Decline Of Novel Ecosystems Used By Endangered Species: The Case Of Piping Plovers, Least Terns, And Aggregate Mines, Joel G. Jorgensen, Stephen J. Brenner, Lauren R. Greenwalt, Mark P. Vrtiska Dec 2020

Decline Of Novel Ecosystems Used By Endangered Species: The Case Of Piping Plovers, Least Terns, And Aggregate Mines, Joel G. Jorgensen, Stephen J. Brenner, Lauren R. Greenwalt, Mark P. Vrtiska

School of Natural Resources: Faculty Publications

Sand and gravel mining creates novel ecosystems along the Platte, Loup, and Elkhorn rivers in Nebraska, USA. Piping plovers and least terns are state and/or federally threatened and endangered species, respectively, that nest and raise young at these sites and their derivatives. Despite hosting relatively large numbers of piping plovers and least terns for decades, an important question that has largely gone unaddressed is whether the industry that has produced these novel ecosystems is stable and will continue to produce habitat consistently in the future. We evaluated how the number, size, and spatial distribution of different site types hosting different …

Beyond Mechanical Markets: Asset Price Swings, Risk, And The Role Of The State (Book Review), Adrian Ravier Dec 2020

Beyond Mechanical Markets: Asset Price Swings, Risk, And The Role Of The State (Book Review), Adrian Ravier

Journal of New Finance

In its opening section, Frydman and Goldberg’s book lays out important methodological contributions questioning the hypothesis of rational expectations, constructed on the basis of the writings of Knight, Keynes and Hayek. But in the second part, it does not propose a convincing model that would help avoid the formation of new financial bubbles. While accepting to some extent that the government entity has no greater knowledge than economic agents, it ignores the perverse public-sector incentives that James M. Buchanan and the School of Public Choice have explored in recent decades. Furthermore, although the repeated reference to Hayek is encouraging, the …

The Structure Of Production And Endogenous And Exogenous Liquidity Of Financial Intermediaries, Daniel Fernández Dec 2020

The Structure Of Production And Endogenous And Exogenous Liquidity Of Financial Intermediaries, Daniel Fernández

Journal of New Finance

Banks directly manage their own liquidity. Banks also indirectly manage the liquidity of the entire economic system. In this article we discuss the relationship between endogenous and exogenous bank liquidity, and their corresponding relationship to the structure of production. We explore these liquidity relationships in the context of both a decentralized and centralized system of free banking, comparing both with the monopoly regime of central banks, “convertible and inconvertible liabilities. We analyze the incentives that engender a liquid “system in the context of free banking as well as the perversion of those same incentives in the context of central banking, …

What Is The Riskfree Rate? A Search For The Basic Building Block, Aswath Damodaran Dec 2020

What Is The Riskfree Rate? A Search For The Basic Building Block, Aswath Damodaran

Journal of New Finance

In corporate finance and valuation, we start off with the presumption that the riskfree rate is given and easy to obtain and focus the bulk of our attention on estimating the risk parameters of individuals firms and risk premiums. But is the riskfree rate that simple to obtain? Both academics and practitioners have long used government security rates as riskfree rates, though there have been differences on whether to use short term or long- term rates. In this paper, we not only provide a framework for deciding whether to use short or long term rates in analysis but also a …

The Equity Premium In 150 Textbooks, Pablo Fernandez Dec 2020

The Equity Premium In 150 Textbooks, Pablo Fernandez

Journal of New Finance

This article is based on a review of 150 textbooks on corporate finance and valuation published between 1979 and 2009 by authors such as Brealey, Myers, Copeland, Damodaran, Merton, Ross, Bruner, Bodie, Penman, Arzac etc. Analysis of the sample shows that the books’ recommendations regarding the equity premium range from 3% to 10%, and that 51 books use different equity premia on various pages. Moreover, the 5-year moving average is seen to have declined from 8.4% in 1990 to 5.7% in 2008 and 2009.

