The Incoherence Of Moral Relativism, Carlo Alvaro Jan 2020

The Incoherence Of Moral Relativism, Carlo Alvaro

Publications and Research

This paper is a response to Park Seungbae’s article, “Defence of Cultural Relativism”. Some of the typical criticisms of moral relativism are the following: moral relativism is erroneously committed to the principle of tolerance, which is a universal principle; there are a number of objective moral rules; a moral relativist must admit that Hitler was right, which is absurd; a moral relativist must deny, in the face of evidence, that moral progress is possible; and, since every individual belongs to multiple cultures at once, the concept of moral relativism is vague. Park argues that such contentions do not affect moral …

Panpsychism As An Observational Science, Gregory Matloff Jan 2020

Panpsychism As An Observational Science, Gregory Matloff

Publications and Research

The metaphysical concept of panpsychism defines a field of proto-consciousness that is present at all levels in the universe. An observational indication that this concept might be correct is self-organization on all levels from the molecular to the galactic. In 2011, an investigation into the validity of author Olaf Stapledon’s concept that a portion of stellar motion is volitional led to a consideration of an observational stellar kinematics anomaly dubbed Parenago’s Discontinuity. Data available at the time indicated that cooler, less massive stars (such as the Sun) revolve a bit faster around the center of the Milky Way galaxy than …

Representaciones De La Identidad Neoleonesa En Los Spots De Las Campañas A La Gubernatura De Nuevo León De 2015representations Of Nuevo León’S Identity Within The Campaign Spots For The 2015 State Election, Xavier Moyssén Álvarez Jan 2020

Representaciones De La Identidad Neoleonesa En Los Spots De Las Campañas A La Gubernatura De Nuevo León De 2015representations Of Nuevo León’S Identity Within The Campaign Spots For The 2015 State Election, Xavier Moyssén Álvarez

Publications and Research

This article parts from the sociological model of voting behavior, according to which social characteristics deter-mine political preferences. It is proposed that regional identity, because of its socialized nature, might’ve had effects on the voting behavior of the 2015 Nuevo León election. This work isn’t focused on the result of the election, it rather intends to verify, through content analysis, the presence of elements belonging to Nuevo Leon’s identity within the campaign spots for the main candidates:Felipe de Jesús Cantú (PAN), Ivonne Álvarez García (PRI), and Jaime Heliodoro Rodríguez Calderón (independ-ent). Furthermore, we propose a theoretical explanation of the possible …

The “Challenge" Of Depletion: Why The Oyster Fishery Is Not Self-Regulating, Eric N. Powell, John M. Klinck, Leanne M. Poussard Jan 2020

The “Challenge" Of Depletion: Why The Oyster Fishery Is Not Self-Regulating, Eric N. Powell, John M. Klinck, Leanne M. Poussard

CCPO Publications

The possibility that the economics of the oyster fishery impose a self-limitation on overharvesting has been proffered on occasion. The inefficiency of harvesting by the fishery has been evaluated and estimates of the exploitation rate permissible under conditions of maximum sustainable yield have been obtained in previous studies. The question becomes to what extent does the inefficiency of harvest interact with the economics of the fishery to compromise ready detection of overfishing? This study explores the possibility that the constraint of economics on the fishery occurs at oyster exploitation rates that are higher than maximum sustainable yield, leading ineluctably to …

Analysis Of The Impact Of Professional Learning Teams On Teaching Practices And Student Achievement In Biology Using Dufour’S Model, Rowena K. Dawkins

Doctor of Education Dissertations

This mixed-methods study addresses the perceived impact of working in Professional Learning Teams (PLTs) on teaching practices and student achievement in biology. The study replicates Roberts’s (2010) study. Success in biology is important to the nation because it aligns with national efforts to prepare students to compete in global markets. Educators use PLTs to support development of educators and address student educational needs. PLTs share basic functions. Basic functions were defined using DuFour’s (2004) three big ideas of PLCs: ensuring students learn at high levels, promoting a collaborative culture, and focusing on academic results. Biology teachers completed an anonymous online …

