Library Philosophy and Practice (e-journal)
A community is not just a place where people live, but an aggregation of folks brought together, whether by chance or design, who share like avocations. This article details frameworks for community engagement, and also identifies the discernible intersection between community engagement work and librarianship. The main focus is to look at these intersecting fields and establish what can be done to elevate a cohesive, homogeneous patron experience and embrace the larger community as a whole.

Emotional Intelligence is a growing field that can be traced from the research publishing from the year when Salovey & Mayer coined EI terminology. However, this field is still lacking synthesizing, chronological, and systematic studies focusing on how EI field has flourished. The objective of current study was to extend the state-of-the-art research work in the field of EI, based on bibliometric research studies published during 2000-2020. The result of the study depicted under subsequent perspectives: growth trend of EI, influential institutions, countries, articles, authors, keywords, and journals, and international collaborations. A publication growth in EI research gradually increase but …

Bibliometric Review On Liver And Tumour Segmentation Using Deep Learning, Jayant Jagtap, Aamir Habeeb, Avinash Jha, Shrey Aggarwal, Khushi Gupta
Library Philosophy and Practice (e-journal)
One of the major organs in the body is liver where tumors occur often. Malignant liver tumors pose a serious hazard to human life and health. Manual segmentation of the liver organ and tumor from computed tomography (CT) scans is difficult, time-consuming, and skewed to the clinician's experience, yet it is essential for hepatic surgical planning. However, due to the following considerations, segmenting liver tumors from computed tomography (CT) images is difficult: In CT pictures, the contrast between the liver tumor and healthy tissues is low, and the boundary is indistinct; the picture of the liver tumor is confusing, with …

Mediation Ethics After The Singapore Convention, Zachary R. Calo
Mediation Ethics After The Singapore Convention, Zachary R. Calo
Scholarly Works
The aim of this essay is to consider the shape of mediation ethics after the Singapore Convention. It assesses the role of ethics with the Convention framework, as well as how the Convention can inform broader conversations about mediation ethics. The international commercial mediation landscape initiated by the Convention commends certain approaches to ethics for its effective and efficient operation. In particular, it is argued that the Convention system is best complemented by codes of ethics that are clear and standardized in their norms as well as modest in the scope of their regulatory ambitions. An ethical system defined by …

An Absolute Power, Or A Power Absolutely In Need Of Reform? Proposals To Reform The Presidential Pardon Power, Milana Bretgoltz, Albert Ford, Alicia Serrani

The presidential pardon power can serve valuable purposes, but the lack of checks on the power invites abuses. This report calls for laws and executive orders to curtail misuses of the pardon power. Congress should pass laws banning the president from pardoning himself or herself and issuing pardons for conduct that has not yet occurred. Executive orders should set detailed procedures for considering pardons and require reports to Congress if the president pardons a family member or close associate.
Takings Localism, Nestor M. Davidson, Timothy M. Mulvaney
Takings Localism, Nestor M. Davidson, Timothy M. Mulvaney

Conflicts over “sanctuary” cities, minimum wage laws, and genderneutral bathrooms have brought the problematic landscape of contemporary state preemption of local governance to national attention. This Article contends that more covert, although equally robust, state interference can be found in property, with significant consequences for our understanding of takings law.
Takings jurisprudence looks to the states to mediate most tensions between individual property rights and community needs, as the takings federalism literature recognizes. Takings challenges, however, often involve local governments. If the doctrine privileges the democratic process to resolve most takings claims, then, that critical process is a largely local …

The transformative potential of technology in legal practice is well recognized. But wholly apart from how law firms actually use technology is the question of what law firms say about how they use and relate to technology—in particular, how law firms communicate whether technology matters and has value in what they do. In the past, firms in the BigLaw category, especially at the top echelon, have grounded their reputations on the credentials and achievements of their lawyers. In this paper, we explore whether elite law firms use technology similarly by describing it as an additional tool of inter-firm competition—a sort …

Fiduciary Law And The Law Of Public Office, Ethan J. Leib, Andrew Kent
Faculty Scholarship
A law of public office crystallized in Anglo-American law in the seventeenth and eighteenth centuries. This body of law—defined and enforced through a mix of oaths, statutes, criminal and civil case law, impeachments, and legislative investigations—imposed core duties on holders of public executive offices: officials needed to serve the public good, not their own private interests; were barred from acting ultra vires; could often be required to account to the public for their conduct in office; and needed to act with impartiality, honesty, and diligence. Officeholding came to be viewed as conditional, with officers removable for misdeeds. These substantive duties …

The Racial Architecture Of Criminal Justice, I. Bennett Capers

One of the pleasures of contributing to symposia—especially symposia where each contribution is brief—is the ability to engage in new explorations, test new ideas, and offer new provocations. I do that now in this essay about race, architecture, and criminal justice. I begin by discussing how race is imbricated in the architecture of courthouses, the quintessential place of supposed justice. I then take race and architecture a step further. If we think of architecture expansively—Lawrence Lessig’s definition of architecture as “the physical world as we find it” comes to mind—then it becomes clear that race is also imbricated in the …

What is the proportionate punishment for conduct that is neither harmful nor wrongful? A likely response to that is that one ought not to be punished at all for such conduct. It is, however, common for the state to punish harmless conduct the wrongfulness of which is not always apparent. Take, for example, the requirement that those who give investment advice for compensation do so only after registering as an investment advisor. Advising a person on how to invest his or her funds and accepting a fee for the advice without registering with the government does not seem harmful or …

Would Reasonable People Endorse A ‘Content-Neutral’ Law Of Contract?, Aditi Bagchi
Faculty Scholarship
This essay raises two challenges to Peter Benson’s compelling new account of contract law. First, I argue that Benson’s use of the concept of reasonableness goes beyond the Rawlsian account to require that we impute to others a capacity to transcend their contingent circumstances in the context of contractual choice. In fact, our choices in contract are driven by external contingencies and it is only reasonable to take those constrains on other people’s choices into account. Second, I contest Benson’s related claim that contract law should be, and largely is, content-neutral. I argue to the contrary that the justice of …

Hand Hygiene For Health Promotion, Phyllis Knight-Brown
Doctor of Nursing Practice Projects
For many years public health organizations, such as The World Health Organization (WHO) and The Centers for Disease Control and Prevention (CDC), have stressed the need for proper hand hygiene. Proper hand hygiene requires a prescribed process to rid the hands of potentially infecting organisms by using soap and water (handwashing) or hand sanitizer (sanitizing). These processes need to be performed at critical times to promote infection prevention. Many studies have shown that hand hygiene is a learned behavior that becomes habitual over time, and behavior change mechanisms in addition to education are needed to affect a long-term change in …

There is an information explosion in this computer age due to the rapid developments of information and communications technology. As a result, research and studies are quickly published because of faster printing and open access publishing. With these, access to information and resources is somewhat compromised. Without access, these collections are meaningless to educators, researchers, scholars, and other information users. Thus, this study prompted to determine the: 1) level of familiarity in the fundamental principles of subject cataloging; 2) level of usage familiarity of: a) grammar and code of relationships, b) types of subject headings and subdivisions, and c) authority …

Technology has brought changes in the behavioral intentions of students in higher education institutions (HEIs). It also helps them to be creative and innovative during their studies at universities. Literature review reveals that technology acceptance model (TAM) has been widely studied but unfortunately the usage of technology at academia has never been comparatively measured between private and public higher education institutions. This study measures effects of TAM-core variables on academic performance of graduate students of public and private HEIs, additionally, the moderating role of academic self-efficacy between actual usage of social media and academic performance was tested.
