Hryniak, The 2010 Amendments, And The First Stages Of A Culture Shift?: The Evolution Of Ontario Civil Procedure In The 2010s, Gerard Joseph Kennedy

PhD Dissertations

This dissertation investigates the effects of amendments to Ontarios Rules of Civil Procedure that came into effect on January 1, 2010 (the 2010 Amendments) and were subject to interpretation by the Supreme Court of Canada in a 2014 decision (Hryniak). Hryniak concerned summary judgment. However, the dissertation largely concentrates on the effects of Hryniak and the 2010 Amendments outside the summary judgment context, inquiring into whether Hryniaks call for a culture shift and the 2010 Amendments enshrinement of the principle of proportionality have had noticeable effects. It does this by analyzing three aspects of Canadian procedural law that were not …

An Analysis Of The Components Of Terrorism, Rhianna Hayes May 2020

An Analysis Of The Components Of Terrorism, Rhianna Hayes

Theses

Terrorism is a complex topic to study. There is no consensus on what the word terrorism means, and there is even less consensus on why groups of people go out of their way to use terrorism as a form of political expression. Various analyses and studies have been conducted to attempt to explain this complex topic. Many of these studies have drawn from criminal justice research to apply criminological theories as an explanation for terrorism. The application of criminological theories provides one baseline for people to attempt to understand terrorism. At first glance, it may seem that criminological theories will …

The Denial Of Black Victimhood: Examining Attitudes Of Sexual Assault And Victim-Blaming On A College Campus, A Continued Analysis, Odia Kane

Master's Theses

This study examines the attribution of guilt and victimhood in the context of rape on predominately white college campuses. The study is comprised of two samples; Sample 1 (n=362) and Sample 2 (n=1,144) of students from a New England university. Each participant read a vignette regarding two classmates: a female victim, Taneesha or Madeline, and a male perpetrator, Jamal or Connor, completing a group project. The findings of this study are critical because they analyze the surrounding attitudes of the treatment of victims of sexual assault and assess the social and political climate of rape culture on college campuses.

Integrating Psychological Theory Into The Legal Doctrine Of Deterrence, Alexander G. Parseghian May 2020

Integrating Psychological Theory Into The Legal Doctrine Of Deterrence, Alexander G. Parseghian

Senior Honors Projects, 2020-current

The deterrence principle within the field of criminology is essential in preventing deviant behavior before its commission and defines the relationship individuals have with an institution’s system of punishment. Deterrence was originally studied solely among criminal populations, but modern deterrence theory broadens the definition of crime to actions relevant to the general population through any act societal values would proscribe. The addition of psychological principles to deviance research and the usage of university student populations has highlighted academic dishonesty as a prolific deviant behavior outcome variable. Criminological researchers have identified factors that complement or mirror psychological and educational theory, yet …

Correlation Between Victim-Blaming Attitudes And Victim Gender In Non-Sexual Crime Scenarios, Caroline Whitlow May 2020

Correlation Between Victim-Blaming Attitudes And Victim Gender In Non-Sexual Crime Scenarios, Caroline Whitlow

Senior Honors Projects, 2020-current

Sex crime victims often experience victim-blaming from third parties. Literature does not discuss whether this pattern comes from gender bias or stigma surrounding certain types of crime. This mixed methods study assesses correlation between gender of non-sexual crime victims and third-party blame assignment. Quantitative research found higher levels of blame towards male victims, with a t-statistic of 5.865. Qualitative research found gendered perceptions of responsibility that invoke female victims’ sex and instruct women to adjust lifestyle choices. Social work practitioners can use this data to improve practice with crime victims and encourage dialogues surrounding victim-blaming in education and practice.

