Publications and Research

The novel coronavirus COVID-19 has profoundly disrupted life in the United States. Among other challenges, jurisdictions are unlikely to be able to administer the July 2020 bar exam in the usual manner. It is essential, however, to continue licensing new lawyers. Those lawyers are necessary to meet current needs in the legal system. Equally important, the demand for legal services will skyrocket during and after this pandemic. We cannot close doors to the profession at a time when client demand will reach an all-time high.

In this brief policy paper, we outline six licensing options for jurisdictions to consider for …

Legal Origins And Evolution Of Local Ethics Reform In New Orleans, David A. Marcello Mar 2020

Legal Origins And Evolution Of Local Ethics Reform In New Orleans, David A. Marcello

New England Journal of Public Policy

The Office of Inspector General came first, and like many another reform in city government, it was born as a campaign commitment. When I met with state senator Marc H. Morial in September 1993 to discuss the issues component of his campaign for mayor, ideas poured out of him for an hour and a half, and I took copious notes. “We need an Inspector General,” he said, “and we need Charter Revision”—the two ideas linked from this first campaign convening. When he was elected mayor six months later and inaugurated in May 1994, charter reform became an early and important …

States’ Evolving Role In The Supplemental Nutritional Assistance Program, David A. Super Mar 2020

States’ Evolving Role In The Supplemental Nutritional Assistance Program, David A. Super

Georgetown Law Faculty Publications and Other Works

States have always been crucial to the Supplemental Nutrition Assistance Program (SNAP, formerly food stamps). Even though the federal government has paid virtually all the program’s benefit costs, state administration has always been indispensable for several reasons. State and local governments pay their staff considerably less than the federal government, making state administration less expensive. States already administer other important antipoverty programs, notably family cash assistance and Medicaid, allowing them to coordinate the programs and minimize repetitive activities. And states have somewhat lower, and less polarizing, political footprints than does the federal government, moderating criticism of the program. In addition, …

Facilitating Distinctive And Meaningful Change Within U.S. Law Schools (Part 2): Pursuing Successful Plan Implementation Through Better Resource Management, Patrick H. Gaughan, Samantha J. Prince

The University of New Hampshire Law Review

In Part 1 of this series, one of the current authors used institutional theory, behavioral economics, and psychology to explain why U.S. law schools have had difficulty evolving faster and better. The author then used institutional entrepreneurship to propose a seven-step, faculty-led, operational change process designed to overcome institutional isomorphism and to enable each law school to formulate a distinctive, meaningful, strategic plan. In Part 2, the current article addresses the typical implementation challenges to be expected within the context of existing law school governance. The article begins by discussing the Resource Based View of the firm and the role …

The Role Of Social Media In Raising Special Needs Awareness Among Saudi People, Lujain Bugshan Mar 2020

The Role Of Social Media In Raising Special Needs Awareness Among Saudi People, Lujain Bugshan

Student Theses and Dissertations

Notwithstanding the decades-long focus afforded by the Saudi government on people with special needs, the sector remains to receive minimal research-based interventions (Alharbi & Madhesh, 2017), making social awareness more challenging. However, social media has become a means for information diffusion and raising awareness about different social issues. Furthermore, it has been employed as a powerful medium in influencing the perceptions of its users in Saudi Arabia (de Alencar, 2016). Given the utility of social media and the expected positive outcomes of public health advocacies, this paper seeks to examine the role of social media in raising awareness of the …

“A Victim Is A Victim:” Lgbt Blindness Among Victim Assistance Workers, Michael C. Lasala, James P. Fedor Mar 2020

“A Victim Is A Victim:” Lgbt Blindness Among Victim Assistance Workers, Michael C. Lasala, James P. Fedor

Qualitative Criminology (QC)

