English Department: Research for Change - Wicked Problems in Our World
For many years, people of color have had an unsteady relationship with police departments and law enforcement due to police misconduct, use of force, and police brutality. We’ve had many of the same conversations over and over again about what we can do to bring upon change within our departments, but no true, consistent action has been taken. In this paper we discuss multiple solutions to help address the issue of police misconduct, the need for police and society reform, and ways we can work towards mending the relationship between citizens and our police departments. In today’s society, change is …

Justice Policy
Parental incarceration is a known Adverse Childhood Experience (ACE) which affects a large number of children nationwide. Research shows that children who experience parental incarceration are more at risk for trauma, mental health problems, and juvenile justice system involvement. The goal of this report was to further our understanding of the scale of parental incarceration and the impact on the children in Maine. This report provides a snapshot of the number of children who were impacted by parental incarceration in the state system over a 5-year period (2015-2020). The findings show that for the majority of these parents, there is …

Forecasting Crime? Algorithmic Prediction And The Doctrine Of Police Entrapment, Mathew Zaia
Forecasting Crime? Algorithmic Prediction And The Doctrine Of Police Entrapment, Mathew Zaia
Canadian Journal of Law and Technology
As the Commissioners of Police in mid-19th century England illustrate above, the prevention of crime is an inherent function of public policing. To carry out their function of detecting and combating crime, police frequently endeavour to locate and use new tools enabling them to pre-empt criminal activity.2 Many conceptual policing models that drive law enforcement’s focus have been highlighted in scholarly literature: community, problem-oriented, CompStat- driven (short for computer statistics), harm-focused, and order maintenance policing. Developments in modern technology provide additional tools, allowing police forces to delve deeper into suspects’ behaviour and uncover previously unknown patterns of information. Such developments …
Paternal Presence As A Protective Factor For A Black Daughter's Teen Births, Marquitta Dorsey
Paternal Presence As A Protective Factor For A Black Daughter's Teen Births, Marquitta Dorsey
Journal of Family Strengths
Associations between father presence in the home and delayed adolescent sexual activity is well established among middle-class populations. However, considering the prevalence of nonresident fathers among Black households, it is necessary to explore whether such associations extend to early adolescent births for Black adolescent females, and whether mother’s timing of sexual debut and level of education confirm previous findings and predict early teen birth outcomes among Black females, who disproportionately represent the second highest teen birth rate (Hamilton, Rossen & Branum, 2016). The Centers for Disease Control and Prevention urges researchers to explore within group differences among groups of adolescent …

Words And Power In Conflict: Rwanda Under Mrnd Rule, Allan T. Moore Ph.D.
Peace and Conflict Studies
Rwanda under the rule of President Juvenal Habyarimana and the MRND government was a de facto totalitarian governed society, and throughout Habyarimana’s twenty-one year rule, it has been established that there was clear propaganda and hatred directed toward those citizens identified as Tutsi through their national identification records. This article examines the effects of centralized power harbored by Habyarimana and the MRND during this time utilizing a theoretical framework based on the intersection of complementary theory from Foucault, Dahl and Weber. The methodology includes a novel critical discourse analysis (CDA) of transcribed speeches delivered by Habyarimana and Leon Mugesera, as …

The Influence Of Online Product Recommendations On Consumer Choice-Making Confidence, Effort, And Satisfaction, Mohammad Amin Saleh
Doctoral Dissertations
The number of products and services available online is growing at a tremendous pace. Consumers increasingly desire the ability to filter through the noise and quickly discover the products that are most relevant to their needs. Many businesses are implementing product recommender systems to provide this ability to consumers, and the result is often increased sales and more satisfied customers.
However, recommender systems can also have negative consequences for consumers. For example, a recommender system can bias consumers to purchase more expensive products. Additionally, theories of consumer choice-making suggest that recommender systems can sometimes make purchase choices more difficult, resulting …
Structural Sensor Surveillance, Andrew Guthrie Ferguson
Structural Sensor Surveillance, Andrew Guthrie Ferguson
Scholarly Articles in Law Reviews & Journals
City infrastructure is getting smarter. Embedded smart sensors in roads, lampposts, and electrical grids offer the government a way to regulate municipal resources and the police a new power to monitor citizens. This structural sensor surveillance, however, raises a difficult constitutional question: Does the creation of continuously-recording, aggregated, long-term data collection systems violate the Fourth Amendment? After all, recent Supreme Court cases suggest that technologies that allow police to monitor location, reveal personal patterns, and track personal details for long periods of time are Fourth Amendment searches which require a probable cause warrant. This Article uses the innovation of smart …

A Framework For Identifying Host-Based Artifacts In Dark Web Investigations, Arica Kulm
Masters Theses & Doctoral Dissertations
The dark web is the hidden part of the internet that is not indexed by search engines and is only accessible with a specific browser like The Onion Router (Tor). Tor was originally developed as a means of secure communications and is still used worldwide for individuals seeking privacy or those wanting to circumvent restrictive regimes. The dark web has become synonymous with nefarious and illicit content which manifests itself in underground marketplaces containing illegal goods such as drugs, stolen credit cards, stolen user credentials, child pornography, and more (Kohen, 2017). Dark web marketplaces contribute both to illegal drug usage …

