Understanding Educators’ Experiences During Long-Term School Closures, Jessica Pryor, Jessica Pryor Jan 2020

Understanding Educators’ Experiences During Long-Term School Closures, Jessica Pryor, Jessica Pryor

Murray State Theses and Dissertations

In the spring of 2020, many public places closed in response to the COVID-19 pandemic. Most public schools in the United States suddenly closed buildings as educators and students scrambled to adapt to distance education. This phenomenological, qualitative study holistically explores elementary educators’ experiences during the extended school closures. The 18current elementary educators who participated in individual interviews, served rural, elementary students. Individual interviews allowed participants to discuss and explain their experiences concerning methods, materials, time commitments, and communication with colleagues, parents, and students. They also discussed how they used feedback to alter their teaching. The interviews were conducted during …

The Transition Experiences Of Deaf And Hard Of Hearing Students Into Postsecondary Education, Christy S. Adkins Jan 2020

The Transition Experiences Of Deaf And Hard Of Hearing Students Into Postsecondary Education, Christy S. Adkins

Murray State Theses and Dissertations

The purpose of this study was to determine what the transition experiences of deaf and hard of hearing students into postsecondary education were and what barriers, exist within the transition process. It is evident that deaf and hard of hearing students, face a number of challenges throughout their academic career. Aspects of deaf culture, language acquisition, and communication method, along with lack of support services further exacerbate, an already difficult transition from secondary school to college. This study sought to shed light on the additional obstacles faced by deaf and hard of hearing students, as they transition into their first …

Help-Seeking Behaviors And Coping Styles Related To Sexual Assault Labelling, Shahzor Hashim Jan 2020

Help-Seeking Behaviors And Coping Styles Related To Sexual Assault Labelling, Shahzor Hashim

Murray State Theses and Dissertations

Sexual Assault is defined as non-consensual sexual activity that includes groping and rape. Based on previous research, a large number of people experience sexual assault, which results in trauma and post-traumatic stress. In order to mediate the stress, people try to cope and seek help to manage the distress and trauma stress. Following the assault, people adopt the identity of or are viewed as victim/survivor. This study investigated the difference between sexual assault label, victim or survivor, in terms of coping strategies, approach or avoidant, and help-seeking behaviors. The study was conducted by administering a survey via Amazon’s Mturk. A …

Paleofloods And Landform Development Influence Carbon Storage In A Humid-Subtropical River Valley, Christopher Lance Stewart Jan 2020

Paleofloods And Landform Development Influence Carbon Storage In A Humid-Subtropical River Valley, Christopher Lance Stewart

Murray State Theses and Dissertations

Floodplains can store large amounts of soil organic carbon (SOC) despite covering a small fraction of the global land area. Since these valley-bottom landforms build through the action of flooding, the century to millennial-scale record of overbank deposition could be important in understanding controls on deep (>30 cm) SOC storage. Yet, the influence of flood history and landform development on carbon content is surprisingly not well known. I use a combined geological and pedological approach to characterize the sedimentation, soil development, and SOC of fluvial terraces along an impounded reach of the humid-subtropical Tennessee River valley, U.S.A. The standardized …

The Role Of Different Tv Storytelling Approaches In Engaging U.S. Hispanic Parents And Caregivers Around Early Childhood Development, Caty Borum Chattoo, Lauren Feldman, Amy Henderson Riley

College of Population Health Faculty Papers

Educational achievement gaps exist between racial and ethnic groups in the United States; early childhood readiness, fostered in part by parents and caregivers, is crucial. To respond to this challenge, the Univision television network produced content that aired across 3 storytelling genres (scripted drama, reality, news) to entertain and educate Hispanic parents and primary caregivers of children ages 0–5 years about early brain development interventions. This pretest/posttest experimental study assessed the impact of each genre and found significant direct effects on knowledge, attitudes, and behavioral intentions; the effects were mediated by perceived entertainment value and positive emotions.

'Terroristic Threats' And Covid-19: A Guide For The Perplexed, Chad Flanders, Courtney Federico, Eric Harmon, Lucas Klein

All Faculty Scholarship

The first few months of the COVID-19 outbreak in the United States saw the rise of a troubling sort of behavior: people would cough or spit on people or otherwise threaten to spread the COVID-19 virus, resulting in panic and sometimes thousands of dollars’ worth of damages to businesses. Those who have been caught doing this — or have filmed themselves doing it — have been charged under so-called “terroristic threat” statutes. But what is a terroristic threat, and is it an appropriate charge in these cases? Surprisingly little has been written about these statutes given their long history and …

Giving Back A Fraudulent Transfer: A Defense To Liability?, David G. Carlson Jan 2020

Giving Back A Fraudulent Transfer: A Defense To Liability?, David G. Carlson

Articles

In Whitlock v. Lowe (In re Deberry) (5th Cir. 2019), the Fifth Circuit court of appeals found it obvious that if a transferee gives back fraudulently transferred funds (which the debtor then dissipates), the transferee has a complete defense to liability to the transferor’s bankruptcy trustee. This puts the Fifth Circuit at odds with the Sixth and Seventh Circuits, where the prepetition give-back counted as no defense. This article concludes that a more nuanced position should mediate between these extremes, based on an “innocent donee” defense retrieved from Nineteenth Century precedent. The article emphasizes that if bad faith transferees for …

