper Jan 2021

Congressional Surveillance, Aaron R. Copper

American University Law Review

In recent years, Congress has increasingly used electronic surveillance in high profile investigations. Reactions to what this Article calls “congressional surveillance” indicate a deep unease among both legal scholars and the broader public about the nature of Congress’s surveillance authority and its normative implications. Despite our ongoing preoccupation with government surveillance, congressional surveillance remains largely unexplored. There is virtually no discussion of how congressional surveillance is treated under key statutory and Fourth Amendment constraints; no consideration of the process or political limits of congressional surveillance; and little scrutiny of congressional surveillance as a tool within the separation of powers.

Who Killed The Radio Star? How Music Blanket Licensing Distorts The Production Of Creative Content In Radio, Ariel Katz, Eden Sarid Jan 2021

Who Killed The Radio Star? How Music Blanket Licensing Distorts The Production Of Creative Content In Radio, Ariel Katz, Eden Sarid

American University Law Review

According to popular and scholarly belief, video killed the radio star. The golden age of radio, culminating in the 1930s and 1940s, was gone with the rise of television in the 1950s and 1960s. In this Article, we advance the claim that television’s role in the “death” of the radio star has been more limited than commonly believed. A major culprit, we argue, is the common licensing practice of musical content for broadcasting, or more precisely, the blanket license issued by copyright collective management organizations (CMOs). By setting a zero marginal price for broadcasting additional songs from the CMO’s repertoire, …
