Utility Mergers And The Modern (And Future) Power Grid, Joshua Macey
Utility Mergers And The Modern (And Future) Power Grid, Joshua Macey
Coase-Sandor Institute for Law & Economics Research Paper Series
Scott Hempling’s Regulating Mergers and Acquisitions of U.S. Electric Utilities provides a comprehensive history of electric utility mergers in the United States since the 1980s. Hempling documents the dramatic consolidation the industry has seen in the past fifty years, and he convincingly argues that electric utility mergers present unique problems for regulators. This Review considers how utility acquisitions (a) allow holding companies to leverage the utilities’ creditworthiness to cross-subsidize non-utility affiliates, and (b) exacerbate informational asymmetries between regulators and utilities. It argues that utility mergers generate negative spillovers outside of the utility’s service territory that have potentially significant environmental consequences, …

Carnivores in the families Mustelidae and Mephitidae are essential hosts for the cranial roundworm genus Skrjabingylus. A high prevalence of Skrjabingylus chitwoodorum has been observed in the striped skunk, Mephitis mephitis. Genetic barcoding studies of other nematodes have successfully used the cytochrome oxidase I (COI) mitochondrial gene to analyze genetic variation and divergence. We tested the hypothesis that low population structuring occurs within S. chitwoodorum because M. mephitis is widespread across much of North America and has high levels of gene flow. We extracted DNA from 38 samples of Skrjabingylus removed from the sinuses of M. mephitis and one from …
Towards Effective Detection Of Botnet Attacks Using Bot-Iot Dataset, Subiksha Srinivasa Gopalan
Towards Effective Detection Of Botnet Attacks Using Bot-Iot Dataset, Subiksha Srinivasa Gopalan
Theses
In the world of cybersecurity, intrusion detection systems (IDS) have leveraged the power of artificial intelligence for the efficient detection of attacks. This is done by applying supervised machine learning (ML) techniques on labeled datasets. A growing body of literature has been devoted to the use of BoT-IoT dataset for IDS based ML frameworks. A few number of related works have recognized the need for a balanced dataset and applied techniques to alleviate the issue of imbalance. However, a significant amount of related research works failed to treat the imbalance in the BoT-IoT dataset. A lack of unanimity was observed …

Theses
In the field of network security, intrusion detection system plays a vital role in the procedure of applying machine learning (ML) techniques with the dataset. This study is an IDS related in machine, developed the literature by utilizing AWID dataset. There tends to be a need in balancing a dataset and its existing approaches from the analysis of its respective works. A taxonomy of balancing technique was introduced due to the lack of treatment of imbalance. This attempt has provided a proper structure defined on all levels and a hierarchical group was formed with the collected papers. This describes a …

Towards Enhancement Of Machine Learning Techniques Using Cse-Cic-Ids2018 Cybersecurity Dataset, Dharshini Ravikumar
Theses
In machine learning, balanced datasets play a crucial role in the bias observed towards classification and prediction. The CSE-CIC IDS datasets published in 2017 and 2018 have both attracted considerable scholarly attention towards research in intrusion detection systems. Recent work published using this dataset indicates little attention paid to the imbalance of the dataset. The study presented in this paper sets out to explore the degree to which imbalance has been treated and provide a taxonomy of the machine learning approaches developed using these datasets. A survey of published works related to these datasets was done to deliver a combined …
Model Extraction And Adversarial Attacks On Neural Networks Using Side-Channel Information, Tommy Li
Model Extraction And Adversarial Attacks On Neural Networks Using Side-Channel Information, Tommy Li
Theses
Artificial neural networks (ANNs) have gained significant popularity in the last decade for solving narrow AI problems in domains such as healthcare, transportation, and defense. As ANNs become more ubiquitous, it is imperative to understand their associated safety, security, and privacy vulnerabilities. Recently, it has been shown that ANNs are susceptible to a number of adversarial evasion attacks - inputs that cause the ANN to make high-confidence misclassifications despite being almost indistinguishable from the data used to train and test the network. This thesis explores to what degree finding these examples may be aided by using side-channel information, specifically power …

