Lay Judge And Victim Participation In Japan: Japan’S Saiban’In Trial, The Prosecution Review Commission, And The Public Prosecution Of White-Collar Crimes, Hiroshi Fukurai

Hastings Journal of Crime and Punishment

In September 2019, the University of California Hastings Law School hosted a symposium on Japan’s newly instituted public and victim participation systems in the criminal process. This paper addresses themes raised by five scholars' presentations at the symposium, covering the effectiveness and impact of three different newly adopted systems of lay and victim participation in Japan: (1) the new 2009 law of the Prosecution Review Commission (PRC), a Japanese-style “civil grand jury” originally introduced in 1948, which gave the PRC the power to force the prosecution of formerly unindicted cases, thereby challenging and reversing the prosecutor’s original non-prosecution decision; (2) …

Negotiating Informal And Formal Supportive Services Among Older Adults: An Analysis Of A Caring Culture At Hope Meadows, Derek Ruszkowski Jan 2020

Negotiating Informal And Formal Supportive Services Among Older Adults: An Analysis Of A Caring Culture At Hope Meadows, Derek Ruszkowski

Student Research – Stevenson Center

This case study examines discourses of living and volunteering at an intentional and intergenerational neighborhood in Rantoul, IL managed by a non-profit called Hope Meadows. This is accomplished through participant and non-participant observations and nine resident interviews. The research contributes to literature on community-level efforts serving to strengthen supportive relationships among neighbors by examining a population that is engaged in providing services to their fellow community residents and the non-profit organization in exchange for below-market rent. Additionally, the outcome contributes to literature on aging-in-place, sustaining volunteer programs dependent on committed residents, and challenges of an increasingly disproportionate aging population. Due …

Critical Media Effects Framework: Bridging Critical Cultrual Communication And Media Effects Through Power, Intersectionality, Context, And Agency, Srividya Ramasubramanian, Omotayo O. Banjo Jan 2020

Critical Media Effects Framework: Bridging Critical Cultrual Communication And Media Effects Through Power, Intersectionality, Context, And Agency, Srividya Ramasubramanian, Omotayo O. Banjo

Media Studies - Open-Access Faculty Scholarship

In this essay, we advance the Critical Media Effects (CME) framework as a way of bridging two major subfields of communication that seldom speak to one another: media effects scholarship and critical cultural communication. Critical Media Effects is situated within the dominant mode of social scientific theorizing within media effects scholarship and draws on four key interrelated concepts from critical cultural communication: power, intersectionality, context, and agency. Critical Media Effects advocates for greater reflexivity, rigor, and nuance in theorizing about media effects to better respond to the complexity and dynamicity of emerging global sociopolitical mediated contexts. Recommendations, salient examples, and …

The Effect Of Health Insurance On Crime: Evidence From The Affordable Care Act Medicaid Expansion, Qiwei He, Scott Barkowski Jan 2020

The Effect Of Health Insurance On Crime: Evidence From The Affordable Care Act Medicaid Expansion, Qiwei He, Scott Barkowski

Publications

Little evidence exists on the effect of the Affordable Care Act (ACA) on criminal behavior, a gap in the literature that this paper seeks to address. Using a simple model, we argue we should anticipate a decrease in time devoted to criminal activities in response to the expansion, because the availability of the ACA Medicaid coverage raises the opportunity cost of crime. This prediction is particularly relevant for the ACA expansion because it primarily affects childless adults, a population likely to contain individuals who engage in criminal behavior. We validate this forecast empirically using a difference‐in‐differences framework, estimating the expansion's …

A Great Nation? The Changing Place Of Religion In Law And Society In Colonial And Contemporary Australia: Reflections On Douglas Murray In An Australian Context, Michael Quinlan Jan 2020

A Great Nation? The Changing Place Of Religion In Law And Society In Colonial And Contemporary Australia: Reflections On Douglas Murray In An Australian Context, Michael Quinlan

Law Papers and Journal Articles

This paper discusses the role of Christian theology in Australian law and society in the period after the arrival of the First Fleet and in contemporary Australia. It argues that Christian theology was foundational to the Australian colonies. Whilst the theology of Australia’s Christians has always been divided doctrinally, a shared knowledge and understanding of Christianity provided the vast majority of colonists with a common understanding of the world and a common language of discourse about it. This understanding was not shared by the indigenous peoples who had their own cultures, traditions, and understandings of the world and their own …

Against Monetary Functionalism: A Social Ontology Of Money, James Payne Jan 2020

Against Monetary Functionalism: A Social Ontology Of Money, James Payne

Honors Program Theses

This paper explores the concepts of individualism and holism in social ontology through an analysis of the ontology of money by integrating insights from the Critical Realist tradition as well as the distinction between metaphysical grounds and anchors. In doing so it examines alternative explanations of money's ontology like the paradigmatic approach of John Searle. The results of the inquiry are then connected in relation to the models of social explanation in mainstream economics.

