Constitutional Law's Conflicting Premises, Maxwell L. Stearns Dec 2020

Constitutional Law's Conflicting Premises, Maxwell L. Stearns

Notre Dame Law Review

Doctrinal inconsistency is constitutional law’s special feature and bug. Virtually every salient doctrinal domain presents major precedents operating in tension. Bodies of precedent are rarely abandoned simply because a newer strand makes an older one appear out of place. And when an earlier strand is redeployed or substituted, the once-newer strand likewise persists. This dynamic process tasks law students, often for the first time, with reconciling the seemingly irreconcilable.

These doctrinal phenomena share as their root cause dual persistent conflicting premises. Some examples: Standing protects congressional power to monitor the executive branch, or it limits congressional monitoring when the selected …

Forgotten Federal-Missionary Partnerships: New Light On The Establishment Clause, Nathan S. Chapman Dec 2020

Forgotten Federal-Missionary Partnerships: New Light On The Establishment Clause, Nathan S. Chapman

Notre Dame Law Review

Americans have long debated whether the Establishment Clause permits the government to support education that includes religious instruction. Current doctrine permits states to do so by providing vouchers for private schools on a religiously neutral basis. Unlike most Establishment Clause doctrines, however, the Supreme Court did not build this one on a historical foundation. Rather, in cases from Everson v. Board of Education (1947) to Espinoza v. Montana Department of Revenue (2020), opponents of religious-school funding have claimed American history supports a strict rule of no-aid.

Yet the Court and scholars have largely ignored a practice that casts light on …

Fraudulently Induced Confessions, Michael J. Zydney Mannheimer Dec 2020

Fraudulently Induced Confessions, Michael J. Zydney Mannheimer

Notre Dame Law Review

The jurisprudence on the use of police deception during interrogations is singularly unhelpful. Police may deceive in order to induce a suspect to confess, the courts tell us, unless they go too far. Police are permitted, for example, to feign sympathy for the suspect, lie about the existence of incriminating evidence, and falsely downplay the seriousness of the offense under investigation. But when police engage in other forms of deception, such as by offering false promises of leniency or misrepresenting the suspect’s Miranda rights, courts will balk and declare the resulting confession coerced. Yet neither courts nor commentators have successfully …

Enforcing A Wall Of Separation Between Big Business And State: Protection From Monopolies In State Constitutions, Alexandra K. Howell Dec 2020

Enforcing A Wall Of Separation Between Big Business And State: Protection From Monopolies In State Constitutions, Alexandra K. Howell

Notre Dame Law Review

The goal of this Note is not to convince the reader to care more about regulatory monopolies than private ones. In fact, it is not to talk about private antitrust law at all. Instead, the goal is to put today’s concern with monopolies in historical perspective. Part I traces the history of the antimonopoly spirit in the United States starting with the English tradition that was highly influential on the Founders. This Note then demonstrates that today’s concern with private monopolies comes from a shift that took place during the progressive era. In Part II, this Note highlights the role …

Fisher Formalism For Anisotropic Gravitational-Wave Background Searches With Pulsar Timing Arrays, Y. Ali-Haïmoud, Tristan L. Smith, C. M. F. Mingarelli Dec 2020

Fisher Formalism For Anisotropic Gravitational-Wave Background Searches With Pulsar Timing Arrays, Y. Ali-Haïmoud, Tristan L. Smith, C. M. F. Mingarelli

Physics & Astronomy Faculty Works

Pulsar timing arrays (PTAs) are currently the only experiments directly sensitive to gravitational waves with decade-long periods. Within the next five to ten years, PTAs are expected to detect the stochastic gravitational-wave background (SGWB) collectively sourced by inspiraling supermassive black hole binaries. It is expected that this background is mostly isotropic, and current searches focus on the monopole part of the SGWB. Looking ahead, anisotropies in the SGWB may provide a trove of additional information on both known and unknown astrophysical and cosmological sources. In this paper, we build a simple yet realistic Fisher formalism for anisotropic SGWB searches with …

All I Want For Christmas Is The New Vaccine!, Jase Graves

Erma Bombeck Writers' Workshop Blog

Now that we are well into the month of December, my three teenage daughters have provided me with their extensive Christmas lists — both electronic and hard copies — in triplicate. Full of the typical objects of adolescent desires like designer clothing, electronics, jewelry and luxury vehicles, their lists read like the inventory of Elon Musk’s next yard sale.

Kinematics Analysis Of A Parallel Robot With 3 Dof And 4 Segments In Pure Translation., A. Cherfia, A. Zaatri, M. Giordano

Mansoura Engineering Journal

In this paper we present the direct and inverse analysis of a geometrical model of an UPS manipulator with three degrees of freedom added to a PPP passive central segment. This structure provides a pure translation motion. We will also determine the relations between generalized and articular velocities by using the inverse Jacobian matrix, Further, we determine the reciprocal relations between cartesian and angular velocities of the end effector via articular velocities by direct re-inversion of the Jacobian matrix. This study aims of implementing the control of a parallel robot manipulator. A prototype of a parallel robot has been built …

“Building That World”: Movements Of Vision In The Carceral Classroom, Rhiannon M. Cates, Benjamin J. Hall, James Broughton, Andrew Reeves, Faith Hocutt Ringwelski, Kathryn Zaro, Jenna Richards, Lani Roberts

Library Faculty and Staff Publications and Presentations

An article in which two teaching assistants and six students of a university course taught inside a correctional facility, "Writing as Activism," collaboratively examine their experience as co-teachers and co-learners in a humanities-based prison classroom. Fostered and framed by their instructor’s critical and transformative pedagogical approaches in this course, the authors locate integrated learning and collaborative writing within carceral classrooms as sites for intentional and resistant futures to be enacted and embodied as a practice of post-carceral world-building. The students enter their individual narratives into this location of their experience of envisioning and enacting resistant futures together in this space …

