Developing A New Snp Chip For Genomic Selection In The North Dakota State University Barley-Breeding Program, Jose Antonio Rivera Dompenciel
Developing A New Snp Chip For Genomic Selection In The North Dakota State University Barley-Breeding Program, Jose Antonio Rivera Dompenciel
Plant Sciences
The use of Genomic Selection has become popular due to its wide success in private and public breeding programs. The current dissertation aims to derive information that will be used to produce a single nucleotide polymorphisms (SNP) chip that can be used to successfully predict traits of economic importance for the North Dakota State University (NDSU) barley breeding program. Three training populations were tested to determine which should be used for predictive modeling. Multiple predictive models were employed to verify the most effective method for each individual trait. Through this research, four major findings were concluded: the successful identification of …
Optimizing Winter Camelina Production As A Cover Crop In North Dakota, Alex Shawn Robert Wittenberg
Optimizing Winter Camelina Production As A Cover Crop In North Dakota, Alex Shawn Robert Wittenberg
Plant Sciences
Winter camelina [Camelina sativa (L.) Crantz] has gained particular interested from producers and researchers in the northern Great Plains and local production information is critical. Without a correct sowing date plant stand establishment can be challenging. Morphological differences between winter- and summer-biotypes of camelina can allow producers and researchers to distinguish the two biotypes. Visible and non-visible seed differences can offer effective means to distinguish the two biotypes. Seed quality of camelina is crucial. Sowing in September until the first week of October had similar seed yield. Morphological differences in the upper most developed leaves of camelina seedling can be …
Jail Suicide By Design, David E. Patton, Fredrick E. Vars
Jail Suicide By Design, David E. Patton, Fredrick E. Vars
Essays, Reviews, and Shorter Works
Jeffrey Epstein’s death in the federal jail in downtown Manhattan was the result of a conspiracy. But the conspirators were not the Clintons, President Trump, or Prince Andrew. Instead, his death, like too many others, was the result of a longtime conspiracy of lawmakers and actors within the criminal legal system itself. Several features of our legal system seem almost designed to promote suicide in jail. This Article examines and proposes solutions to two of those features: (1) jail conditions are inhumane in part because inmates face often insurmountable obstacles to hold jailers accountable; and (2) high rates of pretrial …
Radical Method, Richard Delgado, Jean Stefancic
Radical Method, Richard Delgado, Jean Stefancic
Essays, Reviews, and Shorter Works
Should traditional liberals and insurgent scholars who disdain "the system" nevertheless work together? They start at different points, build on clashing presumptions, and follow different methodologies. Nevertheless, they often come out the same way. Indeed, practitioners of the standard cases-and-policies approach sometimes end up instinctively applying radical techniques, such as the flip or shift of point of view, to great effect. After analyzing a number of examples, we conclude that progressive scholars should not reflexively reject lawyering that proceeds in the time- honored manner merely because it strikes them as quaint or square. By the same token, neither should they …
Borders By Consent: A Proposal For Reducing Two Kinds Of Violence In Immigration Practice, Richard Delgado, Jean Stefancic
Borders By Consent: A Proposal For Reducing Two Kinds Of Violence In Immigration Practice, Richard Delgado, Jean Stefancic
Essays, Reviews, and Shorter Works
We describe a new consensual theory of borders and immigration that reverses Peter Schuck's and Rogers Smith's notion of citizenship by consent and posits that borders are legitimate and make sense only if they are products of consent on the part of both countries on opposite sides of them. Our approach, in turn, leads to differential borders that address the many sovereignty and federalist problems inherent in border design by a close examination of the policies that different borders for example, the one between California and Mexico-need to serve in light of the populations living nearby. We build on our …
Love In The Time Of Cholera, Richard Delgado, Jean Stefancic
Love In The Time Of Cholera, Richard Delgado, Jean Stefancic
Essays, Reviews, and Shorter Works
A famous novel by Gabriel Garcia Mdrquez describes a love story among three actors that took place in a city in Colombia during the time of cholera. The interpersonal dynamics that unfold in this work by a Nobel Prize winning writer offer insight into events taking place today. We show how the urge to romanticize emotions during a time of great social stress, as well as the desire to cleave to a strong leader, explain events in Garcia Mirquez's mythical country, as well as in ours today. We draw conclusions about how citizens should respond to Donald J. Trump's unloving …

Thailand: The Evolution Of Law, The Legal Profession And Political Authority, Frank W. Munger
Thailand: The Evolution Of Law, The Legal Profession And Political Authority, Frank W. Munger
Articles & Chapters
This article describes the origin and development of the modern Thai legal profession. Intimately linked in origin to the development of the modern Thai state, the legal profession increasingly resembles the profession in economically developed democracies. Paralleling other regional developments, Thailand’s rapid economic development, constitutional reforms, and expanding judicialization drives many of the most important changes in the education and function of lawyers. Significant differences continue to exist between the profession in Thailand and legal professions in developed democracies, reflecting the profession’s origins and the continuing influence of consciousness and class structure as well as Thailand’s peculiarly semi-democratic and monarchical …