Ergonomic Assessment Of A New Back Table For Perioperative Nurses, Ketan Prakash Thakur
Ergonomic Assessment Of A New Back Table For Perioperative Nurses, Ketan Prakash Thakur
Theses
Perioperative nurses use back tables (BT) to set up instruments for surgeries consisting of a single surface requiring repetitive lifting due to the stacked trays of surgery tools. Since such actions lead to increased physical (heavyweight of trays) and cognitive (reduced visibility and increased access time) demand, the new DinamicOR table (DT) has been developed. DT has the height adjustment capability and can add up to two shelves providing an extra working area for nurses. We evaluated DT vs. BT by conducting a laboratory experiment involving 16 participants, estimating the kinematics, kinetics, and collecting their subjective feedback, NASA task load …
The Influence Of Oxygen Partial Pressure On The Properties Of Evaporated Alumina Thin Film, Tsion Teklemarim
The Influence Of Oxygen Partial Pressure On The Properties Of Evaporated Alumina Thin Film, Tsion Teklemarim
Theses
Alumina (Al2O3) thin films are used in anti-reflection and high reflection mirror coatings from deep UV to near infrared. The optical, mechanical, and structural properties of films are dependent on the deposition technique and the desired film performance can be achieved by manipulating the deposition parameters. Such deposition parameters are substrate temperature, deposition rate, and oxygen partial pressure. For laser mirror performance applications, it is desirable to optimize the films with regards to laser damage threshold and film stress. To these ends, this thesis work studies Al2O3 thin films synthesized with electron beam evaporation technique as a function of oxygen …

Brown, Massive Resistance, And The Lawyer's View: A Nashville Story, Daniel J. Sharfstein
Vanderbilt Law Review
Editors’ Note: For nearly 75 years, the Vanderbilt Law Review has sought to publish rigorous, intellectually honest scholarship. In publishing the following Essay, we seek to provide an equally unflinching look at one way in which Vanderbilt Law School and its graduates have participated in the creation of inequities that persist today.
The Law School has produced legions of graduates committed to the pursuit of justice. Some alumni’s legacies, however, are more complicated. Brown, Massive Resistance, and the Lawyer’s View: A Nashville Story tells the story of one such alumnus. In many ways, Cecil Sims is a model of an …

Team Production Theory Across The Waves, Brian R. Cheffins, Richard Williams Faculty Of Law
Vanderbilt Law Review
Team production theory, which Margaret Blair developed in tandem with Lynn Stout, has had a major impact on corporate law scholarship. The team production model, however, has been applied sparingly outside the United States. This article, part of a symposium honoring Margaret Blair’s scholarship, serves as a partial corrective by drawing on team production theory to assess corporate arrangements in the United Kingdom. Even though Blair and Stout are dismissive of “shareholder primacy” and the U.K. is thought of as a “shareholder-friendly” jurisdiction, deploying team production theory sheds light on key corporate law topics such as directors’ duties and the …

What Was The "Dartmouth College" Case Really About?, Charles R.T. O'Kelley
Vanderbilt Law Review
This Article is the first modern work of corporation law scholarship fully examining the Dartmouth College case as it was lived and understood at the time. Earlier scholars, the author of this Article included, have relied on the case to make doctrinal and theory-of-the firm arguments about Supreme Court precedents regarding the constitutional rights of corporations. Moreover, these earlier works have primarily focused on, and found talismanic meaning, in two sentences in Marshall’s opinion:
"A corporation is an artificial being, invisible, intangible, and existing only in contemplation of law. Being the mere creature of law, it possesses only those properties …

Social-Emotional Learning And Its Relationship To High School Student Academic Achievement In Stem Courses, Maurice Lavelle Mcdougald
Doctoral Dissertations and Projects
The purpose of this study was to determine the correlation of high school student social-emotional learning and its relationship to academic achievement in STEM (science, technology, engineering, mathematics) courses as moderated by gender and racial groups and within a rural school in the Sandhills area of North Carolina. Using a quasi-experimental variable-centered design, 202 Junior Reserve Officer Corps students participated in this research. The researcher sought to answer: (1) Do individual high school students' self-perceptions of social-emotional learning skills influence academic achievement in traditional STEM courses? (2) Are there significant variations of individual high school students' self-perception of social-emotional learning …

