Business As Usual: Hobby Lobby And The Purpose Of Corporate Rights, Dalia Tsuk Mitchell Jan 2021

Business As Usual: Hobby Lobby And The Purpose Of Corporate Rights, Dalia Tsuk Mitchell

GW Law Faculty Publications & Other Works

This article explores the interdependence of the discourse of corporate rights and the law of corporate purpose. I argue that the history of corporate rights reflects changing reactions of the U.S. Supreme Court to social, political, and cultural concerns, each reaction offering a different purpose for corporations in our modern society. At the turn of the twentieth century, in response to fears about the advance of socialism, the Court used liberal assumptions to justify protecting the publicly held corporation’s property rights as derived from the rights of individual shareholders. In so doing, the Court helped turn the corporation, with its …

Food is an inseparable part of a culture and serves as one of the characteristic markers of a culture or ethnic groups. The arrival and presence of the Chinese ethnic group has contributed to the diversity of the Indonesian culture in general. One of Chinese dishes that have become a favorite delicacy in Bandung is noodles, a wide variety of which is sold in various areas around the city. Noodles are considered as a substitute for daily staple food and have become part of Indonesian identity in general. This field study used the descriptive qualitative method. Data collection was carried …

Jalan Gender, Jalan Spiritual: Menggali Pembentukan Gender Project Dalam Konteks Pengalaman Keberagamaan Perempuan, Katrin Bandel, Anne Shakka, Gusnita Linda, Yustina Devi Ardhiani

Paradigma: Jurnal Kajian Budaya

Using the method of collaborative autoethnography, this study critically reflects on the life stories of three women from different backgrounds by focusing on gender and religion. One of the main aspects that we examined is gender projects, i.e. the projections people make when imagining their future gender roles and identities. As a result of our (self-) observations, we found that, while at first the gender project of those women was formed by the patriarchal gender order of their society, as time progresses, after living through and evaluating a variety of often traumatic experiences, they developed their own gender projects more …

Paradigma: Jurnal Kajian Budaya

Women have a role in a particular culture, and this can serve as a way to express their freedom and to be on an equal footing with their male counterparts. The Jering ethnic group in Palangas Village, Bangka Island, has a traditional ritual that is still carried out by the community, namely sedekah gunung. This ritual is carried out once a year, coinciding with the 14th night of the full moon. This ritual serves as an expression of gratitude for the good harvest that occurred for the entire year. This study used the descriptive qualitative method, while data collection techniques …

Pengaruh Profesi Tukang Cukur Dalam Transformasi Kampung Peundeuy, Banyuresmi, Garut, Hilyatun Nishlah, Dhita Hapsarani

Paradigma: Jurnal Kajian Budaya

Being professional barbers from Garut—known as ASGAR, short for Asli Garut, which means ‘of Garut origin’—has been the main source of income for most men residing in Kampung Peundeuy, Banyuresmi Village, Garut Regency, West Java. The profession is considered so successful in providing financial welfare for the villagers and improving their social status that many of the residents decide to leave the village to expand their business elsewhere, especially in Jakarta and other big cities in West Java. This phenomenon has intensified since the 2000s until the residents finally dub Kampung Peundeuy as a “barber village” in West Java. In …

A Sociological Perspective On Pidgin's Viability And Usefulness For Development In West Africa, Victoria M. Time, Daniel K. Pryce Jan 2021

A Sociological Perspective On Pidgin's Viability And Usefulness For Development In West Africa, Victoria M. Time, Daniel K. Pryce

Sociology & Criminal Justice Faculty Publications

This essay examines the viability and usefulness of pidgin for development in West Africa. Pidgin in West Africa has endured as a unifying medium of communication among people who do not share a common language. It has been lauded as a neutral language that facilitates trade, commerce, and everyday dealings among people of all walks of life. Some have proposed supplanting English, which is the official language in most of the West African countries where the use of pidgin is prevalent, with either pidgin or some other indigenous language. Contrarians, however, consider pidgin to be a limiting factor, in that, …

Imago Dei: A Theological Grounding For Discussions On Social Issues And Generational Cohorts, Gerardo Oudri Jan 2021

Imago Dei: A Theological Grounding For Discussions On Social Issues And Generational Cohorts, Gerardo Oudri

180 Symposium Publications

Discussing “social issues” and “Gen. Z” can be done from many angles and perspectives. While this is good and necessary, it seems imperative to provide a solid and cohesive theological foundation on which those discussions can stand. This paper proposes the biblical concept of the “image of God” as that platform, and argues that despite the differing views and understandings of “Imago Dei,” there is sufficient general consensus on fundamental points which provides both the foundation and the direction for a Christian perspective on “social issues.”

