Neoliberalism Goes To School: Neoliberalism's Influence On Responses To Sexual Violence In Higher Education Institutions, Naomi Strait Feb 2020

Neoliberalism Goes To School: Neoliberalism's Influence On Responses To Sexual Violence In Higher Education Institutions, Naomi Strait

Tapestries: Interwoven voices of local and global identities

This paper will begin by tracing the historical relationship between sexual violence and race, and then describe how neoliberalism compounded upon this history to create a carceral feminist response to sexual violence. After outlining the neoliberal trends present in national responses to sexual violence, I will narrow my focus to responses within higher education and attempt to demonstrate the parallels between them. I will focus on the commonalities of punitive responses and individualization, which result in a culture of compliance in higher education. I will conclude by describing alternatives to the current way higher education executes Title IX policy.

At The Nexus Of Neoliberalism, Mass Incarceration, And Scientific Racism: The Conflation Of Blackness With Risk In The 21st Century, Olivia C. Sailors

Tapestries: Interwoven voices of local and global identities

This paper examines how the systems of power of neoliberalism, scientific racism, and mass incarceration intersect to construct and uphold the image of “black criminality” and “blackness as a risk” to society. Risk assessments used to determine prison sentencing exemplify this phenomenon. Histories of deliberate associations between blackness and criminality--through science, media, political rhetoric, and economic systems--create a field in which risk assessment is widely regarded as a useful and scientifically neutral tool in mass incarceration. Particular scientific, economic, and carceral circumstances culminating in the 21st century collude to elevate risk assessments into one aspect of a big data apparatus …

Don’T Bite The Hand That Feeds You: Environmental And Human Exploitation Sold As Prosperity, Eliza Macy Feb 2020

Don’T Bite The Hand That Feeds You: Environmental And Human Exploitation Sold As Prosperity, Eliza Macy

Tapestries: Interwoven voices of local and global identities

In this article I focus on corporate power and the false jobs versus human rights dichotomy, extending it to include jobs versus human rights. Using the coal, prison, and oil pipeline industries as examples, the paper explores the ways in which corporate industries gain and maintain local power. I discuss the false narratives and language that industries use to convince people of their importance, showing how they exploit poverty and unemployment to become the single industries dominating localities. Ultimately, this paper demonstrates the fallacy of the jobs versus environment and human rights dichotomy and demonstrates the ways that the coal, …

The Press, National Security, And Civil Discourse: How A Federal Shield Law Could Reaffirm Media Credibility In An Era Of “Fake News”, Jenna Johnson Feb 2020

The Press, National Security, And Civil Discourse: How A Federal Shield Law Could Reaffirm Media Credibility In An Era Of “Fake News”, Jenna Johnson

Texas A&M Law Review

The Constitution expressly provides protection for the freedom of the press. Yet there is one area in which the press is not so free: the freedom to refuse disclosing confidential sources when subpoenaed by the federal government. Currently, there is no federal reporter’s privilege. The Supreme Court has held the First Amendment provides no such protection, and repeated congressional attempts to codify a reporter’s privilege in a federal shield law have failed.

Arguments against a shield law include national security concerns and the struggle to precisely define “journalist.” Such concerns were evident in the most recently proposed shield law, the …

Constraining Strickland, Michael Cicchini Feb 2020

Constraining Strickland, Michael Cicchini

Texas A&M Law Review

When a convicted defendant pursues an ineffective assistance of counsel (“IAC”) claim on appeal—for example, by alleging that the defense lawyer failed to call an important witness at trial—the defendant must satisfy Strickland’s two-part test. This requires a showing that (1) defense counsel performed deficiently, and (2) this deficient performance prejudiced the defendant’s case.

The Strickland test is intentionally difficult for a defendant to satisfy, and courts reject nearly all IAC claims. The primary justification for this is that prosecutors and judges should not have to retry defendants because of defense counsel’s errors, as such errors are completely outside the …

The Experience Of Violence And Help-Seeking Among Mothers Of Adult Chronically Mentally Ill Individuals, Darcy A. Copeland Feb 2020

The Experience Of Violence And Help-Seeking Among Mothers Of Adult Chronically Mentally Ill Individuals, Darcy A. Copeland

Dissertations

Mothers of mentally ill adults are frequently primary caretakers. If mentally ill individuals become violent, mothers are most often victims. In their role as primary caretakers, mothers are knowledgeable regarding their children's illnesses. They are also familiar with the mental health system, including criteria for involuntary hospitalization. Mothers can identify signs of decompensation in their mentally ill children and recognize their need for hospitalization. They cannot, however, always access mental health treatment due to their children's refusal and/or not meeting legal criteria for involuntary hospitalization. This is problematic, particularly for mothers whose mentally ill, adult children have a history of …

Why Do Some Terrorist Attacks Receive More Media Attention Than Others?, Erin M. Kearns, Allison E. Betus, Anthony F. Lemieux Feb 2020

Why Do Some Terrorist Attacks Receive More Media Attention Than Others?, Erin M. Kearns, Allison E. Betus, Anthony F. Lemieux

Criminology and Criminal Justice Faculty Publications

Terrorist attacks often dominate news coverage as reporters seek to provide the public with information. Yet, not all incidents receive equal attention. Why do some terrorist attacks receive more media coverage than others? We argue that perpetrator religion is the largest predictor of news coverage, while target type, being arrested, and fatalities will also impact coverage. We examined news coverage from LexisNexis Academic and CNN.com for all terrorist attacks in the United States between 2006 and 2015 (N=136). Controlling for target type, fatalities, and being arrested, attacks by Muslim perpetrators received, on average, 357% more coverage than other attacks. Our …

Are Men Who Pay For Sex Sexist? Masculinity And Client Attitudes Toward Gender Role Equality In Different Prostitution Markets, Barbara G. Brents, Takashi Yamashita, Andrew L. Spivak, Olesya Venger, Christina Parreira, Alessandra Lanti Feb 2020

Are Men Who Pay For Sex Sexist? Masculinity And Client Attitudes Toward Gender Role Equality In Different Prostitution Markets, Barbara G. Brents, Takashi Yamashita, Andrew L. Spivak, Olesya Venger, Christina Parreira, Alessandra Lanti

Sociology Faculty Research

Prostitution clients’ attitudes toward gender equality are important indicators of how masculinity relates to the demand for commercial sexual services. Research on male client misogyny has been inconclusive, and few studies compare men in different markets. Using an online survey of 519 clients of sexual services, we examine whether male client attitudes toward gender role equality are related to the main methods customers used to access prostitution services (i.e., through print or online media vs. in-person contact). We found no differences among men in these markets in attitudes toward gender role equality in the workplace and home. This is in …

An Exploration Of Correctional Counselor Workloads In A Midwestern State, Adam K. Matz, Nathan C. Lowe Feb 2020

An Exploration Of Correctional Counselor Workloads In A Midwestern State, Adam K. Matz, Nathan C. Lowe

Criminal Justice Faculty Publications

Time studies have been conducted with a variety of occupations. However, no known research has examined the workload of correctional counselors. The Iowa Department of Corrections, in partnership with the American Probation and Parole Association, performed the first known workload evaluation of this population. Over a hundred correctional counselors participated in a time study informed by a task analysis conducted with a representative advisory committee. The most common activities concerned inmate requests, classification, assessment, release planning, treatment group work, and administrative tasks. Most concerning, respondents indicated anywhere from 20-to-50% of the activities engaged in were unsatisfactorily completed.
