Race And Reasonableness In Police Killings, Jeffrey A. Fagan, Alexis D. Campbell

Police officers in the United States have killed over 1000 civilians each year since 2013. The constitutional landscape that regulates these encounters defaults to the judgments of the reasonable police officer at the time of a civilian encounter based on the officer’s assessment of whether threats to their safety or the safety of others requires deadly force. As many of these killings have begun to occur under similar circumstances, scholars have renewed a contentious debate on whether police disproportionately use deadly force against African Americans and other nonwhite civilians and whether such killings reflect racial bias. We analyze data on …
Fair Use Factor Four Revisited: Valuing The "Value Of The Copyrighted Work", Jane C. Ginsburg
Fair Use Factor Four Revisited: Valuing The "Value Of The Copyrighted Work", Jane C. Ginsburg
Faculty Scholarship
Recent caselaw has restored the prominence of the fourth statutory factor – “the effect of the use upon the market for or value of the copyrighted work” – in the fair use analysis. The revitalization of the inquiry should also occasion renewed reflection on its meaning. As digital media bring to the fore new or previously under-examined kinds of harm, courts not only need to continue refining their appreciation of a work’s markets. They must also expand their analyses beyond the traditional inquiry into whether the challenged use substitutes for an actual or potential market for the work. Courts should …

“The U.S. won a $7.5 Billion award from the World Trade Organization against the European Union, who has for many years treated the USA very badly on Trade due to Tariffs, Trade Barriers, and more. This case going on for years, a nice victory”, tweeted President Trump’s on October 3, 2019. The United States (US) won not only the highest amount of retaliation ever adjudicated in the history of the WTO but also an ongoing right to retaliate on an annual basis until such time as the EU had complied by either removing the subsidies it granted Airbus or somehow …
The New Mechanisms Of Market Inefficiency, Kathryn Judge
The New Mechanisms Of Market Inefficiency, Kathryn Judge
Faculty Scholarship
Mechanisms of market inefficiency are some of the most important and least understood institutions in financial markets today. A growing body of empirical work reveals a strong and persistent demand for “safe assets,” financial instruments that are sufficiently low risk and opaque that holders readily accept them at face value. The production of such assets, and the willingness of holders to treat them as information insensitive, depends on the existence of mechanisms that promote faith in the value of the underlying assets while simultaneously discouraging information production specific to the value of those assets. Such mechanisms include private arrangements, like …

Development And Testing Of Artificial Membranes For Rearing Of Rhipicephalus Microplus, The Southern Cattle Fever Tick, Ann T. Vacek, John A. Goolsby, Rupesh R. Kariyat
School of Integrative Biological & Chemical Sciences (Formerly Dept. of Biology)
The southern cattle fever tick, Rhipicephalus microplus, is a livestock pest worldwide in tropical and subtropical climates, including South Texas, and can vector Babesia spp., the causal agents of bovine babesiosis. Artificial rearing methods for R. microplus are needed, especially for rearing specialist tick parasitoids that are under evaluation for classical biological control. In this study, we tested the efficiency of artificial feeding of R. microplus larvae, nymphs, and adults on a siliconized substrate (goldbeater’s membrane, lens paper, or Hemotek), or on nonsiliconized goldbeater’s membrane or Hemotek. Other variables tested were a warm water bath, incubator, positioning blood above or …

© 2020, Kaunas University of Technology. All rights reserved. Removal of synthetic dyes from wastewater is essential both from the environmental and human health point of view. A small concentration of synthetic dyes can reduce water transparency and consequently influence photosynthesis and alter aquatic ecosystems. Acid black 48 is an Azo dye that falls under the category of synthetic dyes used in the textile industry. With dyes, coffee wastewater has high chemical oxygen demand (COD) that can affect dissolved oxygen (DO) in surface waters. A mixture of wastes in surface waters creates a need to investigate the efficiency of existing …

This paper reports a new side-channel attack to smartphones using the unrestricted magnetic sensor data. We demonstrate that attackers can effectively infer the Apps being used on a smartphone with an accuracy of over 80%, through training a deep Convolutional Neural Networks (CNN). Various signal processing strategies have been studied for feature extractions, including a tempogram based scheme. Moreover, by further exploiting the unrestricted motion sensor to cluster magnetometer data, the sniffing accuracy can increase to as high as 98%. To mitigate such attacks, we propose a noise injection scheme that can effectively reduce the App sniffing accuracy to only …

