A Reasonable Possibility Of Refoulement: The Inadequacies Of Procedures To Protect Vulnerable Noncitizens From Return To Persecution, Torture, Or Death, Lexie Marilyn Ford

Due primarily to increases in individuals fleeing violence and turmoil in Central America, over 40% of noncitizens arriving in the United States are put on a fast-track removal process and subsequently claim fear of returning to their home countries. A decade ago, the number was only 5%. This influx of asylum-seekers at the border has led to tension between those who wish to protect them and those who view such migrants as “invaders.” In 2019 and 2020, the Trump Administration proffered sweeping regulatory changes with the aim to substantively and procedurally restrict noncitizens’ access to protection from persecution and torture …

Sites of incarceration present stress tests to our theories and practices of administrative law. They yield insights, too, into how law distributes power across the administrative state. While studying administrative law as prison law reveals certain distinctions between the law that rules in prisons and everyday administrative state operations, it also reveals continuities—for instance, between the surveillance and control characterizing prisons and the routine surveillance and control that police, child welfare, social assistance, mental health, and public health authorities concentrate upon Indigenous, Black, disabled, and poor people in ways that produce and reproduce subordination and disproportionate incarceration. This article explores the role that a generalist externship seminar can play in teaching law students about the legal profession - lawyers, the institutions in which they practice, and the markets for their services. After reviewing the evolution of the externship course and externship seminar in the legal curriculum, the article turns to a discussion of the absence of opportunities at most law schools for students to study and learn about the legal profession. An Approach To Preventing Conflict: Unpacking The Standing Neutral, Dan Bumblauskas,, Kate Vitasek, Jim Groton

Contractual relationships are vulnerable to the damage caused by friction in relationships, particularly when this turns into a formal dispute. If negotiations fail, the next step is calling in a mediator, and perhaps ending up in arbitration or the court system. This paper argues for the proactive use of a “Standing Neutral” – a trusted, independent expert advisor (or a panel of three advisors) chosen by the contracting parties to help during their contractual relationship. Community Economic Development (CED) clinicians regularly address issues surrounding economic, racial, and social justice, as those are the core principles motivating their work to promote vibrant, diverse, and sustainable communities. When COVID-19 arrived, and heightened attention to police brutality and racial injustice ensued, CED clinicians focused not only on how to begin to address these issues in their clinics, but on how to discuss these issues more deeply and effectively with their students. The purpose of this paper was to contextualize the intersectionality of racism, globalization, climate change, and forced immigration. The paper focuses on conversations from numerous organizations and individuals working to deal with the aforementioned challenges. In addition to highlighting the challenges faced by many immigrants, or would-be immigrants, the paper pinpoints approaches being adopted by community organizations and social movements to end persecution and forced migration. Poverty, Gender, and Youth

With the COVID-19 crisis continuing to evolve, evidence on the effectiveness of short-term emergency-oriented responses and long-term mitigation strategies is expanding but still limited. There are, and will continue to be, substantial evidence gaps on programming to address risk across outcomes of importance to adolescent girls. More evidence is needed to slow the risks posed by the pandemic for this subpopulation, which can help guide gender- and age-responsive prevention and impact mitigation investments. Evidence from approaches delivered in other unstable contexts may offer important lessons for decision-making in the current context. The Informed Consent Doctrine In Legal Malpractice Law, Vincent R. Johnson

St. Mary's Journal on Legal Malpractice & Ethics

The doctrine of informed consent is now deeply embedded into the law of legal ethics. In legal malpractice litigation, the doctrine holds that a lawyer has a duty to disclose to a client material information about the risks and alternatives associated with a course of action. A lawyer who fails to make such required disclosures and fails to obtain informed consent is negligent, regardless of whether the lawyer otherwise exercises care in representing a client. If such negligent nondisclosures cause damages, the lawyer can be held accountable for the client’s losses.

Lawyers have been implicated in corporate scandals and other client crimes or frauds all too often, and the complicity of some lawyers is troubling both to the public and to members of the legal profession. This is especially true when the crime involved is money laundering. In response to the COVID-19 outbreak, law firms conformed their activities to the Centers for Disease Control and Prevention (CDC), Occupational Safety and Health Administration (OSHA), and state health authority guidelines by immediately reducing the size of gatherings, encouraging social distancing, and mandating the use of protective gear. These changes necessitated the expansion of law firm remote operations, made possible by the increased adoption of technological tools to coordinate workflow and administrative tasks, communicate with clients, and engage with judicial and governmental bodies.
