The Importance Of Cy Pres In Modern Class Action Jurisprudence And Myths Concerning Its Use, Gerson H. Smoger Jan 2020

The Importance Of Cy Pres In Modern Class Action Jurisprudence And Myths Concerning Its Use, Gerson H. Smoger

Lewis & Clark Law Review

When class actions resolve, it is common for some or even all funds paid to the class to remain undistributed. All U.S. circuits, 40 states, and the Class Action Fairness Act have permitted undistributed funds to be distributed as cy pres. Recently, a few commentators have voiced constitutional objections to cy pres, based upon standing pursuant to Article III, the Rules Enabling Act, and the First Amendment. However, these analyses generally ignore the congressional mandate found within Rule 23 and the power of the courts to supervise cy pres distribution. Finally, the following recommendations are made: such awards should not …

Collective Preclusion And Inaccessible Arbitration: Data, Non-Disclosure, And Public Knowledge, Judith Resnik, Stephanie Garlock, Annie J. Wang Jan 2020

Collective Preclusion And Inaccessible Arbitration: Data, Non-Disclosure, And Public Knowledge, Judith Resnik, Stephanie Garlock, Annie J. Wang

Lewis & Clark Law Review

When courts enforce mandates to arbitrate, jurists describe themselves as respecting the individuals’ autonomy to enter into contracts that route claimants to a process that is more user-friendly than adjudication. But those rationales are disjunctive with the practices of providers of goods and services and of employers. These companies neither offer individuals choices about dispute resolution mechanisms nor welcome the exchange of information about experiences with arbitration. Instead, companies impose obligations to arbitrate and set the terms. In addition to the increasingly commonplace bans on joint and collective actions in any forum, many providers and employers also seek to mandate …

Deregulation And Private Enforcement, Brian T. Fitzpatrick Jan 2020

Deregulation And Private Enforcement, Brian T. Fitzpatrick

Lewis & Clark Law Review

Many conservatives oppose much of the administrative state. But many also oppose much of our private enforcement regime. This raises the questions of whether conservatives believe the marketplace should be policed at all, and if so, who exactly should do that policing? In this Essay, based on my new book, The Conservative Case for Class Actions, I take a deep dive into conservative principles to try to answer these questions. I conclude that almost all conservatives believe the marketplace needs at least some legal constraints, and I argue that ex post, private enforcement is superior to the alternatives. Not only …

Dehumanization “Because Of Sex”: The Multiaxial Approach To The Rights Of Sexual Minorities, Shirley Lin Jan 2020

Dehumanization “Because Of Sex”: The Multiaxial Approach To The Rights Of Sexual Minorities, Shirley Lin

Lewis & Clark Law Review

Although Title VII prohibits discrimination against any employee “because of such individual’s . . . sex,” legal commentators have not yet accurately appraised Title VII’s trait and causation requirements embodied in that phrase. Since 2015, most courts assessing the sex discrimination claims of LGBT employees began to intentionally analyze “sex” as a trait using social-construction evidence, and evaluated separately whether the discriminatory motive caused the workplace harm. Responding to what this Article terms a “doctrinal correction” to causation within this groundswell of decisions, the Supreme Court recently issued an “expansive” and “sweeping” reformulation of but-for causation in Bostock v. Clayton …

Manipulating Risk: Immigration Detention Through Automation, Kate Evans, Robert Koulish Jan 2020

Manipulating Risk: Immigration Detention Through Automation, Kate Evans, Robert Koulish

Lewis & Clark Law Review

The U.S. Department of Homeland Security arrests as many as 500,000 migrants per year and detains more than 350,000 of them through Immigration and Customs Enforcement (ICE). Since 2012, ICE has relied on an automated Risk Classification Assessment (RCA) system to recommend whom to detain and whom to release. The authors are the first to obtain access to its algorithm and this Article is the first to make that system’s methodology public. While purportedly basing these recommendations on indicia of flight risk and risk to public safety, the RCA in fact relies on an algorithm driven by political preferences. By …

Separation Of Functions For Ai: Restraining Speech Regulation By Online Platforms, Niva Elkin-Koren, Maayan Perel Jan 2020

Separation Of Functions For Ai: Restraining Speech Regulation By Online Platforms, Niva Elkin-Koren, Maayan Perel

Lewis & Clark Law Review

The Free Speech Clause of the First Amendment of the U.S. Constitution restricts government regulation of private speech. However, it generally does not apply to private management of speech. New forms of speech regulation by online platforms disrupt this constitutional framework. Platforms, such as Google, Facebook, and Twitter, are responsible for mediating much of the public discourse and governing access to speech and speakers around the world. These private businesses match users and content in whatever way best benefits their commercial interests. At the same time, however, they exercise regulatory power when they filter, block, and remove content at the …

Crowdfunding’S Culture Of Noncompliance: An Empirical Analysis, Mercer Bullard Jan 2020