This paper provides a detailed technical description of a prototype ground station network, the Virginia Ground Station Network (VGSN), developed for the Virginia Cubesat Constellation (VCC) mission. Virginia Tech (VT), University of Virginia (UVA), and Old Dominion University (ODU) have each constructed ground stations to communicate with their respective VCC spacecraft. Initially, each university was responsible for commanding its own spacecraft via its own ground station. As the mission progressed, it was decided to network the ground stations and operations centers together to provide backup communications capability for the overall mission. The NASA Wallops Flight Facility (WFF) UHF smallsat ground …

One of the most challenging problems encountered in deep learning-based brain tumor segmentation models is the misclassification of tumor tissue classes due to the inherent imbalance in the class representation. Consequently, strong regularization methods are typically considered when training large-scale deep learning models for brain tumor segmentation to overcome undue bias towards representative tissue types. However, these regularization methods tend to be computationally exhaustive, and may not guarantee the learning of features representing all tumor tissue types that exist in the input MRI examples. Recent work in context encoding with deep CNN models have shown promise for semantic segmentation of …

Generative Adversarial Networks For Visible To Infrared Video Conversion, Mohammad Shahab Uddin, Jiang Li, Chiman Kwan (Ed.)

Deep learning models are data driven. For example, the most popular convolutional neural network (CNN) model used for image classification or object detection requires large labeled databases for training to achieve competitive performances. This requirement is not difficult to be satisfied in the visible domain since there are lots of labeled video and image databases available nowadays. However, given the less popularity of infrared (IR) camera, the availability of labeled infrared videos or image databases is limited. Therefore, training deep learning models in infrared domain is still challenging. In this chapter, we applied the pix2pix generative adversarial network (Pix2Pix GAN) …
Determining Shelving Accuracy Via Sampling In A Community College Library, John P. Delooper, Devika Gonsalves
Determining Shelving Accuracy Via Sampling In A Community College Library, John P. Delooper, Devika Gonsalves
Publications and Research
During the Fall 2017 semester, staff at the Hudson County Community College (HCCC), Library began to notice that many books listed as available in the catalog were often not being found on the shelves when patrons attempted to retrieve them. This situation puzzled library leadership because HCCC had recently conducted an inventory and removed all missing items from its holdings. To determine the cause of this discrepancy, HCCC staff decided to sample the library’s collection to determine if books were available at the expected locations. From this, the library found that a high percentage of its books were not present …
Fiduciary Legal Ethics, Zeal, And Moral Activism, David Luban
Fiduciary Legal Ethics, Zeal, And Moral Activism, David Luban
Georgetown Law Faculty Publications and Other Works
The recent turn to fiduciary theory among private lawyer scholars suggests that "lawyer as fiduciary" may provide a fresh justification for legal ethics distinct from moral and political accounts propounded by theorists in recent decades. This Article examines the justification and limits of fiduciary legal ethics. In the course of the investigation, it argues that the fiduciary relation of lawyer to client as defined in the ethics codes does not align perfectly with fiduciary principles in other legal domains, such as agency, trust, or corporate law. Lawyers are fiduciaries of their clients. Does that mean lawyers can never throttle back …
Law’S Sentiments, Robin West
Law’S Sentiments, Robin West
Georgetown Law Faculty Publications and Other Works
The chapter argues that law and the Rule of Law do not displace moral sentiments, but rather require them, and sometimes produce them. Law gives us some sense of physical security and thereby makes possible the fellow feeling and empathy that are the root of moral action. The chapter seeks to make this claim plausible by looking at fiction that describes various dystopian lawless states, including the hierarchy of the Church, which law has been loath to enter, badly policed neighborhoods, nineteenth century American slavery, and early twentieth century patriarchal marriages. One lesson of much of this fiction is that …
The Costs And Benefits Of Affordable Housing: A Partial Solution To The Conflict Of Competing Goods, Michael R. Diamond
The Costs And Benefits Of Affordable Housing: A Partial Solution To The Conflict Of Competing Goods, Michael R. Diamond
Georgetown Law Faculty Publications and Other Works
In this Article, I extend a prior inquiry into the costs borne by society due to the lack of enough decent, affordable housing units. I previously outlined those costs and suggested a combination of public cost savings and public and private benefits that would accrue by providing that housing. I posited that the savings and benefits, in the aggregate, could at least substantially offset the costs and might even exceed them. If that is so, I queried, why has society not produced the needed units? In answering that question, I offered several possible responses: inadequate resources, racism, and public choice …

