Your Uber Driver Is Here, But Their Benefits Are Not: The Abc Test, Assembly Bill 5, And Regulating Gig Economy Employers, Brian A. Brown Ii
Brooklyn Journal of Corporate, Financial & Commercial Law
In September 2019, California passed Assembly Bill 5 (AB 5) which adopts the ABC test as the standard for determining whether an individual worker is an employee or an independent contractor. This legislation is aimed at gig economy employers, such as Uber, whose workers are arguably misclassified as independent contractors, ultimately denying them access to benefits and the ability to unionize. This Note will discuss AB 5 by identifying the successes and pitfalls of the legislation. While AB 5 is a step in the right direction, the bill still needs to be refined to avoid gaps in enforcement. Further, this …

Cyber-Insecurity: The Reasonableness Standard In Internet Of Things Device Regulation And Why Technical Standards Are Better Equipped To Combat Cybercrime, Chynna Rose Foucek
Brooklyn Journal of Corporate, Financial & Commercial Law
While the Internet of Things (IoT) has created an interconnected world via phones, laptops, and even household devices, it is not infallible. As cyber-attacks increase in frequency, affecting companies of all sizes and industries, IoT device manufacturers have become particularly vulnerable, due in large part to the fact that many companies fail to implement adequate cybersecurity protocols. Mass data breaches occur often. However, these companies are not held accountable due to the use of the reasonableness standard in existing cybersecurity legislation, which is flexible and malleable. In 2019, the California Legislature enacted a cybersecurity law specific to IoT device manufacturers. …
A History Of Consumer Class Actions In State Courts, Anne Fleming
A History Of Consumer Class Actions In State Courts, Anne Fleming
Brooklyn Journal of Corporate, Financial & Commercial Law
Most historians date the “modern” class action to the 1966 amendments to the Federal Rules of Civil Procedure. Yet, the class action or “representative suit” has a longer, unexplored history in the state courts. In the late 1930s and 1940s, a group of scrappy, first-generation lawyers tried to build their businesses by aggregating the small-sum claims of many consumers. The defendants in these cases were, for example, lenders who failed to comply with the technicalities of state disclosure mandates, and utility companies that charged consumers extra fees. Each consumer’s claim was small, but, as a group, the claims could yield …

Intercomparison Of Three Open-Source Numerical Flumes For The Surface Dynamics Of Steep Focused Wave Groups, Thomas Vyzikas, Dimitris Stagonas, Christophe Maisondieu, Deborah Greaves
School of Engineering, Computing and Mathematics
NewWave-type focused wave groups are commonly used to simulate the design wave for a given sea state. These extreme wave events are challenging to reproduce numerically by the various Numerical Wave Tanks (NWTs), due to the high steepness of the wave group and the occurring wave-wave interactions. For such complex problems, the validation of NWTs against experimental results is vital for confirming the applicability of the models. Intercomparisons among different solvers are also important for selecting the most appropriate model in terms of balancing between accuracy and computational cost. The present study compares three open-source NWTs in OpenFOAM, SWASH and …

Detecting Feeding And Estimating The Energetic Costs Of Diving In California Sea Lions (Zalophus Californianus) Using 3-Axis Accelerometers, Mason Russell Cole
Master's Theses
Knowledge of when animals feed and the energetic costs of foraging is key to understanding their foraging ecology and energetic trade-offs. Despite this importance, our ability to collect these data in marine mammals remains limited. In this thesis, I address knowledge gaps in both feeding detection and fine-scale diving energetic costs in a model species, the California sea lion (Zalophus californianus). I first developed and tested an analysis method to accurately detect prey capture using 3-axis accelerometers mounted on the head and back of two trained sea lions. An acceleration signal pattern isolated from a ‘training’ subset of synced video …

Inclusive Leadership, Psychological Empowerment, And Affective Organizational Commitment: A Mediated Model, Mariah Lyn Van Buskirk
Master's Theses
Inclusive leadership has become an important contextual factor to study in organizations given its impact on positive workplace outcomes. However, little is known about the ability of inclusive leadership to affect a wider range of outcomes and the various mediating mechanisms between inclusive leadership and outcomes. Therefore, the present study explored the mediating role of psychological empowerment on the relationship between inclusive leadership and affective organizational commitment. It was hypothesized that inclusive leadership would be positively related to affective organizational commitment both directly and indirectly through psychological empowerment. Results of an online survey from 189 employed individuals showed that inclusive …
Prevalence Of Avoidant/Restrictive Food Intake Disorder And Association With Nutrition Status In Patients With Inflammatory Bowel Diseases, Emily Yelencich
Prevalence Of Avoidant/Restrictive Food Intake Disorder And Association With Nutrition Status In Patients With Inflammatory Bowel Diseases, Emily Yelencich
Master's Theses
There is a large body of research on the relationship between inflammatory bowel disease (IBD) and diet; however, few conclusive, generalizable recommendations have been determined. Regardless, IBD patients often alter their normal dietary intake, which is concerning considering the prevalence of malnutrition in the IBD population. Avoidant/restrictive food intake disorder (ARFID) is a feeding disorder that was recently added to the Diagnostic and Statistical Manual of Mental Disorders and its prevalence and impact on the nutritional status of IBD patients has not previously been described. In this study ARFID risk was measured using the Nine-Item ARFID Screen and in the …