The Parable Of The Rich Man And Lazarus: A Narrative-Exegetical Study Of Its Relationship To The Afterlife, Wealth, And Poverty–Part 1: The Afterlife, Thomas R. Shepherd Jan 2021

The Parable Of The Rich Man And Lazarus: A Narrative-Exegetical Study Of Its Relationship To The Afterlife, Wealth, And Poverty–Part 1: The Afterlife, Thomas R. Shepherd

Journal of the Adventist Theological Society

The parable of the Rich Man and Lazarus in Luke 16:19–31 has garnered attention and commentary by Christians for millennia. The primary interest in the parable arises from the fact that it is the only such story that Jesus told in which some sort of conscious life immediately after death is described, actually in quite vivid detail. That Jesus predicted the Final Judgment and the end of the world, the resurrection of the dead and His glorious Second Coming is seen over and over throughout the Gospels and in the rest of the New Testament. But what happens to a …

Neuroscience Of Object Relations In Health And Disorder: A Proposal For An Integrative Model, Dragan M Svrakic, Charles F Zorumski Jan 2021

Neuroscience Of Object Relations In Health And Disorder: A Proposal For An Integrative Model, Dragan M Svrakic, Charles F Zorumski

Open Access Publications

Recent advances in the neuroscience of episodic memory provide a framework to integrate object relations theory, a psychoanalytic model of mind development, with potential neural mechanisms. Object relations are primordial cognitive-affective units of the mind derived from survival- and safety-level experiences with caretakers during phase-sensitive periods of infancy and toddlerhood. Because these are learning experiences, their neural substrate likely involves memory, here affect-enhanced episodic memory. Inaugural object relations are encoded by the hippocampus-amygdala synaptic plasticity, and systems-consolidated by medial prefrontal cortex (mPFC). Self- and object-mental representations, extracted from these early experiences, are at first dichotomized by contradictory affects evoked by …

Community Hospice Nurses' Perspectives On Needs, Preferences, And Challenges Related To Caring For Children With Serious Illness, Amy S. Porter, Kristina Zalud, Jacob Applegarth, Cameka Woods, Melanie Gattas, Emily Rutt, Karen Williams, Justin N. Baker, Erica C. Kaye

Open Access Publications

Importance: Many of the 50 000 children who die annually are eligible for provision of community-based hospice care, yet few hospice organizations offer formal pediatric services. Population-level data demonstrate that hospice nurses lack training, experience, and comfort in caring for children, but their specific educational needs and preferences are poorly understood.

Objective: To assess the pediatric-specific training and support needs of hospice nurses caring for children in the community.

Design, Setting, and Participants: For this qualitative study, 41 nurses were purposively seletected from a population-level cohort of 551 hospice nurses who completed a previous mixed-methods survey; these 41 nurses participated …

Major Problems: Choice Of Major By Transgender College Students, Lux K. Barton , '21

Senior Theses, Projects, and Awards

Despite the increasing visibility of LGBTQ identities in today's society, there is still a lack of research on how students of these identities navigate higher education. In particular, the factors that determine the choices of major of transgender college students are not well known. This study aimed to answer several questions about how transgender students select majors, including whether they select majors differently than their cisgender peers, what factors drive their decisions, and how they navigate their chosen majors. The study utilized a mixed methods approach, including the use of a survey on major choice and satisfaction with majors distributed …

Motivating Factors Influencing The Decision To Create Worker Cooperative Businesses, Brandon Alexander Debalsi Jan 2021

Motivating Factors Influencing The Decision To Create Worker Cooperative Businesses, Brandon Alexander Debalsi

All ETDs from UAB

While there is a growing body of literature on the subject of worker cooperatives in the field of economics that compares them to conventional capitalist firms, there has been little literature to date looking at lives of the workers within these enterprises. This study investigates the self-stated reasons for why worker-owners of worker cooperative firms chose this form of employment. In unstructured interviews, a sample of thirty-seven current and former worker-owners were asked why they chose to become worker cooperatives members. The responses are grouped into three categories based on their self-reported motivations: Idealists, Economists, and Drifters. Implications for future …

The Role Of Visa Status And Acculturation In The Health Of Us Immigrants, Serra Sevde Hatipoglu Jan 2021

The Role Of Visa Status And Acculturation In The Health Of Us Immigrants, Serra Sevde Hatipoglu

All ETDs from UAB

Using data from the 2003 New Immigrant Survey, I examined the association between visa status and acculturation with physical, mental, and self-rated health among immigrants residing in the United States. The primary predictor variable in the study is immigrant visa status. The outcome variables of interest include physical health as any morbidity (chronic diseases), mental health as depressed (as defined by the DSM-IV) and self-rated health (poor self-rated health). Using logistic regressions, I found those with unfavorable visa statuses have worse mental, physical, self-rated health compared to the favorable visa holders. I used inverse odds ratio weighted (IORW) mediation method …