Conquest And Slavery In The Property Law Course: Notes For Teachers, K-Sue Park
Georgetown Law Faculty Publications and Other Works
This piece contains ideas for teaching about the foundational place of the histories of conquest and slavery to American property law and the property law course. I begin by briefly reviewing how these topics have been erased and marginalized from the study of American property law, as mentioned by casebooks in the field published from the late nineteenth century to the present. I then show how the history of conquest constituted the context in which the singular American land system and traditional theories of acquisition developed, before turning to the history of the American slave trade and the long history …
Interring The Immigration Rule Of Lenity, Patrick J. Glen
Interring The Immigration Rule Of Lenity, Patrick J. Glen
Georgetown Law Faculty Publications and Other Works
The immigration rule of lenity has haunted immigration jurisprudence since its initial iteration in 1947. But as with any spectral entity, its existence is more ephemeral than real. The rule was meant to be a tie-breaker of sorts, a canon that where a provision of the immigration laws was ambiguous, the courts should impose the more lenient construction. It has never, however, been the dispositive basis for a holding of the Supreme Court. Rather, to the extent it has been referenced, it has been trotted out only as a rhetorical device to sanction a decision reached on other grounds. Even …
The Ratchet Wreck: Equality’S Leveling Down Problem, Louis Michael Seidman
The Ratchet Wreck: Equality’S Leveling Down Problem, Louis Michael Seidman
Georgetown Law Faculty Publications and Other Works
Constitutional equality law has a two-way ratchet problem. When someone demonstrates that a government policy treats her unequally, the injury can be remedied by improving things for the claimant, but it can also be remedied by leaving the claimant’s status unchanged while making things worse for the people advantaged by the policy. If a court chooses the latter option, it diminishes the welfare of some people while arguably not improving welfare of anyone else. Why is that a good idea?
Courts have often attempted to avoid hard questions like these by leveling up – that is by allowing advantaged persons …
Robert F. Kennedy And The Attorney General's Referral Authority: A Blueprint For The Biden Administration, Patrick J. Glen
Robert F. Kennedy And The Attorney General's Referral Authority: A Blueprint For The Biden Administration, Patrick J. Glen
Georgetown Law Faculty Publications and Other Works
For nearly four years, the Trump Administration’s use of the Attorney General’s referral authority has been criticized by the legal left on both substantive and procedural grounds. With the advent of the Biden Administration, however, use of the authority for liberal ends deserves serious consideration. To conclude otherwise would be throwing the baby out with the bath water. This article argues that the referral authority can be used for liberal constructions of the immigration laws, and that the perfect model for the incoming administration is former Attorney General Robert Kennedy and his use of the authority for just such ends. …
The Current Role Of The Environment In Reinforcing Acts Of Domestic Terrorism: How Fear Of A Climate Change Apocalypse May Strengthen Right-Wing Hate Groups, Hope M. Babcock
Georgetown Law Faculty Publications and Other Works
Right-wing extremist organizations, like white supremacists and nativists, are using the environment as a rallying cry to gain supporters of their anti-social agendas. Apocalyptic rhetoric about climate change and the lack of action to combat it has frightened some people into accepting the simplistic, violent worldview of these groups. Although the violence is new, the coupling of racism and anti-immigration rants with environmental goals is not—it is part of our cultural history. This Article provides some background on the threats of environmental and domestic terrorism facing our nation and describes how the present-day rhetoric of fear of an environmental Armageddon …
Pandemic As Opportunity For Competence Restoration Decarceration, Susan A. Mcmahon
Pandemic As Opportunity For Competence Restoration Decarceration, Susan A. Mcmahon
Georgetown Law Faculty Publications and Other Works
Before the pandemic, a defendant found incompetent to stand trial was often stranded in jail for weeks or months as she waited for an inpatient bed to open at a psychiatric facility. While there, she usually received no treatment, her mental health deteriorated, and she was astonishingly likely to be abused and neglected. She almost certainly came out of jail in a worse state than she was when she went in.
The pandemic has made this desperate situation even worse. Now that wait in jail is both longer, as many psychiatric facilities stopped accepting new patients as they dealt with …

