Sexual Education As A Form Of Sexual Assault Prevention: A Survey Of Sexual Education Among States With The Highest And Lowest Rates Of Rape, Brittney Herman
Sexual Education As A Form Of Sexual Assault Prevention: A Survey Of Sexual Education Among States With The Highest And Lowest Rates Of Rape, Brittney Herman
BYU Education & Law Journal
Our Nation overwhelmingly supports sexual education in public
schools. A study by Siecus found that 98% of people surveyed support
sexual education in public high schools and 89% in public middle
schools. Unfortunately for some students, they will receive no sexual
education of very limited, ineffective sexual education, simply because
of where they live. Even if a student is fortunate to live in an
area which has or requires sexual education, this education may be
insufficient.
There have been countless advocates for sexual education.
With the rise of each new sexual education concern, advocates emerge
as if in waves. Most …
Alcohol Misuse And Abuse Among College Students: An Implementation Of A Screening Program., Tiffany Slaughter Newcomb
Alcohol Misuse And Abuse Among College Students: An Implementation Of A Screening Program., Tiffany Slaughter Newcomb
Doctor of Nursing Practice Papers
Excessive alcohol use in the United States creates serious economic, health, and mortality problems (CountyHealthRankings, 2018). College students experience high rates of use, binge drinking, and 20% of college students meet the criteria for alcohol use disorder [AUD] (NIH, 2014). Screening by healthcare providers (HCPs) in the student health setting is critical and a recommended strategy for reducing negative consequences of alcohol use experienced by college students (US Preventive Services Task Force, 2018).
Aims: The objective of this project was to implement an alcohol screening program among college-age undergraduate students in a university student health center.
Methods: HCPs …

Examining The Predictors Of The White Racial Justice Advocate, Danielle N. Franks
Examining The Predictors Of The White Racial Justice Advocate, Danielle N. Franks
Doctoral Dissertations
In recent years, race and racial justice issues have been at the forefront of political and academic discourse. Despite claim ha he Unied Sae ha moed ino a pot-acial era with the election of Barack Obama in 2008, empirical evidence unequivocally demonstrates that racial disparities still exist. While the system of racial oppression clearly has deleterious effects on people of color, some argue that White individuals are also negatively affected, albeit indirectly, by this system. Because the system of racial oppression affects White individuals, it is important that they too make efforts to dismantle the system of racial oppression. As …
The Effects Of Variations In Confession Evidence And Need For Cognition On Jurors' Decisions, Kelsey S. Henderson, Lora M. Levett
The Effects Of Variations In Confession Evidence And Need For Cognition On Jurors' Decisions, Kelsey S. Henderson, Lora M. Levett
Criminology and Criminal Justice Faculty Publications and Presentations
The reliability of a confession partially depends on the interrogation methods used and the confession’s content. Confronting suspects with evidence gives a suspect knowledge of nonpublic details, increasing the likelihood of a false confession (Gudjonsson & Pearse, 2011; Leo, 2009), and makes the confession harder to judge as more or less reliable. That is, if a confession is consistent with case facts but details of the crime were communicated to the suspect during interrogation, it is difficult to judge whether the confession is a product of the suspect’s knowledge of the crime or the details that were communicated during the …
Criminal Law In Crisis, Benjamin Levin
Criminal Law In Crisis, Benjamin Levin
University of Colorado Law Review Forum
In this Essay, I offer a brief account of how the COVID-19 pandemic lays bare the realities and structural flaws of the carceral state. I provide two primary examples or illustrations, but they are not meant to serve as an exhaustive list. Rather, by highlighting these issues, problems, or (perhaps) features, I mean to suggest that this moment of crisis should serve not just as an opportunity to marshal resources to address the pandemic, but also as a chance to address the harsh realities of the U.S. criminal system. Further, my claim isn’t that criminal law is in some way …
Why People Remain In Socially Disorganized Communities: A Critique Of Social Disorganization Theory, Lasheyla Kajuan Jones
Why People Remain In Socially Disorganized Communities: A Critique Of Social Disorganization Theory, Lasheyla Kajuan Jones
Public Affairs Dissertations - Archive
The literature surrounding social disorganization has typically focused on crime and a communities inability to influence existing social rules of behavior upon individuals (Paulsen & Robinson, 2004). This qualitative study examines twenty-one tenure tract residents, business owners, and/or leader’s motivation for remaining in areas deemed socially disorganized under the HUD R/ECAP standards. Utilizing interviews and surveys to understand how individual participants experience living, working, and/or advocating in communities classified as socially inadequate, allowed patterns to emerge that pinpointed why people chose to remain in these communities. Leaders, business owners, and residents alike, offered an array of information supporting their position …