Crowdfunding’S Culture Of Noncompliance: An Empirical Analysis, Mercer Bullard

Lewis & Clark Law Review

The JOBS Act of 2012 launched a number of experiments in the regulation of securities offerings. The exemption it created that allows online equity crowdfunding offerings to retail investors garnered the most attention, in part due to widespread concerns regarding the potential for fraud and abuse. More than three years after the first crowdfunding offering, no empirical analysis of compliance has been conducted that would debunk or confirm critics’ concerns. This Article plugs that gap by analyzing a sample of 362 crowdfunding offerings and evaluating compliance with some of crowdfunding regulation’s simplest, most fundamental regulatory requirements. During the first 13 …

Originalist Sin: The Failure Of Originalism To Justify The Unitary Executive Theory, Marc Mohan Jan 2020

Originalist Sin: The Failure Of Originalism To Justify The Unitary Executive Theory, Marc Mohan

Lewis & Clark Law Review

Originalists justify a “unitary executive” theory of presidential powers using the Constitution’s vesting of the executive power in “a President,” as opposed to a council or other multi-member setup. Inspite of this justification’s popularity with originalists, a deeper understanding of prerogative and power, as the Founders understood those key concepts, reveals that the unitary executivetheory cannot be justified through either the original intent orthe original meaning of our founding document. Intheabsence of this grounding, the unitary executive theory is underpinned by modern exigenciesand thereforeloses coherency as an originalist theory.

Holding Oregon Benefit Companies Accountable For Greenwashing And Faux Csr, Sophia Von Bergen Jan 2020

Holding Oregon Benefit Companies Accountable For Greenwashing And Faux Csr, Sophia Von Bergen

Lewis & Clark Law Review

The notion of corporate social responsibility (CSR) has gained popularity in recent years with both consumers and businesses, leading to Oregon and currently 35 other states adopting benefit company statutes that allow companies to elect status as a benefit corporation. CSR, however, can be marred by what is known as “greenwashing” and “faux CSR,” which occur when a company falsely claims that it engages in environmentally friendly or socially responsible practices to boost sales or improve its brand. Oregon’s benefit company statute contains features designed to protect against greenwashing and faux CSR, but the statute’s accountability mechanisms are lackluster. Enforcement …

John Marshall’S Constitution: Methodological Pluralism And Second-Order Ipse Dixit In Constitutional Adjudication, D.A. Jeremy Telman Jan 2020

John Marshall’S Constitution: Methodological Pluralism And Second-Order Ipse Dixit In Constitutional Adjudication, D.A. Jeremy Telman

Lewis & Clark Law Review

This Article provides a comprehensive treatment of the constitutional jurispru- dence of the Marshall Court (1801–1835), addressing its relationship to con- temporary originalism. Until recently, there seemed to be no need for such a study. With the move from intentionalism to textualism in the 1980s, originalists came to understand their movement as an innovation and a reac- tion against the perceived excesses of the Warren and Burger Courts. Original- ists did not claim that originalist methodology informed nineteenth-century constitutional adjudication.

Recently, however, originalists have made claims that constitutional adjudi- cation in the United States has always been originalist. This Article …

The “Free Market” For Marijuana: A Sober, Clear-Eyed Analysis Of Marijuana Policy, H. Justin Pace Jan 2020

The “Free Market” For Marijuana: A Sober, Clear-Eyed Analysis Of Marijuana Policy, H. Justin Pace

Lewis & Clark Law Review

Federal law prohibits the possession and sale of marijuana. At the same time, states are not only decriminalizing marijuana but also attempting to provide a regulatory apparatus for its sale. This has created a unique business environ- ment. In some ways, there is a true “free market” for marijuana in states that have legalized it—free, that is, of the legal and financial infrastructure avail- able to fully licit businesses in America.

Contracts may not be enforceable because they lack a legal purpose. Relief in bankruptcy court may not be available, either as a debtor or as a creditor. Use of …

Discarded Loyalty: The Deportation Of Immigrant Veterans, Deenesh Sohoni, Yosselin Turcios Jan 2020

Discarded Loyalty: The Deportation Of Immigrant Veterans, Deenesh Sohoni, Yosselin Turcios

Lewis & Clark Law Review

The United States has a long history of using the foreign born to meet its mil- itary demands. For many immigrants, military service served both as a way to demonstrate loyalty to their adopted country, and to facilitate their naturali- zation process. However, over the past several decades an increasing number of foreign-born veterans have found themselves being deported, despite their honorable service, for having committed criminal acts. In many cases, these veterans were never given a chance to contest their deportations due to their status as non-citizens. This Article compares the deportation of non-citizen veterans today, with the failure …

Workforce Housing And Housing Preference Policies Under The Fair Housing Act, Jeffrey D. Jones Jan 2020

Workforce Housing And Housing Preference Policies Under The Fair Housing Act, Jeffrey D. Jones

