‘Warming Up’ To Sustainable Procurement, Steven L. Schooner, Markus Speidel Jan 2020

‘Warming Up’ To Sustainable Procurement, Steven L. Schooner, Markus Speidel

GW Law Faculty Publications & Other Works

Procurement professionals will play a critical role in the belated but necessary effort to slow the pace of climate change. That critical, evolved role will lie in sustainable procurement, which, if effectively implemented, will dramatically alter markets and fundamentally change purchasing behaviors. To be effective, procurement professionals will need to rethink how we define our profession, assess our outcomes, and bring value to our government customers. Successfully establishing a sustainable procurement regime will require dramatic change, including, among other things, overcoming the persistent tyranny of low price, understanding and adopting lifecycle costing, considering externalities in the value proposition, and, of …

Solving The Challenges To World Trade, Steve Charnovitz Jan 2020

Solving The Challenges To World Trade, Steve Charnovitz

GW Law Faculty Publications & Other Works

World trade faces fundamental challenges. This essay examines six threats to the intellectual case for open trade: to wit, worries about ecology, fairness, morality, equity, security, and geopolitics. Together, these threats implicate a huge swath of international trade. One of the biggest indicators of diminishing support for trade is the moribund status of the leading institution of the trading system, the World Trade Organization (WTO). There are three branches of WTO governance and all three are in trouble: the judicial branch and its vacant Appellate Body, the executive branch and its vacant post of WTO Director-General, and the legislative branch …

The Occ's And Fdic's Attempts To Confer Banking Privileges On Nonbanks And Commercial Firms Violate Federal Laws And Are Contrary To Public Policy, Arthur E. Wilmarth Jr. Jan 2020

The Occ's And Fdic's Attempts To Confer Banking Privileges On Nonbanks And Commercial Firms Violate Federal Laws And Are Contrary To Public Policy, Arthur E. Wilmarth Jr.

GW Law Faculty Publications & Other Works

The Office of the Comptroller of the Currency (OCC) and the Federal Deposit Insurance Corporation (FDIC) have adopted several recent measures that attempt to confer benefits and privileges of banks on nonbank providers of financial services and commercial firms. The OCC’s and FDIC’s initiatives are unlawful and dangerous because they would allow nonbanks and commercial firms to subvert fundamental public policies embodied in federal laws governing banks and bank holding companies.

In 2018, the OCC announced that it would approve national bank charters for “fintech” firms that provide lending and payment services but do not accept deposits. The New York …

Great Powers And New Risks: What Businesses And Regulators Should Know About China’S Strategic Ambitions, F. Scott Kieff, Thomas D. Grant Jan 2020

Great Powers And New Risks: What Businesses And Regulators Should Know About China’S Strategic Ambitions, F. Scott Kieff, Thomas D. Grant

GW Law Faculty Publications & Other Works

China’s geopolitical ambitions give rise to risks that government agencies and the businesses they regulate need to address. In particular, Military-Civil Fusion (MCF), a whole-of-government legal and administrative machinery created by the Chinese Communist Party (CCP), aims to give China’s military, as well as China’s state championed companies, the technologies essential to strategic competitiveness in the decades ahead. In service of China’s effort to acquire technology, MCF breaks down barriers of professional responsibility and confidentiality that organizations and individuals in the West take for granted. Through both executive and legislative action, the United States has begun to address MCF. To …

The Death Of The Genus Claim, Dmitry Karshtedt, Mark A. Lemley, Sean B. Seymore Jan 2020

The Death Of The Genus Claim, Dmitry Karshtedt, Mark A. Lemley, Sean B. Seymore

GW Law Faculty Publications & Other Works

The central feature of patent law in the chemical, biotechnology, and pharmaceutical industries is the genus claim – a patent that covers not just one specific chemical but a group of related chemicals. Genus claims are everywhere, and any patent lawyer will tell you they are critical to effective patent protection.