Examining The Viability Of Native American Stickball As A Comprehensive Indigenous Peace System, Edison Doyle Pearce Jan 2021

Examining The Viability Of Native American Stickball As A Comprehensive Indigenous Peace System, Edison Doyle Pearce

All ETDs from UAB

This study examines the viability of Native American stickball as a comprehensive peace system developed for the primary purpose of ameliorating hostilities, preventing war, and creating a landscape of peace. Originating as early as the 12th century, Native American stickball is recognized as the oldest field sport in North America. More than a game, stickball is steeped in symbolism and comprised of rich oral histories, elements of fictive kinship alliances, religious connotations, and other prosocial mechanisms designed to create and maintain peace. To determine how the interplay between these various components is adaptive through time, a three-phase research model was …

This thesis explores the relationship between the Works Progress Administration (WPA) laborers and the archaeological institutions of the period within the context of the Great Depression and the social democratic reforms of the New Deal. Labor, labor-time, and logistical information were gathered from the WPA Quarterly Progress Reports prepared by David L. DeJarnette from 1936 to 1942. An inventory of over 130 archaeological sites was compiled based on field reports …

Fight Navigator: Exploring The Feasibility Of A Retaliatory Violence Prevention Program To Help Youth Manage The Code Of The Street, James Barrett, William Pollack, Elizabeth Janopaul-Naylor, Marvin So, Vincenzo Teran, Elizabeth Stilwell Jan 2021

Fight Navigator: Exploring The Feasibility Of A Retaliatory Violence Prevention Program To Help Youth Manage The Code Of The Street, James Barrett, William Pollack, Elizabeth Janopaul-Naylor, Marvin So, Vincenzo Teran, Elizabeth Stilwell

National Youth Advocacy & Resilience Journal

Violence remains the leading cause of injury and death for people between the ages of 15 and 24 and presents a challenge for communities of color. Better understanding of the context surrounding violence is critical in order to develop effective prevention interventions. We conducted a two-phase, qualitative, feasibility study to develop and initially evaluate a retaliatory violence program, Fight Navigator. Focus groups (n=20) and semi-structured case vignette interviews (n=20) were conducted with the target population that were analyzed using a consensual qualitative research approach. Findings suggest that participants were more likely to believe that conflicts could be resolved without violence …

Work–Leisure Blending: An Integrative Conceptual Review And Framework To Guide Future Research, Troy A. Smith, Marcus M. Butts, Stephen H. Courtright, Mat D. Duerden, Mark A. Widmer Jan 2021

Work–Leisure Blending: An Integrative Conceptual Review And Framework To Guide Future Research, Troy A. Smith, Marcus M. Butts, Stephen H. Courtright, Mat D. Duerden, Mark A. Widmer

Faculty Publications

Since the industrial revolution, work and leisure have largely been considered opposing domains. A growing number of organizations, however, enable and/or promote blending leisure activities into the workplace. Similarly, several conceptualizations across different disciplines examine how work and leisure can coexist. These different conceptualizations have yielded a rich but fragmented theoretical account of work–leisure blending. To address this problem, we provide a comprehensive theoretical integration of multiple literature streams where research has explored work–leisure blending. Further, we develop a tripartite dimensional framework designed to elucidate the central dimensions of work–leisure blending (i.e., segmentation– integration, unstructured–structured, and independent–interactive) undergirding this phenomenon. …

Latina Female Superintendents Securing Positions In Small Rural School Districts, Irma Castillo, Velma D. Menchaca, Veronica Lopez-Estrada

Organization and School Leadership Faculty Publications

Underrepresentation of women in the position of school superintendent has been identified as an equity issue in the field of education. National demographics show that approximately 73% of school superintendents are male as compared to only 27% female. Of these female superintendents, Latina and nonwhite female superintendents make up a small percentage of this group (Kominiak, 2016) and scarce in the literature. This research study revealed that Latina superintendents were attracted to small rural districts with a familial environment with high levels of parental and community involvement. They shared the perspective that small rural communities seemed to be more receptive …

Development And Psychometric Examinations Of A Simplified Chinese Mandarin Translation And Adaptation Of The Adjustment Scales For Children And Adolescents, Gary L. Canivez, Yi Ding, Paul A. Mcdermott

Archives of Assessment Psychology

An absence of empirically validated scales limits the assessment of youth psychopathology in Chinese schools. The present study reports on the development and initial assessment of psychometric properties of a simplified Chinese Mandarin translation and adaptation of the Adjustment Scales for Children and Adolescents, a teacher-report behavior rating scale with a representative U.S. standardization sample. Comparisons of a large sample (n = 554) of Chinese elementary school students (Grade 1-6) with an age and grade matched sample (n = 709) from the ASCA standardization data found similar base rates of positive behaviors, rare problem behaviors, and common problem behaviors, suggesting …

