Masterpiece's Equal Treatment Of The Religious And Expressive Freedoms Under The First Amendment, Hwi Won Kim May 2020

Masterpiece's Equal Treatment Of The Religious And Expressive Freedoms Under The First Amendment, Hwi Won Kim

Maurer Theses and Dissertations

This thesis aims at examining the validity of free speech claims for religious exemptions on the one hand and reviewing the Masterpiece Court's holdings on the current complex entanglement of religious exemption theories, on the other hand; and finally, it also provides a possible suggestion for co-existing between two constitutional values without an all-or-nothing solution.

As to the free speech argument, the Court would likely decide that a compelled speech argument should succeed if, and only if, the vendor’s good or service is expressive under the Free Speech Clause. For a baker, the Court would protect making a custom cake …

Exploring The Relationship Between Exposure To Intimate Partner Violence And An Emotional-Behavioral Disability Among Children Involved In The Child Welfare System, Kristen E. Ravi

Social Work Dissertations - Archive

This three-article dissertation examines the relationship between exposure to IPV and having an emotional-behavioral disability (EBD) among children in the child welfare system. The first article is a scoping review of the literature that explores how IPV and EBD have been defined and measured in the literature as well as the relationship between them. The second article is a cross-sectional study utilizing secondary data from Wave 3 of the second National Child and Adolescent Wellbeing (NSCAW II) Survey. Structural equation modeling (SEM) is used to analyze a mediational model to examine the role children’s trauma symptoms has on the relationship …

Forecasting Success: Using The Texas Risk Assessment System To Predict Early Discharge In A Large Sample Of High, Moderate, And Low Risk Offenders, Carley Rene Shelton May 2020

Forecasting Success: Using The Texas Risk Assessment System To Predict Early Discharge In A Large Sample Of High, Moderate, And Low Risk Offenders, Carley Rene Shelton

Criminology & Criminal Justice Theses - Archive

Little is known regarding predictive factors that contribute to adults successfully completing felony probation—particularly those who are granted early release. The current study attempts to fill this gap by analyzing data from a large, urban, community supervision and corrections department to examine what predictive factors—as identified by the Texas Risk Assessment System (TRAS) impact successful early release from adult felony probation. Results from multivariate logistic regression models revealed that the TRAS domains of criminal history and education/employment were significant predictors of early dismissal from felony community supervision as was the total TRAS risk score. Additionally, being male and black significantly …

Absent Father Timing, Criminal Behavior, And Arrest Across The Life Course, Krysta N. Knox May 2020

Absent Father Timing, Criminal Behavior, And Arrest Across The Life Course, Krysta N. Knox

Criminology & Criminal Justice Theses - Archive

Although prior research has examined the link between having an absent biological father and self-reported delinquency, few studies have assessed the influence of the timing of paternal absence (i.e., the child’s age when father leaves). Using data from the National Longitudinal Study of Adolescent to Adult Health (Add Health), the present study examines the impact of the timing of biological father absence on delinquency and arrest across the life course. Results of negative binomial regression reveal that biological father absence before birth, early in childhood, (birth to age 5) and late adolescence (age 14 to 18) was significantly related to …

Improving Indigent Defense: An Evaluation Of Program Effectiveness For The California Defense Investigators Association’S Defense Investigator Training Academy, Sheree Martinek May 2020

Improving Indigent Defense: An Evaluation Of Program Effectiveness For The California Defense Investigators Association’S Defense Investigator Training Academy, Sheree Martinek

Master's Projects

Training is a crucial component of investigation work; however, there is a significant discrepancy regarding the training mandated and received by prosecution-oriented and defense-oriented investigators. Prosecution investigators (such as law enforcement detectives or District Attorney investigators) have considerable resources and require extensive training aside from one’s education. In respect to training, investigators who work for the prosecution are required to complete the California Peace Officer Standards and Training (POST). Completion of POST is a minimum of 664 hours of training (POST, 2020). However, there is no mandatory training program, academy, or number of cumulative training hours required for an investigator …

Operational Procedures For Releasing Police Records: A Process Evaluation Of California Law Enforcement Agencies’ Implementation Of Senate Bill 1421, Bianca Madrid May 2020

Operational Procedures For Releasing Police Records: A Process Evaluation Of California Law Enforcement Agencies’ Implementation Of Senate Bill 1421, Bianca Madrid

Master's Projects

This research intends to explain how law enforcement agencies in California have implemented operational procedures to comply with the CPRA pursuant to SB 1421 requirements. Because SB 1421 vastly expanded the CPRA, demand for law enforcement record requests has significantly increased in volume. Also, due to key components of SB 1421 which lack clarity in defining specific terminology, each law enforcement agency had to develop its own interpretation of how to implement requirements set forth by the statute. Law enforcement agencies have implemented new requirements to reflect the changes in SB 1421 by establishing working protocols for compliance, developing standard …

Who's Writing What We Read: Authorship In Criminological Research, Bethany Bray

Masters Theses and Doctoral Dissertations

This thesis seeks to evaluate and identify authorship trends within criminological journals based on presumed gender and current institutional affiliation from four major criminal justice and criminological (CCJ) journals from 2014 through 2019. A content analysis was conducted on articles from these journals in order to determine the author gender and affiliation. Findings indicate that a vast majority of authors are housed in universities. Moreover, the gender of first authors significantly varied by journal type, with a majority of first authors in Criminology and Critical Criminology being male. In contrast, gender of first authors in Race & Justice was equally …

Miranda Rights Comprehension And Advice To Juveniles, Aishani Eggenberger May 2020

