Overdose Prevention Sites Placement Informed By Simulation, Jing Dong
Overdose Prevention Sites Placement Informed By Simulation, Jing Dong
Honors Theses
In Philadelphia, people are experiencing the greatest opioid crisis in a century. Plac- ing the Overdose Prevention Site (OPS) can alleviate this crisis. However, the journey to the successful launch of the first OPS in the USA is rough. It was first accused of having a collision with federal drug laws. While Safehouse won the lawsuit and the OPS was judged to be legal in 2020, other pressure rose afterward such as the against from the public and the COVID19, which delayed the plan to open the OPS. Without solid research on the effectiveness of OPS, we thought it is …

Multijurisdictional Practice And Transactional Lawyers: Time For A Rule That Is Honored Rather Than Honored In Its Breach, James Geoffrey Durham, Michael H. Rubin
Louisiana Law Review
Model Rule 5.5 of the American Bar Association’s Model Rules of Professional Conduct1 addresses two interrelated issues: the unauthorized practice of law, which applies to lawyers and nonlawyers alike, and multijurisdictional practice, which applies to lawyers who are licensed to practice in one state but whose work may involve or take them to states where they are not licensed.

In-Person Vs Telephonic Interpretation: A Case Study From The Perspective Of Providers And Interpreters At A Virginia Free Clinic, Lucy Cummins
Honors Theses
High-quality medical interpretation is critical to ensuring that patients with limited English proficiency, a rapidly growing group in the US, receive equitable care. Today, as federally-funded hospitals and clinics are legally required to offer language services, a myriad of interpretation options are available and used by providers across the country, including both telephone and in-person interpreters. Though these two options both allow for translation of dialogue between patients and providers, they differ in the communicative and interpersonal experiences they offer.

Understanding The Nature And Dimensions Of Litigation Crowdfunding: A Visual Analytics Approach, Viju Raghupathi, Jie Ren, Wullianallur Raghupathi
Publications and Research
The escalating cost of civil litigation is leaving many defendants and plaintiffs unable to meet legal expenses such as attorney fees, court charges and others. This significantly impacts their ability to sue or defend themselves effectively. Related to this phenomenon is the ethics discussion around access to justice and crowdfunding. This article explores the dimensions that explain the phenomenon of litigation crowdfunding. Using data from CrowdJustice, a popular Internet fundraising platform used to assist in turning legal cases into publicly funded social cases, we study litigation crowdfunding through the lenses of the number of pledges, goal achievement, target amount, length …

Take Note: Teaching Law Students To Be Responsible Stewards Of Technology, Kristen E. Murray
Take Note: Teaching Law Students To Be Responsible Stewards Of Technology, Kristen E. Murray
Catholic University Law Review
The modern lawyer cannot practice without some deployment of technology; practical and ethical obligations have made technological proficiency part of what it means to be practice-ready. These obligations complicate the question of what constitutes best practices in law school.
Today’s law schools are filled with students who are digital natives who don’t necessarily leverage technology in maximally efficient ways, and faculty who span multiple generations, with varying amounts of skepticism about modern technology. Students are expected to use technology to read, prepare for class, take notes, and study for and take final exams. Professors might use technology to teach or …

By inviting thought leaders across the world and in different disciplines, ranging from privacy, contract law, and torts to governance and policy, this book goes beyond abstract and general philosophical observations on matters that concern practitioners. This practical approach has generated a wide range of global perspectives, which are refreshingly novel and timely for what are increasingly global issues. …
Remote Court: Principles For Virtual Proceedings During The Covid-19 Pandemic And Beyond, Alicia L. Bannon, Douglas Keith
Remote Court: Principles For Virtual Proceedings During The Covid-19 Pandemic And Beyond, Alicia L. Bannon, Douglas Keith
Northwestern University Law Review
Across the country, courts at every level have relied on remote technology to adapt the justice system to a once-a-century global pandemic. This Essay describes and assesses this unprecedented journey into virtual justice, paying particular attention to eviction proceedings. While many judges have touted remote court as a revolutionary innovation, the reality is more complex. Remote court has brought substantial time savings and convenience to those who are able to access and use the required technology, but it has also posed hurdles to individuals on the other side of the digital divide, particularly self-represented litigants. The remote court experience has …
The Rescue Of American International Group Module A: The Revolving Credit Facility, Alec Buchholtz, Aidan Lawson
The Rescue Of American International Group Module A: The Revolving Credit Facility, Alec Buchholtz, Aidan Lawson
Journal of Financial Crises
On September 15, 2008, the big three rating agencies downgraded AIG’s credit ratings multiple levels, exacerbating liquidity strains that the company was experiencing due to increasing cash demands by securities borrowers and collateral calls by credit default swap (CDS) customers. To prevent AIG from filing for bankruptcy, the Federal Reserve (the Fed) announced on the following day that, pursuant to its emergency powers, it would provide the company with an $85 billion Revolving Credit Facility (RCF). The RCF was secured by AIG assets and interests in its subsidiaries and required AIG to grant the US Department of the Treasury a …
Employment Arbitration Agreements: The Case For Ethical Standards For Dispute Resolution System Designers, Michael L. Russell
Employment Arbitration Agreements: The Case For Ethical Standards For Dispute Resolution System Designers, Michael L. Russell
Pepperdine Dispute Resolution Law Journal
Dispute resolution design is an emerging field, both academically and professionally. Attorneys, mediators, and arbitrators, the other roles in the alternative dispute resolution process, have codes of ethics which guide their conduct. Dispute resolution designers, however, have no such guidelines. This article uses the example of mandatory arbitration agreements in the employment context to illustrate why this lack of ethical guidelines for dispute resolutions designers is problematic. In recent years, mandatory arbitration agreements significantly impacted employment law and litigation. The two most problematic provisions that often appear in mandatory arbitration agreements in the workplace context are cost sharing provisions and …
When Accessing Justice Requires Absence From The Courthouse: Utah’S Online Dispute Resolution Program And The Impact It Will Have On Pro Se Litigants, Julianne Dardanes
When Accessing Justice Requires Absence From The Courthouse: Utah’S Online Dispute Resolution Program And The Impact It Will Have On Pro Se Litigants, Julianne Dardanes
Pepperdine Dispute Resolution Law Journal
According to the 2017 Justice Gap Report conducted by Congress’s non-profit Legal Services Corporation (LSC), eighty-six percent of civil legal issues involving low-income Americans received scant or no legal assistance. The number of unrepresented (“pro se”) litigants continues to rise, with low-income Americans constituting a significant portion of this population. Due to the inefficiency of socioeconomically challenged litigants appearing pro se, this article proposes implementing Utah’s court-mandated Online Dispute Resolution (ODR) program as a solution nation-wide. Utah’s ODR program for small claims is revolutionary because it is the first ODR system able to handle an entire dispute instead of only …

Why Don't We All Just Wear Robes?, Ruthann Robson
Why Don't We All Just Wear Robes?, Ruthann Robson
Journal of Civil Rights and Economic Development
(Excerpt)
Lawyers and law professors select our professional outfits each day, often experiencing a mix of consternation and gratification. The dread springs from our failures: to know what constitutes the “right look;” to be able to achieve that “right look;” to anticipate what the day will bring; to have prepared by doing the laundry or other tasks. The joy resides in self-expression; we fashion ourselves as works of art, even within the constraints of professional attire.
It could have been different. We could have sacrificed the satisfaction of self-expression for the complacency of conformity; we could wear robes. Judges—at least …