Thought Leader Comparisons Of Risks In Precision Medicine Research, Laura M. Beskow, Catherine Hammack-Aviran, Kathleen M. Brelsford
Law Faculty Scholarship
Biomedical research is increasingly capitalizing on an array of data to illuminate the interplay between “omics,” lifestyle, and health. Leveraging this information presents opportunities to advance knowledge but also poses risks to research participants. In interviews with thought leaders, we asked which data type associated with a hypothetical precision medicine research endeavor was riskiest: 42% chose ongoing access to electronic health records, 17% chose genomic analyses of biospecimens, and 15% chose streaming data from mobile devices. Other responses included “It depends” (15%), the three types are equally risky (8%), and the combination of data types together is riskiest (3%). When …

Revising The "Hibernation" Narrative: Technocratic Legal Experts And The Cold War Origins Of The "Justice Cascade", Mark S. Berlin
Political Science Faculty Research and Publications
Accounts of the rise of atrocity justice often characterize the Cold War decades as a time of "hibernation." I argue that this hibernation narrative, and explanations for the rise of atrocity justice in general, overlook important developments during the Cold War period that later helped facilitate the so-called "justice cascade." Specifically, this period witnessed consequential advancements in the institutionalization, domestication, and professionalization of international criminal law. In contrast to studies that emphasize the roles of civil society activists or policymakers in the rise of atrocity justice, the developments I highlight were often driven by the work of technocratic legal experts.

The Due Process Of Bail, Jenny E. Carroll
The Due Process Of Bail, Jenny E. Carroll
Faculty Scholarship
The Due Process Clause is a central tenet of criminal law’s constitutional canon. Yet defining precisely what process is due a defendant is a deceptively complex proposition. Nowhere is this more true than in the context of pretrial detention, where the Court has relied on due process safeguards to preserve the constitutionality of bail provisions. This Essay considers the lay of the bail due process landscape through the lens of the district court’s opinion in O’Donnell v. Harris County and the often convoluted historical description of pretrial due process. Even as the O’Donnell court failed to characterize pretrial process as …

A Comprehensive Consideration Of The Structural-Error Doctrine, Zachary L. Henderson
A Comprehensive Consideration Of The Structural-Error Doctrine, Zachary L. Henderson
Missouri Law Review
Court proceedings are rarely perfect – far from it. Errors happen regularly before and during litigation, and when they do, courts must decide how to handle them. Gone are the days when a typo might demand a new trial: many errors – typos certainly, but also much more serious mistakes – are regularly deemed harmless by the court, meaning those errors had no prejudicial effect on the outcome of the case (and so do not warrant a new trial). Yet even after the development of the harmless-error doctrine in the early part of the twentieth century, errors involving constitutional rights …
State Prisons Turning Into De Facto Mental Health Institutes: A Comparative Look At The Illinois And Nebraska State Prison Systems, Margaret Kramer
State Prisons Turning Into De Facto Mental Health Institutes: A Comparative Look At The Illinois And Nebraska State Prison Systems, Margaret Kramer
Northern Illinois Law Review Supplement
This Comment discusses the systems of approaching mental health in Nebraska and Illinois state prison systems. Starting with how prison systems became some of the largest de facto mental health institutes in the country after deinstitutionalization happened on a national scale. It will then provide the guidelines and regulations in place for both Nebraska and Illinois. This Comment will then discuss what regulations would be most beneficial and how some of these can help in continuing after an individual is released from prison.
Global Innovation Law, P. Sean Morris
Global Innovation Law, P. Sean Morris
Northern Illinois University Law Review
This Article is about opening up a debate on global innovation law. The Article argues that a new hybrid area of transglobal law has emerged in the past decade due to the rise of various disruptive and technological challenges to law beyond the state. As such, the Article argues that global innovation law is a new field that encapsulates the dynamics of law making and regulatory governance in how law operates in a transglobal environment. With the rapid changes in law and regulation to meet the demands of the global economy--the interaction of law and these changes at the domestic …
The Paradox Of Power In Conflict Dynamics, Daniel Rothbart
The Paradox Of Power In Conflict Dynamics, Daniel Rothbart
Peace and Conflict Studies
In recent decades the political state has been implicated in genocide, mass violence, political oppression, and targeted deprivations. Yet, in the field of conflict analysis, the meaning of state “power over” in conflict settings is under-theorized. In this article I probe the conceptual depths of state power to show that such power is neither singular nor simple. It’s neither ahistorical nor asocial. Beneath the surface of the state’s wide-ranging practices of governing its political subjects is a fundamental paradox that juxtaposes the state’s authority as the rightful authority over its subjects against the state’s vulnerability to potentially de-stabilizing threats to …
