From Nineteenth Amendment To Era: Constitutional Amendments For Women's Equality, Tracy A. Thomas
Akron Law Faculty Publications
A modern movement has renewed efforts to pass the ERA, still believing in the necessity of a constitutional guarantee of the broad legal and social equality of women first advanced 171 years ago. This essay traces the history of the women’s constitutional demands for equality, from its origins in Seneca Falls, the adoption of the Nineteenth Amendment, the proposed ERA, and modern efforts for a new amendment to secure gender equality.
Judicial Drift, Elizabeth Nevins-Saunders
Judicial Drift, Elizabeth Nevins-Saunders
Hofstra Law Faculty Scholarship
Although there is broad consensus on what constitutes procedural due process in criminal cases, in courtrooms around the country, those ideals are often disregarded. In the wake of rising public attention to misdemeanors, be it through marijuana decriminalization or concern over unduly punitive fees and surcharges, a few scholars have pointed to theories explaining the gulf between rights and reality for low-level defendants. Yet none have expressly considered the impact of administrative rules made (or not made) at the courthouse level. This Article analogizes the courthouse to an administrative agency and borrows the doctrine of “bureaucratic drift” to explain how …
Toward A Theory Of Intercountry Human Rights: Global Capitalism And The Rise And Fall Of Intercountry Adoption, Barbara Stark
Toward A Theory Of Intercountry Human Rights: Global Capitalism And The Rise And Fall Of Intercountry Adoption, Barbara Stark
Hofstra Law Faculty Scholarship
Human rights law, as set out in the International Bill of Rights 40 years ago, has not lived up to its drafters’ hopes. Its shortcomings are often blamed on weak enforcement. Because nation states resist restraints on their sovereignty, human rights law depends in large part on states policing themselves. On the international level, the UN and non-governmental organizations report on human rights violations, but they have no authority to sanction violators or compel remedies.
This Article proposes another mechanism for enforcement, an alternative to self-serving domestic policing and weak international bureaucracy. “Intercountry,” as opposed to “international,” human rights would …
The Vimentin Rod Domain Blocks P-Selectin-P-Selectin Glycoprotein Ligand 1 Interactions To Attenuate Leukocyte Adhesion To Inflamed Endothelium, Fong Wilson Lam, Cameron August Brown, Christian Valladolid, Dabel Cynthia Emebo, Timothy Gerald Palzkill, Miguel Angel Cruz
The Vimentin Rod Domain Blocks P-Selectin-P-Selectin Glycoprotein Ligand 1 Interactions To Attenuate Leukocyte Adhesion To Inflamed Endothelium, Fong Wilson Lam, Cameron August Brown, Christian Valladolid, Dabel Cynthia Emebo, Timothy Gerald Palzkill, Miguel Angel Cruz
Faculty, Staff and Students Publications
Acute inflammation begins with leukocyte P-selectin glycoprotein ligand-1 (PSGL-1) binding to P-selectin on inflamed endothelium and platelets. In pathologic conditions, this process may contribute to secondary organ damage, like sepsis-induced liver injury. Therefore, developing novel therapies to attenuate inflammation may be beneficial. We previously reported that recombinant human vimentin (rhVim) binds P-selectin to block leukocyte adhesion to endothelium and platelets. In this study, we used SPOT-peptide arrays to identify the rod domain as the active region within rhVim that interacts with P-selectin. Indeed, recombinant human rod domain of vimentin (rhRod) binds to P-selectin with high affinity, with in silico modeling …

Law Students And Cell Phone Use: Results Of A Six-School Survey, Linda Galler, Robert M. Jarvis, Cindy I.T. Archer, Hugh D. Spitzer, Jodi Wilson, Mark E. Wojcik
Hofstra Law Faculty Scholarship
The sight of a law student using his or her cell phone now is so common that law professors do not give it a second though. But what, exactly, is the student doing? Texting with friends? Shopping? Watching a movie? To try to find out, during the Fall 2019 semester we asked our six diverse law schools to take an online survey consisting of eighteen questions. To our knowledge, this is the first phone survey of law students.
This paper presents the results of the survey, exploring applications used (text, social media, email, etc.) and differences by audience (e.g., whether …

BACKGROUND: Reducing the rising health-care burden associated with shoulder surgical site infection (SSI) is of paramount importance. The purpose of this study was to investigate the antimicrobial efficacy of protocatechuic acid (PCA) as a topical reagent for surgical skin antisepsis surrounding the shoulder joint.
METHODS: This was a 2-phase skin-disinfection trial involving the human shoulder. The shoulders of healthy volunteers were randomized to topical treatment with PCA (a 10% concentration of PCA in Phase I [11 subjects] and a 17% concentration in Phase II [12 subjects]), with a control of isopropyl alcohol (IPA) applied to the contralateral shoulder. Mechanical scraping …
More Than The Vote: The Nineteenth Amendment As Proxy For Gender Equality, Tracy Thomas
More Than The Vote: The Nineteenth Amendment As Proxy For Gender Equality, Tracy Thomas
Con Law Center Articles and Publications
The original idea behind the Nineteenth Amendment was never just about the vote. Instead, the first women's rights movement 175 years ago, like the modern movement for the Equal Rights Amendment, sought comprehensive equality for women in all avenues of life. The constitutional text for women’s full equality and emancipation has changed over the centuries; first embodied in the grant of the vote as a proxy for structural change, and now incorporated into the demand for “equal rights.” Yet women have been consistent over time in understanding the radical idea that systems of governance, family, industry, and church need dismantling …