Exploring The Effectiveness Of A Freshman/Success Academy Program Through The Perceptions Of Educators In An Urban High School, Michelle Pettiford

Doctor of Education Dissertations

The purpose of this qualitative study was to explore the perceptions of educators regarding the effectiveness of an academic success program for ninth- and 10th-grade students who are at-risk males. The term at risk has often been utilized to describe students who have low academic performance as well as social and emotional concerns observed during the transitioning process from middle to high school. The foundation of this study centered on past and current educational initiatives, achievement gaps, and pedagogical and cultural awareness for at-risk minority students as they entered high school. I used a 2-phase process that included …

Principal Perceptions: The Impact Of Positive Behavioral Interventions And Supports On Discipline Disproportionality, Courtney K. Johnson Jan 2020

Principal Perceptions: The Impact Of Positive Behavioral Interventions And Supports On Discipline Disproportionality, Courtney K. Johnson

Doctor of Education Dissertations

This study explored the impact of the Positive Behavioral Interventions and Supports (PBIS) framework on discipline disproportionality in an Eastern Virginia school division. Nationally, African American students are suspended and expelled at a much higher rate than their peers (Skiba et al., 2016). This study explored the impact PBIS had on this rate. The work is valuable to those interested in introducing the PBIS framework in their school division or school. A phenomenological, qualitative study was conducted with the first research question using discipline data from the division to track trends. The second research question was answered by interviewing principals …

Widening The Pipeline: Identifying Practices And Structures That Effectively Recruit And Retain African-American Females In Undergraduate Computer Science Programs At Historically Black Colleges And Universities, Martha Haigler

Doctor of Education Dissertations

The underrepresentation of women and women of color in the disciplines of science, technology, engineering, and mathematics (STEM) is of little surprise to those of us who have kept abreast of the statistical data supporting this phenomenon. In order for the United States (U.S.) to remain “economically and globally competitive” (Ong, 2011, p. 32), it needs to increase its “advanced domestic science and technology workforce” (Ong, 2011, p.32). Perhaps, it is not a coincidence that the majority of students attending U.S. colleges are female, and the number of minority students entering college is on the rise. However, when one looks …

Effective Charter Schools: An Examination Of Operational, Financial, And Governance Practices As It Relates To The Renewal Of North Carolina Charter Schools, Shaunda Cooper

Doctor of Education Dissertations

North Carolina public charter schools are schools of choice authorized by the State Board of Education. North Carolina has nearly 200 charter schools, which are evaluated for effectiveness annually by a tool called the Performance Framework. However, to date, the evidence collected through the Performance Framework has not been offered to scholars and school leaders as a resource for achieving effective charter schools. Furthermore, research has not been conducted to evaluate a school’s performance in relation to its ability to complete a successful charter agreement renewal, which is the vein of a charter school’s existence. the study examined operational, governance, …

An Examination Of Readiness For Response To Intervention Implementation In A Rural School District In North Carolina, Carla Murray Jan 2020

An Examination Of Readiness For Response To Intervention Implementation In A Rural School District In North Carolina, Carla Murray

Doctor of Education Dissertations

In 2015, the North Carolina Department of Public Instruction Exceptional Children Division proposed policy changes, effective July 1, 2020, on how students with specific learning disabilities are defined, evaluated, and identified. A student in North Carolina is now identified for special education through the use of how they respond to high-quality core instruction and research-based instruction. This study examined this process in a rural school district in North Carolina to determine how schools can support educators who do not have the appropriate background knowledge and skills to sustain MTSS, how educator perceptions influence the sustainability of MTSS, and what can …

Gratitude, Resilience And Post-Traumatic Growth Among Kidney Transplant Recipients, Lillie Credle Jan 2020

Gratitude, Resilience And Post-Traumatic Growth Among Kidney Transplant Recipients, Lillie Credle

Honors Theses

Chronic health conditions, such as end-stage renal disease (ESRD), can produce detrimental physical, psychological, and emotional effects (Schulz & Kroencke, 2015). While transplantation helps to alleviate the physical symptoms, other psychosocial problems can remain. The present study sought to investigate whether organ transplant recipients utilize certain strength-based attributes—gratitude, resilience, and post-traumatic growth—when coping with life post-transplant. This mixed-methods study recruited eight (N=8) kidney transplant recipients, who took part in semi-structured interviews followed by a survey. Though quantitative data was limited due to COVID-19 interruptions, the qualitative data revealed evidence of gratitude, resilience, and post-traumatic growth being used by the participants …

