Changing Consultation, Elizabeth Kronk Warner, Kathy Lynn, Kyle Whyte Mar 2021

Changing Consultation, Elizabeth Kronk Warner, Kathy Lynn, Kyle Whyte

Tribal Consultation Project Work

Examples abound of both historic and modern situations where the federal government and tribes failed to engage in effective consultation. Yet, numerous reasons exist—such as effective management of natural resources and the negative impacts of climate change—for tribes and the federal government to engage in effective consultation. Effective consultation can be met through strong government-to-government relationships between Indian tribes and federal agencies and should be based on respect, mutual understanding, and common goals. This can be accomplished through interactions that will enhance consultation and provide other pathways to achieving a strong government-to-government relationship. To date, however, many within Indian country …

City Of Lynwood Tree Canopy Prioritization, Center For Urban Resilience, Treepeople, Gateway Cities Council Of Governments)

Center for Urban Resilience Reports

EXECUTIVE SUMMARY

The Loyola Marymount University Center for Urban Resilience (CURes), TreePeople, and the Gateway Cities Council of Governments partnered to conduct a tree canopy prioritization in the City of Lynwood. This process utilized high resolution, high accuracy tree canopy data as a foundation to engage the public in identifying their priorities for tree planting in the city.

Analysis of tree canopy data acquired through a previous project between CURes and TreePeople showed that the City of Lynwood has 16% existing tree canopy cover. The analyses also found that Lynwood has great opportunity to increase its tree canopy, with 41% …

Sea Level Rise Adaptation Plan For Transportation Infrastructure And Other Critical Resources In The Eureka Slough Hydrographic Area, Humboldt Bay, Ghd, Environmental Science Associates, Northern Hydrology & Engineering, Philip King And Kristina Kunkel (San Francisco State University), Redwood Community Action Agency, Trinity Associates

Local Reports and Publications

This plan (study) presents a framework for developing sea level rise adaptation strategies within the highly vulnerable Eureka Slough hydrographic area of Humboldt Bay. The purpose of the study was to work with public agencies, landowners, scientists, and stakeholders to better understand the specific flood risks to the transportation infrastructure and other critical resources within the study area and to identify viable adaptation measures in the near-term planning horizon (now through mid-century) for the most at-risk locations. A primary focus of the study was to develop a scenario-based planning approach for understanding the range of possible impacts and consequences resulting …

Supplemental Environmental Projects: Dojs March 2020 Policy Showed The Downfalls Of A Ban, Madeline Mckernan Mar 2021

Supplemental Environmental Projects: Dojs March 2020 Policy Showed The Downfalls Of A Ban, Madeline Mckernan

The Business, Entrepreneurship & Tax Law Review

In March of 2020, the Department of Justice (“DOJ”) adopted a policy that bars the use of supplemental environmental projects (“SEPs”) in settlements of environmental enforcement suits. A ban on SEPs can drastically impact both companies and the environment. The DOJ repeatedly rolled back the use of SEPs during the Trump Administration, but President Biden reversed the ban placed on SEPs in March 2020 under the previous administration. SEPs have long been used in environmental enforcement suits and have been extremely useful in the settlement process by giving companies more options when entering into settlement agreements, making settlements easier for …

A “First And Last-Mile” Assessment Of California Rail Stations: A Sketch Planning Approach, Henry Mckay Mar 2021

A “First And Last-Mile” Assessment Of California Rail Stations: A Sketch Planning Approach, Henry Mckay

City and Regional Planning

The purpose of this study is to assess the pedestrian and bicycle accessibility of rail stations in California by providing a sketch planning toolkit enabling planners and decision-makers to compare various accessibility factors and to develop and compare metrics.

Pedestrian and Bicycle Accessibility is a highly important area of transportation planning, especially as it pertains to rail stations. While a well-planned rail network can serve many people, travelers must get to and from rail stations on either end of their trip in order for the rail service to be of any use. The mode by which travelers make these trips …

Laudato Si’ – A Macromarketing Manifesto For A Just And Sustainable Environment, Thomas A. Klein, Gene R. Laczniak

Marketing Faculty Research and Publications

This paper posits that Pope Francis’ 2015 encyclical on environmental climate change, Laudato si’ (“Praise be to you, my Lord”), or LS for short, provides a compelling and multi-faceted framework for co-creating a just and sustainable environment. LS includes considerable commentary about how markets and marketing impact the physical and social environment. Additionally, the document provides religion-inspired ethical norms for market conditions, actions, and performance that reflect both (a) the social teachings of the Catholic Church as they have evolved over the past 125 years and, as we will explain, (b) a foundational predicate of macromarketing scholarship – that is, …

Indigenous Environmental Justice And Sustainability, Deborah Mcgregor Mar 2021

Indigenous Environmental Justice And Sustainability, Deborah Mcgregor

Articles & Book Chapters

This chapter offers an alternative vision for sustainable futures involving self-determined Indigenous environmental justice (EJ). It builds upon a distinct understanding of Indigenous EJ which asserts that the components necessary for Indigenous EJ are Indigenous knowledge systems, legal orders, and conceptions of justice that have existed for thousands of years.1 This contribution will also offer preliminary thoughts on the need to decolonize internationally adopted conceptions of sustainable development expressed more recently through the post-2015 United Nations sustainable development agenda. Indigenous environmental injustice is very much an outcome of “unsustainable” and detrimental “development,” as well as gross violations of human and …

