Governments "Erasing History" And The Importance Of Free Speech, Noah C. Chauvin
Governments "Erasing History" And The Importance Of Free Speech, Noah C. Chauvin
Northern Illinois University Law Review
Nationwide protests against police brutality and structural racism have led to a renewed push for governments to take down or alter Confederate monuments and symbols. Advocates for these changes argue that they will make our public spaces more just and welcoming to all people. Not everyone agrees. Some defenders of the monuments and symbols accuse pro-removal protestors and the governments who acquiesce to their demands as conspiring to "erase history." In this essay, I argue that those who oppose removing the monuments should come away from the controversy with an appreciation for the importance of free speech. On the other …
Inside State Courts: Improving The Market For State Trial Court Law Clerks, Judson R. Peverall
Inside State Courts: Improving The Market For State Trial Court Law Clerks, Judson R. Peverall
University of Richmond Law Review
The power of state trial courts is tremendous. Charged with resolving 95% of the nation’s legal cases, state trial judges decide “the law” for thousands of litigants and criminal defendants every year, not to mention countless others impacted or bound by their decisions. Yet for decades state judges and academics have warned of a “crisis in the courts.” Many state courts today remain chronically underfunded, although they rarely ever compose more than 1% of the average state budget (and never more than 2%). State chief judges have decried the waning quality of state courts, arguing that inadequate funding has led …
The Paradox Of Power In Conflict Dynamics, Daniel Rothbart
The Paradox Of Power In Conflict Dynamics, Daniel Rothbart
Peace and Conflict Studies
In recent decades the political state has been implicated in genocide, mass violence, political oppression, and targeted deprivations. Yet, in the field of conflict analysis, the meaning of state “power over” in conflict settings is under-theorized. In this article I probe the conceptual depths of state power to show that such power is neither singular nor simple. It’s neither ahistorical nor asocial. Beneath the surface of the state’s wide-ranging practices of governing its political subjects is a fundamental paradox that juxtaposes the state’s authority as the rightful authority over its subjects against the state’s vulnerability to potentially de-stabilizing threats to …

Envisioning An Age-Friendly Norwood, Caitlin Coyle, Beth Rouleau
Center for Social and Demographic Research on Aging Publications
Nestled just outside the I-95 beltway, the Town of Norwood, Massachusetts is a community southwest of Boston that takes pride in the history of residents staying in, or returning to, the community across the lifespan. Projections indicate that by 2035, about one out of three Norwood residents will be age 60 or older—24% of the Town’s population will be between the ages of 60 and 79, with an additional 8% age 80 and older (see Appendix A). The desire to stay and a growing older adult population lends to many multi-generational families within the community, creating a sense of supportive …

Agudath Israel of America v. Andrew M. Cuomo
Including the Motion for Leave to File Amicus Curiae Brief in Support of Applicant by the Muslim Public Affairs Council, Religious Freedom Institute's Islam and Religious Freedom Action Team, and Asma Uddin (i–iii).
From the Summary of Argument
Since ancient times, peoples around the world have symbolically vested the perceived wrongdoings of their community onto “scapegoats,” who are sacrificed in the hope that those wrongdoings will be expiated, and the hard times will pass. Too often, religious minorities have served as scapegoats in times of sickness, war, and fear—from Jews …
The Music Of Mass Incarceration, Andrea L. Dennis
The Music Of Mass Incarceration, Andrea L. Dennis
Scholarly Works
Intellectual property law reaches every aspect of the world, society, and creativity. Sometimes, creative expression is at the very crux of societal conflict and change. Through its history, rap music has demonstrated passionate creative expression, exploding with emotion and truths. Now the most popular musical genre in America, rap has always shared—and consistently critiqued—disproportionate effects of the criminal legal system on Black communities. The world is increasingly hearing these tunes with special acuity and paying more attention to the lyrics. Virtually every music recording artist would consider the following numbers a major career achievement: 500 percent increase; 222 percent growth; …
Framing The Second Amendment: Gun Rights, Civil Rights And Civil Liberties, Timothy Zick
Framing The Second Amendment: Gun Rights, Civil Rights And Civil Liberties, Timothy Zick
Faculty Publications
Gun rights proponents and gun control advocates have devoted significant energy to framing the constitutional right to keep and bear arms. In constitutional discourse, advocates and commentators have referred to the Second Amendment as a "collective, ""civic republican," "individual," and 'fundamental" right. Gun rights advocates have defended the right to keep and bear arms on "law and order" grounds, while gun control proponents have urged regulation based on "public health, " "human rights, " and other concerns. These frames and concepts have significantly influenced how the right to keep and bear arms has been debated, interpreted, and enforced. This Article …