Differences In Cognitive Reflection Mediate Gender Differences In Social Preferences, Antonio M. Espín, Valerio Capraro, Brice Corgnet, Simon Gächter, Roberto Hernán-González, Praveen Kujal, Stephen Rassenti

ESI Working Papers

Previous studies have shown that women tend to be more egalitarian and less self-interested than men whereas men tend to be more concerned with social efficiency motives. The roots of such differences, however, remain unknown. Since different cognitive styles have also been associated with different distributional social preferences, we hypothesise that gender differences in social preferences can be partially explained by differences in cognitive styles (i.e., women rely more on intuition whereas men are more reflective). We test this hypothesis meta-analytically using data from seven studies conducted in four countries (USA, Spain, India, and UK; n=6,910) where cognitive reflection and …

The Interacion Between Humans And Buildings For Energy Efficiency: A Critical Review, T Harputlugil, P De Wilde Jan 2021

The Interacion Between Humans And Buildings For Energy Efficiency: A Critical Review, T Harputlugil, P De Wilde

School of Art, Design and Architecture

Buildings consume energy for different purposes. One core function is to provide healthy and comfortable living conditions for the humans that inhabit these buildings. The associated energy use is significant: taken together, buildings are responsible for roughly 40% of the world's total annual energy consumption. This large percentage makes the built environment an important target for researchers, policy makers, innovators and others who aim to decrease energy consumption and the associated emissions of Greenhouse Gases (GHG). Unfortunately, the significant body of research on energy efficient buildings conducted since the 1970s has had only a limited impact on the overall energy …

“You Can’T Catch ‘Em And Sell ‘Em”: Perceptions Of Obstacles To Direct Marketing Among Georgia Fishers, Jennifer Tookes, Tracy Yandle Jan 2021

“You Can’T Catch ‘Em And Sell ‘Em”: Perceptions Of Obstacles To Direct Marketing Among Georgia Fishers, Jennifer Tookes, Tracy Yandle

Sociology & Anthropology: Faculty Publications

Direct marketing of seafood is a promising avenue for seafood sales in the United States, utilizing local foods venues such as farmers markets and Community Supported Fisheries (CSFs). While interest in locally sourced seafood among local foods communities in Atlanta and Athens, Georgia is high, fishers from coastal Georgia have not filled this profitable niche. We investigate why this opportunity is not exploited by conducting qualitative interviews with twenty-one fishers. Fishers described numerous obstacles to direct marketing, focused on the simultaneous labor investment in on-shore and “on the water” efforts. In addition, fishers’ concerns reveal the financial and social risks …

An Analysis And Comparison Of The Missional Doctrine Hermeneutics Of Kevin J. Vanhoozer And Veli-Matti KäRkkäInen, With Emphasis On Their Notions Of God, Eschatology, And Mission, Elmer Arrais Guzman Jan 2021

An Analysis And Comparison Of The Missional Doctrine Hermeneutics Of Kevin J. Vanhoozer And Veli-Matti KäRkkäInen, With Emphasis On Their Notions Of God, Eschatology, And Mission, Elmer Arrais Guzman

Dissertations

This dissertation analyzes Veli-Matti Kärkkäinen’s and Kevin J. Vanhoozer’s theological method, in order to understand its structural elements, and thereby to facilitate comprehension of their missional doctrinal hermeneutics, and the ramifications of those hermeneutics for the construction and development of Christian theology. Missional doctrinal hermeneutical models conceive the missional dimension of doctrine in various ways. Some privilege the maintenance of theological identity cohering with the foundational sources of theological authority. Others privilege theological constructions that assimilate the context and the missional situational framework of understanding. This dissertation strives to examine the diverging missional hermeneutics of Kärkkäinen and Vanhoozer, the foundational …

International Law As Behavior: An Agenda, Harlan G. Cohen, Timothy Meyer Jan 2021

International Law As Behavior: An Agenda, Harlan G. Cohen, Timothy Meyer

Scholarly Works

Over the past few decades, scholars in a variety of fields – economics, psychology, sociology, anthropology, and international relations, among others – have made enormous strides studying the behavioral roots of international law by exploring individual motivations, describing organizational cultures, and mapping communities of practice. Taken together, the work of these scholars presents a complex, nuanced understanding of how international law works. However, these projects are rarely considered together: often separated by academic enclosures and focused on different subfields within international law, communication among scholars using different methodologies is restricted. The goal of this book is to break down some …