Risk Perception Of A Major Earthquake Event At The Cascadia Subduction Plate Boundary, Amanda M. Watson, Dawn Cardace Mar 2021

Risk Perception Of A Major Earthquake Event At The Cascadia Subduction Plate Boundary, Amanda M. Watson, Dawn Cardace

Research Papers by Undergraduate Students (Geosciences)

The Cascadia Subduction Zone (CSZ) is a tectonic plate boundary that is located about 64 to 128 kilometers off the west coast from Northern California to Vancouver Island, British Columbia (Cascadia Region Earthquake Workgroup, 2013). Subduction faults are on a cycle of a pressure build up then quick release, materializing as a megathrust earthquake. These faults have the potential to produce earthquakes of the highest magnitude. Paleoseismic studies and Native American oral history have proved that the last CSZ earthquake occurred in 1700 and likely had a magnitude of 9.0 (Finkbeiner, 2015, Nelson et al., 2006). Most probability analyses suggest …

Home-Deliveries Before-During Covid-19 Lockdown: Accessibility, Environmental Justice, Equity, And Policy Implications, Miguel Figliozzi, Avinash Unnikrishnan Feb 2021

Home-Deliveries Before-During Covid-19 Lockdown: Accessibility, Environmental Justice, Equity, And Policy Implications, Miguel Figliozzi, Avinash Unnikrishnan

Civil and Environmental Engineering Faculty Publications and Presentations

During the COVID-19 lockdowns, home deliveries have changed from being a desirable luxury or comfortable solution to a health-supporting and essential service for many COVID-19 at-risk populations. However, not all households are equal in terms of access to home deliveries. The onset of COVID-19 has brought to light access inequalities that preceded the pandemic and that the COVID-19 lockdown has exacerbated and made visible. The concept of home-based accessibility (HBA) is introduced, and novel research questions are addressed: (i) What type of households had zero home deliveries before COVID-19 lockdown? (ii) How the COVID-19 lockdown affected the type of households …

D-Stem Equity Model: Diversifying The Stem Education To Career Pathway, Adrienne Coleman

Educational Equity and Excellence: webinar series

This presentation will take an intricate look at the global and national value of Diversifying STEM in the United States of America. We will examine the racial inequities in the STEM education to career pathway, gain an understanding of why these inequities exist, reflect on how these inequities have been addressed and introduce a model to address these racial inequities. Several case studies focused on becoming a STEM agent of change in education will be shared, along with the Diversifying STEM Equity Model which connects several studies focused on factors that motivate Black and Latinx students to engage in STEM, …

Authentic Youth Engagement In Environmental Health Research And Advocacy, Kathryn M. Cardarelli, Melinda J. Ickes, Luz Huntington-Moskos, Craig Wilmhoff, Angela Larck, Susan M. Pinney, Ellen J. Hahn

Health, Behavior & Society Faculty Publications

Training in environmental health (EH) engages and inspires youth to tackle health promotion and policy change. Yet, there is little guidance on how to successfully nurture and sustain youth engagement. This paper compares four case studies of youth engagement to promote EH in rural and urban communities using the Youth Empowerment Solutions (YES!) framework. Of the case studies in rural (Central Appalachia) and urban (Cincinnati, Ohio) communities, two employ citizen science approaches using PhotoVoice and environmental sampling; one engages youth in a science communication camp; and one focuses on policy advocacy. We compare and contrast these case studies using the …

Special State Standing Is Environmental: Clarifying Massachusetts V. Epa, Dorothea Allocca Feb 2021

Special State Standing Is Environmental: Clarifying Massachusetts V. Epa, Dorothea Allocca

William & Mary Environmental Law and Policy Review

When the Court granted states “special solicitude in [its] standing analysis” in Massachusetts v. EPA, it left lower courts with more questions than answers. While legal scholars continue to debate these questions thirteen years later, the practical impacts of Massachusetts v. EPA are coming into focus. Today states are suing the federal government, often in multistate coalitions, to enforce or challenge federal administrative policies. This intergovernmental, public-law litigation increased dramatically during the Obama administration and has further skyrocketed since January 2017. States do not exclusively rely upon special state solicitude in suing the federal government. However, this lowered procedural bar …

Understanding Socio-Technological Systems Change Through An Indigenous Community-Based Participatory Framework, Marie Schaefer, Laura Schmitt Olabisi, Kristin Arola, Christie M. Poitra, Elise Matz, Marika Seigel, Chelsea Schelly, Adewale Aremu Adesanya, Doug Bessette

Michigan Tech Publications, Part 1

Moving toward a sustainable global society requires substantial change in both social and technological systems. This sustainability is dependent not only on addressing the environmental impacts of current social and technological systems, but also on addressing the social, economic and political harms that continue to be perpetuated through systematic forms of oppression and the exclusion of Black, Indigenous, and people of color (BIPOC) communities. To adequately identify and address these harms, we argue that scientists, practitioners, and communities need a transdis-ciplinary framework that integrates multiple types of knowledge, in particular, Indigenous and experiential knowledge. Indigenous knowledge systems embrace relationality and …