More Than The Vote: The Nineteenth Amendment As Proxy For Gender Equality, Tracy A. Thomas
Akron Law Faculty Publications
This essay first details the origins of women's political demand for the vote as part of a comprehensive social reform. It then discusses the four strands of the comprehensive early women's rights agenda for gender equality focused on the political state, domestic family, economic industry, and religious church. Finally, it connects the suffrage activism with demands for an equal rights amendment to realize the full civil rights of equality envisioned by and for women. This long view of women's rights shows it was never only about the vote; rather, the vote stood as a shorthand for a complete revolution of …

App Permissions & The Third-Party Doctrine (Symposium), Michael Gentithes
Akron Law Faculty Publications
In the spirit of Professor Tokson's effort to consider the next wave of Fourth Amendment cases likely to reach the Supreme Court, this essay addresses a looming technological challenge to the Court's third-party doctrine: the permissions that app developers obtain on our digital devices. Such permissions - which are either granted by the user upon installation of the app or permitted by the operating system without any user input - entitle app developers to access and send data from the device, such as the user's location services, motion sensors, contacts, calendars, social media accounts, camera, or microphone. Carpenter contracted the …

Utilizing Relational Dialectics Theory To Identify Dominant And Marginalized Discourses In Women's Miscarriage Podcast Stories, Cherinicole Lardino
All Student Theses and Dissertations
This study examined the discourses of miscarriages from the podcast narratives of women who have experienced miscarriage by utilizing Relational Dialectic Theory (RDT). The process of contrapuntal analysis identified the discourse of silence as the dominant miscarriage discourse in which the marginalized miscarriage discourse of silence as the dominant miscarriage discourse in which the marginalized miscarriage discourses of open and honest and fear and anxiety were counterpoint to. There were four interrelated themes of shame, lack of supportive and encouraging messages, lack of readily available information, and a communicated feeling that their circumstances could be worse that revealed the silence …
A New Frontier Facing Attorneys And Paralegals: The Promise & Challenges Of Artificial Intelligence As Applied To Law & Legal Decision-Making, Marissa Moran
Publications and Research
Artificial Intelligence/AI invisibly navigates and informs our lives today and may also be used to determine a client’s legal fate. Through executive order, statements by a U.S. Supreme Court justice and a Congressional Commission on AI, all three branches of the United States government have addressed the use of AI to resolve societal and legal matters. Pursuant to the American Bar Association Model Rules of Professional Conduct[i] and New York Rules of Professional Conduct (NYRPC), [ii] the legal profession recognizes the need for competency in technology which requires both substantive knowledge of law and competent use of technology for …

Representaciones De La Identidad Neoleonesa En Los Spots De Las Campañas A La Gubernatura De Nuevo León De 2015representations Of Nuevo León’S Identity Within The Campaign Spots For The 2015 State Election, Xavier Moyssén Álvarez
Publications and Research
This article parts from the sociological model of voting behavior, according to which social characteristics deter-mine political preferences. It is proposed that regional identity, because of its socialized nature, might’ve had effects on the voting behavior of the 2015 Nuevo León election. This work isn’t focused on the result of the election, it rather intends to verify, through content analysis, the presence of elements belonging to Nuevo Leon’s identity within the campaign spots for the main candidates:Felipe de Jesús Cantú (PAN), Ivonne Álvarez García (PRI), and Jaime Heliodoro Rodríguez Calderón (independ-ent). Furthermore, we propose a theoretical explanation of the possible …

Coagulopathy often develops soon after acute traumatic brain injury and its cause remains poorly understood. We have shown that injured brains release cellular microvesicles that disrupt the endothelial barrier and induce consumptive coagulopathy. Morphologically intact extracellular mitochondria accounted for 55.2% of these microvesicles, leading to the hypothesis that these extracellular mitochondria are metabolically active and serve as a source of oxidative stress that activates platelets and renders them procoagulant. In testing this hypothesis experimentally, we found that the extracellular mitochondria purified from brain trauma mice and those released from brains subjected to freeze-thaw injury remained metabolically active and produced reactive …

Archaeosine (G+) is a structurally complex modified nucleoside found quasi-universally in the tRNA of Archaea and located at position 15 in the dihydrouridine loop, a site not modified in any tRNA outside of the Archaea. G+ is characterized by an unusual 7-deazaguanosine core structure with a formamidine group at the 7-position. The location of G+ at position 15, coupled with its novel molecular structure, led to a hypothesis that G+ stabilizes tRNA tertiary structure through several distinct mechanisms. To test whether G+ contributes to tRNA stability and define the biological role of G+, we investigated the consequences of introducing targeted …