Tuition As A Fraudulent Transfer, David G. Carlson Jan 2020

Tuition As A Fraudulent Transfer, David G. Carlson

Articles

Bankruptcy trustees are suing universities because the insolvent parent of an adult student has written a tuition check while insolvent. The theory is that the university is the initial transferee of a fraudulent transfer that has provided benefit to the student but not to the parent debtor. This article claims that the university is never the initial transferee of tuition dollars. Rather, the student is. Where the university has no knowledge of parent insolvency, the university can count educating the student as a good faith transfer for value, thus immunizing the university from liability. The unpleasant side effect is that …

Subject Approach To Information Retrieval With Special Reference To Bengali Documents: A Critical Study, Dr. Sambhu Nath Halder

Library Philosophy and Practice (e-journal)

The library provides its services to satisfy the user’s approach. This study is done to assess users’ attitudes towards the retrieval of the Bengali document in OPAC through subject headings. It also traces users’ perceptions regarding subject access highlighting the problems in the retrieval of Bengali documents by subject in OPACs. It can be inferred that some features are required to be incorporated to improve the functionality of the OPACs and thereby to satisfy users’ requirements. Results revealed that search experience using subject headings is not satisfactory. Keywords search rather performs better but due to redundancy of search, it is …

Disclosure Of Trans & Gender Variant Identities By Students To Students, C. A. Brimmer Jan 2020

Disclosure Of Trans & Gender Variant Identities By Students To Students, C. A. Brimmer

Graduate Research Papers

In this study the ways in which trans and gender variant students come out to their cisgender peers is discussed utilizing a framework of communication privacy management (CPM), which is broken down into privacy ownership, privacy control, and privacy turbulence. Foundationally, this work was intended to magnify the experiences of trans and gender variant students in addition to expanding the application of CPM to the experiences of those who transition across binaries and who eschew them altogether. Previous literature examines CPM in a binarily gendered way, and does not take into account how the appearance of bodies can disclose private …

The Interdisciplinary Impacts Of Technology Semantics And Communicational Bypassing In The Cybersecurity Field, Brooke Nixon Jan 2020

The Interdisciplinary Impacts Of Technology Semantics And Communicational Bypassing In The Cybersecurity Field, Brooke Nixon

Cybersecurity Undergraduate Research Showcase

In 2012, former director of the Federal Bureau of Investigation (FBI) Robert Mueller shocked many when he warned, “[t]here are only two types of companies: those that have been hacked and those that will be.” As technology and information systems develop rapidly, security has become a topic of increasing interest and concern. In 2018, it was noted that the total cost to account for cybercrime on a global scale surpassed US$1 billion (Milkovich, 2020). In the United States, a hacker attack occurs every 39 seconds, and each year, 1 in 3 Americans are personally impacted by a form of hacking …

Computer Science Faculty Publications

We introduce SmartCiteCon (SCC), a Java API for extracting both explicit and implicit citation context from academic literature in English. The tool is built on a Support Vector Machine (SVM) model trained on a set of 7,058 manually annotated citation context sentences, curated from 34,000 papers in the ACL Anthology. The model with 19 features achieves F1=85.6%. SCC supports PDF, XML, and JSON files out-of-box, provided that they are conformed to certain schemas. The API supports single document processing and batch processing in parallel. It takes about 12–45 seconds on average depending on the format to process a …

Acknowledgement Entity Recognition In Cord-19 Papers, Jian Wu, Pei Wang, Xin Wei, Sarah Rajtmajer, C. Lee Giles, Christopher Griffin

Computer Science Faculty Publications

Acknowledgements are ubiquitous in scholarly papers. Existing acknowledgement entity recognition methods assume all named entities are acknowledged. Here, we examine the nuances between acknowledged and named entities by analyzing sentence structure. We develop an acknowledgement extraction system, AckExtract based on open-source text mining software and evaluate our method using manually labeled data. AckExtract uses the PDF of a scholarly paper as input and outputs acknowledgement entities. Results show an overall performance of F1=0.92. We built a supplementary database by linking CORD-19 papers with acknowledgement entities extracted by AckExtract including persons and organizations and find that only up to …

Investigating Relationships Between Student Burnout And Classroom Communication Behavior, Jordan Atkinson, Mary E. Donato, Elijah Smith, Gannon Cornley Iii Jan 2020

Investigating Relationships Between Student Burnout And Classroom Communication Behavior, Jordan Atkinson, Mary E. Donato, Elijah Smith, Gannon Cornley Iii

Iowa Journal of Communication

Previous research investigating student burnout relating to undergraduate students discovered that burnout has detrimental effects on academic performance and engagement (Schaufeli, Martinez, Pinto, Salanova, & Bakker, 2002). The purpose of this research was to extend the research on undergraduate student burnout by investigating its relationships with interest, engagement, and in-class oral participation. Participants were 120 undergraduate students enrolled at a small Midwestern university. Results indicated that all three dimensions of student burnout were negatively related to emotional interest and cognitive interest. With regard to student engagement: (a) diminished efficacy was negatively related to all four types of student engagement; (b) …

According to federal health and census data, addiction treatment was a $21 billion business in 2003. By 2020, it is expected to double to $42 billion. The opioid crisis has fueled the growth of the industry by increasing the demand for residential drug treatment programs. Astronomical growth of an industry, however, often invites bad actors.

