The Diffusion Of Faculty Development: A Faculty Fellows Program, Tracy W. Smith, Sara J. Greenwald, Lillian Y. Nave, Victor N. Mansure, Michael L. Howell
To Improve the Academy: A Journal of Educational Development
This critical retrospective review describes the ideation, creation, and implementation of a faculty development fellows program at a regional comprehensive university. The authors share their perspectives as fellows regarding primary considerations for designing the program, including attention to the fellows selection process, required multilevel support, cultivation of communication and relationships, professional development of the fellows, development of unit programming, and lessons learned. Each section of the article concludes with critical questions institutions might consider when conceiving a faculty development fellows program.
Changing Consultation, Elizabeth Kronk Warner, Kathy Lynn, Kyle Whyte
Changing Consultation, Elizabeth Kronk Warner, Kathy Lynn, Kyle Whyte
Utah Law Faculty Scholarship
As climate change and fossil fuel extractive industries ravage Indian country and burden many Indigenous communities with risks, the negative impacts on tribal sovereignty, health, and cultural resources demand consultation between tribes and the federal government. Yet, this is an area where the law fails to provide adequate guidance to parties who should be engaging or are already engaging in tribal consultations. The law, both domestic and international, may require that consultation occurs, but leaves parties to determine themselves what constitutes effective and efficient consultation. The legacy of the law’s inability to provide effective guidance has generated a litany of …

Unlikely Alliances And Their Implications For Resource Management In The American West, Vicken Hillis, Kate A. Berry, Briana Swette, Clare Aslan, Sheila Barry, Lauren M. Porensky
Human-Environment Systems Research Center Faculty Publications and Presentations
Collaborative, or participatory governance is an increasingly common means of addressing natural resource issues, especially in the American West where patchworks of public, private, and tribal interests characterize the region’s resources. In this context, unlikely alliances, or partnerships among diverse actors who have historically been at odds, have a growing potential to shape social and ecological outcomes, for better or worse. While these unlikely alliances have received greater attention in recent years, relatively little research has worked to synthesize the concept across diverse contexts and disciplines. Based on a review of the literature on unlikely alliances in natural resource governance, …
Gen Z Perspectives On Climate Change And The Future: Having The Courage To Imagine And Fight For A Better World, Isabelle Graj
Gen Z Perspectives On Climate Change And The Future: Having The Courage To Imagine And Fight For A Better World, Isabelle Graj
Independent Study Project (ISP) Collection
I conducted 6 interviews with Gen Z students to investigate how they think climate change will impact their future and how they frame the issue in general. I communicate my findings and analysis with visual context through a zine, which is a form of alternative media created in the 1930s. Today, zines provide a creative approach to exchange ideas and explain contemporary culture (Gisonny and Freedman, 2006, 26). My zine is not meant to be utterly educational but rather it is meant to convey the emotion, confusion, and chaos associated with my findings. The interviews collectively created an image of …
Indigenous Communities Versus Oil Companies: Identifying Trends In Tactics And Success Of Indigenous-Led Anti-Petroleum Movements In The Ecuadorian Amazon, Ella V. H. Carlson
Indigenous Communities Versus Oil Companies: Identifying Trends In Tactics And Success Of Indigenous-Led Anti-Petroleum Movements In The Ecuadorian Amazon, Ella V. H. Carlson
Independent Study Project (ISP) Collection
In roughly the last 50 years, the Ecuadorian Amazon has become the epicenter of petroleum production in Ecuador. As oil companies attempt to exploit more and more of the rainforest, they have encroached on indigenous lands, leading to violations of indigenous rights through environmental destruction. As their territories have been invaded, indigenous groups throughout the Amazon have formed movements large and small in resistance to petroleum activities. Scholars have studied select campaigns in the past, but the literature lacks a comparative review of the characteristics of those movements. This paper compiles histories of seven campaigns against petroleum in the Ecuadorian …

Identity: Obstacles And Openings, Osamudia R. James
Identity: Obstacles And Openings, Osamudia R. James
SMU Law Review Forum
Progress regarding equality and social identities has moved in a bipolar fashion: popular engagement with the concept of social identities has increased even as courts have signaled decreasing interest in engaging identity. Maintaining and deepening the liberatory potential of identity, particularly in legal and policymaking spheres, will require understanding trends in judicial hostility toward “identity politics,” the impact of status hierarchy even within minoritized identity groups, and the threat that white racial grievance poses to identitarian claims.
Submission To The Us State Department Commission On The Unalienable Rights, Catherine Coleman Flowers, Joann Kamuf Ward
Submission To The Us State Department Commission On The Unalienable Rights, Catherine Coleman Flowers, Joann Kamuf Ward
Human Rights Institute
This submission emphasizes the centrality of economic and social rights to human rights and highlights how advocating for a hierarchy of rights that downplays their equal status is contrary to widely-recognized international norms, ignores the lived experience of individuals, and will serve to further entrench inequality. The submission urges the Commission to recognize and reaffirm the full panoply of human rights found in the Universal Declaration of Human Rights (UDHR) and subsequent human rights agreements. The discussion highlights the negative implications of a narrowed conceptualization of human rights, emphasizing that a circumscribed vision of human rights will perpetuate a system …