Some confusion arises from not distinguishing among the four concepts that the phrase equity premium designates: …

Using Hearing Aids In Determining The Level Of Speech Development In Children With Hearing Impairment, G. Temurova Dec 2020

Using Hearing Aids In Determining The Level Of Speech Development In Children With Hearing Impairment, G. Temurova

Mental Enlightenment Scientific-Methodological Journal

In hearing impairment, the level of speech development is not the same and depends on the following factors: the degree of hearing impairment; time of occurrence of the auditory analyzer defect; the pedagogical conditions in which the child was after the dysfunction of the auditory analyzer; individual characteristics of the child himself. The creation of a hearing-verbal environment involves verbal communication with the child of all family members. Stable visual attention and memory contributes to the compensation of the auditory defect and the development of speech. Children with severe hearing loss due to the state of speech at an early …

Species Distribution Modeling For Arid Adapted Habitat Specialists In Zion National Park, Sam Driver, Daniel R. Unger, David L. Kulhavy, Chris M. Schalk Dec 2020

Species Distribution Modeling For Arid Adapted Habitat Specialists In Zion National Park, Sam Driver, Daniel R. Unger, David L. Kulhavy, Chris M. Schalk

Student Publications

The Arizona toad (Anaxyrus microscaphus) and Jones’ waxy dogbane (Cycladenia humilis var. jonesii) are habitat specialists with historical ranges in the desert southwest and specifically, Zion National Park (ZION). The machine learning method, MaxEnt, constructed species distribution models (SDMs) in ZION for the two study species at 30 m and 900 m spatial resolutions using climate, topographic, and remotely sensed data. Additionally, 900 m forecasting models were constructed to observe the shifts in suitable habitat for the years 2050 and 2070, based off two representative concentration pathway scenarios. Results indicate promising predictive power for both high …

Chevron Abroad, Kent Barnett, Lindsey Vinson Dec 2020

Chevron Abroad, Kent Barnett, Lindsey Vinson

Notre Dame Law Review

This Article presents our comparative findings of how courts in five other countries review agency statutory interpretation. These comparisons permit us to understand and participate better in current debates about the increasingly controversial Chevron doctrine in American law, whereby courts defer to reasonable agency interpretations of statutes that an agency administers. Those debates concern, among other things, Chevron’s purported inevitability, functioning, and normative propriety. Our inquiry into judicial review in Germany, Italy, the United Kingdom, Canada, and Australia provides useful and unexpected findings. Chevron, contrary to some scholars’ views, is not inevitable because only one of these countries …

Substantive Remedies, Hanoch Dagan, Avihay Dorfman Dec 2020

Substantive Remedies, Hanoch Dagan, Avihay Dorfman

Notre Dame Law Review

Often, private law remedies enforce or vindicate infringed underlying rights. Substantive remedies are different. Substantive remedies do not aim at restoring these rights; nor do they seek to change them. Instead, substantive remedies adjust the remedial response for a right violation so as to ensure post-wrong justice. They require the law of remedies not merely to look back, but rather to take a second look at the parties’ post-wrong situation. At times, such a second look affects the type of remedy awarded (damages in lieu of injunctive relief); in other cases—for instance, the tort doctrine of crushing liability—it imposes a …

Taxing Local Energy Externalities, Hannah J. Wiseman Dec 2020

Taxing Local Energy Externalities, Hannah J. Wiseman

Notre Dame Law Review

There is a fundamental problem of scale in the governance of industrial development. For some of the fastest-growing U.S. industries, the negative impacts of development fall primarily at the local level, and the benefits tend to accrue more broadly to states and the federal government. These governments accordingly have inadequate incentives to address the very localized negative externalities of development. Yet states also increasingly preempt most local control over some forms of development. This creates a regulatory void, in which state and federal regulations are inadequate, and local governments lack the power to use traditional Pigouvian tools such as regulation, …

The Problem Of Foreign Convictions In U.S. Immigration Law, Geoff Cebula Dec 2020

The Problem Of Foreign Convictions In U.S. Immigration Law, Geoff Cebula

Notre Dame Law Review

Part I argues that the definition of “conviction” in the INA implicitly leaves room for courts to inquire into the procedural fairness underlying a foreign conviction. Part II surveys the traditional standards for evaluating the sufficiency of foreign convictions in the contexts of extradition and international comity, two areas where U.S. courts have had to decide when to honor foreign judgments for centuries. These longstanding criteria formed the background against which the INA definition was adopted and may provide guidance on how to apply this definition. Accordingly, Part III derives from this analysis suggestions for how the Department of State …

The Role Of Principles And Personal Relationships In Greek Tragedy And Epic, Ellen Pariser Dec 2020

The Role Of Principles And Personal Relationships In Greek Tragedy And Epic, Ellen Pariser

Honors Program Theses and Projects

Understanding motivations are vital for understanding any characters, especially ones so far removed from contemporary society. Through this paper I will attempt to explore the tug between principles and close personal relationships that is often central to ancient texts and manifests so prevalently in the genres of tragedy and epic.