Bad actors have swarmed the residential drug treatment industry. One category of bad actors includes patient brokers, who recruit drug addicts with health insurance to residential drug treatment centers for sizeable kickbacks. Another category of bad actors are the owners and operators of treatment centers …

Church Taxes And The Original Understanding Of The Establishment Clause, Mark Storslee Jan 2020

Church Taxes And The Original Understanding Of The Establishment Clause, Mark Storslee

Faculty Scholarship

Since the Supreme Court’s decision in Everson v. Board of Education, it has been widely assumed that the Establishment Clause forbids government from 'aiding' or subsidizing religious activity, especially religious schools. This Article suggests that this reading of the Establishment Clause rests on a misunderstanding of Founding-era history, especially the history surrounding to church taxes. Contrary to popular belief, the decisive argument against those taxes was not an unqualified assertion that subsidizing religion was prohibited. Rather, the crucial argument was that church taxes were a coerced religious observance: a government-mandated sacrifice to God, a tithe. Understanding that argument helps …

The Myth Of The Privacy Paradox, Daniel J. Solove Jan 2020

The Myth Of The Privacy Paradox, Daniel J. Solove

GW Law Faculty Publications & Other Works

In this article, Professor Daniel Solove deconstructs and critiques the privacy paradox and the arguments made about it. The “privacy paradox” is the phenomenon where people say that they value privacy highly, yet in their behavior relinquish their personal data for very little in exchange or fail to use measures to protect their privacy.

Commentators typically make one of two types of arguments about the privacy paradox. On one side, the “behavior valuation argument” contends behavior is the best metric to evaluate how people actually value privacy. Behavior reveals that people ascribe a low value to privacy or readily trade …

Sentenced To Surveillance: Fourth Amendment Limits On Electronic Monitoring, Kate Weisburd Jan 2020

Sentenced To Surveillance: Fourth Amendment Limits On Electronic Monitoring, Kate Weisburd

GW Law Faculty Publications & Other Works

As courts and legislatures increasingly recognize that “digital is different” and attempt to limit government surveillance of private data, one group is conspicuously excluded from this new privacy-protective discourse: the five million people in the United States on probation, parole, or other forms of community supervision. This Article is the first to explore how warrantless electronic surveillance is dramatically transforming community supervision and, as a result, amplifying a growing privacy-protection disparity: those in the criminal legal system are increasingly losing privacy protections even while those not in the system are increasingly gaining privacy protections. The quickly expanding use of GPS-equipped …

The Fdic Should Not Allow Commercial Firms To Acquire Industrial Banks, Arthur E. Wilmarth Jr. Jan 2020

The Fdic Should Not Allow Commercial Firms To Acquire Industrial Banks, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

On March 17, 2020, the Federal Deposit Insurance Corporation (“FDIC”) published a proposed rule (the “Proposed ILC Rule”), which would govern applications for deposit insurance, changes in control, and mergers involving FDIC-insured industrial banks and industrial loan companies (“ILCs”). If adopted, the Proposed ILC Rule would open the door to widespread acquisitions of ILCs by commercial firms engaged in industrial, retail, information technology, and other types of nonfinancial activities. In addition, on March 18, 2020, the FDIC approved deposit insurance applications filed by ILCs owned by two commercial firms – Square and Nelnet.

The FDIC’s issuance of the Proposed ILC …

Consistent with prior practice, this chapter offers extensive coverage of the federal procurement and defense spending trends and attempts to predict what lies ahead, particularly with regard to legislative and executive activity. This year's paper discusses, among other things, the high degree of uncertainty currently being experienced in the public procurement sphere, dramatic increases to the micro-purchase and simplified acquisition thresholds, the work of the Congressionally-mandated Section 809 …

What’S Wrong About The Elective Share “Right”?, Naomi R. Cahn Jan 2020

What’S Wrong About The Elective Share “Right”?, Naomi R. Cahn

GW Law Faculty Publications & Other Works

This Article examines one form of property rights available to a surviving
spouse, the elective share. The elective share serves as an override to a
testator’s stated intent by allowing the surviving spouse to choose to take a
portion of the decedent’s estate — even if the will explicitly disinherits the
surviving spouse. The Article analyzes a recent five-year period of state
cases raising elective share issues with the goal of determining the
circumstances under which an elective share is most likely to be contested.

The reported elective share disputes typically involve a subsequent spouse
challenging a will that leaves …