Environmental Injustice's Impact On Asthma Disparities In Nyc, Tayler J. Rodriquez

Understanding the social determinants of health is essential when looking at low-income minorities in urban cities. Social determinants of health are conditions in the environment in which people are born, which affects a wide range of health and quality-of-life outcomes. Amongst other determinants, adequate housing can have a significant influence on population health outcomes such as asthma. Zoning inequality negatively and disproportionately impacts the health and the overall quality of life of low-income minorities; zoning is correlated to environmental injustice fueling adverse health effects and health disparities among low-income minority populations. Without the opportunity to receive adequate and affordable housing, …
Indigenous Environmental Justice And Sustainability, Deborah Mcgregor, Steven Whitaker, Mahisha Sritharan
Indigenous Environmental Justice And Sustainability, Deborah Mcgregor, Steven Whitaker, Mahisha Sritharan
Articles & Book Chapters
A distinct formulation of Indigenous environmental justice (IEJ) is required in order to address the challenges of the ecological crisis as well the various forms of violence and injustices experienced specifically by Indigenous peoples. A distinct IEJ formulation must ground its foundations in Indigenous philosophies, ontologies, and epistemologies in order to reflect Indigenous conceptions of what constitutes justice. This approach calls into question the legitimacy and applicability of global and nationstate political and legal mechanisms, as these same states and international governing bodies continue to fail Indigenous peoples around the world. Not only do current global, national and local systems …
Best Methods For Meeting The Goals Of Environmental And Place-Based Education In Short-Term And Immersive Undergraduate Settings, Henry Whitehead
Best Methods For Meeting The Goals Of Environmental And Place-Based Education In Short-Term And Immersive Undergraduate Settings, Henry Whitehead
School of Education and Leadership Student Capstone Projects
This capstone sought to answer the following question: what are the best instructional methods for meeting the goals of place-based and environmental education in a short-term, immersive undergraduate setting? While place-based education and environmental education have been exhaustively studied for younger learners, a dearth of research exists in their application for college students. Through a review of the literature and the execution of the project, a January interim course for college students studying the Driftless Region, it was determined that several factors influence successful and meaningful learning for college students. Most notably, discussion, experiential learning, and engagement with community members …

A Return To Turtle Island: Eco-Cosmopolitics In American Indian Literature, 1880-1920, Kristen Brown
Theses and Dissertations
During opposition to the Dakota Access Pipeline (DAPL), the Lakota words mni wičoni, “water is life,” came to define the ongoing movement at Standing Rock and serve as a reminder of not only humans’ dependence on interconnected ecological communities, but also of the vitality and sentience in more-than-human beings. Looking to Indigenous author-activists producing texts in the late nineteenth and early twentieth centuries— when colonial ideologies of land exploitation and Indigenous dispossession were codified by federal policy—provides valuable insight into the tensions between these land-ascommodity and land-as-community worldviews. While scholars like literary and cultural theorist Joni Adamson and anthropologist Marisol …

Who Decides: Is Water Life Or Capital? Contesting Visions Of Western Water Management In The 21st Century, Ceorl
Water Resources Professional Project Reports
There is an ideological divide between the goal of universal access to clean water and the outcomes of how water regulations are implemented. John Fleck, author of Water is for Fighting Over: and Other Myths about Water in the West and Sivas, et al. in California Water Governance in the 21st Century present contesting prescriptions for Western water management. The ideologies advocated by Fleck and Sivas, et al. differ as to who enacts and profits from each and exemplify the divide between the goals of water regulations and how they are implemented. Fleck regards water as property and an economic …
The Future Of Urbanization And Climate Change, April 2020, Makeyla Hayes
The Future Of Urbanization And Climate Change, April 2020, Makeyla Hayes
Monteverde Institute: Culture, Community, and Health
Urbanization is an inevitable process that affects all countries and major cities. As societies continue to adapt to urban development, the environment is left defenseless to these changes. Through environmental, economical, and social analysis, this case study of Boston – the capital city of Massachusetts – examines the impact of urban growth and development on climate change. Urban areas are densely populated and constantly experience population growth and overpopulation, making them more vulnerable to climate change. Unsustainable practices and living increases the impact that communities and residents have on the environment. Environmental gentrification has been implemented to resolve the consequences …

Trash Talk: An Exploration Of The Problem Of Marine Debris And Some Virginia-Specific Solutions, Elizabeth Pindilli
Virginia Coastal Policy Center
In an effort to address the problem of marine debris, the Virginia Coastal Zone Management Program (Virginia CZMP) undertook a planning process that resulted in the Virginia Marine Debris Reduction Plan (VMDRP) in 2014. In light of the policy issues raised in the VMDRP, this paper will explore the issue of marine debris and some possible solutions that can be pursued in Virginia.

