Forced Business Closures: Executive Orders By The Governor Closing Private Businesses, Baylee A. Culverhouse, Alexa R. Martin

Georgia State University Law Review

Governor Brian Kemp (R) issued Executive Orders in response to the COVID-19 pandemic that required businesses to close in an effort to limit the spread of the virus. Business owners often challenged those forced business closures as unconstitutional or as exceeding the State’s police power, and those challenges were met with varying degrees of success.

First Amendment: Executive Order By The Governor Limiting Large Gatherings Statewide, Alex N. Estroff, Boris W. Gautier Dec 2020

First Amendment: Executive Order By The Governor Limiting Large Gatherings Statewide, Alex N. Estroff, Boris W. Gautier

Georgia State University Law Review

Beginning in March 2020, Georgia Governor Brian Kemp (R) issued a series of Executive Orders addressing the State’s response to the COVID-19 pandemic. Included in these Orders was a prohibition on large groups of people gathering in a single location. Though an effective means of curtailing the virus’s rapid transmission, this specific provision became a source of controversy for groups who believed such a prohibition infringed upon their First Amendment rights.

When the legislature reconvened, legislators passed the Georgia COVID-19 Pandemic Business Safety Act, which provided liability limitation to businesses against tort claims arising from the pandemic.

Ring, Amazon Calling: The State Action Doctrine & The Fourth Amendment, Grace Egger Dec 2020

Ring, Amazon Calling: The State Action Doctrine & The Fourth Amendment, Grace Egger

Washington Law Review Online

Video doorbells have proliferated across the United States and Amazon owns one of the most popular video doorbell companies on the market—Ring. While many view the Ring video doorbell as useful technology that protects the home and promotes safer neighborhoods, the product reduces consumer privacy without much recourse. For example, Ring partners with cities and law enforcement agencies across the United States thereby creating a mass surveillance network in which law enforcement agencies can watch neighborhoods and access Ring data without the user’s knowledge or consent. Because Amazon is not a state actor, it is able to circumvent the due …

Confronting Wicked Crypto: Wicked Problems, Encryption Policy, And Exceptional Access Technology, Kevin Nicholas Kredit Dec 2020

Confronting Wicked Crypto: Wicked Problems, Encryption Policy, And Exceptional Access Technology, Kevin Nicholas Kredit

Masters Theses

Public debate has resumed on the topic of exceptional access (EA), which refers to alternative means of decryption intended for law enforcement use. The resumption of this debate is not a renege on a resolute promise made at the end of the 1990s “crypto war”; rather, it represents a valid reassessment of optimal policy in light of changing circumstances. The imbalance between privacy, access, and security in the context of constantly changing society and technology is a wicked problem that has and will continue to evade a permanent solution. As policymakers consider next steps, it is necessary that the technical …

Incidence Of Antibiotic Resistance And Plasmid Content In Freshwater Beach Sand And Water And Clinical Urinary Tract Infection Escherichia Coli Isolates, Robert F. White

Biology Theses

Antibiotic-resistant (AR) bacteria have been found in environmental ecosystems including beach sand and water, and pose a serious threat to the mitigation of human and animal disease. The presence of antibiotic residues in the environment, fueled by wastewater effluent and agricultural runoff, may produce selective pressure on introduced microbes such as Escherichia coli, leading to the production of AR populations. This study characterized and compared the antibiotic resistance patterns and plasmid content of E. coli isolated from a freshwater beach and clinical urinary tract infection (UTI) samples. A higher level of antibiotic resistance was expected in clinical (UTI) Escherichia coli …

Safety, Crisis, And Criminal Law, Jenny E. Carroll Dec 2020

Safety, Crisis, And Criminal Law, Jenny E. Carroll

Faculty Scholarship

Concepts of safety and prevention of danger pervade the criminal law canon. Arizona is no exception. The state’s criminal systems pivot around central and entwined goals of protecting public safety and preventing danger. The state constitution permits pretrial detention both for the most serious offenses and when no other condition of release will adequately protect the community from the danger the accused’s freedom might pose. The rules of criminal procedure and the criminal code designate some offenses and actors “dangerous” and urge judges to weigh not only the accused’s risk of flight, but also his future dangerousness in making decisions …

Resource Allocation In Healthcare, Sydney Sprau Dec 2020

Resource Allocation In Healthcare, Sydney Sprau

Honors Projects

The overall purpose of this research was to find ways that resources are allocated throughout the healthcare system. Resources are not always what we think of when it comes to healthcare. While it does include personal protective equipment, ventilators, and beds, it also includes the personnel that are required to deliver the care essential to survival. It is well known that many ethical issues revolve around the allocation of such resources in healthcare, but it is unknown what the best solution to sharing these resources is during pandemics such as COVID-19.