"LGBT crime victims underutilize victim assistance services because they fear secondary victimization by homophobic and insensitive workers and organizations. However, assessment of the perceptions and competence of those working with these populations is largely absent from the literature. To address this gap, we qualitatively investigated 83 victim assistance workers and administrators regarding their practices with LGBT victims. Overall, respondents believed that a victim’s sexual orientation or gender identity was irrelevant, which was well-meaning but potentially perpetuated a type of LGBT cultural blindness to the needs of these populations, not dissimilar to color blindness among some white service providers toward African …

Graffiti Gains Recognized Stature In Multi-Million Dollar Victory For Artists, Libby Merritt

Cardozo Arts & Entertainment Law Journal (AELJ) Blog

In 2002, developer Jerry Wolkoff invited aerosol artists to transform a series of dilapidated warehouse buildings that he owned in Long Island City, New York. Among those was distinguished aerosol artist Jonathan Cohen, enlisted as the curator to turn the warehouse into an exhibition space for artists and fill the walls with aerosol art. The site became known as “5Pointz,” to represent the confluence of the five NYC boroughs and attracted global attention for aerosol art, drawing thousands of daily visitors and significant media coverage.

Is Law A Discipline? Forays Into Academic Culture, Gene R. Shreve Mar 2020

Is Law A Discipline? Forays Into Academic Culture, Gene R. Shreve

Cleveland State Law Review

This Article explores academic culture. It addresses the reluctance in academic circles to accord law the full stature of a discipline. It forms doubts that have been raised into a series of four criticisms. Each attacks an academic feature of law, inviting the question: Is law different from the rest of the university in a way damaging its stature as an academic discipline? The Article concludes that, upon careful examination of each criticism, none establishes a difference between law and other disciplines capable of damaging law’s stature.

Professional Identity Formation Through Pro Bono Revealed Through Conversation Analysis, Linda F. Smith Mar 2020

Professional Identity Formation Through Pro Bono Revealed Through Conversation Analysis, Linda F. Smith

Cleveland State Law Review

Law school is supposed to teach legal analysis and lawyering skills as well as mold law students’ professional identities. Pro bono work provides an opportunity for law students to use their legal knowledge and skills and to develop their identities as emerging legal professionals. As important as both pro bono work and identity formation are, there has been very little research regarding how pro bono contributes to students’ identity formation. This Article utilizes a data set of over forty student-client consultations at a pro bono brief advice project that have been recorded and transcribed. It uses conversation analysis to study …

Neither Smarter Nor Stronger: Bill 161 Is A Step Backwards For Access To Justice And Community-Based Legal Services In Ontario, Amar Bhatia, Janet Mosher, Jillian A. Rogin, Gemma Smyth, Erin Sobat, David Wiseman Mar 2020

Neither Smarter Nor Stronger: Bill 161 Is A Step Backwards For Access To Justice And Community-Based Legal Services In Ontario, Amar Bhatia, Janet Mosher, Jillian A. Rogin, Gemma Smyth, Erin Sobat, David Wiseman

Commissioned Reports, Studies and Public Policy Documents

Schedule 16 of Bill 161, the Smarter and Stronger Justice Act, will replace, if passed, the Legal Aid Services Act, 1998 (LASA 1998) with a new Legal Aid Services Act, 2019 (LASA 2019).

The Bill, if passed, will have profoundly negative impacts on the clients and communities served by Ontario’s community legal clinics and community-driven boards. These clinics engage in “clinic law” through: a) the determination of their communities’ legal needs; b) the provision of individual and collective legal services to provide access to justice in numerous and intersecting areas of law; and c) the development and reform of …

Conclusion: A Way Forward, Peter B. Edelman Mar 2020

Conclusion: A Way Forward, Peter B. Edelman

Georgetown Law Faculty Publications and Other Works

Where do we go next? I have three suggestions. One is to enlarge the frame of our work on poverty and race, including a focus on the ever-widening chasm of inequality, and all of it pressing toward the center stage of national attention. A second is to consolidate our work about income, jobs, and cash assistance into a unified frame, which I call a three-legged stool. And the third is to think from a perspective of place, and what that tells us about our antipoverty work.

We need a banner, a message, a theme, a politics for ending poverty. The …
