A New Era Of Legal Services: The Elimination Of Unauthorized Practice Of Law Rules To Accompany The Growth Of Legal Software, Julian Moradian
A New Era Of Legal Services: The Elimination Of Unauthorized Practice Of Law Rules To Accompany The Growth Of Legal Software, Julian Moradian
William & Mary Business Law Review
Since the inception of bar associations in the early twentieth century, states have promulgated rules that prohibit unlicensed individuals from providing legal services. These unauthorized practice of law rules have created a monopoly on legal services, which in turn has inflated the price of obtaining legal services to a point where a significant percentage of individuals who need such services are unable to obtain them. Legal software has the potential to disrupt the market for legal services and make such services available to the mass market. However, for innovation and widespread use of legal software to gain traction, these unauthorized …

“Until We Are First Recognized As Humans”: The Killing Of George Floyd And The Case For Black Life At The United Nations, Balthazar I. Beckett, Salimah K. Hankins
International Journal of Human Rights Education
Following the brutal killing of George Floyd in Minneapolis on May 25, 2020, members of the human rights movement in the United States understood instantly that justice within the American legal system, which has a long history of shielding police officers and racist vigilantes from prosecution, was anything but certain. To enhance the chances of having the individual officers (Derek Chauvin, J. Alexander Kueng, Thomas Lane, and Tou Thao) prosecuted for Floyd’s death, but also to have demands for systemic change heard and amplified, the United States Human Rights Network (USHRN) and the American Civil Liberties Union (ACLU) worked with …

Explaining The Economic Impact Of Covid-19: Core Industries And The Hispanic Workforce, Aaron Klein, Ember Smith
Explaining The Economic Impact Of Covid-19: Core Industries And The Hispanic Workforce, Aaron Klein, Ember Smith
Policy Briefs and Reports
As the United States prepares for a COVID-19 recovery, policymakers need to understand why some cities and communities were more vulnerable to the pandemic’s economic consequences than others. In this paper, we consider the association between a city’s core industry, its economic susceptibility to the pandemic, and the recession’s racially disparate impact across six select metropolitan areas. We find that areas with economies that rely on the movement of people—like Las Vegas with tourism—faced substantially higher unemployment at the end of 2020 than cities with core industries based on the movement of information. Further, we find the hardest-hit areas have …

The Needs Of Helping Organizations In The Community, Ab Currie
The Needs Of Helping Organizations In The Community, Ab Currie
Canadian Forum on Civil Justice
In access to justice, needs are ordinarily conceived in terms of individuals experiencing legal problems requiring assistance from someone with expertise and resources to resolve that problem. Legal problems studies have pointed out the vast number of problems with possible legal aspects experienced by members of the public. In Canada, repeated national surveys have estimated that about half of all adult Canadians will experience one or more problems within a three-year period. This amounted to more than 11 million people estimated by the most recent Canadian study and a greater number of problems because some people experience multiple problems.1 This …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Data-centric technology has not undergone widespread adoption in production agriculture but could address global needs for food security and farm profitability. Participants in the U.S. Department of Agriculture (USDA) National Institute for Food and Agriculture (NIFA) funded conference, “Identifying Obstacles to Applying Big Data in Agriculture,” held in Houston, TX, in August 2018, defined detailed scenarios in which on-farm decisions could benefit from the application of Big Data. The participants came from multiple academic fields, agricultural industries and government organizations and, in addition to defining the scenarios, they identified obstacles to implementing Big Data in these scenarios as well as …

In this contribution, as part of the Indian Feminist Judgement Project, we reconsider the decision of the Supreme Court of India in the Charan Lal Sahu case that followed the Bhopal gas leak tragedy. We present a dissenting opinion on the case, finding that the law empowering the State to supplant the victim-survivors as plaintiffs was unconstitutional. Alongside, we offer a brief commentary on why this finding comports with what a feminist judge on the bench might have decided. We consider a variety of ways in which feminist criticism of the majority decision might proceed, and how this criticism informs …

Chaos Or Continuity? The Legal Profession: From Antiquity To The Digital Age, The Pandemic, And Beyond, Jan L. Jacobowitz
Vanderbilt Journal of Entertainment & Technology Law
The idea of individuals entering into a social contract to relinquish some of their rights in order to have a civilized society protect their fundamental rights originates at least as early as ancient Greece, where it was espoused by the philosopher Epicurus. Implicit in a social contract is the enactment of laws to achieve a democratic, civilized society and the concept of advocacy. Advocacy exists to protect an individual’s rights. The legal profession originated organically as the citizens of ancient Greece and Rome recognized the need for professional advocates. From this nascent beginning, the legal profession has evolved over centuries …

Do Innovative Firms Communicate More? Evidence From The Relation Between Patenting And Management Guidance, Sterling Huang, Jeffrey Ng, Tharindra Ranashinghe, Mingyue Zhang
Do Innovative Firms Communicate More? Evidence From The Relation Between Patenting And Management Guidance, Sterling Huang, Jeffrey Ng, Tharindra Ranashinghe, Mingyue Zhang
Research Collection School Of Accountancy
Successful innovations could induce more disclosure if the information asymmetry between the firm and its investors about post-innovation outcomes leads investors to demand more information. However, such innovations also likely entail greater proprietary cost concerns, which deter disclosure. This paper uses patent grants to examine the effect of innovation success on management guidance behavior. We find that more management guidance follows patent grants, suggesting that despite disclosure cost concerns, firms with successful innovations do respond to information demand. This association is stronger after enactment of Regulation Fair Disclosure and for firms with greater institutional investor ownership, further highlighting the role …
