Project Foresight: A Ten-Year Retrospective, Paul J. Speaker, Max M. Houck Jul 2020

Project Foresight: A Ten-Year Retrospective, Paul J. Speaker, Max M. Houck

Faculty & Staff Scholarship

Project FORESIGHT is a business-guided self-evaluation of forensic science laboratories across the globe. The participating laboratories represent metro, regional, state, and national agencies. Economics, accounting, finance, and forensic faculty provide assistance, guidance, and analysis. Laboratories participating in Project FORESIGHT have developed standardized definitions for metrics to evaluate work processes, linking financial information to work tasks, and functions. Laboratory managers can then assess resource allocations, efficiencies, and value of services—the mission of Project FORESIGHT is to measure, preserve what works, and change what does not.

The benchmark data for the 2018-2019 performance period includes laboratory submissions for a variety of fiscal …

Who Are The Mavens Of Bystander Intervention? Implications For The Social Diffusion Of Intervention Norms, Leah C. Butler, Bonnie S. Fisher Jul 2020

Who Are The Mavens Of Bystander Intervention? Implications For The Social Diffusion Of Intervention Norms, Leah C. Butler, Bonnie S. Fisher

Criminology and Criminal Justice Faculty Publications

A recent randomized controlled trial reported that Green Dot (GD)—a bystander intervention training program that targets popular opinion leaders for intensive training—reduced school-level interpersonal violence perpetration and victimization. Expanding GD’s targeted group members to include “mavens” of bystander intervention—those who spread bystander intervention norms to others by communicating with peers—may increase the effectiveness of such training. Self-report data collected from students at the 13 intervention high schools in Kentucky are analyzed to identify characteristics of those who engage in discussions with peers about preventing interpersonal violence. Findings show that students who engage in more frequent bystander behaviors are more likely …

The Role Of Restorative Practices In Building Community, Increasing Student Learning And Reducing Racially Disparate Discipline In Secondary Schools, Lawrence Koszewski Jul 2020

The Role Of Restorative Practices In Building Community, Increasing Student Learning And Reducing Racially Disparate Discipline In Secondary Schools, Lawrence Koszewski

School of Education and Leadership Student Capstone Projects

The highly negative outcomes of persistent racially disparate discipline for students and communities of color are well documented and wide-ranging. In response many districts are instituting Restorative Practices in order to reduce the racial discipline gap and mediate negative outcomes for communities. Research of these districts shows a reduction in suspension rates for all students although a racial gap persists. In order to maximize the potential positive benefits of Restorative Practices teachers, administrators and facilitators must fully and properly implement Restorative Practices. To do so will require support through clear, personalized and tangible Restorative resources. This project involved the production …

Justice For All? An In-Depth Look At Sexual Assault Kit Testing In The Carolinas, Jessalynn C. King Jul 2020

Justice For All? An In-Depth Look At Sexual Assault Kit Testing In The Carolinas, Jessalynn C. King

Senior Theses

Within the last few decades, technological advancements and an improved understanding of biological materials have led to an increase in evidence that can be submitted for forensic testing in criminal justice investigations. In a sexual assault investigation, a sexual assault kit (SAK) is often collected and contains the evidence found on the victim’s or suspect’s person. While the true total is unknown, it is estimated that several hundred thousand untested SAKs remain in the custody of law enforcement and forensic crime laboratories across the United States. Whether these SAKs were neglected due to law enforcement bias, the prioritization of other …

Unraveling The Temporal Aspects Of Victimization: The Reciprocal, Additive, And Cumulative Effects Of Direct/Vicarious Victimization On Crime, Yeoju Park Jul 2020

Unraveling The Temporal Aspects Of Victimization: The Reciprocal, Additive, And Cumulative Effects Of Direct/Vicarious Victimization On Crime, Yeoju Park

Theses and Dissertations

The current study aims to assess the continuous impact of direct/vicarious victimization on subsequent victimization and delinquency/crime across waves using an incorporated model of Agnew’s general strain theory and the lifestyle/routine activities perspective. This study also aims to assess the additive and cumulative impact of dual victimization (i.e., exposure to direct and vicarious victimization) on offending. A cross-lagged model is conducted to examine the impacts of direct victimization, vicarious victimization, and delinquency/crime at an early point in time on these variables at later points in time using three waves from the Pathways to Desistance Study. Negative binomial regression models and …