Distributed Load Testing By Modeling And Simulating User Behavior, Chester Ira Parrott
LSU Doctoral Dissertations
Modern human-machine systems such as microservices rely upon agile engineering practices which require changes to be tested and released more frequently than classically engineered systems. A critical step in the testing of such systems is the generation of realistic workloads or load testing. Generated workload emulates the expected behaviors of users and machines within a system under test in order to find potentially unknown failure states. Typical testing tools rely on static testing artifacts to generate realistic workload conditions. Such artifacts can be cumbersome and costly to maintain; however, even model-based alternatives can prevent adaptation to changes in a system …

Sensitivity Analysis Of An Agent-Based Simulation Model Using Reconstructability Analysis, Andey M. Nunes, Martin Zwick, Wayne Wakeland
Complex Systems Faculty Publications and Presentations
Reconstructability analysis, a methodology based on information theory and graph theory, was used to perform a sensitivity analysis of an agent-based model. The NetLogo BehaviorSpace tool was employed to do a full 2k factorial parameter sweep on Uri Wilensky’s Wealth Distribution NetLogo model, to which a Gini-coefficient convergence condition was added. The analysis identified the most influential predictors (parameters and their interactions) of the Gini coefficient wealth inequality outcome. Implications of this type of analysis for building and testing agent-based simulation models are discussed.

Malignant Eccrine Adenoma With Sarcomatous (Heterologous) Components: Report Of A Rare Skin Adnexal Neoplasm With Literature Review, Hira Ishtiaq, Muhammad Abdulwaasey, Muhammad Usman Tariq, Saira Fatima
Department of Pathology and Laboratory Medicine
Malignant eccrine spiradenoma (MES) is an exceedingly rare skin adnexal tumor that arises from pre-existing benign eccrine spiradenoma (BES). MES tumors show a wide spectrum of morphological features, posing a diagnostic challenge to the pathologist. Sarcomatous (heterologous) elements are seen in a few of these tumors, further complicating the morphological picture. We herein describe a case of a 66-year-old male who presented with a recently enlarging, ulcerated, nodular skin lesion over the right leg that had been present for the last 25 years. The patient underwent wide local excision of the tumor. Microscopic examination revealed a neoplastic lesion comprising benign …

Macroeconomic Determinants Of Co2 Emissions In Australia: Evidence From Ardl Bound Testing Approach, Reza Sherafatian-Jahromi, Mohd-Shahwahid Haji Othman
Asia-Pacific Social Science Review
This paper examines the macroeconomic determinants of CO2 emissions in Australia by applying the autoregressive distributed lag bound testing approach to cointegration. Findings reveal that CO2 emissions, energy consumption, financial development, and trade openness are cointegrated only when CO2 emissions are considered as the dependent variable. Under this situation, energy consumption and economic development lead to environmental degradation, whereas financial development improves the environment quality in Australia in the long run. The impact of trade openness on CO2 emissions is positive. However, this impact is lower than that of economic development and energy consumption. Moreover, bidirectional causality is found between …

Unique Characteristics Of Bias Crimes Committed By Males Or Females In The United States, Rebecca Stotzer, Meripa T. Godinet, Janet T. Davidson
Journal of Hate Studies
Despite increased research on women’s criminal offending patterns, research on women’s involvement in bias crimes is almost nonexistent. This study examines bias crime incidences that are considered crimes against persons (e.g., assault, murder, robbery, sexual assault) collected in the National Incidence-based Reporting System from 2009–2012 to determine what features characterize crimes committed by men or women. Results indicate that female bias crime suspects choose different victims than male suspects; female suspects are more likely than men to target friends and family members, more likely to target other women, and more frequently commit crimes based on race/ethnicity/national origin than religion or …

The Historical Facts About Hate Crime In America The Social Worker’S Role In Victim Recovery And Community Restoration, Mitchell A. Kaplan, Marian M. Inguanzo
Journal of Hate Studies
Attitudes and belief systems associated with social intolerance and racial bigotry have been part of American society for generations. Analysis of historical records reveals a number of examples of how these social forces have shaped society’s reaction to those they consider to be not part of the mainstream culture. A review of research documented in the literature on social psychology indicates that individuals who hold strong prejudicial beliefs about others based solely on race, religion, sexual orientation, or ancestry often express those feelings in ways that lead to the commission of criminal acts known as hate crimes. The proliferation of …

The pelagic Gulf of Mexico (GoM) is a complex system of dynamic physical oceanography (western boundary current, mesoscale eddies), high biological diversity, and community integration via diel vertical migration and lateral advection. Humans also heavily utilize this system, including its deep-sea components, for resource extraction, shipping, tourism, and other commercial activity. This utilization has had impacts, some with disastrous consequences. The Deepwater Horizon oil spill (DWHOS) occurred at a depth of ∼1500 m (Macondo wellhead), creating a persistent and toxic mixture of hydrocarbons and dispersant in the deep-pelagic (water column below 200 m depth) habitat. In order to assess the …

Dialogue As Being With: An Antitoxin To Hate And Intolerance, Tony Osborne
Journal of Hate Studies
As the social and political landscape becomes more fearful, intolerant, and self-centered, the concept of dialogue offers a different path, a constructive way of approaching alien ideas and beliefs. Understanding the principles of true dialogue is the most effective way to foster inner and outer harmony, broaden one’s horizons, and check aggressive, intolerant impulses. Dialogue’s roots are ancient, related to a method of argument called dialectic. It is a special partnership based on mutual respect and humility. Dialogue isn’t easy to engender. It requires four pre-conditions: 1) non-empirically verifiable topic; 2) two-way flow; 3) fairness; and 4) willingness to risk …