Latinx – African American Relations: Understanding The Perceptions Of Faculty, Administrators And Students In Two College Campuses, Nadarajan Sethuraju, Luis A. Posas

Sociology Department Publications

This study examines the relationship between Latinxs and African Americans in two mid-size colleges located in the southwestern region of the United States. An empirical study was conducted including students, faculty, and administrators using a survey as the main methodological technique. Guided by the group position model advocated by Herber Blumer, this study found evidence for the prevalence of intra-group associations and group competition for access to resources. In this regard, the study documents the existing perception that African Americans have better access to resources in the two college campuses which supports the zero-sum hypothesis favoring members of this group. …

Israelite And Judean Society And Economy, Roger Nam Jan 2020

Israelite And Judean Society And Economy, Roger Nam

Faculty Publications - Portland Seminary

This article examines the economic worlds that correspond to the timeline of the historical books of the Hebrew Bible from the conquest to the return from exile. During this period, Israel and Judah transformed from small subsistence-based tribal economies to more centralized organization, at least partially due to external military threats. Both the northern kingdom and eventually the southern kingdom fell to the Assyrian and Babylonian empires respectively, and the forced migrations instigated socially dis-embedded economies in the exile and repatriation. Even though these ancient economic modalities are largely assumed and unstated, critical analysis of the historical books requires a …

Memory And Millennials: A Review Of First Vision: Memory And Mormon Origins, Spencer R. Marsh Jan 2020

Memory And Millennials: A Review Of First Vision: Memory And Mormon Origins, Spencer R. Marsh

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

The multiple historical accounts of Joseph Smith’s First Vision have been an area of intense study, debate, and discussion for several decades. The newest addition to the discussion is a specialized monograph engaging the various accounts of the First Vision through the lens of psychology and, particularly, memory studies. This book, authored by Steven C. Harper, proves to be a valuable resource in answering some pressing questions about the integrity of the First Vision accounts, even though that was not the book’s explicitly stated purpose. This review highlights these contributions as interpreted through the lens of a Millennial reviewer — …

He Knows My Affliction: The Hill Onidah As Narrative Counterpart To The Rameumptom, Matthew L. Bowen Jan 2020

He Knows My Affliction: The Hill Onidah As Narrative Counterpart To The Rameumptom, Matthew L. Bowen

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

The toponym Onidah, attested as the name of a hill in Alma 32:4, most plausibly derives from Hebrew ʿŏnî /ʿōnî/ʿônî (ʿonyî, “my affliction”) + yādaʿ/yēdaʿ (“he knew,” “he knows”) — i.e., “he has acknowledged my affliction” or “he knows my affliction.” This etymology finds support in the context of the Zoramite narrative in which it occurs. In view of the pejorative lexical associations of the Rameumptom, the “high” and “holy stand,” with Hebrew rām (< rwm, “high”) and haughtiness, arrogance, and pride, we see Mormon using the Rameumptom, the “high” platform for Zoramite self-exalting worship, with Onidah, the hill from which Alma and Amulek taught the Zoramite poor and humble. The latter name and Alma’s teaching from that location constituted a sign that the Lord “knew” their “affliction.” Alma devotes a significant part of his message not only extolling the spiritual value of their state of “affliction” and humiliation or compelled “humility” (ʿŏnî Exodus 3:7, 17), but teaching them how to “plant” the “word” (even Jesus Christ himself) in their hearts through prayer — the word that would grow up into a “perfect knowledge” of God — experientially “knowing” God (Alma 32:16‒36) and being known by him (cf. Alma 7:12).

Nebraska Student Health and Risk Prevention Surveillance System (SHARP)

The Value of SHARP

The Power of Data: Your school can receive school and local level results from the NRPFSS, along with state wide results from the YRBS and YTS. The comparison of local and state data is what makes the SHARP surveys so significant. The results of these surveys will not only affect your school and your students, but your community as a whole. The data collected are used by community, regional, and state level groups, including the NDE and NDHHS, to identify areas needing improvement and to track the effectiveness of their efforts. This information also helps schools …

“Somos Seres Humanos. Merecemos Vivir Dignamente”: Coloniality And Human Rights In The Face Of Family Separation, Olivia Pertierra Jan 2020

“Somos Seres Humanos. Merecemos Vivir Dignamente”: Coloniality And Human Rights In The Face Of Family Separation, Olivia Pertierra

Theses & ETDs

This thesis explores how people who have been deported to Mexico experience and confront state-sanctioned family separation. From a content analysis of 23 interviews in the Humanizing Deportation public access community story telling archive, three key themes emerge: mixed-status families are denied equal access to family unity, attempts and considerations of re-entry post-deportation are affirmations of the value of family unity, and experiences in detention illustrate the dehumanizing experience of family separation. Theories of coloniality, human rights, and state control over reproduction provide ethical and long-term historical lenses that elucidate the experience of deportation and family separation. The content analysis …

You Sew Fine: A Mobile Application About Fabric And Body Measurements, Maya Holt-Teza

Theses & ETDs

This thesis will try to integrate multiple disciplines in order to explore, discuss, and create between Computer Science and Performance Studies. Throughout the thesis I touch on fashion as a subject of academia, not just as an aspect of Performance Studies. More specifically, I focus on its role in self-expression and personal philosophy. This project also aims to show how through the use of Computer Science I have been able to develop a tool to support those who create clothing and fashion. The more experience a sewer has, the more depth of knowledge and intuition they acquire. A large barrier …