Planning For A Managed Retreat: Moving In A New Direction, Caitlin Parry, Michael Heard Snow, Ryan Franklin
Virginia Coastal Policy Center
Climate change is altering the United States’ coastline in both subtle and extreme ways. The threat is especially pressing in the Commonwealth of Virginia, which is experiencing sea levels rising faster than the global average. As global sea level rise continues to increase, coastal communities across the country must make difficult decisions about their futures. Instead of waging an endless war with the tide, one option for them to consider is the process of managed retreat, which provides a long-term solution by relocating communities away from vulnerable areas. Low to moderate income communities face a variety of additional social and …
Crude Intentions: Evaluating The Growing Risks Of Arctic Alaskan Oil Production, Eliot Stein
Crude Intentions: Evaluating The Growing Risks Of Arctic Alaskan Oil Production, Eliot Stein
Independent Study Project (ISP) Collection
The discovery of oil on Alaska’s North Slope in the 1920s began a century of fossil fuel exploration, development, and production in the Arctic region. Alaska became integral to the nation’s growing energy dominance. However, since 1988, oil production on the North Slope has been in steady decline. In 2015, Shell, followed by several other oil majors, terminated their Arctic Alaska operations. This past year, BP made waves by ending six decades of operations in Alaska. Most recently, five of the six major U.S. banks announced they would no longer finance Arctic oil and gas projects. This paper analyzes these …
La Minería Del Litio En Salinas Grandes: Un Análisis De Diferentes Narrativas En Torno A La Extracción De Litio Desde 2010 Hasta El Presente / Lithium Mining In The Salinas Grandes: An Analysis Of Different Narratives Surrounding The Extraction Of Lithium From 2010 Until The Present, Sofia Perrotto
Independent Study Project (ISP) Collection

Sea Level Rise Planning For Socially Vulnerable Communities: A More Equitable Approach To Federal Buyout Programs, Travis Brandon
Sea Level Rise Planning For Socially Vulnerable Communities: A More Equitable Approach To Federal Buyout Programs, Travis Brandon
Law Faculty Scholarship
This Article examines the social justice implications of federal buyout programs as the United States increasingly confronts sea level rise and the necessity of managed retreat. Focusing primarily on the Federal Emergency Management Agency’s (FEMA) Hazard Mitigation Grant Program (HMGP), as well as related programs administered under the Stafford Act and through HUD’s Community Development Block Grants, the Article argues that existing buyout mechanisms risk perpetuating and exacerbating racial and economic inequalities. Drawing on empirical studies, case examples, and interdisciplinary scholarship, it demonstrates that structural features of the HMGP—lengthy post-disaster timelines, cost-benefit analysis methodologies that privilege high-value properties, matching-fund requirements, …
Ordinary Disasters: On Unexceptional Flooding In La's San Fernando Valley, Sayd Randle
Ordinary Disasters: On Unexceptional Flooding In La's San Fernando Valley, Sayd Randle
Research Collection College of Integrative Studies
Talking about flood as California's" other big one," otherwise known as a plausible natural disaster with the power to cause damage equivalent to that caused by a massive earthquake, does important work in capturing the imagination. Nearly a quarter submitted short stories about narrowly escaping death-by-ARkStorm, piling on the melodrama and watery metaphors. Because of its sheer scale, epic flooding is not hard to picture and/or to fear, even amidst the palm trees of Los Angeles.[...] I do fear that ignoring the more quotidian flare-ups and inundations and dry spells and snowstorms and other threats, the unevenly distributed" slow violence" …
An Unknown Past, An Unequal Present, And An Uncertain Future: Transnational Environmental Law Through Three Research Challenges, Natasha Affolder
An Unknown Past, An Unequal Present, And An Uncertain Future: Transnational Environmental Law Through Three Research Challenges, Natasha Affolder
All Faculty Publications
This chapter seeks to bring into focus three broad research challenges facing transnational environmental law – an unknown past, an unequal present, and an uncertain future. Transnational law theory invites scholars to stand at a distance from current orthodoxies and to contemplate environmental law and its practice from new vantage points. The study of transnational environmental law thus prompts new ways of thinking about where to look for environmental law and its foundational influences. New research agendas emerge organically from such shifts of gaze. By identifying future research agendas, we can illuminate both the diversity of sites of past and …