Racial Threat, Economic Resources, And Politics: How Local Structural Conditions Influence The Adoption Of Restrictionist Immigration Policy, Mario Marset Ehrle Dec 2020

Racial Threat, Economic Resources, And Politics: How Local Structural Conditions Influence The Adoption Of Restrictionist Immigration Policy, Mario Marset Ehrle

Honors Theses

ICE has used their 287(g) program to target immigration enforcement at the county level. This program authorizes local police officers to carry out federal immigration work to meet arrest and deportation quotas. This has eroded civil rights and led to the criminalization of minorities, particularly Latinos. While previous research has examined the theories behind local anti-immigration work and the social factors affecting anti-immigrant policy adoption more generally, no large-scale quantitative analyses have been conducted as to why some counties adopted 287(g) while others chose not to do so. Addressing this gap in the literature, the following study uses a newly …

Electronic Theses and Dissertations

On April 10, 2019, a global crisis began outside Ethiopia’s capital, Addis Ababa. A Boeing 737 Max 8 airplane owned and operated by Ethiopian Airline crashed in the desert killing all on board. The accident mimicked a six months old Lion Air flight 610 which happened in Indonesia and claimed the lives of all crew and passengers. Together, these accidents claimed the lives of 346 people and have been noted as one of the dark days in modern aviation history. Subsequently, the aviation world grounded all Boeing 737 Max aircrafts amid safety concerns. This brought severe public criticism to Boeing, …

Crimes And Offenses: Proposed Constitutional Carry Act Of 2019 & Executive Order By The Governor Temporarily Extending Renewal Requirements For Weapons Carry Licenses, Kristin Harripaul, Briana A. James Dec 2020

Crimes And Offenses: Proposed Constitutional Carry Act Of 2019 & Executive Order By The Governor Temporarily Extending Renewal Requirements For Weapons Carry Licenses, Kristin Harripaul, Briana A. James

Georgia State University Law Review

In March 2020, Governor Brian Kemp (R) issued an Executive Order declaring a Public Health State of Emergency due to COVID-19. The Supreme Court of Georgia also issued a Judicial Order declaring a Statewide Judicial Emergency. The Council of Probate Court Judges subsequently characterized the processing of weapons carry licenses as non-essential and temporarily suspended license issuances to limit the spread of COVID-19. HB 2 would have eliminated the license requirement and the need for probate judges to process applications. However, HB 2 never received a hearing before the 2019–20 legislative session ended. Gun rights advocates called on Governor Kemp …

Faith And/In Medicine: Religious And Conscientious Objections To Maid, Daphne Gilbert Dec 2020

Faith And/In Medicine: Religious And Conscientious Objections To Maid, Daphne Gilbert

Dalhousie Law Journal

Across Canada, health care institutions that operate under the umbrella of religious traditions refuse to offer medical assistance in dying (MAiD) on the grounds that it violates their Charter-protected rights to freedom of religion and conscience. This article analyses the Supreme Court jurisprudence on section 2(a) and concludes that it should not extend to the protection of institutional rights. While the Court has not definitively pronounced a view on this matter, its jurisprudence suggests that any institutional right to freedom of religion would not extend to decisions on publicly-funded and legal health care. MAiD is a constitutionally-protected option for individuals …

Learning Before And During The Covid-19 Outbreak: A Comparative Analysis Of Crisis Learning In South Korea And The Us, Seulki Lee, Jungwon Yeo, Chongmin Na Dec 2020

Learning Before And During The Covid-19 Outbreak: A Comparative Analysis Of Crisis Learning In South Korea And The Us, Seulki Lee, Jungwon Yeo, Chongmin Na

Research Collection School of Social Sciences

Learning is imperative in government responses to crises like the COVID-19 pandemic. This study examines the South Korean and United States governments’ responses to COVID-19 from a comparative perspective. The analysis focuses on crisis learning conducted before and during the COVID-19 outbreak, using the conceptual categories of intercrisis/intracrisis learning and single-/double-loop learning. The findings suggest that double-loop, intercrisis learning allows for more effective crisis management by (re)developing a common operating framework. The efficacy of learning is enhanced when double-loop learning is followed by single-loop learning that embeds new structures and operational procedures. The findings also suggest that intercrisis learning facilitates …

Backlogged Or Logjammed? An Analysis Of The Patterns That Surround The Rape Kit Backlog Across Jurisdictions, Elizabeth Dowd Dec 2020

Backlogged Or Logjammed? An Analysis Of The Patterns That Surround The Rape Kit Backlog Across Jurisdictions, Elizabeth Dowd