Enhancing Student Mathematics Success Through Service-Learning: An Examination Of Student Motivation Using The Self-Determination Theory, Shanna E. Banda
Enhancing Student Mathematics Success Through Service-Learning: An Examination Of Student Motivation Using The Self-Determination Theory, Shanna E. Banda
Educational Leadership & Policy Studies Dissertations - Archive
The increase in collegiate enrollment, yet bleak graduation rates, poses a significant problem for students and educators alike. Contributing to the high attrition rates, a lack of academic motivation often leads to poor performance in gateway mathematics courses. Factors influencing academic motivation include self-efficacy, anxiety, perceptions about the importance and utility value of math, and soft skills. To heighten student motivation and improve academic success, educators have implemented active-learning strategies, such as service-learning, which have shown positive effects on academic performance. The self-determination theory guided this study as a theoretical framework for student motivation. During the spring 2019 semester, 615 …
Reporting Realities: Are The Clery Act And Other Federal Policies Failing Women At Institutions Of Higher Education?, Christine Alainebloczynski Hall
Reporting Realities: Are The Clery Act And Other Federal Policies Failing Women At Institutions Of Higher Education?, Christine Alainebloczynski Hall
Educational Leadership & Policy Studies Dissertations - Archive
Violence against women attending institutions of higher education has been called a significant problem by both researchers and federal policymakers. The primary goal of this study was to determine if trends in the institutional reporting of forcible sex offenses and VAWA offenses reflect any changes resulting from the implementation of federal guidelines, policies, and legislation. The study also examined profiles of institutions that (1) fail to complete Clery Act reporting as federally mandated and (2) report data in a systematic way, therefore, results can be compared with the actual rates of violence against women discovered from national campus climate surveys …
Addressing Transplant Tourism Problems And Proposed Solutions: Regulation Instead Of Prohibition, Colleen Naumovich
Addressing Transplant Tourism Problems And Proposed Solutions: Regulation Instead Of Prohibition, Colleen Naumovich
Indiana Journal of Global Legal Studies
Medical tourism, as defined by scholar Glenn Cohen, is "the travel of residents of one country to another country for treatment."' Transplant tourism, a type of medical tourism, is traveling abroad to purchase an organ for transplant. Although organ sale is currently illegal in every country except Iran, many countries-such as India, the Philippines, Pakistan, Bangladesh, and Egypt-have thriving black markets for these goods. Organ transplants are often the only effective means of treating end state organ failure, and the demand for transplants is especially high in developed and middle-income countries. Shortages of available donors and organs, however, have caused …
Recidivism Rates And Its Correlation To Mathematics And Reading Comprehension Among Detention Center Juveniles Who Participate In Trauma Informed Teaching, Isaac Collin
Dissertations
In this study rates of recidivism and their relationship with mathematics and reading comprehension will be analyzed. In the literature, a full comprehensive study of high school mathematics and reading was taught without the implementation of a watered-down academic curriculum. In order for detention center students to benefit from a detention center education they need instructors to expose them to state academic standards. The research questions guiding this study included 1) Is there a significant difference in the achievement scores in mathematics and reading skills and abilities based on the rates of recidivism at XYZ Detention Center, 2) Do XYZ …

Secondary Traumatic Stress In Teachers And School Communities Impacted By The Opioid Epidemic, Anne Steketee
Education (PhD) Dissertations
People who support others who have experienced trauma, like nurses, doctors, social workers, or first responders can sometimes be affected by a type of stress called secondary traumatic stress (STS). Although the effect of STS has been studied in helpers like social workers and medical professionals, the prevalence and characteristics of STS in teachers have not been studied extensively and are less understood. Schools in our communities impacted by the opioid epidemic also report additional stressors from issues like addiction, overdose, crime, neglect, rise in foster care, increased medical care, and death. This dissertation investigates STS in K-12 public school …
Cross-Sectional Analysis Of The Relationship Between Violent Crime And Mental Health Disorders In A Sample Of Homeless Adults Recently Released From Jail, Addison Ransom
Dissertations and Theses (Open Access)