Multinational Bibliography On Acculturation (1808-2020), With Url Links To Abstracts Or Full-Text, Joaquim Castro, Floyd W. Rudmin

Online Readings in Psychology and Culture

Acculturation is an ancient topic of scholarship, with ever more interest and importance as migration increases on a global scale. The pace of scholarship has accelerated in the past few decades, with the result that earlier scholarship tends to be lost and recent scholarship is often unfound. The following bibliography is intended to help remedy these kinds of problems. This 2020 revision of Rudmin’s 2011 bibliography has almost 8,300 references, including much of the acculturation literature written in Portuguese, French, and Spanish.

Ethical Issues With Lawyers Openly Carrying Firearms, Dru Stevenson Jul 2020

Ethical Issues With Lawyers Openly Carrying Firearms, Dru Stevenson

St. Mary's Journal on Legal Malpractice & Ethics

Ethical concerns arise when lawyers openly carry firearms to adversarial meetings related to representation, such as depositions and settlement negotiations. Visible firearms introduce an element of intimidation, or at least the potential for misunderstandings and escalation of conflicts. The adverse effects of openly carried firearms can impact opposing parties, opposing counsel, the lawyer’s potential clients, witnesses, and even judges and jurors encountered outside the courtroom. The ABA’s Model Rules of Professional Conduct in their current form include provisions that could be applicable, such as rules against coercion and intimidation, but there is no explicit reference to firearms. Several reported incidents …

Another Collateral Consequence: Kicking The Victim When She’S Down, Lauren N. Hancock Jul 2020

Another Collateral Consequence: Kicking The Victim When She’S Down, Lauren N. Hancock

Washington and Lee Law Review

Every state has a victim compensation fund that provides financial relief to victims of crime who have no other way to pay for medical expenses, funeral costs, crime scene cleanup, or other costs associated with the crime. States impose their own eligibility requirements to determine which victims can receive funding. Six states prohibit victims with certain criminal histories from obtaining compensation. This means that innocent victims of crime are left with nowhere to turn because of something that they already “paid” for. This leaves victims, who are likely already in a financially precarious situation due to their felon status, with …

July 2020: Revival Of The Social Sciences, Gardner-Webb University Jul 2020

July 2020: Revival Of The Social Sciences, Gardner-Webb University

President William Downs' Blog

In this month’s blog, I’m not going to mention COVID-19, Coronavirus, pandemics, face coverings, vaccines, or even social distancing. Indulge me…there are other pressing issues.

As the infamous year 2020 lurches forward, we should take note of what’s going on across our nation. There’s hurt, frustration, and anger in the streets of some of our largest cities. There’s widespread reconsideration of the nation’s history and of some of its principal players. There’s a highly polarized national election looming on the near horizon. Superimposed upon all of these strains are economic volatility and uncertainty. We see the economic fallout of 2020’s …

When They Hear Us: Race, Algorithms And The Practice Of Criminal Law, Ngozi Okidegbe Jul 2020

When They Hear Us: Race, Algorithms And The Practice Of Criminal Law, Ngozi Okidegbe

Faculty Scholarship

We are in the midst of a fraught debate in criminal justice reform circles about the merits of using algorithms. Proponents claim that these algorithms offer an objective path towards substantially lowering high rates of incarceration and racial and socioeconomic disparities without endangering community safety. On the other hand, racial justice scholars argue that these algorithms threaten to entrench racial inequity within the system because they utilize risk factors that correlate with historic racial inequities, and in so doing, reproduce the same racial status quo, but under the guise of scientific objectivity.