Africans Who Arrive In The United States Before 20 Years Of Age Maintain Both Cardiometabolic Health And Cultural Identity: Insight From The Africans In America Study, Elyssa M. Publications and Research

The overall consensus is that foreign-born adults who come to America age < 20 y achieve economic success but develop adverse behaviors (smoking and drinking) that lead to worse cardiometabolic health than immigrants who arrive age ≥ 20 y. Whether age of immigration affects the health of African-born Blacks living in America is unknown. Our goals were to examine cultural identity, behavior, and socioeconomic factors and determine if differences exist in the cardiometabolic health of Africans who immigrated to America before and after age 20 y. Of the 482 enrollees (age: 38 ± 1 (mean ± SE), range: 20–65 y) in the Africans in America cohort, 23% (111/482) arrived age < 20 y, and 77% (371/482) arrived age ≥ 20 y. Independent of francophone status or African region of origin, Africans who immigrated age < 20 y had similar or better cardiometabolic health than Africans who immigrated age ≥ 20 y. The majority of Africans who immigrated age < 20 y identified as African, had African-born spouses, exercised, did not adopt adverse health behaviors, and actualized early life migration advantages, such as an American university education. Due to maintenance of cultural identity and actualization of opportunities in America, cardiometabolic health may be protected in Africans who immigrate before age 20. In short, immigrant health research must be cognizant of the diversity within the foreign-born community and age of immigration.

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Adiabatic Logic-In-Memory Architecture, Himanshu Thapliyal, S. Dinesh Kumar Dec 2020

Adiabatic Logic-In-Memory Architecture, Himanshu Thapliyal, S. Dinesh Kumar

Electrical and Computer Engineering Faculty Patents

An adiabatic logic-in-memory based complementary metal- oxide-semiconductor/magnetic-tunnel-junction (ALiM CMOS/MTJ) circuit utilizes an adiabatic logic based pre- charged sense amplifier (PCSA) to recover energy from its output load capacitors. The ALiM CMOS/MTJ includes a non-volatile magnetic-tunnel-junction (MTJ) based memory. The ALiM CMOS/MTJ also includes a dual rail complementary metal-oxide-semiconductor (CMOS) logic that performs logic operations in association with the MTJ, and thereby generates logic outputs based on logic inputs. The ALiM CMOS/MTJ also includes the adiabatic PCSA, which is operatively coupled to the dual rail CMOS logic. The adiabatic logic based PCSA includes PCSA circuitry for which an input is a …

Applicability Of Sustainable Construction In Nigeria Infrastructure Projects-Empirical Study Of The Six Geopolitical Zones, Chinedu Adindu, Adamu Musa, Uchenna Nwajagu, Saheed Yusuf, Susan Yisa

CSID Journal of Infrastructure Development

Despite the socio-economic importance of the Built Environment (BE) industry; its resources and products regrettably impact the host environment negatively, necessitating a departure from traditional to Sustainable Construction (SC) methods. Lack of SC awareness has been identified by several researchers as a major impediment to its adoption in Nigeria. This study, therefore, assessed the level of SC awareness, examined the sources of SC knowledge, and determined ways of improving SC applicability in Nigeria. The descriptive survey research methodology was used and a structured questionnaire administered purposively to 171 BE professionals, with 133 valid responses, hence a 78% success rate. The …

Water Quality Modelling To Predict Bod And Tp Loads Of Duriangkang Dam, Calvin Wimordi, Doddi Yudianto, Guan Yiqing

CSID Journal of Infrastructure Development

Water quality modeling is highly needed to predict and to identify the water quality alteration and distribution along the water body. Besides that, water quality modeling also can be used to predict the pollutant load if there is no data recording. The water quality analysis simulation program (WASP), will be used in this study to forecast domestic load, in particular BOD and TP loads in Duriangkang Dam. Initially, the estimated load is obtained based on the previous study that being extended by using a linear regression line. After that, the estimated load is calibrated according to the results of the …

Accelerating Infrastructure Development In Post-Pandemic Era, Mohammed Ali Berawi, Perdana Miraj, Mustika Sari

CSID Journal of Infrastructure Development

COVID-19 outbreak has contributed a negative effect on the infrastructure sector worldwide. Infrastructure projects need to shut down and put on hold for an unspecified time, as this sector required a high number of workers prone to the virus transmissions. However, the degree of slowdown between countries varies and depends on the severity of pandemic and lockdown conditions. Many countries are having a slowdown in economic growth. This condition has greatly affected the supply and demand sides, making it difficult to predict recovery timelines of on-going and future project development. In response to the COVID-19 pandemic, many governments worldwide launched …

Value Capture Instruments As An Infrastructure Project Financing Alternative For Rail-Based Mass Transportation: Qualitative Study From The Government Perspective, Ario Bintang Koesalamwardi, Susy Fatena Rostiyanti, Ravli Thaufiq Reksapernata

CSID Journal of Infrastructure Development

Increasing the mobility of the working class in urban areas will increase their productivity, which in turn will increase the economic output of the region. This can be achieved by providing a means of mass transportation infrastructure that is fast, affordable, and efficient i.e. rail-based mass transportation. However, the Ministry of National Development Planning estimated there is an infrastructure-funding gap of 4,321 trillion rupiahs to achieve Indonesia's development targets. Inviting the private sector to participate in infrastructure development investment in Land Value Capture (LVC) scheme becomes one of the solutions that need to be studied further. LVC is considered a …
