Beginning in 2019, Chile saw a new wave of large scale protests termed the Estallido Social in response to the consequences of the Augusto Pinochet dictatorship and the persistence of social inequality upheld by neoliberal economic expansion. This thesis explores the use of street art in the Chilean Estallido Social Protests and the ways in which it functions as a form of emancipatory journalism. The traditional means of mass communications in Chile are rooted in neocolonial and corporate interests, and are thus a limited means for disseminating information concerning political action against the present administration and its interests. Food waste represents significant amounts of money, energy, and natural resources throughout its lifecycle from production to disposal. Diverting the quantity of food waste sent to landfills is necessary to address the growing strain on resources and reduce greenhouse gas emissions. This study was a collaborative effort between the City of Oberlin and Oberlin College designed to identify challenges and benefits to establishing a pilot municipal composting program. Establishing a citywide composting program will help Oberlin achieve its goal of carbon neutrality. As social justice advocates rejoice over Donald Trump’s defeat and look for paths forward, the biggest lesson comes from the 2020 presidential election itself. The right to vote is “preservative of all other rights[,]” and this past year underscored its importance more than ever. In the midst of the COVID-19 pandemic, high voter turnout—and especially high Black voter turnout—propelled Joe Biden to victory. Even as the Electoral College and partisan gerrymandering continue to undermine the popular will, America’s changing demographics favor people of color and progressives. This thesis examines the forces and factors that gave rise to environmental justice movements surrounding the Port of Los Angeles in the early 21st Century. Through the spatial, economic, and migratory factors that shaped the region of Southeast Los Angeles, this thesis brings to light important tensions between port authorities, politicians, labor groups, employees, and communities that determined the economic and environmental fate of the region. Systemic Racism, The Government's Pandemic Response, And Racial Inequities In Covid-19, Ruqaiijah Yearby, Seema Mohapatra

During the COVID-19 pandemic, federal and state governments have disregarded racial and ethnic minorities’ unequal access to employment and health care, which has resulted in racial inequities in infections and deaths. In addition, they have enacted laws that further exacerbate these inequities. Consequently, many racial and ethnic minorities are employed in low-wage essential jobs that lack paid sick leave and health insurance. This lack of benefits causes them to go to work even when they are sick and prevents them from receiving appropriate medical treatment. As a result, racial and ethnic minorities have disproportionately been infected and died from COVID-19. …

This chapter offers an outline for understanding the key role of race in producing property values in the history of the American property law system. It identifies major developments in the mutually formative relationship between race and property in America that made and remade property interests in America through the processes of 1) dispossessing nonwhites, 2) degrading their homelands, communities, and selves, and 3) limiting their efforts to enter public space and occupy or acquire property within the regime thereby established. The Toxic Crusaders: Exploring The History Of The Criminal Enforcement Of The Toxic Substances Control Act, Joshua Ozymy, Melissa L. Jarrell

Mitchell Hamline Law Journal of Public Policy and Practice

The criminal prosecution of defendants who violated federal laws governing chemical substances has been ongoing for roughly four decades. Yet we continue to have a poor understanding of how federal prosecutors use the U.S. Toxic Substances Control Act (TSCA) to charge and prosecute environmental criminals. Through content analysis of all the Environmental Protection Agency’s (EPA) criminal prosecution case summaries from 1983 to 2019, we analyze all TSCA-focused prosecutions for two purposes. First, to gain a better historical understanding of how federal prosecutors have used TSCA as a prosecutorial tool. Second, to understand outcomes of those prosecutions. Results show that 38% …

In recent years, much has been written about trust principles as a useful lens through which to view environmental obligations – particularly with respect to the obligations of the present generation to those who will live in the generations to come.
Underlying much of this discussion is the ancient principle of the public trust doctrine as a vehicle for meeting that intergenerational responsibility. However, while trust theory enjoys an impressive legal pedigree, it has not gained as much traction in American environmental law as might be effective for addressing contemporary environmental issues.

The field of criminology continues to give little attention to the behaviors and crimes that adversely impact the environment although decades of research has highlighted these crimes result in greater social harms, losses, and deaths compared to traditional street crimes. Moreover, these crimes are met with little consequences despite several laws and regulations charged with protecting the environment and public welfare. This Article evaluates the strategy of claiming personhood for natural objects as a way to advance environmental goals in the United States. Using the Colorado River Ecosystem v. Colorado litigation as the focus, we explore the normative foundation of the claim—elements of nature are legal persons—and the work personhood is being asked to do by the plaintiff and other environmental activists. We identify three possibilities: procedural work, substantive work, and rhetorical work. Of those, we suggest the plaintiff’s strongest case is rhetorical. As climate change leads to both internal displacement and mass migrations, we need not only new places for people to live but also new locations for infrastructure projects and other public needs. Some of the most attractive areas for these new land uses are currently unoccupied land, including land set aside for conservation. Numerous laws restrict the availability and possible uses of public conservation land. Individual agreements and property restrictions encumber private conservation land, varying in the ease with which the restrictions can be modified. Writing about experiences as a white, middle-class Madwoman, this dissertation explores the intersections between Mad studies and EcoJustice education using an arts-based, specifically poetic inquiry and fiction-based research, and autoethnographic approach. Weaving together the creative and academic, this writing is combined memoir, fiction, poetics, and theory on living Mad in a saneist, anthropocentric culture. The Meat of the Gothic: Animality and Social Justice in United States Fiction and Film of the Twenty-First Century— situates twenty-first century US gothic narratives in relation to animal studies, even as it illuminates how these narratives interrogate the effects of historic and ongoing global systems of human oppression: slavery, imperialism, and capitalism. Instead of reacting to bias by asserting a claim to a humanity perpetually imbricated in divisions of class, race, and gender, present-day authors and filmmakers create characters who form communities that include nonhuman actors as a means of generating empowerment and critique. This thesis situates Zora Neale Hurston and the folk communities in her oeuvre within the context of modernity’s dependencies on fossil fuels. Such a disciplinary context provides an energy footing for our understandings of African American migrations in the twentieth century—which radically transformed the nation on multiple levels—and it illuminates the communal values that undergird Black approaches to petromodern forms of mobility. Furthermore, by engaging the Black spaces of the South, my argument begins filling a gap in the energy humanities. One of the biggest challenges with international law remains its enforcement. This challenge grows when it comes to enforcing international law norms against corporations and other business organizations. The United Nations Guiding Principles recognizes the “corporate responsibility to respect human rights,” which includes human rights due diligence practices that are adequate for “assessing actual and potential human rights impacts, integrating and acting upon the findings, tracking responses, and communicating how impacts are addressed.” Unfortunately, many corporations around the world are failing to implement adequate human rights due diligence practices in their supply chains. For over a decade the Roundtable on the Crown of the Continent – a landscape-scale collaborative conservation network– has convened and connected people together to enhance conservation, culture, and community in the Crown of the Continent region. After years of conferences, workshops, and projects, participants have expressed a need to take stock of the difference that the network has made. This paper shares the results of an evaluation that used both qualitative and quantitative methods to assess the social impacts the Roundtable has generated for active participants.
