The “Green Patent Paradox” And Fair Use: The Intellectual Property Solution To Fight Climate Change, Samuel Cayton
The “Green Patent Paradox” And Fair Use: The Intellectual Property Solution To Fight Climate Change, Samuel Cayton
Seattle Journal of Technology, Environmental, & Innovation Law
As the climate crisis consistently worsens, the United States’ response to the crisis has proven inconsistent. Even with the United States likely to recommit to the Paris Climate Agreement, political tensions will likely further delay a climate response. The polarized characterization of the Green New Deal, the inaction of scientifically misguided conservatives, and the incessant proposal for middle ground approaches lacking the urgency needed to change course all contribute to this delay. While swift action from the federal government is needed, looking to the private sector to transition to sustainability is equally important. Specifically, patent protection is a strong intellectual …

Native Fish Loss In A Transition-Zone Stream Following Century-Long Habitat Alterations And Nonnative Species Introductions, Matthew R. Haworth, Kevin R. Bestgen, Edward R. Kluender, William H. Keeley, Donald R. D'Amico, F. Boyd Wright
Western North American Naturalist
Habitat destruction, hydrologic alteration, and nonnative species introductions have greatly altered the composition of North American stream fish assemblages. In the western United States, intermediate-elevation transition-zone stream reaches––those located between higher-elevation mountain and lower-elevation plains areas––historically supported native fish assemblages that included sensitive species and peripheral or isolated populations of more widespread taxa. We compiled historical records and conducted sampling to examine changes to the fish assemblage in the transition-zone reach of South Boulder Creek, Colorado, USA. Because human development of transition zones altered stream and riparian ecosystems prior to sampling, we developed a historical timeline of human activities to …

Nevada Supreme Court Summaries
In an opinion drafted by Justice Stiglich, the Nevada Supreme Court considered the scope of its recent opinion in Clark County School District (CCSD) and whether that scope applies to more than investigative reports. The Court ruled that courts should apply the test adopted in CCSD when the government asserts any nontrivial privacy interest. The Court reversed and remanded the case for consideration as to whether disclosure of a unit assignment is likely to advance a significant public interest under CCSD and for the district court to balance that interest against the government’s nontrivial privacy interest.

Revisiting The Cooperation Matrix For Classifying Cases Of Port Cooperation — Case Study: Northern Adriatic Ports, Kristijan Stamatović, Peter De Langen, Aleš Groznik
Economic and Business Review
The maritime industry has witnessed transformational changes due to the structural developments in the competitive landscape among maritime stakeholders. These trends lead to cooperation between ports, particularly those sharing common hinterland. This paper extends the existing frameworks for analysing cases of port cooperation among adjacent ports by exploring the relevance of the presence or absence of a national border, thus proposing an upgraded version of the matrix for classifying cases of port cooperation. We operationalize our theoretical findings with a case study of the North Adriatic (NAPA) ports. We conduct in-depth, semi-structured expert interviews with relevant port stakeholders in order …

Kako Hierarhije Deležnikov Oblikujejo Strateške Cilje In Strategije Športnih Klubov?, Igor Ivašković
Economic and Business Review
The paper addresses the problem of identifying stakeholders’ hierarchies in sport clubs and, on the case of basketball clubs, reveals how they reflect on the hierarchies of goals and on actual strategic decisions of observed organizations. The study is based on data obtained in 73 basketball clubs from four countries of South-Eastern Europe. The results show that private sponsors are the most influential stakeholders in top-quality clubs that pursue top-sports achievements and financial results more than the goals aimed at meeting the needs of local communities. In contrast, the low-quality clubs, where the greatest influence have volunteers, the local community …

Until recently, no special measures were foreseen for the control of foreign direct investment. Free movement of capital is one of the pillars of economic systems and legal regulations, but it also allows some exemptions for the reason of public order and national security. However, the COVID 19 epidemic has shown that it can be very important that state is in position to execute efficient control on foreign direct investments to prevent some vital interests. The Republic of Slovenia also adopted some measures to control foreign direct investment in the Act Determining the Intervention Measures to Mitigate and Remedy the …

Potential For Increased Rural Electrification Rate In Sub-Saharan Africa Using Swer Power Distribution Networks, Aviti Thadei Mushi
Tanzania Journal of Engineering and Technology (TJET)
Rural electrification rate (RER) in Africa is still low to date. Several countries in Sub-Saharan Africa have tried to address this problem using conventional single phase two-wire or three-phase three-wire systems, however at large costs due to the nature of dispersed rural load centres, low load demand, and low population density. Another solution of off-grid generation creates associated health problems. Therefore, this paper undertakes a review of a single wire earth return (SWER) network as a RER improvement solution. The paper undertakes intensive literature review to elucidate challenges and solutions to the implementation of SWER technology. Advantages of SWER technology …
