Walk The Line: Aristotle And The Ethics Of Narrative, Melissa Love Koenig, Lori D. Johnson Jan 2020

Walk The Line: Aristotle And The Ethics Of Narrative, Melissa Love Koenig, Lori D. Johnson

Faculty Publications

Lawyers are storytellers who face tremendous pressure to persuade judges and juries of the rightness of their stories. Zealous advocacy has long been a touchstone in lawyering, but lawyers need to balance zealousness with candor to the tribunal. As narrative and storytelling have evolved in scholarship and practice as powerful tools for persuasion, lawyers can find themselves walking a delicate ethical line. The applicable Model Rules of Professional Conduct do not provide a sufficient framework for ensuring sufficient candor in the use of narrative, particularly when considering the cultural and psychological power inherent in stories. Thus, lawyers can find themselves …

Elusive Justice: Reflections On The Tenth Anniversary Of Afghanistan's Law On Elimination Of Violence Against Women, Mehdi J. Hakimi Jan 2020

Elusive Justice: Reflections On The Tenth Anniversary Of Afghanistan's Law On Elimination Of Violence Against Women, Mehdi J. Hakimi

Northwestern Journal of Human Rights

The Taliban’s fall in 2001 elevated hopes for improving the plight of women and girls in Afghanistan. Those aspirations were bolstered with the promulgation of the country’s landmark Law on the Elimination of Violence against Women (EVAW) in 2009. The tenth anniversary of Afghanistan’s EVAW Law, however, offers little cause for celebration. This essay examines Afghanistan’s legal framework on combating gender-based violence against women, and the mounting challenges on the ground. The ongoing rampant violence against women, pervasive use of mediation in criminal cases, and violations perpetrated by State agents have made Afghan women’s quest for justice increasingly more elusive. …

From Advocate To Party - Defenses For Lawyers Who Find Themselves In Litigation, Richard J. Wilson Jan 2020

From Advocate To Party - Defenses For Lawyers Who Find Themselves In Litigation, Richard J. Wilson

Scholarly Articles in Law Reviews & Journals

Attorneys, like all professionals, face civil liability when their action or inaction causes harm to a client. When an attorney fails the client, the claim most often asserted, and the claim that is typically most appropriate, is a legal malpractice claim. A legal malpractice claim is based on negligence.' Thus, the elements of a legal malpractice claim are (1) a duty, (2) a breach of that duty, (3) the breach proximately caused injury to the plaintiff, and (4) damages occurred.

Still, attorneys find themselves in a different circumstance than the average litigant. An attorney is not responsible for the client's …

Parents And Educators Perspectives Of Chronic Absenteeism: Strategies To Improve Attendance, Gloria Genene Woullard-Wilder Jan 2020

Parents And Educators Perspectives Of Chronic Absenteeism: Strategies To Improve Attendance, Gloria Genene Woullard-Wilder

Walden Dissertations and Doctoral Studies

The research problem for this study was the chronic absenteeism for students in Grades 1–3 in a high-poverty, low-performing elementary school in a Southern state. Chronic absenteeism (CA) can result in poor reading skills and high dropout rates for students in low-income areas. The purpose of this basic qualitative study was to explore the perspectives of 6 parents, 6 educators, and 4 school support staff regarding the causes of CA in Grades 1–3 and recommendations to increase and sustain attendance. Bronfenbrenner’s ecological systems theory served as the framework. The research questions were used to identify causes of CA and suggestions …

Why Is Bribery Pervasive Among Firms In Sub-Saharan African Countries? Multi-Industry Empirical Evidence Of Organizational Isomorphism, Nnaoke Ufere, James Gaskin, Sheri Perelli, Antoinette Somers, Richard Boland Jr. Jan 2020

Why Is Bribery Pervasive Among Firms In Sub-Saharan African Countries? Multi-Industry Empirical Evidence Of Organizational Isomorphism, Nnaoke Ufere, James Gaskin, Sheri Perelli, Antoinette Somers, Richard Boland Jr.

Faculty Publications

Motivated by the prevalence and persistence of corruption in Sub-Saharan Africa (SSA) despite high-profile anticorruption efforts, and by calls for more research on unethical organizational behavior by firms in Africa, we investigated the link between bribery in 12 SSA countries and the phenomenon of organizational isomorphism, long used to explain legitimate, but rarely, illegitimate firm practices. Analysis of 5989 SSA firms in three distinct industries known for high levels of bribery reveals direct positive relationships between bribery and its perception as frequently practiced in specific industries (“mimetic isomorphic effect”); institutional constraints on businesses (“coercive isomorphic effect”); and local market rivalry …