But as we show in this article, the law has changed dramatically in the last twenty-five years, to the point where it is no longer possible to have a valid genus claim. Courts almost always hold them invalid. Remarkably, they do this without having acknowledged that they have fundamentally …

Decisions In The Dark: Why "Pregnancy Exclusion" Statutes Are Unconstitutional And Unethical, Shea Flanagan Jan 2020

Decisions In The Dark: Why "Pregnancy Exclusion" Statutes Are Unconstitutional And Unethical, Shea Flanagan

Northwestern University Law Review

Advance health care directives are tools that allow people to state their health care treatment wishes or designate a health care proxy in anticipation of being unable to make those decisions in the future, including preferences to remove life-sustaining medical treatment. However, thirty-six states currently have “pregnancy exclusion” laws that require physicians to void the advance directives of pregnant women receiving life-sustaining treatment. This Note assesses the constitutionality and ethics of state pregnancy exclusion statutes by employing a new five-category typology of current pregnancy exclusion laws. This Note argues that all categories of these statutes violate an individual’s constitutional rights …

Perceptions Of Adaptive Technology Usage In Secondary Math Classrooms, Ryan J. Benjamin Jan 2020

Perceptions Of Adaptive Technology Usage In Secondary Math Classrooms, Ryan J. Benjamin

Graduate Student Dissertations, Theses, Capstones, and Portfolios

Adaptive learning is an emerging technology in education that teachers use to instruct, reinforce, and assess student performance (Smith, 2016). Adaptive technology is powerful because it gives teachers an opportunity to differentiate based on individual needs (Bilous, 2019). It is efficient, allows students to get instant feedback, and can improve the learning experience for students (Matherson & Windle, 2017). Like many other technologies, it is constantly evolving; this makes it difficult to research and update curriculum because programs are constantly changing (Parsons, 2014).

With these changes, teachers are also required to update how they manage their classroom and how they …

Evaluating The Safety And Mobility Of The Cumulative-Anticipative Car-Following Model For Connected Autonomous Vehicles, Hafiz Usman Ahmed

Civil and Environmental Engineering

The advancements of vehicle automation are progressively improving resulting in safer driving environments in addition to more efficient mobility and fuel cost savings. However, autonomous and connected autonomous vehicles (AVs, CAVs) require decades to achieve complete market penetration. It is important to investigate the coexistence of conventional and autonomous cars during such a transition period. Traditionally, adaptive cruise control (ACC) and cooperative ACC (CACC) models were used for the AVs to guide their car-following. Recently, the cumulative-anticipative car-following (CACF) model was developed with consideration of the cumulative influences from surrounding vehicles through vehicle-to-everything (V2X) communication. This study further evaluates the …

Globular Clusters In Coma Cluster Ultra-Diffuse Galaxies (Udgs): Evidence For Two Types Of Udg?, Duncan A. Forbes, Adebusola Alabi, Aaron J. Romanowsky, Jean P. Brodie, Nobuo Arimoto

Faculty Research, Scholarly, and Creative Activity

Ultra-diffuse galaxies (UDGs) reveal extreme properties. Here, we compile the largest study to date of 85 globular cluster (GC) systems around UDGs in the Coma cluster, using new deep ground-based imaging of the known UDGs and existing imaging from the Hubble Space Telescope of their GC systems. We find that the richness of GC systems in UDGs generally exceeds that found in normal dwarf galaxies of the same stellar mass. These GC-rich UDGs imply haloes more massive than expected from the standard stellar mass–halo mass relation. The presence of such overly massive haloes presents a significant challenge to the latest …

Faculty Research, Scholarly, and Creative Activity

Cloud computing offers an economical and elastic means to handle the storage and computation needs of the Internet of Things (IoT). However, storage and retrieval from the cloud could potentially violate policies, especially those pertaining to data privacy. Edge computing as a paradigm is a suitable way to overcome these issues. This poster presents an edge computing architecture that enables policy-aware normalization and filtration of the data that is sent to cloud services to preserve policies. We use a secure and encrypted channel to transmit the data generated by the IoT devices to the dedicated computing units at the edge …

Faculty Research, Scholarly, and Creative Activity

With the advancement of wireless access networks and mmWave New Radio (NR), new applications emerged, which requires a high data rate. The random packet loss due to mobility and channel conditions in a wireless network is not negligible, which degrades the significant performance of the Transmission Control Protocol (TCP). The TCP has been extensively deployed for congestion control in the communication network during the last two decades. Different variants are proposed to improve the performance of TCP in various scenarios, specifically in lossy and high bandwidth-delay product (high- BDP) networks. Implementing a new TCP congestion control algorithm whose performance is …

Nigerians lack access to effective mother tongue education (MTE) at all levels of their schooling. It is well established that cognitive and educational benefits are achieved if one’s mother tongue (MT) is used as the medium of education. This study aimed to determine how adult Nigerians around the world who had been deprived of using their mother tongues (MTs) in their education reflect on their past experiences with negative messages or colonial language ideologies received in school. Also, it explored how these past experiences have shaped their positive MT identities, their MT experiences, and their perspectives on MTE. In this …