Miranda Rights Comprehension And Advice To Juveniles, Aishani Eggenberger

Masters Theses and Doctoral Dissertations

Juveniles have limited understanding of their Miranda rights. Reforms including simplified wording and the presence of an “interested adult” have been implemented to assist juveniles with legal decisions, but adults’ understanding of Miranda rights is also limited. The present study examined whether adults’ Miranda knowledge related to their estimates of juveniles’ Miranda understanding and their advice to juveniles being questioned by police. Online participants (n= 498) completed measures of Miranda knowledge and read one of eight hypothetical scenarios varying the juvenile’s age (13 or 16 years), Miranda rights version (standard or simplified), and crime (shoplifting or shooting). Across all conditions, …

The Impact Of Social-Emotional Training On Social-Emotional Development In Students Based On Student Grade And Teacher Experience, Qian Hui Lim May 2020

The Impact Of Social-Emotional Training On Social-Emotional Development In Students Based On Student Grade And Teacher Experience, Qian Hui Lim

Electronic Theses and Dissertations

Research suggests that early childhood is a sensitive developmental period for social and emotional development, and early intervention leading to social-emotional skills in preschool years is significantly associated with positive outcomes later in life. Many preschool children are reported to already experience social-emotional problems, but very few teachers have received training to implement social-emotional development programs. Educational institutions must carry the responsibility of promoting children’s social and emotional development because most young children spend the majority of their time learning and socializing in school. This study sought to add to current literature by looking into the effects of student grade …

Adverse Childhood Experiences: The Influence Of Poly-Victimization On Adolescent Delinquency And Adult Criminality, Samantha Qualkenbush May 2020

Adverse Childhood Experiences: The Influence Of Poly-Victimization On Adolescent Delinquency And Adult Criminality, Samantha Qualkenbush

Master's Theses

Adverse childhood experiences (ACEs) are under-researched and a large part of unrecognized child victims. Although there is considerable research on trauma and adverse experiences in children, there are gaps in research concerning specific types of offending and specific ACEs. The purpose of this study is to determine if specific types of ACEs, or combinations of ACEs, influence children in differing ways related to adolescent delinquency and adult criminality. Analyses of previously collected data, specifically considering information on differences in the average number and likelihood of offenses for both juveniles and adults provides intriguing results. In concurrence with previous research, this …

The Limits And Possibilities Of Data-Driven Antitrafficking Efforts, Jennifer Musto Ph.D. May 2020

The Limits And Possibilities Of Data-Driven Antitrafficking Efforts, Jennifer Musto Ph.D.

Georgia State University Law Review

An examination of technology in the countertrafficking space reveals recurring tensions between law enforcement and rights-based approaches. It also illuminates assumptions, such as the one that posits more law enforcement-focused, nonstate-actor-supported data-driven efforts are necessary to securing justice for people in trafficking situations. However, a closer look at how technology is used and by whom also invites us to ask different questions and to leverage the power of our all-too-human creative potential in thinking about how to value and prioritize data ethics, transparency, and accountability in future countertrafficking work.

Evaluation Of The Reach Program In Juvenile Detention, Samantha Burgett, Eseosasere Okundaye, Abby Koselke

Symposium on Research and Creative Expression (SORCE)

Although mentorship programs have been determined to be effective in promoting positive outcomes in youth and in decreasing delinquency, there is a significant gap in the literature in terms of implementation and evaluation of mentoring programs within juvenile detention facilities. The aim of our study is to evaluate the effectiveness of the REACH program, a violence prevention and delinquency intervention curriculum which the researchers implemented from September through December 2019 within the Porter County Juvenile Detention Center. The REACH curriculum is centered around four key program components: 1) Self-esteem enhancement, 2) Decision-making skills, 3) Setting post-release goals, and 4) Sense …

Executive Privilege - With A Catch: How A Crime-Fraud Exception To Executive Privilege Would Facilitate Congressional Oversight Of Executive Branch Malfeasance In Accordance With The Constitution's Separation Of Powers, Anthony W. Wassef May 2020

Executive Privilege - With A Catch: How A Crime-Fraud Exception To Executive Privilege Would Facilitate Congressional Oversight Of Executive Branch Malfeasance In Accordance With The Constitution's Separation Of Powers, Anthony W. Wassef

Cornell Law Review

A crime-fraud exception to assertions of executive privilege in response to congressional subpoenas would help level the playing field between the two branches in those moments when Congress is most needed to serve as a check and balance on the executive branch. A crime-fraud exception would signal to executive branch officials that executive privilege will not conceal their malfeasance; would counteract hyperpartisanship as a force that insulates executive branch officials from the consequences of their actions; and would rein in the expansive reach of protective assertions of executive privilege. For years, Congress has surrendered power to the executive branch. A …

This study analyzes factors that potentially contribute to America’s elevated rate of identity theft in relation to Australia in order to reveal its cause. It was ultimately found that the United States experiences a greater amount of computer usage within its country, has the ability to implement a stricter prison sentence on those convicted of committing identity theft in accordance with its legal code, and has a greater conviction rate while Australia has a higher prosecution rate. These findings, when applied in the …

The information needed to perform a meaningful statistical analysis is established, along with hypothetical potential outcomes.

Family Annihilators: The Psychological Profiles Of Murderous Fathers, Taylor Oathout May 2020

Family Annihilators: The Psychological Profiles Of Murderous Fathers, Taylor Oathout

Criminal Justice

Yardley, Wilson, and Lynes (2014), in their study of British family annihilators between 1980 and 2012, established four profiles of familicide offenders: self-righteous, disappointed, anomic, and paranoid. This paper located 39 cases of familicide within the United States between 2009 and 2019 using LexisNexis. Familicide is defined as a domestic crime where a father murders at least one of his biological children and the children’s mother. Cases were categorized by analyzing the relationship between the offenders’ primary motives and features of the crime and offender. Primary motives were family breakdown, appearance, financial distress, mental illness, and protection. Features included domestic …