Adverse mental health conditions among incarcerated populations are high, and treatment for these conditions is particularly low. Additionally, there is a culture of stigma in the United States towards those with mental health conditions and violent criminal history, contributing to mass incarceration. The present cross-sectional study sought to assess the association between violent criminal history and mental health symptoms among recently incarcerated homeless adults in Dallas, Texas. This study included 230 participants, taking place at The Bridge Homeless Recovery Center, evaluating non-violent versus violent criminal history. Outcome measures of positive screens for post-traumatic stress disorder, generalized anxiety disorder, and depression …
Reconciling Ideals: Restorative Justice As An Alternative To Sentencing Enhancements For Hate Crimes, Olivia Levinson
Reconciling Ideals: Restorative Justice As An Alternative To Sentencing Enhancements For Hate Crimes, Olivia Levinson
Minnesota Law Review Headnotes, Vols. 94-106 (2009-2022)
The Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act of 2009 (“the Act”) was seen as a significant step forward in legal protections for LGBTQ+ people and racial minorities. It expanded the federal definition of hate crimes to include gender, disability, gender identity, and sexual orientation, and made it easier to prosecute race- and religion-motivated crimes. Ironically, the sentencing enhancements provided for by the Act feed the same hyper-carceral system that disproportionately impacts LBGTQ+ and racial minority groups. These enhancements do little to address the causes of hate crimes or bridge understanding in diverse communities. Indeed, hate crime …
Non-Binary And Gender Expansive Young Adults: Perceptions Of Their Lived Experiences With Gender Identity, Devyn Adrian Box
Non-Binary And Gender Expansive Young Adults: Perceptions Of Their Lived Experiences With Gender Identity, Devyn Adrian Box
Social Work Theses - Archive
Non-binary and gender expansive (NBGE) young adults face disproportionate rates of violence and discrimination within systemic, interpersonal, and intrapersonal contexts. Extant literature neglects the study of this population and their unique needs and experiences. This phenomenological study sought to answer the question, “what are the lived experiences of non-binary and gender expansive college students ages 18-24?” This study used a convenience sampling strategy with a snowball approach, and recruited college students across the state of Texas. A total of 10 participants were interviewed using a semi-structured interview guide. All participants identified as assigned female at birth (AFAB). 70% of participants …
Swimming Upstream To Achieve The Dream: A Descriptive Phenomenological Study Of The Postsecondary Experiences Of Foster Care Alumni, Sharron Crear
Swimming Upstream To Achieve The Dream: A Descriptive Phenomenological Study Of The Postsecondary Experiences Of Foster Care Alumni, Sharron Crear

Education has been deemed the "great equalizer" for the condition of man (Horace Mann, 1848). Studies have found that years of education and income are highly correlated--the higher the educational level, the higher the income (National Center for Education Statistics, 2017). Numerous studies highlight the benefits of attaining a college degree; however, college enrollment and graduation rates among young adults with foster care experience lag significantly behind those of their non-foster care peers. Despite increased policies and efforts at the federal, state, and local levels to improve the educational outcomes of this vulnerable population, poor educational outcomes are still prevalent. …
Likelihood Inference For Flexible Cure Rate Models In The Context Of Infectious Diseases With Multiple Exposures, Zachry Joseph Engel
Likelihood Inference For Flexible Cure Rate Models In The Context Of Infectious Diseases With Multiple Exposures, Zachry Joseph Engel
Mathematics Dissertations - Archive
Cure rate models are mostly used to study data arising from cancer clinical trials. Its use in the context of infectious diseases has not been explored well. In 2007, Tournoud and Ecochard rst proposed a mechanistic formulation of cure rate model in the context of infectious diseases with multiple exposures to infection. However, they assumed a simple Poisson distribution to capture the unobserved number of pathogens at each exposure time. In this thesis, we propose a new exible cure rate model to study infectious diseases with discrete multiple exposures to infection. This new model uses the Conway-Maxwell Poisson (COM-Poisson) distribution …
Increasing Case Traffic: Expanding The International Criminal Court's Focus On Human Trafficking Cases, Nadia Alhadi
Increasing Case Traffic: Expanding The International Criminal Court's Focus On Human Trafficking Cases, Nadia Alhadi
Michigan Journal of International Law
Human trafficking falls within the jurisdictional competence of the International Criminal Court (“ICC”) as one of the article 7 crimes against humanity, whether committed in an atmosphere of conflict or in times of relative peace. Despite the ICC’s jurisdiction, as well as the globally pervasive nature of peacetime trafficking in particular, the ICC has not yet heard a human trafficking case.
