An Evolution Of Legal Rights For Guantanamo Bay Detainees: Habeas Corpus In The 21st Century, Jennifer Hirst Oct 2020

An Evolution Of Legal Rights For Guantanamo Bay Detainees: Habeas Corpus In The 21st Century, Jennifer Hirst

Student Theses

Guantanamo Bay, resting under United States’ jurisdiction since the early 20th century, has infamously stood as the symbol for where alleged terrorists and constitutional protections disappear. However, between the years of 2004 – 2008, the United States Supreme Court ruled on four landmark cases, gradually providing Guantanamo Bay detainees constitutional protections and access to the writ of habeas corpus – allowing detainees for the first time to challenge the legalities behind their detentions. Subsequently, judicial and executive powers have continuously contested one another, as Supreme Court rulings and documents released by the Bush Administration have intentionally aimed to minimize the …

Youth, Interrupted: Encouraging A Holistic Approach To Juvenile Incarceration Policy, Ashley Tisdale Oct 2020

Youth, Interrupted: Encouraging A Holistic Approach To Juvenile Incarceration Policy, Ashley Tisdale

Modern Psychological Studies

Scientific research into the experience of juveniles in detention has recently had an impact on court rulings. In the cases of Roper v Simmons (2005), Graham v Florida (2010) and Miller v. Alabama (2012) judges used research in juvenile cognitive development to inform their rulings. Though current research covers different aspects of juvenile experience in the criminal justice system, few studies approach the subject holistically or examine the inherent symbiotic relationship between juvenile detention policy and juvenile incarceration. This literature review seeks to present information on and encourage further examination of this relationship. For the purposes of the review, the …

Biased Coverage Of Bias Crime: Examining Differences In Media Coverage Of Hate Crimes And Terrorism, Adam Ghazi-Tehrani, Erin M. Kearns Oct 2020

Biased Coverage Of Bias Crime: Examining Differences In Media Coverage Of Hate Crimes And Terrorism, Adam Ghazi-Tehrani, Erin M. Kearns

Criminology and Criminal Justice Faculty Publications

News media differentially cover violence based on social identity. How does media bias apply to terrorist attacks—typically “upward crimes” where perpetrators hold less power than targets—that are also hate crimes—typically “downward crimes”? We compare coverage of incidents that are both terrorist attacks and hate crimes to coverage of incidents that are just terrorism in the U.S. from 2006 to 2015. Attacks that are also hate crimes receive less media attention. Articles are more likely to reference hate crimes when the perpetrator is unknown and more likely to reference terrorism when the perpetrator is non-white in some models.

Drug Policy Reform In The Americas: A Welcome Challenge To International Law, Alvaro Santos Oct 2020

Drug Policy Reform In The Americas: A Welcome Challenge To International Law, Alvaro Santos

Georgetown Law Faculty Publications and Other Works

Drug policy in the American hemisphere is in flux. After decades whereby a prohibitionist regime reigned supreme and proposing alternatives was taboo, several countries have begun to reconsider policy, particularly in the case of marijuana. International law has been instrumental in building the legal and institutional regime of prohibition, and it has remained largely impervious to critiques of its disastrous consequences. Indeed, when it comes to drug law and policy, international law has been part of the problem. Nevertheless, countries in the Americas have begun to adopt innovative strategies that also embrace international obligations. In this essay, I examine the …

Justice Is Served--Review Of J Journal, Fall 2009, Abby Machson-Carter Oct 2020

Justice Is Served--Review Of J Journal, Fall 2009, Abby Machson-Carter

The Review Review

For the second volume of a literary journal, J Journal is off to a good start. Published by John Jay College of Criminal Justice, J calls itself “a journal of new creative writing that poses questions about justice, directly and tangentially.” Receiving it in the mail, I wasn’t sure what to expect – how much mileage could they get out of just one topic? Would it be filled exclusively with essays about the criminal justice system, or would fiction be a part? Could this really be called “literary”?

Exploring The Final Years Of The Life Of John F. Kennedy Jr.: A Mixed Methods Psychobiographical Case Study, Caitlin R. Ferrer, Joseph G. Ponterotto Oct 2020

Exploring The Final Years Of The Life Of John F. Kennedy Jr.: A Mixed Methods Psychobiographical Case Study, Caitlin R. Ferrer, Joseph G. Ponterotto

The Qualitative Report

This present study utilized a mixed methods design to explore the inner emotional experiencing of John F. Kennedy Jr. during the last five years of his life. A large first-person data set culled from JFK Jr.’s letters and interviews was subjected to a qualitative theme analysis and the quantitative Linguistic Inquiry Word Count (LIWC) program (Pennebaker, Boyd, Jordan, & Blackburn, 2015). Among the major themes emerging from the qualitative analysis were JFK Jr.’s efforts to balance and integrate his public and private selves; navigating the Kennedy legacy and understanding his family’s place in political history; and establishing George magazine with …

Autonomous Cyber Capabilities Below And Above The Use Of Force Threshold: Balancing Proportionality And The Need For Speed, Peter Margulies Oct 2020

Autonomous Cyber Capabilities Below And Above The Use Of Force Threshold: Balancing Proportionality And The Need For Speed, Peter Margulies

International Law Studies

Protecting the cyber domain requires speedy responses. Mustering that speed will be a task reserved for autonomous cyber agents—software that chooses particular actions without prior human approval. Unfortunately, autonomous agents also suffer from marked deficits, including bias, unintelligibility, and a lack of contextual judgment. Those deficits pose serious challenges for compliance with international law principles such as proportionality.

In the jus ad bellum, jus in bello, and the law of countermeasures, compliance with proportionality reduces harm and the risk of escalation. Autonomous agent flaws will impair their ability to make the fine-grained decisions that proportionality entails. However, a …