Transfixed In The Camera's Gaze: Foster V. Svenson And The Battle Of Privacy And Modern Art, Michael Goodyear
Articles & Chapters
The battle between First Amendment expression and privacy interests in twenty-first century America is in full force. In Foster v. Svenson, a photographer used a high-powered camera to take snapshots of his neighbors. The New York court ruled that it was art and therefore immune from New York’s privacy statute. Constrained by New York’s ineffective privacy statute, the court’s ruling included a cry for the New York legislature to act.
Privacy has become an increasingly powerful right in American law, especially with the growth of technology. Yet the problem with Foster and the New York statute is that the sole …
A Shield Or A Solution: Confronting The New Copyright Troll Problem, Michael Goodyear
A Shield Or A Solution: Confronting The New Copyright Troll Problem, Michael Goodyear
Articles & Chapters
The past few years have seen the rise of a new threat to American access to knowledge and creativity: the attorney copyright troll. While previous scholarship has focused on the copyright owner as a copyright troll, this note examines the motivations and dangers of the attorney as a copyright troll. Guided by the rewards copyright infringement cases offer and equipped with mass mailed letters threatening thousands of purported infringers, these attorneys are practicing a new brand of copyright law focused on extorting money over pursuing legitimate claims. This poses a danger to the spirit of copyright.
Since the efforts of …

The illicit trade in cultural property is a global phenomenon, powered by criminal networks and smuggling trains that sacrifice local culture for the black market of the art world. Headlines featuring the Islamic State’s lucrative exchange in stolen cultural property, among other incidents, have raised the profile of the illicit cultural property trade on the global stage. Developing countries, as the most prominent source countries of cultural property, are particularly at risk. Existing scholarship has searched for a solution to this crisis, suggesting a new international treaty to protect cultural property or recommending the utilization of adjacent legal fields. However, …
Structure Modification To Enhance Pulse Protein Functions And Flavor Profile Opportunities In Saccharide Mediated Glycation Via Maillard-Driven Chemistry, Fengchao Zha
Plant Sciences
Owing to the combined characteristics of low allergens and lipids, as well as high versatility and abundance, eco-friendly pulse-based protein has served as a critical contender to supplement animal protein. The inferior solubility and off-flavor, however, place a practical restriction on its application. Glycation via Maillard-driven reaction is a potential green chemistry to modulate protein structure and functions. The various types of protein, saccharides with different molecular mass and structural characteristics, and two reaction systems (dry and wet heating) were applied to synthesize protein-saccharides conjugates. The aims were to investigate (i) the effect of glycation on functionalities and flavor of …
Further Characterization Of Pathogen Virulence And Genetic Mapping Of New Virulence Genes In Pyrenophora Tritici-Repentis, The Causal Agent Of Tan Spot Of Wheat, Jingwei Guo
Plant Sciences
The ascomycete Pyrenophora tritici-repentis (Ptr) causes tan spot of wheat, a devastating foliar disease on both common wheat (Triticum aestivum L., 2n=6x=42, AABBDD) and durum (T. turgidum ssp. durum L., 2n=4x=28, AABB). Ptr is known to produce three necrotrophic effectors (NEs), namely Ptr ToxA, Ptr ToxB and Ptr ToxC, to cause disease by interacting with corresponding host sensitivity genes. However, many studies in the last twenty years have suggested that Ptr produces additional virulence factors. My Ph.D. research focused on further identification and genetic mapping of new virulence genes in Ptr. In Chapter 2, a bi-parental fungal population was developed …
Transfer Of Fhb Resistance Genes Into Hard Red Winter Wheat, Venkata Rao Ganaparthi
Transfer Of Fhb Resistance Genes Into Hard Red Winter Wheat, Venkata Rao Ganaparthi
Plant Sciences
Fusarium head blight (FHB) is a serious foliar disease of hard red winter wheat (HRWW) in North Dakota. Disease resistance was identified as major component in disease management. First objective of this study is to transfer resistance QTL, Qfhb.rwg.5A.2 into HRWW germplasm. Second part of this study aims is to confirm FHB resistance of two-triticale-Th. distichum addition lines (W1450 and W1451) and attempt to bring acrocentric addition chromosome in W1450 into common wheat, and characterization of W1423X-3 progeny in search of true breed resistance genotype. Qfhb.rwg-5A.2 is transferred into three different populations, and haplotype consisting of three SNP close to …
Pre-Breeding To Improve Yield And Disease Resistance Of Hard Red Winter Wheat, Dylan Mitchell Barry
Pre-Breeding To Improve Yield And Disease Resistance Of Hard Red Winter Wheat, Dylan Mitchell Barry
Plant Sciences
Challenges to growing winter wheat in North Dakota include winter temperature and disease pressure. Fusarium head blight (FHB) is a devastating disease that necessitates breeding for resistance. In the NDSU breeding program FHB resistance genes are often associated with a decrease in performance. This study used single seed descent to advance lines while maintaining a near random population. Early generation (F4) selection focused heavily on yield and the presence of FHB resistance quantitative trait loci to develop winter wheat lines with FHB resistance and high yield. Stripe rust is a fungal disease that is becoming increasingly problematic in North Dakota. …
Functional Bioactive Compounds From Sweet Potatoes For Human Health Benefits, Pradeepika Chintha
Functional Bioactive Compounds From Sweet Potatoes For Human Health Benefits, Pradeepika Chintha
Plant Sciences
Global food and nutritional insecurities, public health challenges of diet-linked non-communicable chronic diseases (NCDs), and rapid climate change-linked agricultural production challenges are interconnected and require urgent attention. Therefore, to address these complex and interconnected challenges, it is essential to advance robust and resilient strategies based on sustainable agricultural production practices, wider integration of nutritionally-balanced plant-based foods in the diet, improvement of human health-targeted nutritional qualities, post-harvest preservation qualities and food processing optimization. Therefore, food plants that are climate resilient and rich source of human health protective nutritional bioactives, such as sweet potato are ideal dietary targets for advancing global food …