Despite growing evidence of positive student outcomes from course-based undergraduate research experiences (CUREs), little consideration has been given to employing graduate teaching assistants (GTAs) as CURE instructors. GTAs may be novice researchers and/or teachers and likely vary in their interest in teaching a CURE. Guided by expectancy-value theory, we explored how GTAs’ self-efficacy and values regarding teaching a CURE impact motivation and perceptions of their roles as CURE instructors. Using a multiple case study design, we interviewed nine GTAs who taught a network CURE at one research institution. Though most GTAs held a relatively high value for teaching a CURE …
The History Of Congressional Apportionment, Charles M. Biles
The History Of Congressional Apportionment, Charles M. Biles
Trade & Scholarly Monographs
NEW REVISED SECOND EDITION.
The Congressional apportionment problem is deceptively easy to state: How many seats in the U. S. House of Representatives does each state get? To answer that question, Charles Biles, award-winning Professor Emeritus of Mathematics at Humboldt State University, examines the math and politics that has shaped government and power from the founding of the country to the modern day.
Employing an interdisciplinary approach that stems from his research in mathematical modeling and the modeling of natural resource systems, Biles tells a flowing evolutionary tale of how slight changes in calculating apportionment has wrought massive shifts in …

Judges have a dual role: they decide cases and they determine the law. These functions are conventionally understood to be intertwined: adjudication leads to case law, and disputes over judge-made laws lead to adjudication. Because judgments involve the resolution of past disputes, judge-made law is retrospective. The retrospective nature of judicial law-making can seem to work an injustice in hard cases. It appears unfair and inefficient for novel judicial decisions to apply to conduct occurring prior to the date judgment is handed down. A proposed solution is to separate the law-making and adjudicatory functions of courts. This is the technique …

This analysis considers the Supreme Court of Canada’s decision in References re Greenhouse Gas Pollution Pricing Act, 2021 SCC 11, in which a majority of the Court upheld as constitutional national carbon pricing legislation. The decision presents an excellent illustration of the legally disruptive nature of climate change. Illustrating that nothing is static in a climate disrupted world—including constitutional law—this article identifies three shifts the Court makes in relation to climate disruption. First, the decision represents a shift away from climate denialism toward a judicial willingness to confront the environmental, social and legal implications of climate change for Canada. Second, …

This article assesses the development of Vancouver as an entrepreneurial region. Using data collected from commercial startup databases, we find that Vancouver produces more startups and receives more venture capital financing per capita than any other major Canadian city. However, we also find that Vancouver lags many U.S. cities on these same metrics. In light of our empirical findings, we explore whether differences in entrepreneurial activity between Canada and the United States are due to differences in the countries’ legal environments. We conclude that legal differences do not explain observed economic disparities, and that differences in entrepreneurial activity are due …

An Auditing Imperative For Automated Hiring, Ifeoma Ajunwa

The goal of this Article is neither to argue against or for the use of automated decision-making in employment, nor is it to examine whether automated hiring systems are better than humans at making hiring decisions. For antidiscrimination law, the efficacy of any particular hiring system is a secondary concern to ensuring that any such system does not unlawfully discriminate against protected categories. Therefore, the aim is to suggest collaborative regulatory regimes for automated hiring systems that will ensure that any benefits of automated hiring are not negated by (un)intended outcomes, such as unlawful discrimination on the basis of protected …

Forum Selection Clauses, Non-Signatories, And Personal Jurisdiction, John F. Coyle, Robin J. Effron

Who is bound by a forum selection clause? At first glance, the answer to this question may seem obvious. It is black letter law that a person cannot be bound to an agreement without her consent. In recent years, however, courts have not followed this rule with respect to forum selection clauses. Instead, they routinely enforce these clauses against individuals who never signed the contract containing the clause. Courts justify this practice on the grounds that it promotes litigation efficiency by bringing all of the litigants together in the chosen forum. There are, however, problems with enforcing forum selection clauses …

Cruise Contracts, Public Policy, And Foreign Forum Selection Clauses, John F. Coyle

A cruise ship contract is the prototypical contract of adhesion. The passenger is presented with the contract on a take-it-or-leave-it basis. If she refuses to sign, the ship sails without her. To ensure that cruise companies do not draft one-sided contracts that are unfair to passengers, Congress has enacted a number of statutes that regulate these agreements. One such statute is 46 U.S.C. § 30509. This law stipulates that any contract provision that limits the liability of the cruise company for personal injury or death is void as against public policy if the ship stops at a U.S. port.

As the federal government has come to rely increasingly on private companies to perform government functions, more businesses are testing the power of the resulting contractual relationships to shield themselves from liability, regulation, and oversight. Such nongovernmental entities seek the benefit of what we call the federal government’s sovereign shield by exploiting three doctrines: preemption, derivative sovereign immunity, and intergovernmental immunity. Because these contractors provide services supporting every conceivable government action, allowing them to act with impunity puts citizens at risk across myriad aspects of their lives.
This Article untangles the doctrines that extend the sovereign shield to private actors …
