When Speech Is Your Stock In Trade: What Kennedy V. Bremerton School District Reveals About The Future Of Employee Speech And Religion Jurisprudence, Dr. Brett Geier, Ann E. Blankenship-Knox

Campbell Law Review

Coaches play an important role in establishing a nondiscriminatory environment in public-school athletics, both on and off the field. In addition to the duties associated with training a team for athletic competition, coaches, like teachers, are hired to communicate with players and spectators both verbally and demonstratively. Coaches are expected to not only teach sports techniques, but also teach character, leadership, sportsmanship, and other positive character traits. In Kennedy v. Bremerton School District, courts from the district level to the Supreme Court have considered how Coach Joe Kennedy's role as a coach factored into his right to pray on the …

This Article explores the term "sex" and its various interpretations by Congress, the courts, and the various states. Further, this Article explains why it is up to Congress, if the Supreme Court of the United States reverses …

When Market Forces Fail: The Case For Federal Regulation Of Insulin Prices, Erin M. Barker Jan 2020

When Market Forces Fail: The Case For Federal Regulation Of Insulin Prices, Erin M. Barker

Campbell Law Review

Rising insulin prices entail rising economic and social costs that are shouldered by all Americans. While three insulin manufacturers cling to their control of the insulin market, consumers are unable to exercise meaningful choices between competitors to drive prices down. When market forces fail, the solution is federal regulation of the insulin market. The failure of typical forces like competition in this market necessitates federal regulation to curb the monopolistic powers of insulin manufacturers. This Comment explores the history and importance of insulin and the current ramifications of exorbitant insulin prices. This Comment then examines different categories of economic regulation …

Customer service has been a part of marketing for years. A common definition is: “Customer service is the act of taking care of the customer's needs by providing and delivering professional, helpful, high quality service and assistance before, during, and after the customer's requirements are met.” This approach has been main streamed in higher education by Neal Raisman in his four books on the subject. This panel will present and discuss the perils and pitfalls of this approach in higher education along with a summary of an informal survey of marketing Professors.

A Spatially Distributed Investigation Of Stream Water Temperature In A Contemporary Mixed-Land-Use Watershed, Jason P. Horne Jan 2020

A Spatially Distributed Investigation Of Stream Water Temperature In A Contemporary Mixed-Land-Use Watershed, Jason P. Horne

Graduate Theses, Dissertations, and Problem Reports (ETD)

Stream water temperature is an important physical variable that influences many biological and abiotic water quality processes. The land-use/land-cover (LULC) types and corresponding variability in stream water temperature (Tw) processes in contemporary mixed-land-use watersheds necessitate research to advance management and policy decisions. Water temperature was analyzed from 21 gauging sites using a nested-scale experimental watershed study design. Results showed that forested land use was significantly negatively correlated (α = 0.05) with mean and maximum Tw. Agricultural land use was significantly positively correlated (α = 0.05) with maximum Tw except during the spring season. Mixed development and Tw were significantly correlated …

Investigation Of Molecular Functions Of Zinc Finger Protein (Znf71) In Non- Small Cell Lung Cancer, Rehab O. Mohamed

Graduate Theses, Dissertations, and Problem Reports (ETD)

Non-small cell lung cancer (NSCLC) is the first cause of tumor-related death worldwide. Despite the advancement in surgical and medical treatment, the prognosis of the disease remains poor1. To date, there is no available molecular assay to predict the benefit of therapy or tumor recurrence 2. ZNF71 was reported in our previous study, which identified a 7-gene predictive signature for the clinical benefit of chemotherapy and prognosis in NSCLC2. The study concluded that patients who have higher ZNF71 protein expression have better survival. For this reason, we decided to study the molecular function of ZNF71 and how it may affect …

Wv Dental Hygienists' Knowledge And Educational Approach For Pregnant Women, Isabella Hope Mcdaniel

Graduate Theses, Dissertations, and Problem Reports (ETD)

Background: Adverse pregnancy outcomes have become a concern for dental professionals caring for pregnant women with poor oral health. Pregnant women may not be aware of their increased risk of bacterial infections in their oral tissues and how it could relate to adverse pregnancy outcomes such as pre- term birth (PTB) and low birthweight babies (LBW). Dental healthcare professionals need to be well informed of risk related to poor oral health and have confidence to effectively educate pregnant women. PTB and LBW babies account for 1 million infant deaths annually. It is the responsibility of dental healthcare professionals to be …

The Effects Of Internal Physiology On Polyphenic Horn Development In The Dung Beetle Onthophagus Taurus, Naomi Garrett Williamson Jan 2020

The Effects Of Internal Physiology On Polyphenic Horn Development In The Dung Beetle Onthophagus Taurus, Naomi Garrett Williamson

Graduate Theses, Dissertations, and Problem Reports (ETD)

An organism’s phenotype can be affected in development by alterations to gene expression based on environmental inputs. Nutrition is one such environmental input and the central regulator of development of large horn or small horn phenotypes in the dung beetle species, Onthophagus taurus. However, little is known about the nature of chemical compounds that are critical to this plastic horn development. To better understand these compounds, we are utilizing an untargeted metabolomic approach as well as a targeted gene approach. Through the metabolomic approach, it was uncovered that environmental conditions tend to have a greater impact on metabolomic composition …