Researchers have not yet dedicated sufficient attention to the effect of prison facility characteristics on the various uses of solitary confinement. This study employs nationally representative correctional facility survey data to assess how certain prison characteristics affect the use of disciplinary segregation, administrative segregation, and protective custody. The prison characteristics include inmate total, female facility, proportion of inmates in maximum custody, proportion of black inmates, overcrowding, staff-to-inmate ratio, proportion of inmates with work assignments, and total assaults. The study also evaluates how the various forms of solitary confinement impact prison violence/misconduct. Poisson regression models suggest that the use of all …

Iron Manicures: Sex, Power, And Sedition In Margaret Atwood's Writing, Anna Zarra Aldrich May 2020

Iron Manicures: Sex, Power, And Sedition In Margaret Atwood's Writing, Anna Zarra Aldrich

Honors Scholar Theses

Margaret Atwood has often been criticized as a bad feminist writer for featuring villainous, cruel women. Atwood has combatted this criticism by pointing out that evil women exist in life, so they should in literature as well. Every story requires a villain and a victim, for Atwood these roles are both usually played by women. This thesis will explore the idea of the woman as spectacle in both behavior and body. Women are controlled by the idea that they must care. When they stop caring, they become a threat. At the heart of Atwood’s writing are the relationships between women …

The Effects Of Childhood Trauma On Romantic Support And Adult Problem Behavior, Keiva R. Brannigan May 2020

The Effects Of Childhood Trauma On Romantic Support And Adult Problem Behavior, Keiva R. Brannigan

Senior Honors Projects, 2020-current

Adverse childhood experiences (ACEs) are a common topic in research investigating outcomes of abused or traumatized children. Previous literature on ACEs have established that high levels of ACEs are associated with both higher levels of problem behaviors in adulthood and lower quality of support in romantic relationships in adolescence/early adulthood. However, the potential for high levels of romantic support and other healthy relationship qualities to act as a buffer against the negative effects of ACEs on later problem behaviors has yet to be addressed in the literature. Thus, the present study utilizes data from an ongoing longitudinal study on social …

Grounds For Asylum: How Victims' Rights Laws Confer Particular Social Group Status To Domestic Violence Victims, Jordan Cotleur May 2020

Grounds For Asylum: How Victims' Rights Laws Confer Particular Social Group Status To Domestic Violence Victims, Jordan Cotleur

Immigration and Human Rights Law Review

Despite an uptake in legislation criminalizing domestic violence since the 1990’s, women in Latin America still face the highest rates of gender-based and domestic violence of any region in the world. In Central America, two-thirds of female homicide victims are killed because of their status as a woman (also known as “femicide”) and half of women face this fate at the hands of a current or former partner. The violence perpetuates at such an alarming rate because investigations into gender-based violence are nearly non-existent in the region. In 2016, it was reported that up to ninety-eight percent of cases involving …

“We Can’T Just Throw Our Children Away”: A Discussion Of The Term-Of-Years Sentencing Of Juveniles And What Can Be Done In Texas, Anjelica Harris May 2020

“We Can’T Just Throw Our Children Away”: A Discussion Of The Term-Of-Years Sentencing Of Juveniles And What Can Be Done In Texas, Anjelica Harris

Texas A&M Law Review

In the words of Supreme Court Justice Elena Kagan, children are different. The issue of how to sentence juvenile offenders has long been controversial. Although psychology acknowledges the connection between incomplete juvenile brain development and increased criminality, the justice system lags behind in how it handles juvenile offenders. A prime example is the case of Bobby Bostic, who at the age of sixteen was charged with eighteen offenses and sentenced to 241 years in prison. This sentence, known as a term-of-years or virtual life sentence, essentially guarantees that no matter what Bobby does or who he proves himself to be …

Responding To Crossover Youth: A Look Beyond Recidivism Outcomes, Emily M. Wright, Ryan E. Spohn, Michael Campagna

Criminology and Criminal Justice Faculty Publications

Crossover youth are involved in both child welfare and juvenile justice systems. The Crossover Youth Practice Model (CYPM) promotes collaboration between these systems to inform decision making between the two agencies and better serve these youth. Yet, few outcome evaluations of the CYPM exist, especially those that assess outcomes beyond recidivism, such as case dispositions, case closure, or placement or living situations. This study examined whether the CYPM (n = 210) decreased recidivism and increased system/case responses and positive outcomes among youth within 9–18 months after the youth’s initial arrest relative to a comparison group of crossover youth ( …

METHODS:

For 2 years beginning in fall 2013, we collected data through key informant interviews on community programs and policies related to healthy weight among children that occurred in the 10 years before the interview. We characterized community …
