The Parthenon
The Parthenon, Marshall University’s student newspaper, was published by students Monday through Friday during the regular semester and weekly on Thursdays during the summer. Due to budgetary constraints, beginning with the 2018 Fall semester, the newspaper is only published one day a week (and once every other week during the summer). The editorial staff is responsible for the news and the editorial content.

Body-Worn Cameras And Transparency: Experimental Evidence Of Inconsistency In Police Executive Decision-Making, Brandon Tregle, Justin Nix, Justin T. Pickett
Criminology and Criminal Justice Faculty Publications
Body-worn cameras (BWC) have diffused rapidly throughout policing as a means of promoting transparency and accountability. Yet, whether to release BWC footage to the public remains largely up to the discretion of police executives, and we know little about how they interpret and respond to BWC footage – particularly footage involving critical incidents. We asked a nationally representative sample of police executives (N=476) how supportive they were of legislation that would mandate releasing BWC footage upon request as public information, and presented them with an experimental vignette about BWC capturing one of their officers fatally shooting an [armed/unarmed] [Black/White] suspect. …

A Colonial Castle: Defence Of Property In R V Stanley, Alexandra Flynn, Estair Van Wagner
Articles & Book Chapters
In 2016, Gerald Stanley shot 22-year-old Colten Boushie in the back of the head after Boushie and his friends entered Stanley’s farm. Boushie died instantly. Stanley relied on a hangfire defence, rooted in the defence of accident, and was found not guilty by an all-white jury. Throughout the trial, Stanley invoked concerns about trespass and rural crime (particularly property crime) that raised much evidence of limited relevance to whether or not the shooting was an accident. We argue that the assertions of trespass, without formerly raising the defence of property or trespass, shaped the trial by providing a racist, anti-Indigenous-tinged …
Removing Racially Biased Algorithms In Policing, Andie Lee
Removing Racially Biased Algorithms In Policing, Andie Lee
Student Papers in Public Policy
Local police departments use algorithm-based programs to do police work and predict crime. Technology has created the police tactic of predictive crime prevention. Police work, however, requires social skills, assessment of the environment, and most importantly human interaction. Automated policing lacks these characteristics. Moreover, the algorithms used to make crime predictions and risk assessments have disproportionately affected minorities.
Researching Sexual Violence Against Men In Bosnia-Herzegovina: Current Progress And Research Gaps, Anna Gopsill
Researching Sexual Violence Against Men In Bosnia-Herzegovina: Current Progress And Research Gaps, Anna Gopsill
International Conference on Genocide
Over the past two decades, scholarly research on conflict-related sexual violence (CRSV) has steadily grown. Despite this, gaps remain. Significantly, while there is a strong foundation of research on female victims of CRSV, research on male victims is growing but still lags behind. In the Bosnian context, women have been widely recognised as victims of genocidal sexual violence during the 1992 to 1995 war, while male victims of sexual violence often fall under the category of torture or crimes against humanity. This is despite a large amount of evidence indicating that men were victims of sexual violence in the conflict. …

A Critical Analysis Of Dower (Mahr) In Theory And Practice In British India Through Court Records From 1800 To 1939, Sunil Tirkey
A Critical Analysis Of Dower (Mahr) In Theory And Practice In British India Through Court Records From 1800 To 1939, Sunil Tirkey
Theses and Dissertations
The colonial court records between 1800 to 1939 in India show the existence of excessive dower, which were usually paid at the dissolution of marriage to discourage divorce. Supporting this view of excessive dower as a useful device, Mitra Sharafi argues that inflated dower and divorce law protected Muslim women against instant divorce, making it too expensive for husbands to use it. Further, according to her, British judges enhanced women's rights to dower and divorce by pronouncing rulings in favour of a high amount of dower to protect the women against the one-sided authority of men to divorce. Contrary to …

Uber And The Need For Particularized Regulation, Kayla Marie Heckman
Uber And The Need For Particularized Regulation, Kayla Marie Heckman
University of Miami Business Law Review
With technology constantly evolving, the law must evolve with it. Uber Technologies, Inc. (“Uber”) has transformed the transportation industry by making transportation readily available with the touch of a button on one’s mobile phone. Uber is now one of the leading companies in transportation and operates worldwide. While this expansion has been great for consumers, it has come with significant drawbacks and challenges. Uber threatens the taxi industry, the cities in which it operates, and even its own drivers. This Note will discuss how Uber’s rapid growth is disrupting transportation in major cities quicker than its impact can properly be …

Conceptualizing The Effects Of Continuous Traumatic Violence On Hiv Continuum Of Care Outcomes For Young Black Men Who Have Sex With Men In The United States, Dexter R. Voisin
Faculty Scholarship
The United States (US) is on track to achieve the 90-90-90 targets set forth by UNAIDS and the National HIV/AIDS strategy, yet significant racial disparities in HIV care outcomes remain, particularly for young Black men who have sex with men (YBMSM). Research has demonstrated that various types of violence are key aspects of syndemics that contribute to disparities in HIV risk. However, little research has looked collectively at cumulative violent experiences and how those might affect HIV treatment and care outcomes. Drawing on extant literature and theoretical underpinnings of syndemics, we provide a conceptual model that highlights how continuous traumatic …

Transitioning Into Conventional Housing: Narratives Of Houseless Individuals, Joyce La Belle Mcnair
Transitioning Into Conventional Housing: Narratives Of Houseless Individuals, Joyce La Belle Mcnair
Dissertations and Theses
Past research has shown that it is possible for individuals to exit houselessness. However, it does little to provide insights into the types of experiences and events that facilitate these moves towards housing stability. This study explores indepth interviews, utilizing an interview guide with 12 individuals who exited houselessness in Portland, Oregon. This research project seeks to understand the conditions that influence successful exits out of houselessness from the perspective of the lived experiences of once houseless individuals. This study utilizes two theoretical frameworks, the theory of Habitus (Bourdieu, 1977 & Wacquant, 1998) and the networking theory of Strong and …

Poverty Lawgorithms A Poverty Lawyer’S Guide To Fighting Automated Decision-Making Harms On Low-Income Communities, Michele E. Gilman
All Faculty Scholarship
Automated decision-making systems make decisions about our lives, and those with low-socioeconomic status often bear the brunt of the harms these systems cause. Poverty Lawgorithms: A Poverty Lawyers Guide to Fighting Automated Decision-Making Harms on Low-Income Communities is a guide by Data & Society Faculty Fellow Michele Gilman to familiarize fellow poverty and civil legal services lawyers with the ins and outs of data-centric and automated-decision making systems, so that they can clearly understand the sources of the problems their clients are facing and effectively advocate on their behalf.
Mindfulness Interventions For Educators: Preventing Burnout Through Personal And Professional Development, Jessica Noble
Mindfulness Interventions For Educators: Preventing Burnout Through Personal And Professional Development, Jessica Noble
Mindfulness Studies Theses
When it comes to professions with the highest rate of burnout, educators are prime candidates for facing this often debilitating and life-altering phenomena. Although the causes of teacher burnout are vast (and typically depend on the teacher’s context and level of experience), the effects appear to not only impact the life and career of the teacher, but also the students and school community. Despite the sense of both hopelessness and helplessness that arise with burnout, there are accessible strategies teachers can use in order to mitigate the amounting stressors. The growing field contemplative sciences have found that mindfulness, the act …