Assessment Of Fetal Alcohol Spectrum Disorders, Diego Gomez, Christie Petrenko, Maristela Monteiro, Omar A. Rahman Jan 2020

Assessment Of Fetal Alcohol Spectrum Disorders, Diego Gomez, Christie Petrenko, Maristela Monteiro, Omar A. Rahman

Books: Munroe-Meyer Institute

Fetal alcohol spectrum disorders (FASD) represent a range of physical, mental, and behavioral disabilities caused by alcohol use during pregnancy, or prenatal alcohol exposure (PAE). FASDs are considered to be one of the leading preventable causes of developmental disability. Despite its high prevalence, FASD is often misdiagnosed or underdiagnosed, making interventions more challenging or delayed. Earlier diagnosis yields greater benefits for affected children, which include a reduction in secondary disabilities such as substance use disorders and learning and cognitive disabilities leading to school failure, and improved life outcomes. Most importantly, diagnosis provides a context for understanding a child’s behavior. When …

Environmental Contaminants, Parasitism, And Neoplasia In White Perch Morone Americana From Chesapeake Bay, Usa, Mark Arnold Matsche Jan 2020

Environmental Contaminants, Parasitism, And Neoplasia In White Perch Morone Americana From Chesapeake Bay, Usa, Mark Arnold Matsche

Graduate Theses, Dissertations, and Problem Reports (ETD)

White perch are an abundant demersal fish species in freshwater and oligohaline habitats of the Chesapeake Bay. An avoidance of salinity > 12-15 ppt generally restricts the distribution and movements of fish to within tributaries in the mid to lower Bay, which over time has resulted in the formation of at least three separate stocks in Chesapeake Bay. Sub-populations of white perch that are partially isolated may serve as sentinels of the conditions or stressors in the tributaries in which they reside. Fish are exposed to a variety of environmental contaminants and other anthropogenic stressors that can vary in magnitude based …

Missing: An Abandoned Daughter Searches To Fill The Inner Emptiness, Marnie Michelle Craig

Undergraduate Theses, Professional Papers, and Capstone Artifacts

The 2019 Reporting Native News Honors Capstone Project reported on the ongoing epidemic of missing and murdered indigenous women (MMIW) in Montana. I was assigned to the Crow Indian Reservation and Billings. My story is about Natasha Rondeau.

Natasha Rondeau’s mother, Diane Medicine Horse, was last seen on Sept. 28, 1981. Her 23-year-old mother handed Rondeau to the child’s father and drove away in a dusty white Buick.

Rondeau grew up in the old Rondeau family home in Crow Agency with her father, step-mother and grandfather. In the way of extended Native American families, everyone contributed. Aunties were moms and …

Progress And Patriarchy: Female Students At The University Of Montana, 1918-1922, Natalie D. Mongeau

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Physical Education student Lillian Christensen embodied the reality female students faced while pursuing higher education at the University of Montana in the 1920s. Known as “co-eds,” women were expected to be more than just successful in academics. Coeds were expected to pursue women-acceptable majors, attend clubs, organize events, and participate in the campus traditions that all reinforced gender standards. Essentially, the ideal coed was expected to succeed at everything while their academic achievements were seen only as a path to their ultimate role of wife and mother. Even while women were achieving significant victories for women's rights in the 1920s, …

Hiit-Ing The Books: University Student Time Allocation And Exercise, Teigan Nicole Avery

Undergraduate Theses, Professional Papers, and Capstone Artifacts

A growing body of economic literature examines irrational human behavior in a variety of contexts, including exercise habits (Duckworth and Milkman 2019). Based on this research, small interventions known as nudges have been introduced, sometimes significantly altering how individuals behave. This study focuses on a specific population’s behavior to nudge: university student’s exercise habits. Despite the benefits of physical exercise, such as a 40-50% reduction in all-cause mortality, only half of the students surveyed by this study met CDC suggested exercise requirement of 5 hours per week—5% responded that they do not exercise at all (Morris et al. 1953). This …

Kim Williams: Professionalizing Domesticity In Montana And Abroad, 1923-1986, Emmett Ball

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Kim Williams was a renowned writer and naturalist living and working in Missoula, Montana in the 1970s and 80s. She gained national recognition for her regular guest appearances on National Public Radio’s program “All Things Considered,” where she offered home-spun lessons on frugality, naturalism, and happiness through simplicity. Williams’s professionalization of domesticity was the culmination of a lifelong battle in an attempt to reconcile her own personal conception of femininity against her conflicting aspirations for a professional career and a familial, domestic life. There is little scholarship analyzing Williams’s personal life, and no known scholarship has attempted to condense her …

Critical Reasoning: A User's Manual, V.4.0, Jason Southworth, Chris Swoyer Jan 2020

Critical Reasoning: A User's Manual, V.4.0, Jason Southworth, Chris Swoyer

Philosophy Open Educational Resources

Teaching critical reasoning is difficult. So is learning to reason more carefully and accurately. The greatest challenge is teaching (and learning) skills in such a way that students can spontaneously apply them outside the classroom once the course is over (teaching people to apply skills in the classroom can be hard enough, but clearly isn’t a worthwhile goal in itself).

We (the authors) have learned a good deal about these matters from the students who took courses using earlier drafts of this book, and from colleagues who’ve taught from it. But one key theme of this book is the importance …