Accountability at the international level, however, is crucial, and the ICC’s oversight has the potential to fill gaps in the current anti-trafficking regime. This note explores this potential, and then examines whether the text of the Rome Statute or …
Upholding Tribal Sovereignty And Promoting Tribal Public Health Capacity During The Covid-19 Pandemic, Heather Tanana, Aila Hoss
Upholding Tribal Sovereignty And Promoting Tribal Public Health Capacity During The Covid-19 Pandemic, Heather Tanana, Aila Hoss
Utah Law Faculty Scholarship
Tribes are sovereign nations with authorities and responsibilities over their land and people. This inherent sovereign authority includes the right to promote and protect the health and welfare of their communities. The COVID-19 pandemic has brought national attention to the health inequities experienced by American Indian and Alaska Native communities. The sovereign legal authority for Tribes to respond to this pandemic has received less attention. This Chapter describes some, but not all, of the urgent legal issues impacting Tribal response to the COVID-19 pandemic. It describes and identifies gaps in federal Indian health policies and highlights how Tribes have exercised …

Angry Women And Empathic Men: How Individuals "Do Gender" In A Criminal Justice Context Through Conformity Or Resistance To Gendered Feeling Rules, Shannon Dodd
Qualitative Criminology (QC)
Studies on gender differences in public punitiveness show that women generally hold less punitive attitudes toward offenders than men. The reverse is true, however, when it comes to ‘back-end’ criminal justice processes, like parole, that involve the early release of prisoners. With evidence to suggest that differing emotional responses may help to explain gender gaps like these, this study draws on the concepts of gendered feeling rules and emotion management, together with the notion of gender as a performance, to explore how men and women enact their gendered identity through emotion in a criminal justice context. The findings highlight the …
Being A Good College Student: The History Of Good Moral Character Rules In State Financial Aid Programs, 1850 To Now, Bradley Custer
Being A Good College Student: The History Of Good Moral Character Rules In State Financial Aid Programs, 1850 To Now, Bradley Custer
BYU Education & Law Journal
Federal and state governments regulate the character of
their residents as a condition of immigration, employment, social
services, and beyond. At the state level, “good moral character”
rules have been analyzed in depth for decades, mostly as they pertain
to admission to the bar and other licensed professions. Character
requirements also affect the ability of college students to get
state-funded financial aid, but these policies have received no scholarly
analysis. According to this study’s findings, there have been at
least 50 state financial aid grant programs with character rules,
which begs the question: what does it mean to be a …
Rethinking Contemporary Counter-Piracy Policy, Hugh Fleming
Rethinking Contemporary Counter-Piracy Policy, Hugh Fleming
Minnesota Law Review Headnotes, Vols. 94-106 (2009-2022)
Traditional piracy often evokes the image of swashbuckling sailors, independent from the rest of society and roaming the seas to seek their fortune. The image has been heavily romanticized by Hollywood and other sources of popular folklore, much like the cowboys in the western United States. In reality, modern piracy presents a significant threat to the international community, by endangering innocent lives, interfering with important shipping routes, and imposing significant costs through enforcement efforts and ransoms paid to pirates. Yet piracy has proven exceedingly difficult to combat for a variety of reasons. This Essay examines and critiques current approaches to …

Beliefs And Perceptions Of Millennials Pertaining To Climate Change And Sustainability, Rae Cade
Theses, Dissertations and Culminating Projects
The purpose of this qualitative multi-case study is to explore the beliefs and perceptions of millennials on the subjects of climate change and sustainability. Some millennials pursuing an undergraduate degree in a non-environmental science field may lack knowledge pertaining to climate change and sustainability. The conceptual framework for this qualitative explanatory multi-case study is grounded in contributions from Henri Lefebvre, Nicholson-Smith (1991), and Simpson (2014) who explore how the notion of space has evolved in recent years, as well as researchers who are quantitatively studying climate change and sustainability. I conducted semistructured focus groups and drafted field notes from two …
Sins Of Our Fathers : Assessing Parental Incarceration As A "Turning Point" In The Lives Of Young Adults, Melissa Elizabeth Noel
Sins Of Our Fathers : Assessing Parental Incarceration As A "Turning Point" In The Lives Of Young Adults, Melissa Elizabeth Noel
Legacy Theses & Dissertations (2009 - 2024)
Coupled with other disadvantages, parental incarceration negatively impacts outcomes for children. Researchers have examined the consequences of parental incarceration mainly for children and adolescents, but it remains unclear about the long-term consequences as these children emerge into adulthood. Parental incarceration can affect social relationships and life attainments, increase labeling and stigmatization, and influence perceptions about society for young adults. Thus, this research study sought to examine parental incarceration as a “turning point” in which life outcomes of young adults are weakened or strengthened through this experience. Semi-structured interviews with 19 young adults were conducted and analyzed to examine: (1) whether …
Exploring Experiences With Social Disorganization In Denver Communities, Tiffanie Pham
Exploring Experiences With Social Disorganization In Denver Communities, Tiffanie Pham
Master's Theses
Social disorganization theory states that individuals residing in disadvantaged communities are more likely to engage in delinquency and criminality due to the elements the individuals experience (Shaw & McKay, 1969). More specifically, social disorganization theory refers to the failure of the community to fully understand and acknowledge the common goals or solve any issues that the community might be experiencing (Kubrin & Weitzer, 2003). Utilizing social disorganization theory, specifically, the family disruption and poverty elements, the current literature focuses on individuals who reside in disadvantaged communities in Denver, Colorado. By using the qualitative approach, this study relied on in-depth interviews …