Political Science Undergraduate Honors Theses

Untested rape kits sit in crime labs, hospitals, evidence lockers, or storage facilities untouched. In the worst-case scenarios, rape kits have been thrown out of police storage before the statute of limitations had expired. A major public policy problem is developing as these kits stack up and create a backlog. The primary problem with the rape kit backlog is that all victims are not receiving justice. To solve the problem, the backlog of rape kits needs further exploration and analysis. If a pattern can be established about why the problem is occurring, then policies can be constructed and implemented to …

The summit series centered on the safety and preparedness of NOS staff, facilities, partners, and other key resources as well as mission related activities and response actions. These mission activities included, but were not limited to, coordination with USCG for port safety and reopening, readiness and response for pollution …

The Life And Death Of Confederate Monuments, Jessica Owley, Jess Phelps Dec 2020

The Life And Death Of Confederate Monuments, Jessica Owley, Jess Phelps

Articles

Confederate monuments have again received increased attention in the aftermath of George Floyd's tragic death in Minneapolis, Minnesota, on May 25, 2020. Momentum and shifting public opinion are working toward the removal of these problematic monuments across the country. This Article seeks to provide insight for monument-removal advocates: specifically focusing on the legal issues associated with the "death" or removal of these monuments, how property law shapes and defines these efforts, and briefly examining what happens to these statues after removal. Our exploration of Confederate monuments reveals that some removal efforts occur outside of legally created processes. Both public and …

The Role Emergency Medical Services Organizations Play In Preparing And Supporting Emergency Medical Technicians To Minimize The Effects Of Peritraumatic Dissociation, Stephen Knapp Dec 2020

The Role Emergency Medical Services Organizations Play In Preparing And Supporting Emergency Medical Technicians To Minimize The Effects Of Peritraumatic Dissociation, Stephen Knapp

Education Doctoral

The purpose of this qualitative descriptive phenomenological research study was to identify the role of emergency medical services (EMS) organizations in preparing and supporting emergency medical technicians (EMTs) with the effects of peritraumatic dissociation (PD). Specifically, the aim was to gain insight into the shared phenomena of PD and the impact of occupational stress on EMTs and EMS managers, in a county in Central New York State, to identify, from the perspective of a total of eight practicing EMTs and EMS managers, the services, the employee benefits, and the activities that assist in destigmatizing and minimizing the effects of PD. …

Specialized Police Units: Nypd Anti-Crime And The Effect Of Body-Worn Cameras, Rudolph B. Hall Jr. Dec 2020

Specialized Police Units: Nypd Anti-Crime And The Effect Of Body-Worn Cameras, Rudolph B. Hall Jr.

Education Doctoral

The use of body-worn cameras (BWC) by law enforcement organizations has continued to expand across the United States. The ability for BWC to bring about transparency, trust, and accountability between police and citizens has been touted as one of the significant benefits of BWC deployment. The assignment of BWC to uniformed officers has been a topic of multiple empirical studies. However, there has been a paucity of research directly focused on officers assigned to specialized plain-clothes enforcement, also known as anti-crime teams. These officers carry out a unique mission and purpose compared to their uniformed colleagues. The author utilized a …

Politicized Prayer: How Thoughts And Prayers Hinder Gun Legislation, Hope Cody Dec 2020

Politicized Prayer: How Thoughts And Prayers Hinder Gun Legislation, Hope Cody

Honors Theses

Thoughts and prayers are a strategic rhetorical tool, rather than a religious sentiment, when it comes to gun reform in the US. I confirm my three hypotheses: that the rhetorical use of thoughts and prayers do rise sharply after a mass shooting, that the use is centered in the gun rights coalition, and the use of thoughts and prayers is intentional. This establishes a direct link between the sending of thoughts and prayers and the lack of measurable gun reform laws in the United States.

Data collected from the Water Check program includes lot size, square feet (sf) of turfgrass, sprinkler types, sprinkler efficiency, and existing watering schedules.

This thesis examines the …

Labor Redemption In Work Law, Andrew Elmore Dec 2020

Labor Redemption In Work Law, Andrew Elmore

Articles

People with criminal records are not a protected class under Title VII, and many employers fear that hiring people with criminal records invites negligent hiring liability. Ban the Box privacy laws delay but may not deter overbroad criminal background checks. This Article challenges this standard account by shifting focus to the state in imposing arbitrary barriers to work. I expose a dignity interest in the removal of these unnecessary barriers, or "labor redemption." I find foundations of labor redemption in successful constitutional challenges to denials of public employment and occupational licenses. Labor redemption is also, increasingly, a statutory right, in …