The Hidden Value Of Abandoned Applications To The Patent System, Christopher A. Cotropia, David L. Schwartz Jan 2020

The Hidden Value Of Abandoned Applications To The Patent System, Christopher A. Cotropia, David L. Schwartz

Law Faculty Publications

Some inventors abandon their patent applications without ever receiving a patent. Although patent scholars view such abandoned applications as essentially worthless, we question that conventional wisdom. In conducting an empirical analysis of a recently released patent application dataset (in light of a 1999 change requiring publication of most abandoned applications), we find that the United States Patent and Trademark Office (USPTO) often uses abandoned applications as prior art when examining future patent applications. Abandoned applications thus generate an administrative disclosure that prevents the issuance of broader patent rights to later applicants. By narrowing the scope of new patents, abandoned applications …

It’S All Fun And Games Until Somebody Dies: Grief, Mortality Salience, And Coping In Meaningful Permadeath, Mckay Steven West Jan 2020

It’S All Fun And Games Until Somebody Dies: Grief, Mortality Salience, And Coping In Meaningful Permadeath, Mckay Steven West

Graduate Theses, Dissertations, and Problem Reports (ETD)

Because part of the enjoyment of video game experiences is rooted in their ability to afford players to fail but still reattempt gameplay with relatively little consequence, the appeal of playing games with permadeath seems paradoxical. This dissertation proposed that players’ motivations for playing these games with permadeath stem from an enhanced sense of appreciation garnered by players through the meaningfulness of permanent character death, rather than just through simple, hedonic enjoyment. Enhanced appreciation was expected to arise from permadeath through the grief players experienced toward the loss of their characters and through their contemplation of their own mortality. Grief …

Women Veterans’ Descriptions Of The Patient-Provider Interaction With Civilian Providers, Billie S. Vance Jan 2020

Women Veterans’ Descriptions Of The Patient-Provider Interaction With Civilian Providers, Billie S. Vance

BACKGROUND: Women veterans require care for unique gender, and war-related health issues. Concerns exist regarding non-Veterans Health Administration (VHA), civilian healthcare providers’ preparedness to deliver care to the veteran population. Health outcomes are influenced by the quality of care provided to patients. There is a significant gap in the literature with regard to woman veterans’ perspectives about the quality of the patient-provider interaction between women veterans and non-VHA, civilian providers.

PURPOSE: The purpose of this study was to describe women veterans’ perspectives about interactions between themselves and civilian providers and to critically analyze the veterans’ data to further inform the …

Effects Of Commission Errors During Noncontingent Reinforcement, Stephanie Hope Jones Jan 2020

Effects Of Commission Errors During Noncontingent Reinforcement, Stephanie Hope Jones

Graduate Theses, Dissertations, and Problem Reports (ETD)

Noncontingent reinforcement (NCR) is a behavioral treatment in which a reinforcer is provided at set intervals independently of responding. Although NCR is commonly used, effects of inconsistent implementation (i.e., implementation with integrity failures) during NCR were previously unknown. The current study included six participants, but full-integrity NCR suppressed problem behavior for only three participants. Thus, we evaluated effects of one kind of integrity failure, reinforcement of problem behavior, on NCR outcomes for three children who engaged in inappropriate vocalizations maintained by access to tangible items. Effects of commission errors were idiosyncratic across participants.

Mnemonic Discrimination And Social Anxiety: The Role Of State Anxiety, Gabriella T. Ponzini Jan 2020

Mnemonic Discrimination And Social Anxiety: The Role Of State Anxiety, Gabriella T. Ponzini

Graduate Theses, Dissertations, and Problem Reports (ETD)

The Mnemonic Similarity Task (MST) measures mnemonic discrimination, or the ability to correctly identify new stimuli from highly similar, old stimuli. Neuroscientific and theoretical suppositions suggest that poor mnemonic discrimination may represent a potential risk or maintenance factor for anxious individuals. However, state affect appears to moderate the relation between mnemonic discrimination abilities and trait anxiety. The current study aimed to elucidate the nascent research on mnemonic discrimination and anxiety by evaluating the MST in a specific subtype of anxiety (i.e., social anxiety) and utilizing a clinically relevant stressor task (i.e., knowledge of a future speech). Participants (N = …