Widening The Pipeline: Identifying Practices And Structures That Effectively Recruit And Retain African-American Females In Undergraduate Computer Science Programs At Historically Black Colleges And Universities, Martha Haigler
Doctor of Education Dissertations
The underrepresentation of women and women of color in the disciplines of science, technology, engineering, and mathematics (STEM) is of little surprise to those of us who have kept abreast of the statistical data supporting this phenomenon. In order for the United States (U.S.) to remain “economically and globally competitive” (Ong, 2011, p. 32), it needs to increase its “advanced domestic science and technology workforce” (Ong, 2011, p.32). Perhaps, it is not a coincidence that the majority of students attending U.S. colleges are female, and the number of minority students entering college is on the rise. However, when one looks …

Electrotransfer Of Il-15/Il-15rα Complex For The Treatment Of Established Melanoma, Shawna A. Shirley, Cathryn G. Lundberg, Richard Heller
Bioelectrics Publications
Gene electrotransfer (GET) is a safe, reliable, and effective method of delivering plasmid DNA (pDNA) to solid tumors. GET has been previously used to deliver interleukin-15 (IL-15) to mouse melanoma, resulting in long-term tumor regression and the survival of a percentage of treated animals after challenge. To enhance this effect, we evaluated modulating the expression levels of IL-15 and co-expressing its receptor, IL-15Rα. GET was used to deliver plasmids encoding IL-15 and IL-15Rα to established B16.F10 tumors on days 0, 4, and 7. Two delivery protocols that yielded different expression profiles were utilized. Mice that were tumor-free for 50 days …
A License To Kill: The Institutional Failure Of The Legal System To Hold Police Accountable, Eliana R. Fleischer
A License To Kill: The Institutional Failure Of The Legal System To Hold Police Accountable, Eliana R. Fleischer
Honors Theses
In recent years, police shootings of unarmed African American men have become nationally visible. With few exceptions, the police officers involved in those shootings have escaped any criminal penalties. This paper addresses why so few police officers are convicted after shooting unarmed African Americans. Using an interdisciplinary approach, it addresses three aspects of the criminal justice system: prosecutorial power, Supreme Court case law, and jury bias. This paper argues that the legal system is structured to protect police officers from liability, making it unable to deliver justice after on-duty police shootings of unarmed African American men.
Evaluating A Culprit: A Review Of The Biochemical Mechanisms Of Non-Celiac Gluten Intolerance, Callie Cinque
Evaluating A Culprit: A Review Of The Biochemical Mechanisms Of Non-Celiac Gluten Intolerance, Callie Cinque
Honors Theses
Non-Celiac Gluten Intolerance (NCGI) has evaded biological and chemical mechanisms since it was first reported in 1978. Celiac Disease, a multi-system immune mediated disorder has long served as the most similar counterpart to NCGI. Less cases of celiac disease are going undiagnosed reflecting an improvement on sensitive and decisive diagnostic tools. However, NCGI has been significantly growing as a diagnosis over the past decade with little match or similarity to the markers found in celiac disease patients. Critical evaluation of NCGI theories, experimentation, and existing hypotheses is necessary. This review seeks to synthesize multiple disciplines of gluten research and enhance …
Learning To Check Yourself: Improving Civic Engagement Through Duties, Better Voting Practices, And Combatting Group Loyalty, Katherine Brumund
Learning To Check Yourself: Improving Civic Engagement Through Duties, Better Voting Practices, And Combatting Group Loyalty, Katherine Brumund
Honors Theses
This project examines civic engagement. It is divided into three chapters: apathy, voting, and group loyalties. I derive two duties, a duty to care and a duty to reason well, that serve as a framework for community engagement aimed at facilitating moral progress. In the second section the main topic is voting. I argue for strategies to vote well. The third section of this project then focuses on group loyalties. This project uses two duties to frame how to engage with others, proposes a better way to participate civically, and ways to avoid pitfalls associated with group membership.
How To Be A Good Believer: A Multifaceted Defense Of Christian Belief, Cameron Bonsell
How To Be A Good Believer: A Multifaceted Defense Of Christian Belief, Cameron Bonsell
Honors Theses
In this paper I will argue that holding Christian beliefs is consistent with intellectual virtues. I must first clarify that holding Christian beliefs does not consist only in the affirmation of certain propositions like “God exists”. This is not to say that affirming certain doctrine is not essential to Christian belief, but this is only part of what it encompasses. When I refer to Christianity and Christian beliefs in this paper, I mean affirming basic religious propositions like “Jesus was the son of God”, but I also take certain practices to be part of Christian belief. For example, spiritual disciplines …

Un Vrai Centriste? Les Politiques D’Emmanuel Macron Au 21Ème Siècle, Alexandra Kohnert
Honors Theses