Environmental Advantages In Additive Manufacturing, Analise Walter, Cheryl Marcham
Publications
Additive Manufacturing (AM) is a technology that uses a variety of methods to ultimately apply layers of material and create products (Ford & Despeisse, 2016; Ford, Mortara & Minshall, 2016). Although there has been an expansion in recent technology, AM has been used in manufacturing for a few decades (Ford, Mortara, et al., 2016). Since the late 1980s, AM has grown from simple product designs, with a focus on prototyping and customization, to modern times with billions of dollars in revenue and large-scale production of consumer and industrial products (Cotteleer, 2014). Forecasts showed a near $10 billion market by 2020, …

Results From A Pre-Post, Uncontrolled Pilot Study Of A Mindfulness-Based Program For Early Elementary School Teachers, Summer S. Braun, Robert W. Roeser, Andrew Mashburn
Psychology Faculty Publications and Presentations
Background: Mindfulness-based programs are a novel and promising approach for supporting teachers’ occupational health and well-being. Although rationales for mindfulness programs for teachers have been offered, the empirical research base evaluating approaches for educating teachers in mindfulness is still developing. This study reports the findings of a pilot study of a mindfulness-based program. This study is unique in that it is one of the only studies of the Mindfulness-Based Emotional Balance (MBEB) program to focus on early elementary teachers, to be implemented by a new instructor, and to recruit teachers via extrinsic motivators.
Methods: A pre-post, uncontrolled pilot study of …
Anthropogenic Suffering Of Farmed Animals: The Other Side Of Zoonoses, Jean-Jacques Kona-Boun
Anthropogenic Suffering Of Farmed Animals: The Other Side Of Zoonoses, Jean-Jacques Kona-Boun
Animal Sentience
Wiebers & Feigin’s (W&F’s) target article warns of the zoonotic threat to human health from factory farming and urges phasing out meat production and consumption, for the benefit of both human and nonhuman animals. This commentary focuses on the physical and emotional suffering of farmed animals. This varies by species, production system and geographic location, but suffering is there throughout all stages of production — breeding, housing, transport, usage and slaughter. Ubiquitous monitoring of all facilities where farmed animals are kept, with surveillance cameras recording all phases of production would help reduce some forms of suffering. Other forms are caused …
Big Data Prosecution And Brady, Andrew Ferguson
Big Data Prosecution And Brady, Andrew Ferguson
Scholarly Articles in Law Reviews & Journals
Prosecutors are joining the big data revolution, adopting “intelligence-driven” strategies to target crime patterns. Centralized big data systems now track offenders, places, and groups allowing prosecutors to link crimes by time, place, associations, or other connections. Adding to these types of formalized, structured databases are growing sources of raw, unstructured big data from digital surveillance technologies like video cameras, police body cameras, and automated license plate readers. The prosecutors of the future will sit on a wealth of valuable investigative insights – all searchable and potentially relevant for a more aggressive and proactive investigation strategy. But as helpful as these new …

Antitrust & Corruption: Overruling Noerr, Tim Wu

We live in a time when concerns about influence over the American political process by powerful private interests have reached an apogee, both on the left and the right. Among the laws originally intended to fight excessive private influence over republican institutions were the antitrust laws, whose sponsors were concerned not just with monopoly, but also its influence over legislatures and politicians. While no one would claim that the antitrust laws were meant to be comprehensive anti-corruption laws, there can be little question that they were passed with concerns about the political influence of powerful firms and industry cartels.

The U.S. nonprofit sector spends $2.54 trillion each year. If the sector were a country, it would have the eighth largest economy in the world, ahead of Brazil, Italy, Canada, and Russia. The government provides nonprofits with billions in tax subsidies, but instead of evaluating the quality of their work, it leaves this responsibility to nonprofit managers, boards, and donors. The best nonprofits are laboratories of innovation, but unfortunately some are stagnant backwaters, which waste money on out-of-date missions and inefficient programs. To promote more innovation and less stagnation, this Article makes two contributions to the literature.
First, this Article …

Coronavirus, Civil Libertities, And The Courts: The Case Against Suspending Judicial Review, Lindsay Wiley
Scholarly Articles in Law Reviews & Journals
Introduction: For obvious reasons, local and state orders designed to help “flatten the curve” of novel coronavirus infections (and conserve health care capacity to treat coronavirus disease) have provoked a series of constitutional objections — and a growing number of lawsuits attempting to have those orders modified or overturned. Like the coronavirus crisis itself, much of that litigation remains ongoing as we write this Essay. But even in these early days, the emerging body of case law has rather elegantly teed up what we have previously described as “the central (and long-running) normative debate over emergency powers: Should constitutional constraints …