Lewis & Clark Law Review

The workforce housing movement grew out of two urgent realities. First, the lack of affordable housing near where workers are employed has a substantial impact on local economies and local business. Second, the lack of affordable housing near where workers live undermines the twin goals of inclusive com- munities and reversing historical patterns of segregation. The latter remains a primary obstacle to equality of opportunity throughout the United States. There is no one definition of “workforce housing.” The leading definition of workforce housing is provided by the influential Urban Land Institute (ULI). The ULI defines workforce housing as housing that …

Retribution As Ancient Artifact And Modern Malady, Molly J. Walker Wilson Jan 2020

Retribution As Ancient Artifact And Modern Malady, Molly J. Walker Wilson

Lewis & Clark Law Review

One of the oldest and most entrenched goals of punishment is retribution, which is the idea that inflicting pain on someone who has committed a wrong is a worthwhile goal, regardless of any other benefits or harms that may result. Retribution has been the justification for increasingly punitive policies in the United States, the effect of which has decimated communities of color, strapped taxpayers with huge associated costs, and increased crime rates. It is difficult to understand why we perpetuate harmful policies based on “just deserts” until we consider that the foundation of these policies is moral outrage—a powerful, automatic, …

Credit Rating Agencies: Regulation And Liability, Colin Bradshaw Jan 2020

Credit Rating Agencies: Regulation And Liability, Colin Bradshaw

Lewis & Clark Law Review

In 2007, the economy crashed because of credit rating agency misconduct. Through the early 2000s, credit raters’ reckless pursuit of profits facilitated the enormous real estate and structured finance bubble that eventually burst in 2007. This Article examines the ratings industry and its institutions, their role in the crash, the regulation that led to their dominance in the markets, how that regulation changed in the wake of the economic crisis, and how they can be held liable today for present and future misconduct.

Section I describes what credit rating agencies (CRAs) are and what they do. Understanding the function of …

A Return To The Traditional Use Of The Writ Of Mandamus, Audrey Davis Jan 2020

A Return To The Traditional Use Of The Writ Of Mandamus, Audrey Davis

Lewis & Clark Law Review

A litigant filing a petition for a writ of mandamus takes a gamble. If unsuc- cessful, the petitioner risks not only wasting time and effort but also insulting the district court judge by calling into question his or her ability to carry out the basic duties of a judge. And even if successful, the petitioner still faces the risk of returning to the district court on less-than-friendly terms. More than anything, however, the writ of mandamus poses such risks because appellate courts have employed widely varying approaches in developing a standard for granting the writ. In order to offer greater …

Pulmonary And Systemic Pathophysiological Impact Of Silver Nanoparticles: Effects Of Coating, Time, And Dose, Zannatul Ferdous

Dissertations

Nanotechnology is rapidly developing, and engineered materials (ENMs) are utilized in a wide array of end-user products owing to their unique physicochemical properties. Of the various forms of ENMs, silver nanoparticles (AgNPs) have gained much attention for potential uses in commercial applications. Due to their unique features, particularly antimicrobial properties, there had been a surge in the production of AgNPs-based products, hence increasing the potential of both occupational and consumer exposure. Among the various routes of human exposure, pulmonary exposure to AgNPs has received increased interest due to their potential to cause pulmonary injury, cross the alveolar-capillary barrier, and distribute …

Enhanced Label Free Normal And Cancer Cells Classification Using Combined Parametric Modeling And Optical Techniques, Ayshathul Fouzia Abdul Gani Jan 2020

Enhanced Label Free Normal And Cancer Cells Classification Using Combined Parametric Modeling And Optical Techniques, Ayshathul Fouzia Abdul Gani

Dissertations

The development of label-free methods for cell classifications has been driven by the importance of early detection and identification of cancer disease. The future point-of-care (POC) treatment methods require rapid and real-time cancer screening techniques. As the labelled methods of cell classification are time-consuming processes and require a large amount of sample preparation along with skilled persons, they do not appear to be suitable for POC treatment methods. This necessitates the importance of such development. The label-free methods incorporate the biophysical properties of cells instead of biomarkers. The optical properties of cells have been frequently utilized for cell classification. This …

Natural Products For The Management Of Cardiovascular Diseases, Maha Salama, Shahira Mohammed Ezzat, Mohamed Salem

Pharmacy

Cardiovascular diseases constitute a serious public health problem. It is estimated that they are responsible for nearly 30% of world mortality. Regardless of the developments in the diagnosis and management of cardiovascular diseases, their incidence rate remains increasing. Therefore, newlines of drugs are needed to manage the expanding population of patients with cardiovascular diseases. Even though the most common existing treatments for cardiovascular diseases are synthetic molecules, natural compounds, of different chemical classes, are also being tested. Medicinal plants have been employed in the treatment of some cardiovascular diseases such as congestive heart failure and hypertension many centuries ago. Recently, …