Equal Protection Under Algorithms: A New Statistical And Legal Framework, Crystal S. Yang, Will Dobbie
Michigan Law Review
In this Article, we provide a new statistical and legal framework to understand the legality and fairness of predictive algorithms under the Equal Protection Clause. We begin by reviewing the main legal concerns regarding the use of protected characteristics such as race and the correlates of protected characteristics such as criminal history. The use of race and nonrace correlates in predictive algorithms generates direct and proxy effects of race, respectively, that can lead to racial disparities that many view as unwarranted and discriminatory. These effects have led to the mainstream legal consensus that the use of race and nonrace correlates …

Industrial Archeology In The City Of Gjirokastra Seen From A Structural Perspective, Egla Luca
Industrial Archeology In The City Of Gjirokastra Seen From A Structural Perspective, Egla Luca
UBT International Conference
The industrial development in Albania arrived late. On the eve of independence, back in the early 1900s, the country was essentially an agricultural economy. The industrialization of the country span a period of almost 150 years starting from the earlier industrial traces to the end of the communist era. The industry helped to form the country's modern image, awareness, and understanding about the role of industrialization; and monuments that it left behind and the communities it has managed to build, and created opportunities to better known themselves/ourselves. (Luca, 2017) This paper is focused on the Industrial Archeology of the City …

Loneliness, Prosocial Relationships, And Recidivism In Long-Term Incarcerated Juveniles, Amy R. Jozan
Loneliness, Prosocial Relationships, And Recidivism In Long-Term Incarcerated Juveniles, Amy R. Jozan
Walden University Research Conference
Lengthy juvenile facility placement has resulted in deterioration of important prosocial supports and social isolation, increasing risk for recidivism. Lengthy juvenile incarceration impacts on loneliness, post-release prosocial relationships, and desistance implications have been investigated utilizing interpretative phenomenological analysis. Social maladaptation, institutionalization, stigmatization, identifying with prosocial support, antisocial peer dissociation, and loneliness were six overarching themes discovered. Recommendations for future research efforts and proactively addressing youth maladaptation with relatable prosocial supports will be discussed. Implications for practice may be used to promote positive social change towards improving public safety, mitigating recidivism, and avoiding negative transgenerational effects from mass incarceration.

Police Officers’ Knowledge And Perception Regarding Miranda And The Public Safety Exception, Alexandria Goldstein
Police Officers’ Knowledge And Perception Regarding Miranda And The Public Safety Exception, Alexandria Goldstein
Master of Science in Criminal Justice Theses & (Pre-2016) Policy Research Projects
The public safety exception to Miranda attempts to balance an individual’s Fifth Amendment rights against self-incrimination with police officer and community safety. Under the public safety exception, if officers possess a reasonable belief that their safety or the public’s safety is in imminent danger, they may forego reading the Miranda warnings to a suspect in custody whom they wish to interrogate. The purpose of this empirical, survey study is to examine police officer perception and knowledge of the public safety exception. To this end, a questionnaire was distributed to officers in a large, populated county in the Southeastern United States. …
Development And Characterization Of Robust Methods For Field Investigations With Portable Mass Spectrometry, Ashley Rose Stelmack
Development And Characterization Of Robust Methods For Field Investigations With Portable Mass Spectrometry, Ashley Rose Stelmack
Theses and Dissertations
Portable mass spectrometry (MS) has become an area of interest due to the ability to conduct chemical analyses in native environments. These instruments have the potential to increase efficiency and analytical throughput via real-time experimentation, minimizing the need for sample transportation. One drive towards the development of fieldable mass spectrometers is the potential for coupling to novel ambient ionization methods (or “ambient MS”), which can generate spectral data at ambient conditions from unprepared or minimally prepared samples of interest. Since the first introduction of the desorption electrospray ionization (DESI) technique in 2004, a myriad of novel techniques have been reported …

Publications and Research
This is the sixth of six updates presenting interim findings from the evaluation of the NYC Mayor’s Action Plan for Neighborhood Safety (MAP). Researchers conducted surveys of residents in housing developments operated by the New York City Housing Authority (NYCHA), half involved in MAP and half not involved. The survey measured opinions and perceptions about public safety and resident well-being. Surveys were conducted well after the 2014 launch of MAP, but the data allowed the study to examine differences between MAP and non-MAP communities.

Charleston Library Conference
Chicago State University’s Gwendolyn Brooks Library decision to trial and acquire Kanopy, A Patro-Driven-Acquisition video streaming service, was completely a patron-demand-driven undertaking. The decision to obtain this service was led by faculty interest in the resource and ranged from the initial inquiry for a trial by a foreign language faculty member to its PDA model, which has allowed faculty to select the films purchased. The article discusses the acquisition process, set-up steps for making the trial and then the resource available to the CSU community, and the steps taken to promote the resource.