This symposium keynote address discusses the challenge that …

Impacts Of Positive Behavior Interventions And Strategies Programs On Educator Practices, Charles O’Donnell Jul 2020

Impacts Of Positive Behavior Interventions And Strategies Programs On Educator Practices, Charles O’Donnell

School of Education and Leadership Student Capstone Theses and Dissertations

Positive Behavior Interventions and Strategies has been a driving force in reshaping educator responses to student behavior and promoting equity since 1997. As a non-prescriptive initiative that varies across settings, implementation styles and effectiveness can also appear differently. In its overall aim to keep students out of the school-to-prison pipeline and promote positive behavior management techniques over punitive ones, PBIS has caused many educators to re-evaluate old attitudes about school discipline and learn new, more effective and equitable strategies to set students on the path to greater behavioral self-management and success. This action research encapsulates educator attitudes about PBIS on …

College Supports For Asd: Autistic Perspectives Across Educational Career, Rachel Stanley Jul 2020

College Supports For Asd: Autistic Perspectives Across Educational Career, Rachel Stanley

Master's Theses (2009 -)

Higher education has become a viable pursuit for many autistic individuals, but those who seek a college degree graduate at rates significantly lower than their peers. Social skills, mental health, executive functioning, independent living, and sensory processing are highlighted as areas of difficulty for autistic college students. However, research seeking the perspectives and experiences of autistic individuals has been limited, and proposed solutions are not based on input from the population they seek to serve. Further, research has been largely limited to current college students, and may miss potentially useful perspectives on transition from individuals pre- and post-college. This study …

Exploring Perceptions Of Healthcare Quality In Oregon Male Prisons: Interviews With Individuals Recently Released From Long-Term Imprisonment, Rén Rosz Jul 2020

Exploring Perceptions Of Healthcare Quality In Oregon Male Prisons: Interviews With Individuals Recently Released From Long-Term Imprisonment, Rén Rosz

University Honors Theses

The healthcare that people who are imprisoned receive is inadequate and does not meet the requirements owed to them by the Eighth Amendment. The Bureau of Justice Statistics has repeatedly surveyed inmates about the health care that they receive (Bureau of Justice Statistics [BJS], n.d.). One of the most recent iterations, in 2004, showed that there were large gaps in the health care that prisoners received: not being able to see a healthcare provider after an injury, necessary medications being discontinued, and lab tests being restricted (Wilper, et al, 2009). The surveys were implemented to highlight policies needing correction and …

Teaching Professional Responsibility Through Theater, Michael Millemann, Elliott Rauh, Robert Bowie Jr. Jul 2020

Teaching Professional Responsibility Through Theater, Michael Millemann, Elliott Rauh, Robert Bowie Jr.

UC Law Journal of Race and Economic Justice

This article is about ethics-focused, law school courses, co-taught with a theater director, in which students wrote, produced and performed in plays. The plays were about four men who, separately, were wrongfully convicted, spent decades in prison, and finally were released and exonerated, formally (two) or informally (two).

The common themes in these miscarriages of justice were that 1) unethical conduct of prosecutors (especially failures to disclose exculpatory evidence) and of defense counsel (especially incompetent representation) undermined the Rule of Law and produced wrongful convictions, and 2) conversely, that the ethical conduct of post-conviction lawyers and law students helped to …

See This Empty Cage Now Corrode: The International Human Rights And Comparative Law Implications Of Sexually Violent Predator Laws, Michael L. Perlin, Heather Ellis Cucolo

Articles & Chapters

From every perspective, our sexually violent predator (SVPA) laws are a miserable failure. In this paper, we present a new approach: a turn to international human rights law as a source of rights for the population in question, and a consideration of the matter from the perspective of comparative law.

To briefly summarize, many nations have enacted laws that both mirror and contradict early developments in United States civil commitment jurisprudence. In these nations, though, challenges to community containment and preventive detention laws have been more successful when based upon international human rights law. Also, registry notification is generally far …

Understanding The Requisite Content For Interprofessional Education On Sentinel Injuries, A Qualitative Study, Elizabeth A. Cleek Jul 2020

Understanding The Requisite Content For Interprofessional Education On Sentinel Injuries, A Qualitative Study, Elizabeth A. Cleek

Dissertations (1934 -)

Child maltreatment is a public health concern in the United States. The consequences of child maltreatment pose both immediate and lifelong health threats to victimized children. Given the health consequences of child maltreatment, health care providers (HCPs) are legally required to report any reasonable suspicion of child maltreatment to child protective services (CPS). Sentinel injuries (SIs) are some of the earliest and most readily identifiable red flags of child maltreatment. SIs are any unexpected bruising or intra-oral injuries in non-mobile infants. SIs are highly correlated with child maltreatment and may be the only sign of child maltreatment in an otherwise …