Plant Sciences
Field experiments were conducted in 2017 and 2018 at the NDSU Horticulture Research Farm near Absaraka, ND to evaluate the growth and yield characteristics of twelve commercial hop cultivars in response to varied training densities. Cultivars were trained at two, four, and eight bines per crown each season. Cultivars produced significantly higher yield (kg/ha) trained with eight bines per crown in 2018. ‘Nugget’, and ‘Canadian Red Vine’ significantly yielded highest in 2017. ‘Nugget’, ‘Canadian Red Vine’, and ‘Cascade’ significantly yielded highest in 2018. Research investigating mulching as a weed control method on mature hop production systems was conducted. Hop cultivars …
Understanding Host Resistance And Pathogen Biology In The Wheat-Fusarium Graminearum Pathosystem, Bikash Poudel
Understanding Host Resistance And Pathogen Biology In The Wheat-Fusarium Graminearum Pathosystem, Bikash Poudel
Plant Sciences
Fusarium head blight (FHB) is a major challenge in global wheat production. In the United States, the disease is predominantly caused by the fungus Fusarium graminearum. Utilization of FHB-resistant wheat cultivars integrated with other measures such as fungicide application is the most effective approach for the management of this disease. This study aimed to 1) identify novel quantitative trait loci (QTL) for resistance to FHB in a Brazilian spring wheat cultivar ‘Surpresa’ through bi-parental mapping, 2) detect QTL for FHB resistance in a global panel of 233 spring wheat accessions by genome-wide association analysis (GWAS), and 3) localize genomic regions …
Cognitive Biases, Dark Patterns, And The ‘Privacy Paradox’, Ari Ezra Waldman
Cognitive Biases, Dark Patterns, And The ‘Privacy Paradox’, Ari Ezra Waldman
Articles & Chapters
Scholars and commentators often argue that individuals do not care about their privacy, and that users routinely trade privacy for convenience. This ignores the cognitive biases and design tactics platforms use to manipulate users into disclosing information. This essay highlights some of those cognitive biases – from hyperbolic discounting to the problem of overchoice – and discusses the ways in which platform design can manipulate disclosure. It then explains how current law allows this manipulative and anti-consumer behavior to continue and proposes a new approach to reign in the phenomenon.

This Article provides the first systematic account and justification of software applications as works of scholarship. Software is scholarship to the extent that software functionality is derived from scholarly research, software is used as a means to develop scholarship, or software is used as a medium to communicate scholarly ideas. Software applications are superior to articles and books for communicating scholarly ideas because software is not limited by the constraints of traditional written works. Software can communicate using a wide variety of textual components, graphical elements, and programmable interactivity that significantly enhance the ability to communicate scholarly concepts, arguments, and …

Several years ago, I wrote that Bob Dylan was “a scholar with a well-developed jurisprudence on a range of topics including civil, criminal, public, and private law” (Perlin, 2011, p.1396). In that article, I discussed and analyzed Dylan songs that dealt with, variously, civil rights, inequality in the criminal and civil justice systems, institutions, governmental/judicial corruption, equality and emancipation, and the role of lawyers in the legal process. (Id.). But I noted that I was omitting – for space considerations – any discussion of Dylan songs dealing with war and international affairs (Id., p. 1398, n. 15).