Internal Migration Of Foreign-Born In Us: Impacts Of Population Concentration And Risk Aversion, Thin Yee Mon Su Jan 2020

Internal Migration Of Foreign-Born In Us: Impacts Of Population Concentration And Risk Aversion, Thin Yee Mon Su

Honors Theses

Internal migration in the US has been declining since the 1990s and research has mostly focused on labor market dynamics and aging population to explain the migration trends. This paper analyzes migration patterns of foreign-born groups in the US from 2000 to 2019. Along with the migration determinants such as education and employment, the paper focuses on population concentration as a factor that shapes foreign-born decisions to relocate in the US. Population concertation is defined to be a measure of how geographically concentrated each foreign-born group is across the US. I find that the likelihood of migrating to another state …

Public Perceptions And Knowledge Of Transplantation, Kimberly Smith Jan 2020

Death Of A Bail Bondsman: The Implementation And Successes Of Nonmonetary, Risk-Based Bail Systems, William M. Carlucci Jan 2020

Death Of A Bail Bondsman: The Implementation And Successes Of Nonmonetary, Risk-Based Bail Systems, William M. Carlucci

Emory Law Journal

The Eighth Amendment to the United States Constitution provides that bail, when afforded to a criminal defendant, not be excessive. However, there is no provision as to what form bail must take or how it is to be determined. Starting in the twilight of the nineteenth century, monetary conditions of bail became increasingly prevalent throughout the United States. Yet, in recent years, there has been a movement to eliminate the requirement that defendants pay their way to pretrial freedom. States have taken measures to move away from cash bail, ranging from significantly limiting its use to outright prohibitions against monetary …

Judging Hypocrisy, Todd E. Pettys Jan 2020

Judging Hypocrisy, Todd E. Pettys

Emory Law Journal

Editorialists, politicians, and others sometimes accuse U.S. Supreme Court Justices of hypocrisy, especially when they believe that divisions among the Justices are the product of partisan loyalties rather than good-faith differences in impartial legal judgment. These hypocrisy charges pose a serious threat to the Court’s legitimacy. In legal circles and elsewhere, however, one finds a remarkable lack of clarity about what hypocrisy is and the moral precepts that define its boundaries. As a result, participants in public discourse about the Court can easily find themselves talking past one another. To be assured that the Justices are not hypocrites with respect …

The Political Process Of Preemption, Paul A. Diller Jan 2020

The Political Process Of Preemption, Paul A. Diller

University of Richmond Law Review

Preemption, particularly of the state-city variety, has become a hot topic. State legislatures in many states over the last decade have preempted a wide swath of areas in which cities and counties were previously free to govern. In addition to the sweeping nature and frequency of preemption, the increasingly aggressive methods of enforcing preemption have drawn notice. The threat of fiscal penalties, removal of local officials from office, and even criminal sanctions constitute what one scholar has dubbed the phenomenon of “hyper preemption.”

Pills, Public Nuisance, And Parens Patriae: Questioning The Propriety Of The Posture Of The Opioid Litigation, Michelle L. Richards Jan 2020

Pills, Public Nuisance, And Parens Patriae: Questioning The Propriety Of The Posture Of The Opioid Litigation, Michelle L. Richards

University of Richmond Law Review

The opioid crisis has been in litigation for almost twenty years on various fronts, including criminal prosecutions of pharmaceutical executives, civil lawsuits by individuals against drug manufacturers and physicians, class actions by those affected by opioid abuse, and criminal actions filed by the Drug Enforcement Administration (“DEA”). In the early 2000s, opioid litigation began with individual plaintiffs filing suit against manufacturers and others for damages allegedly related to opioid use. The litigation has since expanded significantly in terms of the type of plaintiffs and defendants, the nature of the claims being asserted, and the damages attributable to the crisis.

The …
